END USER LICENSE AGREEMENT

Please review these terms carefully. By downloading all or any portion of the Sound
Recordings and/or Software included in our products, you accept all the terms and
conditions of this agreement. All Glitchmachines, LLC products are licensed to you for
use only under the terms of this agreement. This license agreement is your proof of
license to exercise the rights granted herein and must be retained by you.
Glitchmachines, LLC retains all title to and ownership of Sound Recordings and/or
Software and reserves all rights not expressly granted to you. We reserve the right to
change or modify these terms without notice.

DEFINITIONS:

Sound Recordings: referring to any audio files included within “Sample Pack” products
as well as any audio files included within “Plugin” products.

Software: referring to any Software Plugin or Standalone Software products.

Licensor: referring to Glitchmachines, LLC whom set the terms of this license.

Licensee: referring to the end user whom agrees to the terms of this license.

SINGLE-USER MEDIA PRODUCER LICENSE:

An individual purchase of one product will grant you the personal license to use one or
more versions of this product to its full extent, including the royalty-free use of all assets
in your productions, recordings and/or performances. You are legally prohibited to
distribute, lend, rent or sell your copy of any products in whole or in part.

• Mechanical Rights: Glitchmachines, LLC grants the Licensee the non-exclusive

right to use the purchased Sound Recordings and/or Software as part of their
media productions in whichever medium they choose.

• Synchronization Rights: Glitchmachines, LLC grants the Licensee the non-

exclusive right to use the purchased Sound Recordings as a soundtrack
synchronized with visual images, games, or theatrical works.

• Public Broadcast Rights: Glitchmachines, LLC grants the Licensee the non-
exclusive right to use the purchased Sound Recordings as part of a public
performance or viewing of their productions.
LIMITATIONS:

The Sound Recordings contained within our products may not be resold as part of
another sample library, software product or collection of audio tracks using these
recordings in part or in whole. The Sound Recordings may not be copied or sold for
profit, except when used in the licensee's productions as part of a greater body of work.
No Remote Sites may have access to Glitchmachines, LLC Software or Sound
Recordings unless a multi-user license is purchased and expressly authorized in writing.

The Licensee May Not:

• Claim ownership or authorship of the Sound Recordings and/or Software.

• Install the Software on computers other than their own.

• Sell or distribute the Sound Recordings or Software in any form. (The Sound
Recordings may be sold as part of a production/product so long as said product
is not another Sample Library or Software Instrument Product.)

• Store or share the Sound Recordings on a server without a multi-user license,

unless necessary to complete a project started by the original single user
licensee where said files are already in use in a greater body of work.

• Share or store the Sound Recordings or Software on a public server or torrent

site, without the express permission from the Licensor (Glitchmachines, LLC).

The Licensee May:

• Store the Sound Recordings and/or Software on up to 2 personal computers.

• Use the Sound Recordings in any type of applicable media production that isn't
a sample library, software product or collection of audio recordings that are re-
sold/licensed or attached to another product.

• Use the Software within any applicable production so long as any associated
Sound Recordings are not used in the creation of another sample library or
software product.

• Use specific Sound Recordings as part of a larger project and share the sounds
on other systems in order to complete that specific work, so long as you are not
re-distributing, selling the sounds or sharing the general collection (in part or in
whole) on a server.
TERMINATION:

The license granted to you is effective immediately upon download of any products, until
terminated. The license will terminate automatically without any notice from
Glitchmachines, LLC if you fail to comply with any term or condition of this agreement.
Upon termination, Glitchmachines, LLC may also enforce any and all rights provided by
law. You may also terminate the license at any time by destroying Glitchmachines, LLC
software and documentation (including any portions or copies thereof) currently in your
possession or control. The provisions of this agreement that protect the proprietary
rights of Glitchmachines, LLC will continue in force after termination.

LIABILITY:

Any liability of the provider will be limited exclusively to product replacement or refund of
purchase price. In no event shall Glitchmachines, LLC be liable for any damages
(including without limitation, incidental, direct, indirect, special or consequential
damages, damages for loss of business profits, business interruption, loss of business
information, or other pecuniary loss) arising out of the use or inability to use any
product, even if Glitchmachines, LLC have been advised of the possibility of such
damages.

INDEMNIFICATION:

If you use or distribute any product from Glitchmachines, LLC in violation of this
agreement, you hereby indemnify, hold harmless and defend Glitchmachines, LLC from
and against any and all claims or lawsuits, including attorney's fees and costs that arise,
result from, or are connected with the use of or distribution of any product in violation of
this agreement.

COPYRIGHT:

All software and documentation is owned by Glitchmachines, LLC and all rights are
reserved. All instances of names of companies, brands, and individuals appearing in
products, advertisements or web assets are trademarks or registered trademarks of
their respective holders and appear strictly for reference.
