Vision / Mission

To help people, organizations and communities to manage conflicts and resolve


disputes without the delays and frustrations of doing so through litigation.

MCN goal is to reach out to as many people in dispute and provide them time tested
proprietary approach to resolve disputes.

Our Market / TG

Litigated as well as non-litigated disputes that may need support of mediators and
conciliators at the highest level of expertise and commitment to resolve deadlocked
issues.

Business objectives

To establish MCN as the only Indian origin leading mediation and conciliation network
that operates across continents to help manage conflicts and resolve disputes of
individuals, communities and organizations.

Business Location

The MCN will have its main office in New Delhi located at Greater Kailash 2 and will
have ad-hoc mediation facilities of various capacities as well as facilities that clients
may want to choose from.

MCN may also use some office locations and facilities of its regional members as the
branch offices or local offices in each main city.

Mediation Venue/s

We will have selection of few venues in Delhi NCR region in the price band of 5000 to
10,000 per day. The cost will be borne by client as per their choice. Clients can also
suggest the neutral venue of their own choice.

Mediations could happen in the courthouse, in members/attorneys’ offices, or in


executive suites. All of which will depend on the nature of dispute and the choice of the
MCN clients.

For initiation of the Mediation process we can use the Delhi Governments Mediation
centers and gradually transfer the cases to our other venues and mediators based on
the clients and their needs. We will use the government mediation center and mediators
for typical cases which need the notices to be served yo one of the parties to initiate.

Marketing and Business Development

MCN will use a variety of marketing and business development tools and approaches to
generate awareness build credibility and educate prospective individual as well as
corporate clients. The list will be exhaustive and include some of the services like –

1. MCN Experts and members will write few blog articles and create a few videos
directly as well as through the members of MCN.
2. Develop a high profile website with information that clients and members may
want to use from time to time.
3. Create brochures and documents that position the organization as a leading
private mediation and conciliation resource (mainly for all kinds of out-of-court
settlements resolutions for cases at pre litigation stage or in the litigation)
4. Approach all leading lawyers of all courts in Delhi initially and later on approach
all leading lawyers across the country to refer cases to MCN for mediation on a
fee sharing basis.
5. Generate direct leads by way of social media marketing - that includes,
linkedin, instagram, facebook and twitter
6. Create a very comprehensive mediation and conciliation blog online starting
with at least 20 very comprehensive articles (this will be done in the first 20
days of inception)
7. Piggyback some news articles in the newspapers and magazines to spread the
brand name as India’s leading conciliation platform for all.
8. Track all court judgments of civil cases with high stakes and to contact both
parties for trying an out-of-court settlement. MCN will send the communications

to all these prospective contestants to make them aware of alternative dispute
resolution options and for trying resolution through mediation.
9. Sending communications to the legal departments of all the companies - over
10,000 companies in all business segments within India to update them about
our mediation services for their commercial disputes
10. Develop relations with some senior police officers and other such socially
networked individuals to gain referrals and word of mouth
11. Promote and list the services various directories like justdial, sulekha,
indiamart and all legal portals, all law related directories and journals etc.
12. Leads can also be generated through the first session of free (moonlight) as an
unpaid mediator through court-annexed mediation program and may want to
consult parties and the parties may later ask the “free” mediator to continue the
session through private mediation past the period the courts offer gratis
through the government mediation centers.

The Modus Operandi

• Mediation and conciliation to be done by using our own "PROPRIETARY


PROCESSES AND APPROACHES" that no other conciliation experts use.
• A brief about our processes approaches and systems created and used by MCN
will be shortly available on our website and other communication collateral.
• MCN Mediation and conciliation approach and process is relatively painless and
less time consuming process with everlasting outcomes for clients

Competition

There are many court annexed as well as other government mediation centers that
provide free mediation services, but we can use these facilities to compliment and
should not take this as our competition.

Secondly every lawyer and law firm may also be taking up mediation cases on a private
level to resolve disputes and settle them out-of-courts for their clients. We find these
lawyers also as compliment to our business and not a threat as they may be able to
refer the cases to us for an unbiased client review and yet share revenues earned as
mediation fee.

There are very few instances of private mediation centers or networks in India and so
the challenge would be to create that awareness and build credibility and trust about
our network among prospective clients who seek mediation to resolve disputes.

The Client Service Approach

The service model will be based on two client-centered considerations: What is at


stake? And what are the client’s objectives?

It will start from getting a detailed questionnaire filled by the client for the MCN experts
to understand the case in detail and evaluate the procedure / modus operandi that may
be followed for that specific case.

The model will identify the optimal way to achieve the client’s objectives, in light of the
stakes involved. It should take all relevant factors into account, specifically, how to
resolve dispute in the most amicable manner using least resistance and time.

While maintaining the commitment to quality, outcomes and ethics, the service model
will be equally determined to achieve these objectives using the optimal set of
resources (mediation centers, mediators and other requisites) and proceeding in the
most effective way.

MCN Resource Model

To enable an optimized service model, the mediation center will use diversified resource
model to include a different mix of professionals, people, technology (a mobile app) and
more collaboration with third parties that enables MCN to add value to its services for its
clients in conflict.

The model will consist of a smaller percentage of lawyers and an increased percentage
of other professionals also as MCN believes that mediation and conciliation requires a
very holistic approach that is more attuned to identifying the cause of conflict, which is
more often psychological, social or influenced by other factors and a legal perspective
and outlook may actually delay or complicate the resolution of the dispute.

The model will also contemplate active and close collaboration with third parties who
can provide resources and service at the requisite quality levels more efficiently than the

network can on its own. Examples include legal process outsourcers, investigators and
data analytics providers.

Income sources

Mediation Service Fee, Consulting Fee - from corporate on how to avoid conflicts and
resolve them internally, Research and fact finding, writing, and speaking; performing
other allied mediation and conciliation services for the individual and corporate clients.

Estimates operating costs and investments

Facility and office rentals, operating costs of the offices, human resources, and other
expenses.

MCN Fee/ Pricing

MCN will charge its fee based on the value delivered rather than on the number of
hours. For one thing, as the service is progressively delivered by resources other than
lawyers, the billable hour model will not work.

The pricing model will be mainly based on fees on outcomes along with a small upfront
registration fee, mediator’s daily fee, venue, documentation and other ancillary
expenses. In some cases MCN will also quote its fixed fees for an entire engagement,
for parts of an engagement, or for the achievement of designated milestones.

Structure and Governance

MCN’s management and functions will be jointly managed by the board of 7 members
selected by the panel every year. MCN is initiated by “Lawrel Winners Advisory
Advocacy and Law Network Pvt. Ltd. (A NOT-FOR-PROFIT company) and will be
governed by the elected board with voting rights to all its members.

New Members of the Network

Anyone individual having necessary skills and experience in mediation and conciliation
can apply to be part of MCN network. All approvals to the network will be made by the

governing board of the MCN. The approval criteria are reviewed from time to time as
MCN is in its initial stages of its evolution.

Revenue Model and how the revenue is shared

MCN revenue will be shared based on the revenue sharing policy reviewed by the
board from time-to-time. As on date the revenue will be shared as below –

o 50% - Mediator/s
o 50% - MCN towards covering operational and business development
costs of the organization
• MCN will collect the fee and other expenses from the clients and will share the
fee portion of the collections with mediator/s appointed on the case.
• Fee will be paid to the mediators within 7 days of the collection from clients by
MCN
• The Fee schedule covers a fixed fee portion and success fee. All Fees schedules
of MCN commercial cases are starting at INR 50,000/ and above.
• Mediators will cover the cost of travel within city and for outstation travels MCN
will recover the costs from clients to be paid to MCN mediators.

Your Involvement

I consider you as the first founding partner and member of MCN, but it will be your free
will to be a part of MCN in the way you want. My expectations will be to see your full
interest, involvement and guidance on the backdrop so that we can together take it to a
level that we can together feel good about.

Please note that your involvement and passion in the project is my main driving factor
and so I will need full passion to be seen from your side to pull it to that level of success.

I will also request you to manage all the revenue that MCN will earn from its clients. This
is more also because I want this to be done through you also for auspicious reasons
other than emotional. Because I believe that you will manage the funds in the best
possible manner and also will give it a divine luck factor.
