REGULATION ORDINANCE NO. 2017-145

AN ORDINANCE REQUIRING OWNERS/MANAGEMENT OF MALLS,


SUPERMARKETS, HOSPITALS, HOTELS, UNIVERSITIES AND TRANSPORT
TERMINALS IN ILOILO CITY WITH PARKING FACILITIES, TO INSTALL
SECURITY SYSTEM AND ADOPT SECURITY MEASURES IN THEIR PARKING
GARAGES AND PROVIDING PENALTIES TO VIOLATORS

Whereas, Local Government Units (LGU) may legislate measures for the good of the
greater majority under the general welfare clause of the Local Govern1nent Code of 1991;

Whereas, the openness to the general public and its location in an isolated area makes it
likely for critnes to be committed in parking facilities;

Whereas, parking facilities comprise a large volume of space and relatively low level of
activity, cri1ne is more likely to occur in a parking facility than in other commercial facilities;

Whereas, lighting is universally acknowledged as the most important security feature in a


Nf parking facility but which is absent or poorly observed in some parking facilities~

f Whereas, some parking facilities located underground and upper ground floor are not
properly illumined and patrolled by guards of the establishment;

Whereas, there are parking t'hcilities that do not have adequate security syste1n and active
security tneasures such as guards and einergency co1nmunication system making them attractive
to people with criminal intent;

Whereas, incidents of violence and crimes in parking facilities have been reported lately;

NOW THEREFORE, be it ordained, as it is hereby ordained by the Iloilo City Council in


session assembled that:

Section I - SHORT TITLE - "Security Syste1ns and Security Measures in Parking Garages
of Establishments in Iloilo City"

Section II - COVERAGE : This Ordinance shall cover all malls, super1narkets, hospital,
hotels, universities and transport terminals with parking garages in Iloilo City.

Section lII - DEFINITION OF TERMS

a) Security system - an electrical device that set off an alarm when so1neone tries to break
m.
b) Security measures - course of action or steps and strategies to ensure safety of parking lot
users.
c) Establish1nent - a place of business or residence with its furnishing and staff. In this case,
refers to 1nalls, hospitals, shopping centers, hotels and universities.
d) Watchtower- a tower built to create an elevated observation point.
e) Security patrol - an employee I security guard doing the action of traversing a place.
f) Device - scheme or strategies or plan.
g) CCTV - closed-circuit television is a TV system in which signals is not publicly
distributed but are monitored primarily for surveillance and security purposes.

Section IV - REQUIREMENTS FOR ALL ESTABLISHMENTS WITH PARKING


LOTS.

l. All malls, supermarkets, hospitals, hotels, un1vers1tles and transport terminals with
parking lots should adopt security measures to safeguard lives and properties of parking
lot patrons.
2. That said establishments should have security patrols who should check the area every 30
minutes. If an individual is observed sitting inside a vehicle, the security guard making
the inspection shall check the vehicle to 1nake sure there is no problem. Management
should see to it that these security patrols receive instructions in the 1nonitoring of audio
visual and alarm devices and the proper way to approach individuals to ensure they are
customers I visitors parking in the facility.
3. The guards should issue parking tickets to the driver, this way, the drivers will surely
lower his window to receive his parking number.
4. CCTV camera should ride a track back and forth down the length of parking aisles and
must be 1nonitored by trained security officers during operating hours.
5. Open parking garage should have a watchtower manned by security personnel.
6. Guards assigned in the parking lot should use short arms while guards assigned in a lock
down area or exit areas should be armed with a 12 gauge shotgun.
7. The inanagement of the parking facility will be given 100 days from the effectivity of
this ordinance to comply with the requirements.

Section V - THE INSPECTION TEAM

A. Composition:

The Mayor shall designate the 1ne1nbers of the Oversight/Inspection Team which
shall be composed of the following:
Two (2) members of the PNP, recommended by the City Police Director;
One (I) member from the CCTV Council
Two 2) members from the City Engineer's Office
One (1) member from the City Treasurer's Office
One (1) 1nember from the City Council, Chairman on Police Matters

B. Powers and Functions:

a. The team shall inspect the garage and monitor compliance with the required security
systems and measures applicable to the parking lot of the establishment.
b. The tea1n shall inspect the lighting system of the parking lot, its emergency
communication systems, the CCTV and ensure that security guards have ample
security training.
c. When the team finds that the parking lot violates the requirements set forth in this
ordinance, the members of the team from the City Treasurer's Office shall issue a
citation ticket to the management of the establish1nent. Payment should be 1nade at
the City Treasurer's Office.

Section VI - PENALTY CLAUSE: Management found not complying with the above
security system and measures, will be fined Php 5,000 per month until it has duly complied.

Section VII-REPEALING CLAUSE: all ordinance inconsistent with the provisions of this
ordinance are hereby repealed.

Section VIII - EFFECTIVITY CLAUSE. This Ordinance shall take effect upon its
approval and publication in a newspaper of general circulation.
