As per the interim orders of Hon’ble High Court 13th cited and also in
terms of Judgment of the Hon'ble APAT, Hyderabad 15th cited, a provisional
zone-wise seniority list of Deputy Executive Engineers of Roads & Buildings
Department from the panel year 2002-03 to 2010-11 was issued vide Circular Memo

16th cited and concerned staff members were directed to submit objections or
modifications, if any, on the above panels within 15 days from the date of placing
of Circular Memo in the official public domain www.aproads.cgg.gov.in.

2) Further all the objections and modifications suggested by the staff


members were carefully examined as per the existing rules as on the date of
commencement of each panel year and were accordingly resolved. Further, in
regard to implementation of the Rule of Reservation in promotions in respect of
Scheduled Caste and Scheduled Tribes, the following guidelines are being followed:-

1) Rule of Reservation in promotions in respect of Scheduled Caste and Scheduled


Tribes was implemented in terms of orders issued vide GO Ms No.5
SW(SW.ROR.I) Dept, dated 14-02-2003 read with GO Ms No.123 GAD(Ser-D)
Dept, dated 19-04-2003 (came into force with retrospective effect from 14-02-
2003) and also as per the policies prescribed by the Government vide GO Ms
No.2 SW (SW.ROR.I) Dept, dated 09-01-2004.

2) For arriving the adequacy in respect of Scheduled Caste and Scheduled Tribes,
Para-5 of GO Ms No.2 SW (SW.ROR.I) Dept, dated 09-01-2004 was taken for
consideration up to the panel year 2007-08 and the orders issued vide GO Ms
No.154 SW (ROR.I) Dept, dated 30-07-2008 were given prospective effect
from 2008-09 onwards.

3) Further, even while preparing seniority list of DEEs for the panel year 2002-03,
Para-4(d) of GO Ms No. 5 SW(SW.ROR.I) Dept, dated 14-02-2003 read with
Para-10 of GO Ms No.2 SW (SW.ROR.I) Dept, dated 09-01-2004 and Rule-
6(b) of AP State and Subordinate Service Rules’1996 were scrupulously
implemented.

4) As per the Hon’ble Supreme Court Judgment dated 05-11-2004 in Appeal


(Civil) 6758 of 2000 between M/s. MALAMAHANADU REGISTERED SOCIETY
and STATE OF ANDHRA PRADESH & ORS and MALLELA VENKATA RAO &
ORS and STATE OF ANDHRA PRADESH & ORS and Judgment dated 25-09-
2006 in I.A. No.5 Civil Appeal No 6758 of 2000, all the promotions made in
the (R&B) Department in their respective Zones prior to the Judgment of
Hon’ble Supreme Court on the basis of the “ABCD” categorization in
Scheduled Caste employees, were made un-affected”.

5) In terms of the Judgment of Hon’ble High Court dated 01-12-2014 in WP


No.21316/2004 and WP No.1438 of 2005 and dated 29-12-2014 in WPMP
No.49168 of 2014 in WP No.1438 of 2005, preference was given to the Post
Graduate Engineers in every 9th AEE vacancy as prescribed in Note-(1) under
Rule-3 of GO Ms No.103, T(R&B)(Ser-II) Dept, dated 22-05-1996, subject to
amendment of Service Rules issued vide GO Ms No.103 dated 22-05-1996.
However, while giving preference to PG holders, the orders issued vide
Government vide Memo No.1193/Ser.IV-2 /77-1, dated 13th October, 1978
were also implemented along with Rule-6(b) of AP State and Subordinate
Service Rules’1996 were scrupulously followed.

6) Further, for filling up of the year-wise vacancies of Deputy Executive Engineers


in their respective Zones, the cycle prescribed in Note-(1) under Rule-3 of AP
(R&B) Engineering Service Rules’1996 was followed.

3) As such, after modifying of the said Zone-wise provisional seniority


list of Deputy Executive Engineers dated 19-12-2015 to the extent required, it is
hereby ordered that the Zone-wise seniority list of Deputy Executive Engineers,
Roads & Buildings Department from the panel year 2002-03 to 2008-09 is herewith
finalized and communicated to the concerned individuals through website i.e.,
www.aprdc.ap.gov.in under Administration caption.

4) However, the above finalization of seniority list of Deputy


Executive Engineers is subject to outcome of any cases pending in Hon’ble APAT or
High Court or further directions issued by the Government in this regard.
