ORDINANCE NO. 2001-064

AN ORDINANCE CREATING THE NAGA CITY DANGEROUS DRUGS BOARD (NCDDB)


AND APPROPRIATING FUNDS THEREFOR:-

Be it ordained by the Sangguniang Panlungsod of the City of Naga, that:

ARTICLE I - TITLE, PURPOSE AND DEFINITION OF TERMS

SECTION 1. - TITLE. - The title of the Ordinance shall be “An Ordinance Creating the
Naga City Dangerous Drugs Board (NCDDB) and appropriating funds therefor”.

SECTION 2. - PURPOSE. - The purpose of this Ordinance is to establish a local over-all


consultative, multi-sectoral body that shall serve as the exclusive policy-making, monitoring and
coordinating body on the prevention and control of drug abuse in Naga City and for the
execution of the programs and projects under this Ordinance, with the end in view of formulating
and implementing short-term, long-term and sustainable solutions to the drug problem.

SECTION 3. - DEFINITION OF TERMS. - As used in this Ordinance, the terms:

a. BOARD - shall refer to the Naga City Dangerous Drugs Board or NCDDB;

b. DRUG ABUSE - shall refer to the deliberate use or taking of substance for other than
its intended purpose or of dangerous drugs, both prohibited and regulated drugs;

c. DRUG DEPENDENCE - shall refer to the state of psychic or physical dependence,


or both, on a dangerous drug, arising in a person following administration or use of
that drug on a periodic or continuous basis;

ARTICLE II - COMPOSITION OF THE BOARD AND THE COMMITTEES

SECTION 4. - COMPOSITION. - The Board herein created shall be composed of the


following:

a. The City Mayor, who shall serve as Chairman, in an ex-officio capacity, and Chief
Executive Officer;

b. The Sangguniang Panlungsod’s Chairman of the Committee on Public


Safety and Human Rights, as Vice Chairman and Presiding Officer of
the Board;
c. President, Kapisanan ng mga Broadkaster sa Pilipinas (KBP), Camarines Sur
Chapter;

d. President, Association of Television and Radio Announcers of Camarines Sur


(ATRACS);

e. Representative from civic groups (to be represented by the Pakisumaro President);

f. Representative from radio groups (NEWACS, KABALIKAT, CARE, ACES, REACT,


etc.).

g. President, Association of Barangay Councils (ABC);

h. President, Pag-iribang Bantay Barangay Federation;

i. Superintendent, Division of City Schools;

j. President, Sangguniang Kabataan Federation;

k. City Youth Mayor;

l. Representative of different Parishes;

m. President, Jovenes Laban sa Droga Federation.

n. City Director, DILG;

o. Chief, Naga City PNP;

p. Chief, Camarines Sur NARCOM;

q. Regional Director, NBI;

r. Chief, CIDG Camarines Sur;

s. President, Integrated Bar of the Philippines, Camarines Sur Chapter;

t. City Prosecutor, Naga City;

u. Director, City Social Welfare and Development Office;

v. City Health Officer;

w. Head, Public Attorney’s Office, Camarines Sur;

x. Coordinator, International Coordinating and Advisory Group in the City.

SECTION 5. - COMMITTEES. - For facility, convenience and speedy formulation and


implementation of short-term and long-term plans, programs and projects, the members of the
Board shall be constituted into four (4) committees, namely: 1) Committee on Public
Information; 2) Committee on Education and Advocacy; 3) Committee on Intelligence,
Enforcement and Prosecution; and 4) Committee on Early Intervention and Rehabilitation, or
such number of committees as the Board may decide from time to time, if necessary. The
responsibilities and membership of the four committees shall be as follows:
SECTION 5.1 - COMMITTEE ON PUBLIC INFORMATION. - This committee shall be in
charge of public information on the ill-effects of drug dependence and the dissemination of the
local government’s programs and actions in combating the drug problem. The committee shall
be composed of the following members:

a. President, Kapisanan ng mga Broadkaster sa Pilipinas (KBP),


Cam. Sur Chapter;
b. President, Association of Television and Radio Announcers of Camarines Sur
(ATRACS);
c. Representative from civic groups (to be represented by the Pakisumaro President);
e. Representative from radio groups (NEWACS, KABALIKAT, CARE, ACES, REACT, etc.).

SECTION 5.2. - COMMITTEE ON EDUCATION AND ADVOCACY. - This committee


shall be in charge of the education campaign, promotion and advocacy thrusts of the Board.
The committee shall be composed of the following members:

a. President, Association of Barangay Councils (ABC);

b. President, Pag-iribang Bantay Barangay Federation;

c. Superintendent, Division of City Schools;

d. President, Sangguniang Kabataan Federation;

e. City Youth Mayor;

f. Representative of different Parishes;

g. President, Jovenes Laban sa Droga Federation.

SECTION 5.3. - COMMITTEE ON INTELLIGENCE, ENFORCEMENT AND


PROSECUTION. - This committee shall be primarily in charge of intelligence gathering,
enforcement of drug-related laws and prosecution of offenders. The committee shall be
composed of the following members:

a. City Director, DILG;

b. Chief, Naga City PNP;

c. Chief, Camarines Sur NARCOM;

d. Regional Director, NBI;

e. Chief, CIDG Cam. Sur;

f. President, Integrated Bar of the Philippines, Cam. Sur Chapter;

g. City Prosecutor, Naga City.

SECTION 5.4. - COMMITTEE ON EARLY INTERVENTION AND REHABILITATION. -


This committee shall be in charge of the early intervention and rehabilitation program. The
committee shall be composed of the following members:
a. Director, City Social Welfare and Development Office;

b. City Health Officer;

c. Head, Public Attorney’s Office, Cam. Sur.

ARTICLE III - DUTIES AND FUNCTIONS OF THE BOARD

SECTION 6. - DUTIES AND FUNCTIONS. - The Board shall have the following duties
and functions:

a. meet on a bimonthly basis;

b. prepare and adopt internal rules to govern the conduct of bimonthly meetings, and
amend or revise the same, from time to time, if necessary;

c. undertake planning and evaluation sessions on quarterly and annual bases;

d. undertake semi-annual programming and assessments;

e. undertake systematic consultations with the barangays, schools, and other sectors;

f. hold annual drug summit;

g. formulate and cause the implementation of short-term and long-term plans,


programs and projects;

h. closely coordinate with line agencies and non-government organizations regarding


the plans of action and programs approved by the Board;

i. monitor and maintain the necessary records on the status of drug abuse in Naga City
and submit quarterly summary reports thereof to the Sangguniang Panlungsod;

j. provide the local chief executive and the chair/s of the concerned committee/s of the
Sangguniang Panlungsod with minutes, plans of action, policy recommendations
and other pertinent decisions regarding the programs and projects of the Board;

k. perform such other functions, necessary and proper, to effect the foregoing
functions.

ARTICLE IV - IMPLEMENTING MECHANISM

SECTION 7. - FORMULATION OF IMPLEMENTING RULES AND REGULATIONS -


The Committee on Public Safety and Human Rights of the Sangguniang Panlungsod shall be
tasked to formulate the implementing rules and regulations (IRR) of this Ordinance within one
(1) month after its approval, after which it shall take effect pursuant to Section 11 hereof.

ARTICLE V - FINAL PROVISIONS

SECTION 8. - APPROPRIATIONS - To effectively implement the plans, programs and


projects of the Board, seventy five percent (75%) of the Anti-Illegal Drugs Fund in the Annual
Budget which forms part of the Annual Local Development Fund (LDF) shall be appropriated for
purposes of this Ordinance.
SECTION 9. - SEPARABILITY CLAUSE. - If any provision of this Ordinance is declared
invalid or unconstitutional, the remaining provisions not affected thereby shall continue in full
force and effect.

SECTION 10. - REPEALING CLAUSE. -All ordinances, local issuances or rules


inconsistent with the provisions of this Ordinance are hereby repealed or modified accordingly.

SECTION 11. - EFFECTIVITY CLAUSE. - This Ordinance shall take effect after the
Implementing Rules and Regulations (IRR) shall have been approved by the Sangguniang
Panlungsod.
