Comparison of Constitution
Please note the following:
1. This is just a basic and simple comparison
2. I have not mentioned every single change since this would have been extremely tedious, especially for minor wording differences, but my
suggestion would be to sit and review it word by word and this can be done by a constitution review committee who are assisted by a lawyer.
3. I am not a professional in the language of law, so my view of differences may be obscured due to ignorance in the language of law.
2002 Constitution
Membership Article V #2
 $150. A year per family or single,
 A new member shall be eligible to vote
90 days after the membership dues are
paid.
 Members residing in the community
who defaulted in paying their dues for
the previous two years shall be eligible
to vote upon payment of all dues ninety
days prior to election date.
Board of Trustees Article VI #2, 3, 5(d), 6, 8
 2. There shall be a total of nine board
members
 3. The general body will elect the
president and the remaining four
executive members of the association.
In addition the remaining four board
members will be handpicked by the
elected president in consultation with
the executive committee.
2007 Constitution
Membership Article V #2
 $200 a year per household.
 $100 a year per single member.

paid.

Differences
 We would have to refund every family

2. Number of board members presents a
problem it states 9 in the 2002 and 11 in the
2007
3 & 4. In the 2002 general body elects president

  5 (d). Process as defined in article XI, of
the bylaws
 6. An elected trustee in violation of the

the constitution may be removed from
trusteeship by 2/3 majority of the

recommendation of the board of trustees

Article XIV Amendments to the constitution
11 members to the board of directors.
5 & 6. In the 2002 constitution gives you better
navigation as to where to find the articles within
the bylaws and in the 2007 it just states that it is
in the bylaws without stating where it can be
found.
6 & 7. In the 2002 it states that an elected
trustee may be removed by 2/3 majority vote of
members at a general body and in 2007 it states
an elected director may be removed from
dictatorship by simple majority vote by the
board of directors, totally removing the general
body from the decision.
8. this was removed for the 2002
8. This was added in the 2007 –
#’s 3 & 4, 5, 6, 7, 8 Were added to the 2007
and did not exist in the 2002 and Allah knows
best.
2. Not sure if it being an autonomous (self-
governing) body is of concern to the
MAGR/general body
3. This is a good thing (found in 2007) but just
pointing out that it did not exist in the 2002
 If we stick with 2007 constitution it
cannot be ratified until August of 2009

 1. The number of people needed to
propose amendments can vary up or
down if we stick with the 2007
constitution (may and may not be
important but it is a difference)
 5. It states that for the initial change you
will need 2/3 of the general vote in order
to make a change but if quorum is not
met in the first meeting, then you have
to set up another meeting and the people
who show up represent quorum in the
second meeting. In the 2002 you need a
total of 2/3 majority vote in order to
amend the constitution in general.
 4. Not in the 2002
 What does simple majority mean?
Explanation for quorum cannot be found
due to it being labeled wrong XI and it
should IX and again you would need 2/3
for the first meeting and if a second has
to be called whoever shows for the
second makes quorum.
