COMPROMISE AGREEMENT

This Agreement is entered into this __day of ____________, 2018 , in the City of
_________________, by and between

___________________, of legal age, single and a resident

of _____________________, hereafter referred to as the
“FIRST PARTY”

-and-

___________________, a corporation duly existing under

the laws of the Republic of the Philippines with office address
at the ____________________, represented by
__________________, hereafter referred to as the “SECOND
PARTY”

WITNESSETH THAT:

WHEREAS, the FIRST PARTY and the SECOND PARTY are the accused and private
complainant in Criminal Cases No. _______________ for ________________ and
Criminal Cases No. ________________ for _______________, entitled
“________________________”, all pending before the Municipal Trial Court for Cities in
_____________________;

WHEREAS, during the pendency of the cases, several opportunities for discussions and
negotiations of a possible compromise on matters that are allowed to be compromised
by existing laws were give to the parties by the court;

WHEREAS, after such negotiation and discussions, the parties mutually realized and
deem it best to resolve the case in an amicable manner in order to avoid a protracted
litigation;

WHEREAS, the SECOND PARTY has manifested its willingness to be indemnified

reasonable for the amount taken by the FIRST PARTY;

WHEREAS, both parties have come to a mutually beneficial arrangement as to the

method of payment of settlement for its convenient and immediate disposition;

NOW THEREFORE, for and in consideration of the mutual covenants and agreements
herein established, the parties hereto agree as follows:

I. AMOUNT OF DAMAGES

Based form the audit of the Second Party and as admitted by the First
Party, the latter took and misappropriated the amount of
___________________________Philippine Currency. .

Furthermore, as consequent of the ___________________committed by

the First Party, the Second Party’s business was put at risk and caused
damage to its reputation which if converted to monetary amount is
equivalent to __________________________, Philippine Currency.
 Thus, FIRST PARTY agrees to pay the Second Party the total amount of
______________________________, Philippine Currency.

II. TERM AND FORM OF PAYMENT

The above stated amount shall be payable in twelve (12) monthly equal
installments starting on ____________________. For the succeeding
installment, payment shall be made on or before the 30th of every month.
All payments must be in form of CASH.

In the event of a default in any or all of the installment, the criminal cases
above-mentioned shall be immediately open and revived.

III. MISCELLANEOUS PROVISIONS

a. This Compromise Agreement shall not affect nor prejudice any case
or cases between the parties not specifically referred to herein.

b. The Second Party hereby warrants that the signatory to this

Agreement is duly authorized to execute this Agreement.

c. Both parties have executed this Agreement by their own voluntary

act and deed in their mutually agreed terms. Both parties warrant
further that they do so with the full understanding of its nature and
its consequence to the pending cases.
