AFFIDAVIT

I, LUZVIMINDA B. PAZ, of legal age, Filipino, married, and a resident of

Centro West, Santiago City, after having been duly sworn to in accordance with
law, hereby depose and say:

1. That on March 31, 1997, I sold to Oscar Mina that parcel of land (Lot 2-
B of the subdivision plan Psd-023124-041112) situated in Villa Carmen, Ramon,
Isabela (formerly Cabulay, Santiago, Isabela);

2. That at the time I sold said parcel of land, I was the owner and my title
then is evidence by TCT No. T-204289 of the registry of Deeds for the Province
of Isabela;

3. That the land is now registered in the name of Oscar Mina per TCT No.
T-269624 of the Registry of Deeds of Isabela in Santiago City;

I, BART S. SIBAL, of legal age, Filipino, married to Sharon Estabillo Sibal,
and a resident of Sta. Ines Subdivision, Sagana, Santiago CIty, after having been
duly sworn to in accordance with law, hereby depose and say:

1. That I and my family are occupying the house of my parents BENJAMIN

SIBAL and ROSITA SAIN, situated in their Lot in Batal, Santiago City;

2. That our stay in the said housing unit of Benjamin Sibal and Rosita Sain
is upon their tolerance;

3. That we undertake to vacate the said housing unit in favor of the

spouses Benjamin Sibal and Rosita Sain upon written or verbal notice to vacate
by them to me;

4. That should I fail or refuse to abide by this undertaking, I hereby, further,

obligate myself to pay liquidated damage of P50,000.00 plus attorney’s fees of
P30,000.00;
