Subject: Strict Implementation of the Prol'isions of Sec. 112-

of Commonwealth Act 141 (C.A. 141) or the Public
Land Act., as amended by Presidential Decree No. 635.

In the int.erest of the service and to ensure the expeditious acquisition

of right-of-way for the roads and tlood control projects of the Depattment,
dll irnp1etnenting offices, such as the Regiondl, District atld Proiect
JVlanagetnent Offices, shdll strictly impletnent the provisions of the Public
Land Act, as amended by P.D. No. 635. If the title t.o the property was
acquired before January 7, 1975, under the Public Land Act, the govenunent
shdll be entitled to a 20-tneter rig.ht-of-way under Sec. 112 of C.A. 141 or a
60-nleter right-of-way if the title \vas acquired on or after said ck1.teunder
P.D. 635, "\\-ith corresponding cOlnpensation only for the affect.ed
irnprovement.s thereon.

Under and by virtue of this Order, dl1irnp1etnenting offices are hereby

directed to subnlit to the P1aru1i:n.gService the monthly report inventory of
properties acquired under CA 141 as amended by P.D. no. 635 for proper
consolidation prior to its subtnission to the office of the lmdersigned. Copies
of said report should also be furnished to the Project }\·1anagetnent.Office for
Infrastructure Right-of- \Vay and Resettlenlent. (PJVI0-IROVi).
