Regulations, Terms & Conditions for

NESC-2018 (Road to Asian Games)

1. OFFICIAL NAME
The name of the National Qualifiers for India (Event / Tournament), which is subject to
these Regulations is the National eSports Championship (hereinafter called “NESC”);
winners and or winning teams will qualify to be part of Team India* (esports) for 18th
Asian Games - 2018 organized by Olympic Council of Asia (OCA), where esports have
been included as a Demonstration Sport. Esports Championship will be held by Asian
Esports Federation (AESF) during the Asian Games.
*Subject to approval from Indian Olympic Association (IOA)

2. RIGHTS RELATED TO NESC AND THE ASIAN GAMES


The Electronic Sports Federation of India (hereinafter called "ESFI") owns National
Esports Championship (NESC), has the exclusive rights to the name NESC and all
intellectual property rights (hereinafter called "IPR") thereof. ESFI governs all matters
regarding to organizing and operating NESC.
Olympic Council of Asia (OCA) owns all the rights etc related to Asian Games.
All other IPs, Game Names, Sponsors name, logos etc. are of the respective owners.

3. COMPETITION REGULATIONS FOR ASIAN GAMES


Competition Regulations means the "Sport Technical Handbook" for the Asian Games as
and when released by OCA.

4. GAME TITLES

The Official Titles of “the Asian Games” are as follows :


a. Team Title
- Arena of Valor (Team Event / 5 regular athletes, at most 1 regular
substitute and no more than 1 coach)
- League of Legends (Team Event / 5 regular athletes, 1 substitute
and 1 coach)

- Pro Evolution Soccer (Team Event / 2 regular athletes)
b. Individual Title
- Hearthstone (Individuals Event / 1 Athlete)
- StarCraft II (Individuals Event / 1 Athlete)
- Clash Royale (Individuals Event / 1 Athlete)

5. AGE ELIGIBILITY
a. Hearthstone: No player shall be considered eligible to participate before his or her
16th birthday, defined as having lived 16 full years.
b. StarCraft II: No player shall be considered eligible to participate before his or her
16th birthday, defined as having lived 16 full years.
c. Clash Royale: No player shall be considered eligible to participate before his or her
16th birthday, defined as having lived 16 full years.
d. Arena of Valor: As per the game developer
e. League of Legends: No player shall be considered eligible to participate before his
or her 17th birthday, defined as having lived 17 full years.
f. Pro Evolution Soccer: As per the game developer

g. Players who have not attained the age of 18 years on the day of registration shall have to
submit the Minor and Parental/Legal Guardian Consent Form

5. SCHEDULE, PERIOD AND VENUE*


a. Schedule as below:
Date of Registration (Hearthstone) :29th May 2018

b. Tournament Starts (Hearthstone) :29th May 2018 onwards (Depending on


the number of registrations)
c. Qualifying player will compete at the South Asian Regional Qualifiers which will
happen online or offline from June 10th – June 20th 2018. Details will be shared during
the course of time. Winners of the South Asian Regional Qualifiers will participate in
the physical championship which will be held in Jakarta Palembang (Indonesia) from 18
Aug 2018 – 2 Sep 2018.
d. Hearthstone India Qualifiers will be held Online.
*Format, Games, NESC, Schedule and Venue City are subject to change or cancellation
altogether at any time as a result of any incident / event beyond the control of ESFI. For
the avoidance of doubt, ESFI and its office bearers/directors shall in no manner be
responsible for any liability / costs / penalties / damages in the event of any change or

cancellation of the format / games / schedule / venue city as the case may be (either of
the NESC or the Asian Games).

6. WINNING TEAM / PLAYER

a. Winner(s) of the NESC will qualify to participate in the Asian Games - 2018 as
Team India. If for any reason the Winner(s) is / are not able to go then the next
ranked team / player will be given the chance and so on. Winner(s) need to confirm
the same within the stipulated time frame as and when given by ESFI and follow
the process as and when suggested by ESFI.
b. In a situation wherein none of the team or player is able to go then ESFI in the best
national interest has all the right to send any other team and or player at its own
discretion. ESFI shall have all the rights and sole discretion regarding this clause.
c. Winner(s) will play as "Team India"; to make it more specific they will not play as
their "Team Name" but only as "Team India".

7. EXPENSES

a. All the expenses regarding and related to participation in NESC will be borne by
the players themselves. Expenses of Airtickets and stay for the Asian Games will
be borne by the Asian Esports Federation (AESF). ESFI shall not provide or bear
any travel or other related expenses for any team / player either for NESC or for
the Asian Games.
b. The accommodation at the Asian Games will be provided by AESF for the
winner(s) only and ESFI shall in no way be responsible for the status / condition /
security / safety in such accommodation.
c. Winning Team and or Player going for the Asian Games will have to get the
overseas Travel and Medical Insurance.

8. ACCEPTANCE TO THESE REGULATIONS

a. By registering for the NESC, you acknowledge that you have read, understood,
and agree to abide by these Regulations, Terms and conditions including and not
limiting to any future updates and amendments.
b. By registering in the NESC you also agree to the Competition Regulations issued
by AESF/IOA/OCA from time to time for the Asian Games and confirm to abide
by them.

a. Eligibility: Open for all Indian Citizens having valid Indian Passport; regardless of
gender, race or disability.
b. If the participant to NESC or Winning Player or any member of the Winning team of the
NESC is below 18 years, he or she has to be accompanied by his / her Parent or Guardian
to travel to the Asian Games or related events as the case may be at their own expense.
None of the expenses for the accompanying parent / guardian will be borne by ESFI.
c. Passport should be valid for 12 months from the day of registration date. Please refer the
guidelines issued by the Indonesian / or related country's Government for Visa. The
Winning Team / Players of the NESC shall be responsible for applying for the Visa in a
timely manner and the ESFI or its office bearers/directors shall not be responsible in any
manner for the failure of the Winning Team / Players to arrange for their or the respective
parent / legal guardian's visa.
d. Registrations are open until midnight of 28th May 2018 and will be on a first come first
serve basis.
e. All players / teams are requested to submit their registrations within the time frame,
beyond which ESFI has the right to accept or reject the registration at its sole discretion
without requirement of providing reasons for such acceptance / rejection.
f. Every player is required to fill his / her registration form himself / herself, and with
complete and accurate information.
g. Changes to the team roster can be made only before registration closes.
h. Players are not permitted to register with multiple teams or multiple accounts. An
appropriate action at the sole discretion of ESFI will be taken against that player.
i. If the information provided by the participant is found to be false / incomplete / incorrect
at any time, ESFI has the right in its sole discretion to terminate the registration and
disqualify the participant from NESC and / or the Winning Team / Player from the Asian
Games. In no event shall ESFI be responsible to pay the costs incurred by such
disqualified participant(s).

10. PLAYER CONDUCT

a. Players must conduct themselves in true sportsman spirit and professional manner,
maintaining a friendly and polite demeanor with everybody including and not limiting to
administrators, spectators, competitors, ESFI staff and other participants of the event.

b. Any form of vulgarity, abuse or dissent against anyone will not be tolerated (in-game,
lobby or any pre or post event) and players / teams indulging in such behavior will be
penalized in accordance with Penalty Clause below which may lead to their

disqualification from NESC and or the Asian Games temporarily or permanently as
decided by the ESFI in its sole discretion after providing the player / team a reasonable
opportunity of being heard.

c. Players are expected to compete in a professional manner. Throwing a match, halting


play without cause, or showing a flagrant lack of effort will be construed as a violation of
player conduct, and will result in match penalties, forfeiture and disqualification from the
Tournament.

d. ESFI has a zero tolerance policy for cheating and or hacking. Any player or team using
ineligible players, cheating and trying to gain an unfair advantage through any means will
be penalized as deemed appropriate by administrators and or ESFI.

11. PLAYER HARASSMENT

Any form of abuse, bullying, hooting, harassment including and not limiting to Sexual,
Verbal, discrimination on the basis of sex, caste, race or religion will be taken with
utmost seriousness and ESFI may disqualify / impose penalties in accordance with
Penalty Clause below and or take appropriate actions including and not limiting to legal
actions as per the law.

12. PROHIBITED SUBSTANCES AND PROHIBITED METHODS

a. ESFI strictly prohibits the use of alcohol, illegal drugs and prohibited substances as per
law.
b. Participant(s), represent and warrant that he / she will not take any illegal drugs,
abuse any prescription or over the counter drugs, nor take any performance enhancing
drugs prohibited by the World Anti-Doping Agency (WADA) as described on the
WADA website, currently located at https://www.wada -
ama.org/en/prohibited -list, which may be updated from time to time, and any
other substances that may be prohibited by ESFI, in connection with the Events.
c. It is the responsibility of the player to determine whether a substance they are using, or
considering for medical purposes, is prohibited. Before and during the NESC and the
Asian Games, players are strongly advised to check the status of the medication they are
taking or intend to take through the following websites:

d. If found guilty appropriate action and penalties will be imposed by ESFI.

13. BETTING

ESFI does not support and encourage betting and match fixing. Any player found
involved in any such activities shall be subject to an appropriate action including and not
limiting to legal actions.

14. PENALTIES

i. If any of the rules, regulations, terms and / or conditions are violated, ESFI may apply
penalties according to their judgment and discretion, at any stage of the tournament, for
any reason, without prior warning to the players, and their decision will be final after an
appeal.
ii. Penalties that can be applied are the following:
a. Warning.
b. Default loss.
c. Disqualification of a player / team from the entire tournament. Disqualification will
void all rights to participate further in the tournament.
d. Blacklisted from future tournaments either temporarily or permanently at the sole
discretion of ESFI.

15. UNIFORM REGULATION

a. All winner(s) participating in the Asian Games will wear the uniform representing India,
and such uniform's guidelines will be shared in due course of time. ESFI will and has sole
exclusive commercial rights and any other relates rights for the same.
b. Players or teams without uniform will forfeit their matches at the Asian Games.

c. Players representing India shall wear the above uniform after obtaining prior approval of
ESFI. Once the Asian Games is over or Team India is eliminated (whichever is earlier),
the player(s) / team shall not wear the uniform in any other event whatsoever whether or
not authorized by ESFI without obtaining the prior written approval of ESFI.

16. GENERAL TERMS & CONDITIONS

i. It is the responsibility of all participants to know and understand these Regulations,


Terms and Conditions including and not limiting to any future updates and amendments.
By registering for the NESC, you acknowledge that you have read, understood, and agree
to abide by these Regulations, Terms and conditions mentioned herein including and not
limiting to any future updates and amendments related to NESC and updated from time to
time via ESFI Facebook page https://www.facebook.com/esportsfederationofIndia/ or

respective Facebook game event page, at the sole discretion of ESFI without requiring
prior approval of the participants.

ii. It is the responsibility of all participants to know and understand the Regulations, Terms
and Conditions for the Asian Games. By registering for the NESC, you also acknowledge
that you have fully read, understood, and agree to abide by those Regulations, Terms and
conditions and any other terms and conditions related to the Asian Games as informed to
the Participants from time to time via ESFI or Facebook page
https://www.facebook.com/esportsfederationofIndia/ or respective Facebook game event
page

iii. It is the participants responsibility to follow and check the ESFI Facebook page and
Facebook game event page regularly.

iv. All the participant(s) are required to follow the ESFI's Facebook page and the respective
Facebook game event page for updates including and not limiting to any information,
regulations, brackets, schedule etc; ESFI or its office bearers/directors are under no
obligation to inform and or communicate with participant and or prospective participant
individually. There shall be no liability what so ever on ESFI or its office
bearers/directors in the event the participant and or prospective participant misses any
communication or information. The participants acknowledge that ESFI and its office
bearers/directors will try and disseminate information via the above media at the earliest
possible opportunity and shall not be held responsible for any delay that may have
occurred in dissemination any information / changes / updates.

v. Participant(s) who manipulate these rules maliciously and / or at the expense of other
members will be penalized for unsportsmanlike conduct.

vi. It is the Participant's responsibility to ensure that true and correct information is provided
including and not limiting to name, email address, phone number, address, passport
details and any other details/documents required by ESFI and is provided within the
timeframes given by ESFI. ESFI will not be responsible whatsoever in case of any issues
which arise because of incorrect or incomplete information shared by the participants.
Participant(s) may be disqualified from the NESC and or the Asian Games and or the
prize winnings (if any) may get forfeited at any stage if the details are found to be
incorrect or false. In such a case participant(s) agree to remit the losses which ESFI may
incur, within 15 days of details / claims shared by ESFI. In case of failure to do so, ESFI
will be at liberty in its sole discretion to take whatever legal recourse as deemed fit.

vii. Participant(s) will participate in the event in true sportsperson spirit, exhibit professional
behavior and in accordance with the instructions / rules / conditions laid and informed by
ESFI and or AESF and or OCA and or the organizing committee from time to time. Upon
failure to do so, ESFI is free to take any action as deemed fit including and not limiting to
participant(s) disqualification, removal from the NESC and or the Asian Games, bans,
forfeiting of participant(s) winnings(if any) / prize / any or all benefits.

viii. Participant(s) and Winner(s) will make themselves available for any photoshoots, video
recordings, promotions etc for sponsors and or ESFI, as and when asked by ESFI. The
Participant(s) and Winner(s) hereby waive all rights and grant to ESFI or its Affiliates a
royalty-free, exclusive, irrevocable perpetual worldwide license to copy, modify and
otherwise use and distribute such content and, or, any such element, in any and all media
and in any publication whether online, offline or on the Internet. ESFI shall also be free
to use any such elements and or content or materials for any purpose including and not
limiting to commercial exploitation. ESFI will be the sole owner of such content and or
elements.

ix. ESFI reserves the right to reject any entry form in case of any technical or other
improprieties. Any decision taken in this regard shall be final and binding and shall not
be subject to any dispute or challenge anywhere.

x. The Participant undertakes and declares that for participating in the Tournament, he / she
shall not use any unauthorized or pirated software. If a Participant is found to be doing
so, the entry from such Participant shall forthwith be disqualified from the Tournament.
Further, the participants acknowledge that they may be at the risk of facing legal action
from third parties in case of any violation of third party IP.

xi. ESFI officials engaged in the organization and management of the Tournament, including
its directors, officers, partners, employees, consultants and agents are under no obligation
to render any advice or service to any Participant in respect of the Tournament in any
manner whatsoever.

xii. Mere participation in the NESC shall not entitle a Participant to the Benefits (if any) or
qualifies him / her to participate in the Asian Games. No other person or agent can claim
the benefits (if any) on behalf of the Participant.

xiii. The decision on the Participants / Teams selected by ESFI shall be final and binding and
no correspondence or communication shall be entertained in this regard.

xiv. Participants and or Winners should be medically fit and will be responsible to get
required vaccinations, tests etc and will be solely responsible for their own health &
wellbeing during the NESC and the Asian Games. Participant(s) will conduct themselves
during NESC and or the Asian Games in a manner which ensures his / her health and
wellbeing. The ESFI or its office bearers/directors shall not be held responsible for any
injury or deterioration in health faced either directly or indirectly by the participants or
their parents / legal guardian / accompaniments as the case may be as a result of player's
participation in the NESC or the Asian Games. Further, the ESFI or its office
bearers/directors/directors shall not be held responsible for any loss incurred by the
participant(s) or their legal guardian in Indonesia / India / or any other venue, city or
country / otherwise due to act of god or foreseeable or unforeseeable events such as
including but not limited to riots, war, commotion, natural disaster, state emergency,
political emergency, civil disobedience, mutiny, earthquake, storm, hurricane, tempest,
fire, terrorism, aircraft failure, aircraft / travel related delays, travel or other related
accidents, etc.

xv. ESFI including and not limiting to its Directors, Staff, it's appointed third parties is not
responsible to the Participant(s) or to any other party for compensation and or what so
ever claims and or damages as a result of the above-mentioned actions or any other
breach of these regulations, terms and conditions.

xvi. The Participants hereby waive all rights and grant to ESFI or its Affiliates a royalty-free,
exclusive, irrevocable, perpetual worldwide license to copy, modify and otherwise use
and distribute their submission entry and, or, GamePlays and, or, any element of the
submission, in any and all media and in any publication whether online, offline or on the
Internet. ESFI shall also be free to use any ideas, concepts, know-how or techniques
contained in such submissions or materials for any purpose including and not limiting to
commercial exploitation.

xvii. The participant(s) hereby grants to ESFI a royalty-free, exclusive, perpetual worldwide
license to copy, modify and otherwise use and distribute including any copyright in the
applications developed including and not limiting to the GamePlays by the participant(s)
and, or, submissions, feedback, material. ESFI or its Affiliates shall have sole and
exclusive right to commercially exploit the same.

xviii. ESFI does not make any commitment, express or implied, to respond to any feedback,
suggestion and, or, queries of the Participants or furnish reasons for inclusion and, or,
exclusion of any particular submission of the Participant at any stage of the Tournament
or the Asian Games as the case may be.

xix. Participant(s) understand and agree that ESFI may assign any or all of its rights under
these Terms and Conditions to its Affiliates or any third parties without participant(s) and
or Winner(s) consent.

xx. Participant(s) understand and agree that ESFI or its Affiliates or its appointed third party
agencies shall be entitled to use, in any manner, the name, gamertags, photographs and
any other details of mine, likeness and status in any publication including the Benefits
awarded to them, if any.

xxi. After being confirmed for the Asian Games, winner(s) will not withdraw from the Asian
Games for what so ever reasons (whether foreseen or unforeseen). If the winner(s)
withdraw from the Asian Games or fail to appear for the Asian Games for what so ever
reasons (whether foreseen or unforeseen), winner(s) shall be fully responsible for the
ensuing costs / damages / expenses to ESFI. The winner(s) will remit such costs / losses
within 15 days from being informed on the losses, if the winner(s) fail to do so, ESFI is
free to take any legal recourse as deemed fit. The winner(s) also acknowledge that their
withdrawal may cause reputational damage to ESFI and shall be liable to pay damages
along with the other damages envisaged above.

xxii. Participant(s) will provide all the correct information in a timely manner including and
not limiting to passport details and or any other document or information as and when
required by ESFI.

xxiii. Participant(s) shall provide correct and relevant information as and when required by
ESFI for the transfer of the Winnings (from the Asian Games) if any. ESFI will not be
liable for any losses and or claims what so ever incurred because of the false, incomplete
and or incorrect information provided by the participant(s).

xxiv. Winnings, if any will be transferred to the Winner(s) of the Asian Games as per the
standard operation procedure and timelines of ESFI. ESFI shall transfer the winnings
after the deductions of the expenses, taxes including and not limiting to the government
taxes, bank charges, applicable taxes and or any other charges.

xxv. Participant(s) and their Parents / legal guardians / representatives understand and agree
that ESFI including and not limiting to its Associates, Directors, employees, appointed
agencies will not be held responsible (for any Legal or Financial Liability or claim
whatsoever) for any mishap, foreseen, unforeseen or any unfortunate event that occurs
(due to participant(s) or their legal guardian's direct or indirect involvement) during the
NESC and or the Asian Games.

xxvi. Participant(s) and their legal guardian / representatives indemnifies and will defend and
hold harmless ESFI, its associates, Directors, Partners, employees from and against any
damages / any and all losses, liabilities (including statutory liabilities), claims, actions,
judgments, assessments, tax liabilities (direct or indirect including any interest and
penalties), costs and expenses, including without limitation, interest, penalties, reasonable
legal fees, costs and disbursements in connection therewith (hereinafter called "Losses") /
expenses that are incurred due to his / her actions, and / or any and damages / Losses /
expenses arising as a result of third party claim and / or damages / Losses / expenses
arising from any event (within or outside his / her control) including but not limiting to
any kind of losses (repairable or non repairable) while participating in the NESC and or
the Asian Games or during or in the course of travel to the NESC and or the Asian Games
or the return to India or otherwise.

xxvii. Participant(s) and their Parents / legal guardians / representatives indemnifies and will
defend and hold harmless ESFI, its associates, Directors, Partners, employees from and
against any legal / regulatory / police actions that are pursued against the participant(s)
and their Parents / legal guardians / representatives due to any actions committed by the
participant(s) and their Parents / legal guardians / representatives during or in course of
the NESC and or the Asian Games.

xxviii. Participant(s) and their Parents / legal guardians / representatives also understand and
confirm that ESFI, its associates, Partners or Directors, employees will not be held
responsible for any kind of Financial expenses / losses / damages / claims, including but
not limited to for any consequential, incidental, special, indirect, exemplary or punitive
damages, or damages for any loss of profits, revenue or business, loss of reputation, loss
of goodwill, loss of time and opportunity.

xxix. Participant(s) and their Parents / legal guardians / representatives acknowledge and
confirm that he / she will not defame ESFI on any platform, media including and not
limiting to statements, online or offline or sue ESFI in what so ever manner and for what
so ever reasons. If the participant(s) do so, ESFI will be free to take any legal course
(criminal or civil) which is inclusive and not limited as deemed fit and claim the damages
from the participant(s) and their Parents / legal guardians / representatives.

xxx. Participant(s) agree to comply with all applicable laws of India and local laws during the
participation in the NESC and the Asian Games. Participant(s) understand it very clearly
that any violation of the law by the participant(s) shall be his / her responsibility and on
his / her own risk. Participant(s) indemnify ESFI including and not limiting to its
Directors, Employees, staff, third party agencies etc. from any claims / disputes /

damages / Losses that are raised in India and or Korea due to Participant(s) actions or
inactions and or violations or otherwise.

xxxi. Participant(s) clearly understands and agrees that any violation of these Regulations,
Terms & Conditions might result in Participant(s) levying of penalty as envisaged in the
Penalty Clause above and may also lead to disqualification from participating in the
NESC and or the Asian Games at any stage. ESFI or its office bearers/directors will not
be liable for any loss and or claims what so ever caused due to such disqualification.
Further, the participants / their legal representatives shall be responsible to indemnify
ESFI all costs and damages including reputational damage incurred as a result of such
disqualification including costs of investigation and other related costs.

xxxii. The validity, construction and performance of these Regulations, Terms & Conditions
shall be governed and construed in accordance with the laws of India applicable to
contracts made and to be wholly performed within such state, without giving effect to any
conflict of law provisions thereof.

xxxiii. Any attempt by a Participant to deliberately damage any website / online media or
undermine the legitimate operation of the Tournament is a violation of Criminal and Civil
Laws and should such an attempt be made, ESFI reserves the right to seek damages from
any such Participant to the fullest extent permitted by law.

xxxiv. ESFI shall in no circumstances be responsible for paying any amount to the Participants
and or Winners and or their Parents / legal guardians / representatives including but not
limited towards the costs of travel, etc, in respect to the NESC and or the Asian Games at
Busan or otherwise. All such and related cost and expenses shall be borne by the
participants and or the Winner(s) and or their Parents / legal guardians / representatives.
Any unexpected costs due to any unforeseen changed circumstances shall also be borne
by the participants and or the Winner(s) and or their Parents / legal guardians /
representatives.

xxxv. Taxes and other levies imposed by any relevant applicable government or tax authority,
as well as other costs including, insurance and incidental costs, that may be levied or
incurred shall be fully borne by the participant(s), selected / winning Participants
(Winner(s)) and or their Parents / legal guardians / representatives. Participants shall also
bear any taxes or statutory levies that may be imposed by Government of Korea and the
participants shall indemnify ESFI against any tax liabilities and losses that may be
incurred by it or imposed by Indian or foreign government as a result of the winnings or
rewards attained by the Winner(s).

xxxvi. Subject to any applicable law (a) All warranties of any kind whatsoever, whether express
or implied, are hereby expressly disclaimed by ESFI including, but not limited to,
meeting of the Participant's requirements or aspirations, timeliness, security, the results or
reliability of any Tournament, or the delivery, quality, quantity, merchantability, fitness
for use or non-infringement in respect of any goods, services, benefits or awards acquired
or obtained through the Tournament or any transactions effected through the
Tournament; (b) The Participant expressly agrees that his / her participation in the
Tournament offered by ESFI is at the Participant's sole risk and is governed by the Terms
and Conditions herein; and (c) No advice or information whether by representations, oral,
written or pictorial derived from the website or through the Tournament shall be
construed to mean the giving of any representation / warranty / indemnity of any kind
whatsoever by ESFI or its office bearers/directors.

xxxvii. Nothing in the Tournament shall affect any IPR of ESFI in any product or service, which
may be the subject matter of the Tournament or otherwise.

xxxviii. All perpetual and worldwide IPR, including any copyright in the applications developed
by the Participants and, or, their submissions, feedback, material and the like shall be
owned by ESFI or its Affiliates. ESFI shall be entitled and will have sole rights to exploit
the same in any manner whatsoever.

xxxix. The Participant(s) expressly agree to waive any privacy or data protection rights of their
personal data provided to ESFI and provide consent to ESFI to use their personal data in
any manner permitted under the applicable law as deemed fit by ESFI in its sole
discretion.

xl. The Tournament shall be governed by and construed in accordance with the laws of
India. Any dispute arising out of or in connection with this agreement shall be referred to
and finally resolved by arbitration at Delhi, India in accordance with the Arbitration &
Conciliation Act, 1996. The arbitral tribunal shall consist of one arbitrator to be
appointed by ESFI in its sole discretion. The language of the arbitration shall be in
English. The decision of the arbitrator shall be final and binding. The cost of arbitration
shall not be borne ESFI and shall be borne by the participant(s) and or winner(s) and or
their Parents / legal guardians / representatives as the case may be.

xli. The Participant undertakes to indemnify and keep ESFI harmless and indemnified against
any loss, damage, claims, costs and expenses which may be incurred or suffered by ESFI
due to breach of any Terms and Conditions contained herein by the Participant and / or
infringement or violation of any patent, copyright, trademark, trade secret or other

proprietary right of a third party by the Participant and, or, arising from the participation
of the Participant in the Tournament.

xlii. In addition to these Regulations, Terms and Conditions, other specific terms may be
imposed by ESFI at any time to deal with any unforeseen situation. ESFI also reserves
the absolute right to change / amend / update the Regulations, Terms and Conditions
contained herein and, or, any other rules and regulations in respect of the Tournament at
any time without any notice, without assigning any reason and without any liability
whatsoever. Participants are requested to refer to such other terms and conditions, if any,
which may be displayed on-line or intimated separately as ESFI considers fit. However,
no obligation whatsoever is cast on ESFI to separately intimate each individual
Participant with regard to such additional terms and conditions / changes / updates.

xliii. ESFI, at its sole discretion reserves the right to withdraw or discontinue with the
Tournament or from the Asian Games at any stage without any prior notice and without
any liability whatsoever to the Participant and, or, anyone. Participant(s) indemnify ESFI
including and not limiting to its Directors, employees, staff, admins, affiliates etc from all
sort of claims / damages what so ever with respect to such claims or disputes /
withdrawal.

xliv. An 'Affiliate' means any legal entity owned or controlled by ESFI, which owns or
controls ESFI or which is under common ownership or control with ESFI. The term
'ownership' means more than 50% direct or indirect ownership / shareholding and the
term 'control' means direct or indirect control of the management or the board of directors
as applicable. Third party agency means any party appointed by ESFI in regards to the
NESC.

xlv. These Regulations, Terms and Conditions also apply to the Parents / legal guardians /
representatives of the participant(s)/Winner(s) below the age of 18years, wherever
applicable. By allowing/permitting their ward to registering for the NESC, they
acknowledge that they have fully read, fully understood, and agree to abide by these
Regulations, Terms and conditions including and not limiting to any future updates and
amendments.

xlvi. This document has to be read along with the Minor and Parental/Legal Guardian Consent
Form and is integral part of this document. In case of any inconsistency the Regulations,
Terms & Conditions for NESC-2018 will prevail.

Every player picks four different decks using 4 unique classes (1 class is banned by your opponent).

The Player who is able to win once with all three playable classes is the winner of the match.

If you win with a class, you MUST switch your class for the next game and you can not choose it for this
match again. If you lose with a class, you can keep it or choose another class.

General Match Rules:


You're not allowed to have multiple decks per class prepared! Your opponent can ask for a screenshot of
the challenge lobby in order to check your deck screen. If you have several decks for one class prepared
or leave the challenge at any time, your opponent can call a 1-game defwin!

Never enter your collection! In case you leave the challenge for any reason, make sure you don't change
your online status or enter your card collection. A defwin will be granted if your opponent screenshots
that you have entered the collection, have made a deck or have changed the status to AFK / DND (this
might hide the fact you entered the collection).

Don’t cancel the challenge multiple times or your opponent can receive a default win.

Don’t select the wrong hero in Hearthstone for game 1 or your opponent can take a 1-game defwin!
Misspicks after game 1 won't lead into a defwin.

In case of disconnection or Hearthstone bug while you are playing a game, your opponent decides if he
wants to rematch or not. Your opponent can also ask for a default win for this game. A screenshot is
needed in order to take the default win.

Don’t delete your opponent from the friends list during the match or your opponent receives a default win
for the whole match.

This Hearthstone tournament will be played in Standard Mode. Please make sure you challenge your
opponent with the correct mode selected.
