Wages
1. Define wage.
Wage is a payment usually of money for labor or services usually according to contract which is
written or not and on an hourly, daily, weekly, piecework or commission basis made by an employer
to an employee. A fixed weekly or monthly wage is usually called a salary.
In short, the benefit or privilege given to the employee which constitutes an extra remuneration
above and over his basic or ordinary earning or wage is supplement; and when said benefit or
privilege is part of the laborers’ basic wages, it is a facility. The distinction lies not so much in the kind
of benefit or item (food, lodging, bonus or sick leave) given, but in the purpose for which it is given.
Thus, free meals supplied by the ship operator to crew members, out of necessity, cannot be
considered as facilities but supplements which could not be reduced having been given not as part of
wages but as a necessary matter in the maintenance of the health and efficiency of the crew
personnel during the voyage.
The payment of wages of employees engaged to perform a task which cannot be completed in
two (2) weeks shall be subject to the following conditions, in the absence of a collective bargaining
agreement or arbitration award:
That payments are made at intervals not exceeding sixteen (16) days, in proportion to the amount of
work completed; That final settlement is made upon completion of the work.
9. What is a service incentive leave? How may the employee avail of the service incentive leave? Give
the exceptions.
A service incentive leave pay is an employee benefit that enables them to take or avail of leave
with pay for five days provided the worker has rendered service for at least one year. Every
employee who has rendered at least one year of service shall be entitled to a yearly service incentive
leave of five days with pay. The term “at least one-year service” means service for not less than 12
months, whether continuous or broken. The 12-month period shall be reckoned from the date the
employee started working, including authorized absences and paid regular holidays. However, where
the operation of the establishment as a matter of practice or policy, or that provided in the
employment contract, is less than 12 months, such period shall be considered as one year. This
provision shall not apply to those who are already enjoying the benefit herein provided, those
enjoying vacation leave with pay of at least five days and those employed in establishments regularly
employing less than ten employees or in establishments exempted from granting this benefit by the
Secretary of Labor and Employment after considering the viability or financial condition of such
establishment. The grant of benefit in excess of that provided herein shall not be made a subject of
arbitration or any court or administrative action. The service incentive leave may be used for sick and
vacation leave purposes. And, at the end of the year, the unused service incentive leave may be
commuted to cash.
