DEED OF HEIRSHIP, PARTITION AND ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:


This DEED is entered into and executed by EMILIA GRAPA GREFALDIA and EVA
GRAPA IBNOHAJAN, the latter is duly represented by ROSALINDA GRAPA BUSCATO, by
virtue of a Special Power of Attorney known as Doc. No.. 334; Page 67; Book No. 64; Series of
2017, notarized by Adolfo A. Angala, Notary Public; both of legal age, Filipinos, married, and
residents of barangay Cangmating, Sibulan, Negros Oriental, hereinafter called the HEIR-
VENDORS, in favor of,

ROSENIE MARIBAO GREFALDIA, also of legal age, Filipino, married, and a resident
of barangay Poblacion, Sibulan, Negros Oriental, hereinafter referred to as the VENDEE;

WITNESSETH:

That JOSE GRAPA, ANDRES GRAPA and EUSTAQUIA GRAPA were the co- owners
of a certain parcel of land known as Lot No. 194, situated in barangay Cangmating, Sibulan,
Negros Oriental consisting of EIGHT THOUSAND ONE (8,001) square meters, more or less,
covered by Tax Declaration No. 2017-16-0007-00459;

That aforementioned co-owners died long time ago and the said parcel of land was
inherited by their respective HEIRS and the latter have agreed to subdivide the aforementioned
parcel of land into several sublots, partitioned, settled and adjudicated among themselves said
sub-lots in the following manner:

1. Lot No. 194-A, consisting of THREE HUNDRED SEVEN (307) Square Meters; Lot No.
194-B, consisting of SIX HUNDRED (600) Square Meters; Lot No. 194-C consisting of
EIGHTY FIVE ( 85) Square Meters; Lot No. 194-D, consisting of SEVEN HUNDRED
NINETY (790) Square Meters; and Lot No. 194-E, consisting of EIGH HUNDRED NINETY
ONE (891) Square Meters, all shall belong to ANDRES GRAPA;

2. Lot No. 194-F, consisting of TWO THOUSAND SIX HUNDRED SEVENTY THREE
(2,673) Square Meters, shall belong to JOSE GRAPA; and,

3. Lot No. 194-G, consisting of TWO THOUSAND SIX HUNDRED SEVENTY


THREE (2,673) Square Meters, shall belong to EUSTAQUIA GRAPA;

That ANDRES GRAPA, one of the co-owners of Lot No. 194, died longtime ago and
upon his death he was survived by his three children, namely ABRAHAM, ERNESTO, and
LOURDES, all surnamed GRAPA;

That the shares of ANDRESS GRAPA were also partitioned among his children in the
following manner, to wit:
1) Lot No. 194-A, consisting of 307 Square Meters and Lot No. 194-B consisting of 600
shall belong to LOURDES GRAPA;

2) Lot No. 194-C consisting of 85 Square Meters and Lot No. 194-D consisting of 790
Square Meters, shall belong to ERNESTO GRAPA; and

3) Lot No. 194-E, consisting of 891 Square Meters, shall belong to ABRAHAM GRAPA.

That ERNESTO GRAPA also died sometime ago and upon his death he was survived by
his two legitimate and only compulsory heirs, namely: EVA GRAPA IBNOHAJAN and
EMELIA GRAPA GREFALDIA, the herein VENDORS.

WITNESSETH FURTHER:

That for and in consideration of the sum of EIGHTY TWO THOUSAND PESOS (Php
82,000.00), Philippine Currency, in hand paid by the herein Vendee, ROSENIE MARIBAO
GREFALDIA and receipt in full is hereby acknowledged by the Vendors, to their entire
satisfactions and that by virtue of these presents, the herein Vendors do hereby SELL,
TRANSFER, and CONVEY, by way of absolute sale, unto the vendee, her heirs and assigns, the
vendor’s rights, interests and participations over the aforementioned Lot No. 194-C, including
all the improvements found therein, consisting of EIGHTY FIVE (85) square meters only, free
from all liens and encumbrances;

That the vendor herein declares that due notice has been given to all persons affected by this
transaction in compliance with the provisions of the New Civil Code of the Philippines,
pertaining to the rights of the redemptioner and preemptioner, but nobody opted to exercise the
said rights and the sale of these parcels land is in consonance with the provisions of the
Comprehensive Agrarian Reform Law because this parcel of land is within the retention limits of
the vendor, further, the vendor warrants her ownership over the said parcel of land and will
defend the rights of the herein vendee against any adverse claim whatsoever.

personally appeared the herein vendors, EMELIA G. GREFALDIA and ROSALINDA G.
BUSCATO, who exhibited their Community Tax Certificates Nos.22213543, issued on January
05, 2017, at Sibulan, Negros Oriental, and 22212892, issued on January 3, 2017 at Sibulan,
Negros Oriental, respectively; and the vendee, ROSENIE M. GREFALDIA, who exhibited to me
her Community Tax Certificate No. 15584673, issued on February 27, 2017, at Sibulan, Negros
Oriental, all known to me to be the same persons who executed the foregoing deed, consisting of
two (2) pages, including this page of acknowledgement and all pages were duly signed by the
Vendor, together with her two instrumental witnesses and that they acknowledged to me that the
same is their free act and voluntary deed.
