3. Whereas, the Hon'ble Punjab and Haryana High Court has preferred
to file S.L.P No.31154-31155 of 2015 and Hon'ble Supreme Court,
which has passed the following orders on dated 16-11-2015 as under :-
"Dismissed. However we grant one months time from today to
comply with the orders and directions issued by the High Court."
4. Whereas the aforesaid Writ Petitions were treated as C.W.P No. 15869
of 2012 and C.W.P No.16339 of 2012 in which Hon'ble High Court
disposed of these Writ Petitions vide its judgement dated 26-08-2015,
the relevant part of which is reproduced as under :-
In view of the afore citied decisions and following their ratio and
dictum, we answer the first question that the sustainability of
adverse remarks in the annual Confidential report for the year
2010-2011 requires a fresh and dispassionate reconsideration by
the High Court. Thus, the impugned order dated 19-08-2011 vide
Annexure P-17 in Civil Writ Petition No. 15869 of 2012 is quashed.
Consequently, the High Court is directed to reconsider the
representation of the petitioner and pass fresh order within a period
of two months in accordance with law.
Coming to t he 2nd question whether the recommendations made by
the High Court to the Government for compulsorily retirement of
Petitioner, are the order of the compulsory retirement issued by the
Government , suffers from any flaw or not, the same shall depend
on the reconsideration of the petitioner's representation by the High
Court. Therefore challenge to compulsory retirement orders dated
254-07-2012 vide Annexure P-1 (Colly) in Civil Writ Petition 16339 of
2012 is concerned, the High Court is directed t o take a fresh
decision after considering the representation as stated above
within a period of 2 months.from the dateThf taking decision on the
representation of the petitioner against ACR. Accordingly, both the
writ petitions are disposed of in above terms.
Whereas Hon'ble Punjab and Haryana High Court reviewed its decision
dated 05-08-2011 regarding recommendation of retiring Shri Jatinder Pal
Singh, the then member of PCS ( JB) prematurely from service, in view
of the judicial verdict dated 26-08-2015 of this Court passed in CWP No.
15869 of 2012 and CWP16339 of 2012 filed by the officer. Further,

Honeble Punjab and Haryana High Court, through its Registrar General
has recommended the Punjab Government for recalling the order dated
27-04-2012 with regard to premature retirement of Sh. Jatinder Pal Singh
from service.
