Sir,
With reference to your letter No. 4-3/71-GS dated 21th April, 2009, it is
submitted that internal inter section posting/adjustments are made by the University for
Administrative Convenience from time to time. No change of station is involved and
further the University will consider framing of guidelines regarding posting of staff in
sensitive positions. All service benefits to the employees are regulated in accordance with
the set rules and regulations. No case of prejudice or bias against any employee of weeker
section has been reported so far. The matter regarding not posting the Union/Executive
Council/Court Member in the Establishment Branch will also be taken into consideration.
The case of Mr. Uma Kant, Private Secretary is receiving attention of the Hon’ble Court
so the University is unable to take any further action in the matter till the decision of the
Court.

Sub: - Relaxation in H.P Allotment of Government residences (General Pool)


2nd amendment Rules, 2008.

Sir,

It is brought to your kind notice that some of the teachers of the University
frequently go out of the University to different institutions on teaching or research
assignment and they request for retention of residence allotted to them by the
University for such period of foreign assignment on usual rent. In the past the
retention of accommodation on payment of usual rent has been allowed liberally
by the University. It is, therefore, requested that the Vice-Chancellor may kindly
be authorized to grant relaxation in the matter of retention of residence to such
teachers who proceed on teaching/research assignment in relaxation of H.P.
Allotment of Government Residences(General Pool)2nd Amendment Rules, 2008.

Item No.7:- Deferred. It was decided to refer back the case to the
Faculty of Engineering & Technology for furnishing full details as to
how infrastructure development fund is proposed to be utilized

Item No.8:- Deferred. Circulation figures of all the newspapers be


collected and placed before the Executive Council for taking
appropriate decision as regards inclusion of additional
newspapers in the roster for releasing advertisements.

Item No.9:- Deferred. The matter is required to be re-examined and placed


before the Executive Council with more clarity.

Item No.10:- After detailed discussion, it was decided that a committee


consisting of Hon’ble Vice-Chancellor, Secretary(Education),
Secretary(Finance) and Director(Higher Education) will
examine the reports of Resource Mobilization Committee in the first
instance. It was further decided that a White Paper on the
financial position of the University posts and implementation of
pay-revision be placed in the next meeting of the Executive
Council.

Item No.11:- After detailed discussion on each and every aspect, it was
decided to make the following changes in the Tally Sheet for
recruitment of teachers in the University:-

Item No.14: The pay fixation case of Shri Som Krishan Sharma and others
as per orders of the Hon’ble High Court of Himachal Pradesh was discussed in
detail. lt was decided that the benefit of additional pay of Rs.120/-per month
cannot be granted to the incumbents as they were not holding the post of
Superintendent Grade-II as on 31.12.1985. The Executive Council further took
note of the fact that the instructions regarding grant of additional pay of
Rs.120/- per month to Superintendents Grade-II holding the position, as
such, on 31.12.1985 do not explicitly provide for up-gradation of the pay of
seniors due to anomaly arising on this scare so that stepping up of pay of
senior with reference to the juniors in the instant case is not required. The
forwarding of the case of petitioners by the University to the State Government
for clarification cannot be allowed to come in the way of enforcing the
correct position as per the rules. It was, therefore, decided not to grant additional
pay of Rs.120/- per month or any other kind of step-up to the petitioners.

Item No.17:- The item was deferred again. It was decided to take up the matter
with the State Government with the request to consider merger of HPSTEP in
the State Government with the Department of Science & Technology or in
any other Department of the State Government as merger of HPSTEP with
the University will lead to pressure from various Projects/Schemes in the
University for their merger also in the University.

Item No.18:- The item was discussed in detail. The Finance Officer of the
University confirmed that it will be possible to pay salary to the
non-teaching staff according to revised payscales from September, 2009 to
March, 2010 out of existing budget without demanding additionally. In view
of this, it was decided to release the revised scales as notified vide
Notification No._____________dated_______. It was further
decided that as soon as the notification of UGC payscales is issued
by the State Government, the same shall be adopted and implemented by the
University.

Item No.19:- The vacancy position in respect of teaching and non-teaching


staff was discussed in the meting. The Hon’ble Vice- Chancellor
assured that the already advertised vacant posts will be filled up soon. It
was further decided to take steps for reducing expenditure and stepping up
resource `1=766 mobilization. The steps for rationalization of staff and
computerization of Examination Wing of the University was also
stressed. It was decided to move proposal to the State Government for
filling up of vacant posts.

Brief facts of the case are that Sh. Vinod Kumar Guleria, presently

working as Draughtsman in the H.P.University, Shimla filed a CWP No.2649 of

2009 stating that the University may be directed to decide his representation

dated 29.4.208 and representation dated 3.7.09. The Hon’ble High Court of

Himachal Pradesh vide order dated 20.8.2009 has ordered that these

representations be decided within a period of four weeks.

I have perused his representations dated 29.4.08 and 3.7.09.

Second representation is by way of reminder repeating the contents of

representation dated 29.4.2009. The representationist is requesting for his

promotion/change of designation from the post of Draughtsman to that of Junior

Engineer to the exclusion of his three seniors on the grounds that at some stage

he was assigned the duties of Junior Engineer. I have heard the representationist

in detail as also the Executive Engineer and Superintending Engineer of the

Construction Division. It turns out that the representationist does not possess the

qualifications prescribed for the post of Junior Engineer in the Rectt. & Promotion

Rules. He is staking claim to the post of Junior Engineer due to mis-

understanding of the contents of Govt. Instructions circular No.PBW.A.B(12)-

22/2005. These instructions lay down that:


“…employees who are in possession of technical
qualifications and serving against other category may be
considered for appointment against such vacant posts after
providing requisite training.”

The case of the representationist is just not covered under these

instructions. He does not possess the technical qualifications for the post of

Junior Engineer for which he is staking claim. He possesses the qualification for

the post of Draughtsman, has been appointed against the post of Draughtsman

and is working against the same post. If he is promoted/appointed to the post of

Junior Engineer, other Draughtsmen who are senior to him will be aggrieved.

Assigning the duties of Junior Engineer to him for a brief period is

inconsequential. Duties assigned to him were such that these were being

performed earlier by some Junior Engineer but the same could be performed by

any clerical staff as well. In view of the above I found no merit in his

representation and the same is hereby rejected.

Subject : Clarification regarding pay fixation cases of non-teaching


employees of the University.

Sir,

I am to refer to your letter No.EDN-A-Kha(7)-4/97-Part-I, dated


7.5.2010 on the subject mentioned above and to say that the Executive Council
vide its Resolution No.18 of its meeting held on 20.6.2007 has approved the
recommendations made by the Committee constituted by it vide Resolution
No.2(32) dated 31.8.2006. The recommendations of the Committee are also
enclosed for ready reference in which it has been concluded that the pay fixation
cases of the University employees have been settled by the University in
accordance with the instructions, guidelines issued by the State Government from
time to time. The Committee found that there is no departure from the
instructions contained in various letters issued by the State Government from time
to time and the University has regulated the pay fixation cases judiciously and
there is no point of doubt on which any clarification from the State Government is
still required. The recommendations of the Committee were upheld by the
Executive Council after detailed deliberations on each issue and decided that
since there had been judicious application of rules in the pay fixation cases of the
University employees settled by the University, the Local Audit Department
should clear all those cases. The instructions contained in the letter No.Fin.-C-
A(4)2/99 dated 27.12.2003 referred to in your letter have also been looked into
while taking a final decision by the Committee.

It is, therefore, requested that the report of the Committee


and the decision taken by the Executive Council thereon may be perused and the
University may be allowed to proceed further to settle the pay fixation cases so
that the resentment prevailing amongst the University employees due to
inordinate delay is resolved amicably.

At the very outset, the Registrar welcomed the Chairman


and other Members of the Joint Action Committee(NT). The
Chairman informed that as a gesture of goodwill and keeping in mind
the post of Registrar who is also the Member-Secretary of the
Executive Council, we are here to negotiate the demands raised by
the Joint Action Committee with a hope that all the issues will be
settled amicably in the interest of peace and development of the
University. The following matters were taken up for discussion:-

1. Promotions against upgraded posts in different non-


teaching cadres:

It was resolved that the decision(s) of the Executive


Council in this regard do not attract Section 35-A. The Joint Action
Committee referred to the E.C’s Resolution No.8, dated 29.9.2009
wherein Sh. Suresh Bhardwaj, Hon’ble M.L.A pointed out that though
the matter regarding upgradation of posts has been pursued with the
Finance Department repeatedly, the necessary approval is not coming

forth. Meanwhile, it was also stated by the Joint Action Committee


that since legal opinion in this regard had already been obtained,
therefore necessary orders for promotion against upgraded posts may
be issued at the earliest. Besides, there is also a decision of the
Central Administrative Tribunal(CAT) which interalia says that
upgradation is not creation of posts. It was further pointed out that
decision of the Executive Council (18th February, 2005) is very much
clear i.e. “the Council reviewed the matter and decided that there
was no necessity of referring the cases of upgradation of various
posts to the State Government, since the posts are being
upgraded as personal measure to the incumbents and no fresh
creations are involved.”

The Joint Action Committee also pointed out that the Vice-
Chancellor was authorized by the Executive Council to
examine/decide the cases relating to upgradation of posts in the
technical cadre and this may also be done immediately.

The promotion cases of Sh.Bishan Singh Chandel and Sh.


Mohan Lal Gill are also pending since long. These officials are to be
promoted against the upgraded posts from the due date and it does
not require reference to the Recruitment and Promotion Committee as
the posts stand already approved.

2. Revision of pay scales in respect of Administrative Officers


on the UGC pattern
It was resolved that the University has already adopted the
pattern of pay-scales to the teachers and administrative officers on
UGC pattern. The Joint Action Committee pointed out that we have
dual pay structure in the University i.e. H.P.Sectt. pattern upto the
rank of Section Officers and U.G.C. pattern for the teachers and
administrative officers as well as the Library staff etc. It was stressed
upon that the Administrative Officers are in receipt of UGC pay-scales
but the revision is due from 1.1.2006. It was pointed out that during
the year 1973, 1986 & 1996, the pay-scales were allowed on UGC
pattern. There are clear cut decision(s) of the Finance
Committee/Executive Council in this regard. Therefore, necessary
notification may be issued as per past practice. However, the
Registrar informed the Joint Action Committee that the matter has
been taken up with the State Govt. on these lines.

3. Settlement of pay fixation disputes:

It was resolved that pay fixation cases of non-teaching


employees are to be settled in view of the report submitted by Atwal
Committee and the decision taken thereon by the Executive

Council (Resolution No.18, dated 28.6.2007) i.e. “The Council


deliberated over the issue in details and found that there had
been a judicious application of rules in the pay-fixation cases
which have been settled by the Committee constituted for the
purpose. Thus it was decided that there is no necessity to obtain
further clarification from the State Government in this regard.
However, the LAD stationed at the Campus may be directed
through their Head of the Department to settle the said cases in
accordance with the recommendations of the Committee as per
annexure”. The Joint Action Committee also referred to letter No.Fin.
(LA)H(2)C(15)-14-52/82-Vol.15-480, dated 18.1.2001 received from
the Addl. Secretary(Finance)-cum-Examiner, Local Fund Accounts,
H.P. which was addressed to the Joint Controller(Aduit), Resident
Audit Scheme, H.P.University in response to Registrar’s letter No.6-
21/76-HPU(Estt.)Vol.II-147, dated 9.1.2001 which states that “the
Executive Council is the highest executive body of the
University(HPU) and no interpretation whatsoever, at any level,
should be derived against the spirit of its decisions”. The
Members also stated that information obtained in this regard under
R.T.I. has duly been supplied to the Establishment Branch and the
pay fixation made in the University has been found at par with the
H.P.Sectt. In this context, the Registrar informed the Joint Action
Committee that the matter is being taken up again on these lines.

1. Regularization/Confirmation of employees:
It was resolved that the regularization and confirmation of
employees wherever due will be done immediately. The
representations made by individuals to consider their cases from back
date including Cooks deployed in the Hostels may also be decided
and justice be done to them. The Joint Action Committee also pointed
out that Finance Committee/Executive Council has approved creation
of 32 posts to regularize the services of those officials employed
under NRI/Self Financing Schemes during the month of July, 2009 but
necessary approval of the State Government is still pending for no
reasons. The matter be taken up on priority basis. The Registrar
informed that the meetings of the Recruitment and Promotion
Committees shall be convened by the end of this month and all such
cases will be considered and decided accordingly.

5. Recruitment of staff against vacancies:

The Joint Action Committee pointed out that approximately


300 posts of non-teaching staff in different cadres are lying vacant.
Besides, in view of superannuation of the officials, every month, is
adding to the vows of the existing staff, especially posted in the
examination wing. In view of the shortage of class IV and Clerical
Staff, it is very difficult to carry out the time bound job relating to
declaration of results and other important assignments etc. The

Registrar informed that necessary steps are being taken to initiate the
recruitment process and assured that needful will be done at the
earliest.
6. Promotion against all resultant vacancies:

The Joint Action Committee pointed out that promotion


orders against resultant vacancies be issued forthwith. It is departure
from practice that promotion orders are with-held for months together
whereas in the past, the official(s) next in line were getting promotion
immediately after the superannuation, if otherwise eligible. Besides,
placement as Jr. Assistants, there are vacancies in the personal staff
as well as in different non-teaching cadres but the employees have to
wait for long, which denies promotional benefits, for no reasons. The
Registrar informed that needful will be done by the end of this month.

7. Immediate appointment of Clerks by way of promotion from


among the eligible Class IV officials.

It was resolved that list of eligible class IV employees will


be prepared and put up before the competent authorities for
promotion against vacant posts of Clerks. The Joint Action
Committee pointed out that since recruitment process may take
considerable time and it will be appropriate to post additional work
force in the Examination Wing by way of promotion from amongst the
category ‘D’ employees.

8. Abolition of Section 35-A.

It was resolved that office will prepare a comprehensive


note in this regard. The Joint Action Committee pointed out that in the
meeting held during the month of July, 2009 under the Chairmanship
of Hon’ble Vice-Chancellor, Prof. Sunil Kumar Gupta in the Committee
Room, the matter regarding abolition of Section 35-A was discussed
threadbare. In this meeting Sh. Suresh Bhardwaj, Hon’ble MLA was
present. This issue has also been discussed in the meetings of the
Executive Council time and again. Therefore, it is desirable that a
detailed note is handed over to the Hon’ble MLA and Member of the
Executive Council, Sh. Suresh Bhardwaj so as to enable him to take
up this issue with the Hon’ble Chief Minister, Prof. Prem Kumar
Dhumal for deletion of the aforesaid unwanted clause added in the
Himachal Pradesh University Act, 1970 (amended from time to time).

While concluding the meeting, the Registrar said that he


will apprise the Hon’ble Vice-Chancellor about the outcome of the
discussions held with the Joint Action Committee led by Sh. Sohan
Singh Thakur,Chairman and President, H.P. University Administrative
Officers’ Association. Though, he is convinced that the decisions of
the Executive Council are to be implemented in letter and spirit and
admitted that being Member-Secretary of the Executive Council, the
Action Taken Report (ATR) regarding various resolutions adopted in
the meetings of the Executive Council are prepared at his end and

placed before the Executive Council in the next meeting. However,
the Hon’ble Vice-Chancellor being the Chairman of the Executive
Council is the final authority to resolve all the issues as pointed out
above and, therefore, he is duty-bound to inform the Hon’ble Vice-
Chancellor about the outcome of the negotiations held with the Joint
Action Committee today i.e. 13th May, 2010. However, Sh. Sohan
Singh Thakur, Chairman, Joint Action Committee informed the
Registrar that we are ready to talk to the Hon’ble Vice-Chancellor to
resolve all these matters as per decisions of the Executive Council.
Since, there are assurances from the concerned authorities from time
to time as well as commitments made during the meetings of the
Executive Council and Court of the University (HPU), we can withdraw
the on-going dharnas/rallies/gate meetings as soon as the decisions
of the Executive Council are implemented in letter and spirit.
Necessary orders, therefore, be issued in this regard so as to bring an
end to the on-going stalemate.

HELD ON 20th MAY, 2010 AT 12.30 P.M. IN THE
OFFICE CHAMBER OF THE REGISTRAR

A meeting with the Joint Action Committee(NT) was


held in the office chamber of the Registrar, Himachal Pradesh
University on 20th May, 2010 at 12.30 p.m. to apprise the
decision(s) taken by the State Government on the demands
raised by the duly elected leadership of Non-Teaching
Employees headed by Sh.Sohan Singh Thakur, Chairman, Joint
Action Committee(JAC). The following were present:-

The Registrar welcomed the Chairman and other


Members of the Joint Action Committee(NT). The Chairman
stated that we are here to know the outcome of the demands
negotiated on 13.5.2010 which were further placed before the
Executive Council on May 15, 2010. The following issues came
up for review and the following deliberations took place:-

1. The Registrar read out the letter received through fax
from the Principal Secretary(Hr.Education) to the Govt. of
Himachal Pradesh before the Joint Action Committee and the
Members expressed their happiness over the final settlement of
pay fixation Cases. The Members of the Joint Action
Committee(JAC) further pointed that Administrative Officers of
the University were borne on the UGC pay-scales, as per the
decisions of the Finance Committee/Executive Council, from time
to time and now supplemented by an Order/direction/Judgment
delivered by the Hon’ble High Court, Himachal Pradesh to allow
the same as revised w.e.f. 1.1.2006. And, therefore, necessary
follow-up action in the matter be taken up on priority

Further, the Registrar informed the Joint Action


Committee, that the State Government has constituted a high
powered Committee to look into the issue raised with regard to
abolition of Section 35-A.

The Members expressed their gratitude to the Hon’ble


Chief Minister, Prof. Prem Kumar Dhumalji and Shri Suresh
Bhardwaj, Hon’ble MLA & Member of Executive Council for
redressing the grievances of the University community.

We genuinely feel, that all these steps will not only
help to restore the autonomy of the University but also up-hold
the dignity of the Executive Council which is an apex governing
body of the University(HPU).
2. The Registrar also informed that Recruitment &
Promotion Committee meetings in respect of all categories are
being convened very shortly and necessary orders of promotion
will be issued. The Chairman of the Joint Action Committee
further pointed out that promotion against vacant positions of all
non-teaching categories be made forthwith. Further, the
Members took serious note of the matter that the Vice-
Chancellor’s Office is quoting someone else as ‘President of
Non-Teaching Employees Union’ in a communication to the
Administration with reference to promotion as Superintendent(Ex-
cadre) from amongst the Sr. Assistants. It is totally wrong as the
Non-Teaching Employees Union is the integral part of the Joint
Action Committee(JAC) and its President, Dr. Hiteshwar
Thakur is one of its Secretary General, another being Sh. Arjun
Thakur from amongst the Administrative Officers. Therefore, the
Hon’ble Vice-Chancellor cause not to lower the position of the
Joint Action Committee which represent all the
Unions/Associations of Non-teaching employees. Further, the

Members stressed that decisions of the Executive Council be
implemented in letter and spirit in view of its unanimous
Resolution adopted during the meeting on May 15, 2010.
Accordingly, they demanded issuance of orders/notifications, in
black and white, in respect of all matters negotiated in the
meeting held on 13.5.2010 including Class IV employees /
Technical Cadres so as to end the on-going stalemate. The
promotion orders in respect of Sh.Bishan Singh Chandel and
Sh.Mohan Lal Gill may also be issued from due date.

3. The Chairman, Joint Action Committee further pointed


out that the proceedings of the ‘Negotiation Committee’ held on
13.5.2010 have not been annexed with the proceedings of the
Executive Council issued on 19th May, 2010. The same may,
therefore, be circulated immediately or else the matter will be
brought to the notice of the Hon’ble Chancellor(Governor of
Himachal Pradesh). He further pointed out that Hon’ble Vice-
Chancellor may like to talk with the Joint Action Committee
alongwith the Statutory Officers as well as Dean of Studies in
view of the on-going stalemate in the University to call off the
agitation. Left out employees be promoted against the upgraded
posts as already referred to in the E.C’s Resolution No.8, dated

29.9.2009 i.e. “The item was discussed in detail. Shri Suresh
Bhardwaj Hon’ble Member pointed out that though the
matter regarding up-gradation of non-teaching posts has
been pursued with the Finance Department repeatedly, the
necessary approval is not coming forth. Shri Waryam Singh
Bains Member Executive Council representing non-teaching
employees constituency also pointed out that the decision
regarding up gradation of 39 posts of Superintendents, 27
posts of Section Officers, 2 posts of Deputy Registrars, 4
posts of Assistant Registrars and 6 posts of Personal
Staff was taken by the Executive Council during the year
2006 and 2008, but necessary approval of the Govt. is
getting much delayed. The Principal Secretary (Fin.)
assured that the matter will be examined expeditiously and
appropriate decision in the matter will be taken before the
next meeting of the Executive Council.” It is discriminatory
that matter of upg-radation of posts has been left half-way which
should be completed now as per decision of the Executive
Council (15.5.2010). Needless to mention here, that earlier
Executive Council in its meeting held on 18th February, 2005 has
passed Resolution i.e. ““the Council reviewed the matter and
decided that there was no necessity of referring the cases of
up-gradation of various posts to the State

Government, since the posts are being upgraded as
personal measure to the incumbents and no fresh creations
are involved.”
4. There is also decision of the Finance
Committee/Executive Council for regularization of 32 employees,
deployed under NRI/Self Financing Scheme. Besides, creation
of posts for NOIDA Centre has also been approved by the
Executive Council and, therefore, these decisions are to be
implemented in letter and spirit in view of the Resolution adopted
in the meeting of the Executive Council (15.5.2010). The Joint
Action Committee further pointed out that there is no question of
seeking justification in these cases as the decisions on these
issues have already been taken after thorough examination at
different levels.

In view of the above negotiations, the Registrar


requested the Chairman to withdraw the on-going agitation.
While responding to the request, the Chairman informed that as
soon as necessary orders and notifications, in all matters as
discussed above are issued, the Joint Action Committee(JAC),
will consider the further course of action accordingly.

Further, all the Members desired shifting of ‘Leaders’
from the Establishment Branch to ensure un-biased functioning of
the University Administration as per proceedings of the Court of
the University (April 8, 2010).
In the end, the Registrar assured the Joint Action
Committee, that he would place the entire matter before the
Hon’ble Vice-Chancellor who had directed him to hold dialogue
with the agitating employees under the banner of Joint Action
Committee(JAC).

The matter has been discussed with the Hon’ble Vice-


Chancellor, the other day while attending a meeting regarding
shifting of work relating to affiliation to the Dean of Colleges-cum-
Director, College Development Council from the Academic
Branch that the services of Mr. G.S.Kutlehria, Section
Officer(Academic) be utilized in the Office of the Registrar and he
will sit in the O/O the Registrar and will also look after the work
relating to Academic Branch i.e. staff dealing with admission,
Academic Council meeting and Syllabus only additionally. The
Dy.Registrar(Estt.) may, therefore, issue orders in this regard
today positively.
