JUDICIAL AFFIDAVIT

I, GLENDA GRANDE GUSPID, 32 years of age, Filipino, married,

overseas contract worker and a resident of Taribubu, Tuao, Cagayan.

PRELIMINARY STATEMENT

The person interrogating me is Atty. Mac Paul B. Soriano with

office address at the Second Floor, Soriano Building, Luna Street,
Tuguegarao City.

The interrogation is being held at the same address.

I am answering his questions fully conscious that I do so under

oath and may face criminal liability for false testimony and perjury.

Interrogation begins:

Q1: Do you know Rodel Guspid?

A1: Yes sir because he is my lawful husband and this is our Certificate of
Marriage. (affiant handing over to Atty. Soriano the copy of her Certificate
of Marriage)

Q2: I am marking this Certificate of Marriage as exhibit “A” and I will

attach it to your judicial affidavit to form part of it. Do you conform to my
action?
A2: Yes sir.

Q3: Out of your conjugal union did you bear a child?

A3: Yes sir we have a daughter named Glendhel Guspid who is now 13
years old and this is her certificate of live birth. (affiant handing over to
Atty. Soriano the copy of her daughter’s Certificate of Live Birth)

Q4: I am marking this Certificate of Live Birth as exhibit “B” and I will
attach it to your judicial affidavit to form part of it do you conform to my
action?
A4: Yes sir.

Q5: How was your marital relationship with your husband?

A5: We live a happy life and we enjoyed each others company. Every time
we encounter marital problems we make it a point to talk it over to solve
it.

Q6: After your marriage where did you stay with your husband?
A6: We stayed in the house of my parents in law in Taribubu, Tuao,
Cagayan for a few months and afterwhich we transferred to our house
which we constructed.

Q7: Where is your husband?

A7: He has been missing since 2008 sir.

Q8: Will you explain to us how your husband was missing?

A8: In the early part of 2008 sir my husband kept on complaining about
threats in his life from persons whom he might have offended and have
been aggrieved of his extra marital affairs.

Q9: Did he ever mention to you the persons who made threats in his life?
A9: Yes sir he told me about the husbands of women with whom he had
an illicit affair.

Q10: Because of such threat in his life what did your husband do?
A10: He cannot stay long in our house sir he went from one place to
another to elude his aggressors but one night in December of 2008 while
he was in our house a group of unidentified armed men barged inside
our house and forcibly took away my husband but before they left they
warned me not to report the incident to the police or else they would
come back for me and our child.

Q11: Did you find out why they took your husband?
A11: Yes sir I heard them saying that my husband is wanted for a wrong
he had done however they did not tell me what that wrong was which he
committed.

Q12: After they left what did you do?

A12: I was so afraid to be their next victim sir and so I kept unto myself
what happened to my husband in order not to complicate the matter.
But after a few days, I could not help but to inform my mother in law
about it.

Q13: After the incident what did you do if any?

A13: I went to look for my husband in his place of work as well as in
other places where he used to go but I was not able to find him there. I
also inquired from his friends and relatives and from those persons who
know about him but they told me that they have not seen him.

Q14: From the time your husband left in 2008 did he ever communicate
with you?

A14: No sir I never heard any word from him sir and likewise I have not
received any information of his whereabouts from anyone. In fact his own
mother never received an information or news about him since 2008.

Q15: During the period that your husband was missing what happened
to your life?
A15: By accident I met a Swiss national who later on courted me and
after a brief courtship we became sweet hearts and now he is pressing to
marry me.

Q16: What was your response to his proposal to marry you?

A16: I could not resist his offer as this is a rare opportunity which comes
only once in my life and so I have to grab it but since I am still married I
was forced to file a petition in court to declare him presumed dead.

Q17: By the way how long have your husband been missing?
A17: Since 2008 up to the present or for a period of 6 years now sir.

Q18: Why do you say that your husband is presumed to have died?
A18: Because there were several armed men who forcibly took him for a
wrong he had committed and so I assumed that they might have killed
him already.

Q19: In the order of the court dated October 10, 2014, it is required that
a copy of the Petition be mailed to the respondent in his last known
address. Was this order of the court complied?
A19: Yes sir, the Registry Receipt and Registry Return Receipt are
attached to the record of the case. (affiant handing over to Atty. Soriano
the copies of the Registry Receipt and Registry Return Receipt)

Q20: I am marking this Registry Receipt and Registry Return Receipt as

exhibit “C” and “D” respectively and I will attach them to your judicial
affidavit to form part of it do you conform to my action?
A20: Yes sir.

Q21: In the same order of the court you are required to publish this
order of the court once a week for 3 consecutive weeks in the newspaper
of general circulation in the Province of Cagayan, did you comply with
this order of the court?
A21: Yes sir and these are the affidavit of publication and the three (3)
issues of the northern forum. (affiant handing over to Atty. Soriano the
affidavit of publication and the three (3) issues of the northern forum the
first issue is dated October 12, 2014, the other is dated October 19, 2014
and the last is October 26, 2014.

Q22: I am marking this affidavit of publication as exhibit “E” and the

newspaper clipping of the order as exhibit “E-1.” The October 12, 2014
issue of the northern forum as exhibit “F” and page where the order of
the court was published as exhibit “F-1”. The October 19, 2014 issue of
the northern as exhibit “G” and the page where the order of the court
was published as exhibit “G-1”. And the October 26, 2014 issue of the
northern forum as exhibit “H” and the page where the order of the court
was published as exhibit “H-1” and I will attach them to your judicial
affidavit to form part of it do you conform to my action?
A22: Yes sir.
