ISSUE: 20180831- Re: Reality check about renewable energy

As a CONSTITUTIONALIST my concern is the true meaning and application of the constitution.

* Gerrit, so you are now an expert on renewable energy?

**#** INSPECTOR-RIKATI®, absolutely not and I have the guts to admit it.
* Well, what are you then on about/
**#** I have read some articles and well I have my concerns. We hear a lot about solar panels
but what about the issue of disposing of them? Are they recyclable? Then you hear about all
those claims how it will be better for us all to have solar energy usage, electric cars, etc. but what
about all those batteries that will clog up the world? Then you have all those predictions which
turn out often to be falsifications, errors in calculations, etc. We have also a gigantic solar panel
company reportedly going broke. Now, who is going to serve the existing solar panels if this
company is bust? It will be yet another cost to consider. If we consider what went on in the USA
then I wouldn’t hold my breath to expect any improvement. Shareholders who had shares of $30
each now a mere $0.50 hardly will be all the way laughing to the bank.
* What do you suggest?
**#** A moratorium on this solar panel business and to have the Inter-State Commission to have
its experts to consider the benefits, if any, of this renewable energy issue. It also should then
investigate as part of it the so called SMART METERS related issues.
* Isn’t that a state issue?
**#** Actually no. the commonwealth has the sole constitutional legislative powers as to weight
and measures and so it and it alone can deal with SMART METERS, such as calibrations,
installation, any harm to humans, etc.

* Is this SMART METER privacy issue not a State matter?

**#** No, this as it uses electronic means to convey details and that fall within the provisions of
telecommunications a Commonwealth legislative power. Also, as the Framers of the Constitution
made clear that our constitution was no less than the USA constitution and its 14 Amendment as
to liberty then our constitution has the embedded legal provisions regarding the 14 Amendments
also.
Director of Public Prosecutions v Serratore Nos. Ca 40642/95 and Crd 72680/95 Criminal Law and Procedure -
Statutes - Human Rights - Telecommunications - Law Reform [1995] NSWSC 154 (14 November 1995)
QUOTE
"It is well established that the Court should not impute to the legislature an intention to interfere with
fundamental rights, freedoms or immunities; such an intention must be clearly manifested by clear and
unmistakable language: Coco v The Queen [1994] HCA 15; (1994) 179 CLR 427 at 436-437. ... The close
link between the fundamental right to be secure against trespass and the right to privacy is illustrated by the
observations by Lord Scarman in Morris v Beardmore (1981) AC 446 ... Parliament itself has ...
recognised, in the context of telecommunications, the fundamental importance of protecting individual
privacy, although also recognising that the value of privacy can be over-ridden where it conflicts with
other significant community values, provided that detailed safeguards are observed. The recognition
and protection of privacy in the Intercept Act, in my view, justifies a restrictive approach to the
construction of the statutory exceptions to the prohibitions on interception. ... where there is a genuine
doubt as to whether the statutory language authorises the use of intercept information for a particular
purpose, that doubt should be resolved in favour of a narrow, rather than a broad construction of the
statutory authorisation."

The value of a provider not having to manually read metres in my view is not an overriding
reason to interfere with the privacy of individuals and hence cannot be permitted unless each
individual personally request a utility company specifically to record such privacy details.
As TERRY PATRICK SHARPLES in his case before the High Court of Australia No. B104 of

Lord Shaw of Dunfermline Scott vScott 1913 AC at 477 – despotism “In the darkness of secrecy, sinister
interest and evil in every shape have full swing. Only in proportion as publicity as publicity has place can any
of the checks applicable to judicial injustice operate. Where there is no publicity there is no justice”

So, Politicians hold that their cabinet meetings are secret from the public, at least for a long
period of time but not a person’s personal details as to when the person is using gas, electricity,
etc. the danger that crooks may access this information as to know when likely the resident
might be away from home as to rob the place seems to be of lesser significant than for a
electricity supplier to do electronic readings. It seem to me if the politicians can access my
privacy details that we should as electors have immediate access to their cabinet details. After all

that relates to us all! No more Freedom of Information exclusions for them because if they hold
there is no right of privacy for us then the same should apply to them.
This scaremongering about GLOBAL WARMING has been very costly to our society and for
what? We have politicians working on thought bubbles and White Elephant projects that are
generally very costly and of little or no benefits to the general community.
We need to take the politicians out of it and leave it up to the Inter-State Commission experts.
This as the politicians are using other people’s monies to waste on their pet projects and not that
of their own.
This correspondence is not intended and neither must be perceived to state all issues/details.
