Re: Appeal of Manifestly Unjust Diversion Judgment in King v. Rattan,

Complaint No.

The private settlement of this dispute involving an act of physical aggression by

Respondent Rattan besmirches the legal and journalist community and will be
addressed in my TV show on ROKU and beyond; “Corruption Meets Camera.”

Further, the applicable section reads:

Unless good cause is shown, an attorney may not participate in an alternative to

discipline program if any of the following circumstances is present:

(a) The discipline likely to be imposed in the matter is more severe

than a private reprimand.

....As such, the Director is telling me and the entire Free World that this heinous
misconduct does not rise past the level of a private reprimand for misconduct that
was occasioned in a very public setting involving, at a minimum, the First
Amendment to the United States Constitution and the attendant Wisconsin
Constitutional Principles I believe at Article I §3 Free Press, Libel.

The inherently Unconstitutional nature of these proceedings compels further review

and in some fashion that is definitely going to occur: SCR Chapter 22 (22.06) does
not appear to grant a grievant any right to review the determination by the Director
to a diversion program which has been approved by the preliminary review
committee. As I stated above you have got to be kidding me that the discipline likely
to be imposed for attacking a journalist in a public hearing is no more serious than a
private reprimand.

Or is that the rule when it’s a black journalist that the Hearing Officer doesn’t want
around? Either way it is Unconstitutional be it under Due Process, the Equal
Protection Clause, or both.

This is an even greater foul considering the express finding that Respondent Rattan
approached me in a “threatening manner… and showed no remorse.”

I don’t know who you are kidding but you are not fooling me one bit. You are racist
pigs and you will be exposed.1

Respondent Rattan’s conduct stands in blatant violation of SCR 3.5(d) and 8.4(b),
8.4(a), (b), (f) and also SCR 20:38.4(g) which makes SCR 40.15 enforceable in
disciplinary proceedings. See rules cited below:

SCR 20:3.5 Impartiality and decorum of the tribunal

A lawyer shall not:

(d) engage in conduct intended to disrupt a tribunal.

SCR 20:8.4 Misconduct

It is professional misconduct for a lawyer to:
(a) violate or attempt to violate the Rules of Professional Conduct, knowingly assist
or induce another to do so, or do so through the acts of another;
(b) commit a criminal act that reflects adversely on the lawyer's honesty,
trustworthiness or fitness as a lawyer in other respects;
...
(f) violate a statute, supreme court rule, supreme court order or supreme court
decision regulating the conduct of lawyers;
(g) violate the attorney's oath;

SCR 40.15 provides:

The oath or affirmation to be taken to qualify for admission to the practice of
law shall be in substantially the following form:
I will support the constitution of the United States and the constitution of the
state of Wisconsin; (interference with the exercise of First Amendment rights
and rights under Article One, Section 3 of the Wisconsin Constitution)
I will maintain the respect due to courts of justice and judicial
officers; (disrespect of the hearing process)
I will not counsel or maintain any suit or proceeding which shall appear to me
to be unjust, or any defense, except such as I believe to be honestly debatable under

reprimand Respondent Rattan after he attacked my camera and me. “You don’t get to ask
questions,” he bellowed. He only ejected me immediately after I told him I was going to
exercise my Constitutional Right to seek redress from his Actions with the Wisconsin

the law of the land;

I will employ, for the purpose of maintaining the causes confided to me, such
means only as are consistent with truth and honor, and will never seek to mislead
the judge or jury by any artifice or false statement of fact or law;
I will maintain the confidence and preserve inviolate the secrets of my client
and will accept no compensation in connection with my client's business except
from my client or with my client's knowledge and approval;
I will abstain from all offensive personality and advance no fact prejudicial to
the honor or reputation of a party or witness, unless required by the justice of the
cause with which I am charged; (assaulting a journalist in a hearing is offensive)
I will never reject, from any consideration personal to myself, the cause of the
defenseless or oppressed, or delay any person's cause for lucre or malice. So help
me God.

This is completely unacceptable and I hereby formally tender this Objection and
Request for Modification. This is just another brick in the foundation of racism in a
State already fraught through with racism by and through Governor Scott Walker’s
metaphysical buddy, the Pardoned Joe Arpaio.

We struggle to find words that adequately convey our revulsion at Donald Trump’s
policy of separating children from parents who brought them to the U.S. seeking
asylum from violence in Central America.

But Trump is not alone in this. Most of Wisconsin’s GOP leaders have helped to
enable his “zero tolerance” policy. They do that in one of three ways:
 By defending the policy, as have U.S. senatorial candidates Leah
Vukmir and Kevin Nicholson — along with U.S. Sen. Ron Johnson;
 By waltzing around it, which Paul Ryan — who says it makes him
“uncomfortable” — and Glenn Grothman did;
 Or by supporting “zero tolerance” outright, as Scott Walker has by sending
Wisconsin National Guard troops to the border to help enforce the policy.

Ongoing efforts to disenfranchise blacks

The challenge to Gronik’s nominating papers is fits right in with ongoing Republican
efforts to disenfranchise African Americans. That’s a cornerstone of the party’s
electoral strategy — and it paid off for them in 2016, when the black-voter turnout
in Wisconsin dropped 19 percent from 2012. While the lack of an African American
at the top of the ticket in 2016 may explain part of the fall-off, much of it resulted
from Walker’s photo ID restrictions and the end to early voting. It’s possible that the
latter factors were large enough to have changed the state's election outcome.
Trump won by around 22,000 votes.

I honestly cannot believe that you would think this result would be anything
approaching fair or reasonable, particularly given the fact that the OLR review
indicated that Respondent Rattan “showed no remorse” for his actions and instead
he and his attorney –himself a member of an OLR Committee who for some reason
never even signed the filings – tried to claim that I altered the video.

The OLR expressly found otherwise.

This is legally and morally aberrant behavior and the Decision by the Director
simply cannot stand. It is a manifest injustice to the legal and journalism
professions, point blank.
