COUNTER-AFFIDAVIT

I, OSCAR ANCHETA BARUELA, of legal age, Filipino citizen and

resident of Patucannay, Bangued, Abra, after having been sworn to in
accordance with law hereby depose and state that:

1. I am the respondent in the above-captioned case for trespass to dwelling

filed by complainant Rodel Villastiqui Laureta;

2. I vehemently deny the allegations of the complainant. Complainant and

his witnesses were conniving and lying under oath because their sworn
affidavits were made to harass and vex me since I did not support the
candidacy of the complainant in the recent barangay elections.

3. The allegations are groundless and blatant fabrications, the truth being
that on May 12, 2018 around eight oclock in the morning while I was
heading home, the complainant was shouting at the top of his voice
 saying “putang ina mo, patayin kita!” (you son of a bitch, I will kill you!).
Since I was in a hurry I just answered saying “sige, kung kaya mo!”
(sure, if you can!) and left him.

4. Furthermore, upon inquiry, no complaint, petition, action or proceeding

involving any matter within the authority of the Lupon shall be filed or
instituted directly in court or any other government office for
adjudication, unless there has been a confrontation between the parties
before the Lupon Chairman or Pangkat, and that not conciliation or
settlement has been reached as certified by the Lupon Secretary or
Pangkat Secretary as attested to by the Lupon or Pangkat Chairman or
unless the settlement has been repudiated by the parties (Local
Government Code, Section 412);

5. Considering that we have not gone through the Barangay Conciliation

process, this case should be dismissed for jurisdictional defect;

6. I am executing this Counter-Affidavit for the purpose of attesting to the

truth of the foregoing statements, to inform the proper authorities of
the above facts, to support my prayer for the dropping or dismissal of
the instant case against me and for whatever purpose this may serve
best.
