‫بسم اهلل الرحمن الرحيم‬

All praise is for Allah and may the prayers and peace be upon the messenger of Allah and upon his family
and companions, Allah the most high says:

ِ ‫وقُل لّْعِب ِادي ي ُقولُواْ الَِِّت ِىي أَحسن إِ َّن الشَّيطَا َن ينزغُ ب ي نَ هم إِ َّن الشَّيطَا َن َكا َن لِ ِإلنْس‬
‫ان َع ُد ِّوا ُّمبِينًا‬
.
َ ْ ْ ُ َْ َ َ ْ َُ ْ َ َ َ َ
And say to My slaves) that they should (only) say those words that are the best. (Because) Shaitân (Satan)
verily, sows disagreements among them. Surely, Shaitân (Satan) is to man a plain enemy. (Al-Isra 17:53)

And he the most high says:

ٍ ِ ِ ٍ ِ ِ َّ
ْ ُ‫ين َآمنُوا إِن َجاء ُك ْم فَاس ٌق بِنَبَأ فَتَبَيَّنُوا أَن تُصيبُوا قَ ْوًما ِبَ َهالَة فَت‬
‫صبِ ُحوا َعلَ ى َما فَ َع ْلتُ ْم‬ َ ‫يَا أَيُّ َها الذ‬
‫ي‬ ِِ
َ ‫نَادم‬
.

O you who believe! If a rebellious evil person comes to you with a news, verify it, lest you harm people in
ignorance, and afterwards you become regretful to what you have done. (Al-Hujurat 49:6)

As for what follows: indeed some of the people have become overjoyed with some statements that have
emanated from your honourable self, may Allah preserve you, in which you were asked concerning some
issues and statements (were presented to you) that were based upon lies, daunting affairs, exaggerations
and (affairs that cause) others to misguide, we ask Allah for protection and security. We – may Allah
protect you – (some of the students of knowledge at Dar Al-Hadeeth in the city of Sa‟dah in Yemen) have
heard on the 25th of Safar 1423 a tape; which was entitled by its owners as: “Warning the Creation from the
Ignorance and Foolishness of al-Hajooree, in what Pertains to Knowledge and Da‟wah”??!! And here is –
may Allah protect you – what we know and have heard from the issues and statements (that have been
attributed to you), whilst we believe that everyone‟s statement is taken and rejected except the messenger
of Allah , and returning back to the truth – even it be by statement – is not considered a defect or
deficiency, rather it is from the signs of the people of justice and truth and is from the methodology of the
pious predecessors, may Allah have mercy upon them.

We have heard in your previous beneficial lectures; the obligation of advising the one that is being spoken
about. If only you were to know, may Allah preserve you, what these people are doing?!

Take what you have seen and leave some of what you have heard

And in the rising of the sun is what frees you from needing Saturn1

The first issue: their statement: “he (al-Hajooree) said: “The first to profess Al-Irjaa was Abdullah
Bin Madh‟oon”

We say, our Shaykh Abu Abdurahman Yahya Bin Alee al-Hajooree, may Allah grant him success, had
mentioned of what the summary of it is: that al-Imaam Ibn Abil-„Izz al-Hanafee, may Allah the most high
have mercy upon him said in his explanation of at-Tahaawiyyah, page 324 – print Al-Maktab Al-Islaami:
“Indeed the doubt that come upon the Murjiah had occurred to some of the earlier ones, and they are
Qudaamah bin „Abdullah (his name is actually Qudaamah Bin Madh‟oon) and his companions…” to end
of the quote.

So they became overjoyed by this statement and added some words to it!! From them (i.e. the words that
they added) was their statement: „The first one to profess Al-Irjaa was Abdullah Bin Madh‟oon‟ and in
another narration of theirs „Uthmaan Bin Madh‟oon‟, and from them was their statement: „indeed there are
from the Sahaabah those that fell into Al-Irjaa‟ and other than that from statements that are based upon the
narrating of lies and fabrications. All of these statements are accusations upon him, that which the narrator
is incapable of affirming from a tape or book, except perhaps narrating from something that is based upon
„Qeel2 and what will make you come to know what Qeel is?

And ash-Shaykh Yahya, may Allah the most high grant him success, rebukes all of these statements as we
have heard from him a long time ago. The most that the Shaykh had within his speech; that which is
actually affirmed (that he had said) is that he quoted from Imaam Abil-„Izz, may Allah the most high have
mercy upon him, especially the fact that he was teaching the explanation of At-Tahaawiyyah (at the time of
saying this statement), so he is merely quoting here and not saying (it from himself) and he was merely
relaying speech from an Imaam (at the point of when he was reading this) not criticising.

And since some time ago, perhaps a year ago, he looked into this issue (deeper) and refrained from
engaging in it, and some of his students gathered a compilation (of narrations concerning the affair) at the
time and read the summary of it upon him (i.e. ash-Shaykh Yahya), so this student had concluded that this
statement of Imaam Ibn Abil-„Izz, may Allah the most high have mercy upon him, is incorrect and that he
(Imaam Ibn Abil-„Izz) had erred in his relaying of it from Shaykh Al-Islam, may Allah the most high have
mercy upon him (return back to Majmoo‟ Al-Fataawa, volume number 11, page 403 and that which is
before it). So he (ash-Shaykh Yahya) retracted from this statement, especially (seeing) that he had
researched and then ordered his students to look into the chains of these narrations, then it had become
clear that many of the additional wordings and narrations were not affirmed! Despite this, these people are
still becoming overly rejoiced with their lies, exaggerations and distortions, to the extent that they have
extracted the issues from the taking place of research, the looking into (of affairs), the deeming of issues to
be correct and wrong, to the dictionary of revilements, fountains of lying and a sea of defamation!!

ً‫قُ ْل ُكلّّ يَ ْع َم ُل َعلَ ى َشاكِلَتِ ِو فَ َربُّ ُك ْم أ َْعلَ ُم ِِبَ ْن ُى َو أ َْى َدى َسبِيل‬
Say (O Muhammad to mankind): "Each one does according to Shakilatihi (i.e. his way or his religion or
his intentions, etc.), and your Lord knows best of him whose path (religion, etc.) is right." (Al-Isra 17:84)

The second issue: their statement: “that he said: Abu Dharr declared people to be disbelievers due
to major sins”.

We say, this, may Allah grant you success, is a great fabrication and a dangerous form of ignorance, he did
not say it and the one that narrated this to you is incapable of ascribing it to a book or a tape, that is if he
has with him a truthful narration, and there is no might or strength except with Allah. How is this so? When
the belief of Ahlus-Sunnah in that which relates to sinning is well known, and he has a illustrious defence
of the honourable companion; Abu Dharr, may Allah be pleased with him, in his book: “Radiance upon the
Book; the rectification of the Ummah” (page 565-568 under the 83 Hadeeth) Daar Al-Aasimah print, which
he authored more than five years ago (before 1418 i.e. 1996).

The third issue: their statement: “that he said: Oh mercy of Allah”.

And this is, may Allah grant you success, like the one that has preceded it, how can that be when he has
given Fatwa with the impermissibility of the likes of these wordings that contain a supplication to an
attribute? (and he had narrated the statement of Shaykh ul-Islam, may Allah have mercy upon him, in the
book Al-Istighaathah) and the Fatwah of Al-„Allaamah Ibn Uthaymeen, may Allah have mercy upon him,
which is clear, as is in: “The Answers of Al-Hajooree upon Da‟wah issues”, dating 24/7/1422.

The forth Issue: Their statement: “That he does not see it permissible for Ahlus-Sunnah to fight
Jihaad alongside the leaders of the innovators and he says: they should fight alone”.

This is clear lying, how can that be when his Fatwaa of fighting Jihaad alongside the Taaliban is well
known, and he said: that Shaykh ul-Islam fought alongside with those who were worse than these people.
As is in the two tapes: “A clarification of what the movement of Taaliban are upon”, dating: 13/7/1422.

The fifth issue: their statement: that he says: “Indeed to Allah belong five fingers only”.

This is similar to the one that has preceded it, rather he said: that we should remain upon the apparentness
of the Hadeeth and we state it as it is, so where is the statement that is based upon submitting to the texts
and leaving off explaining that which has not been expanded upon?!! Wallahul-Musta‟aan. Rather he
rebukes the one who says this statement with increasing the word „only‟ after it and he says that it is a false
statement.

The sixth issue: their statement: that he says: “There is no problem in praying Salaah upon the
infants of the Mushrikeen”.

This, may Allah protect you, is an issue that the scholars differ upon, and our Shaykh Yahya, may Allah
grant him success, read upon us from: „Fath Al-Baaree‟: the Hadeeth: “Every child is born upon the natural
disposition…” (Hadeeth no 1385), then he brought forth their differing and came to the conclusion of it not
being permissible, due to what has been authentically reported from the well esteemed Imaam - the Imaam
of Ahlus-Sunnah, Ahmad Bin Hanbal, may Allah have mercy upon him, and that the previous statement is
Marjooh (i.e. a less predominant saying), and that the Salaah upon the infants of the Mushrikeen is
impermissible, as we heard in the „Asr and Maghrib lesson that day, approximately 6 months ago.

And pay attention, may Allah grant you success, to the question of these people! What is it that they want?
And what is it that they narrate?! Look at how they hunt in murky waters?! And this is not the way one that
desires direction and advice, rather this is the way of one that wants to cause commotion and defamation,
and to Allah we belong and to him we will return.

The seventh issue: their statement: that he says: “Indeed the statement that the Arabs are better
than the Non-Arabs is a statement of nationalism”.

Subhaanallah, the lessons of the Shaykh do not cease to be fresh, moist and tender in mentioning that the
race of the Arab is better than the race of the „Ajam (non Arab) according to what Shaykh ul Islaam has
mentioned in Al-Iqtidaa3.

The eighth issue: their statement that he says: “Indeed the „Ulamaa in the land of Hizaaz can be
counted upon the fingers”.

We say, that he said this statement in the context of mentioning the great number of Hizbiyyeen and their
roots in the land of Hijaaz and Najd, and that the Salafi „Ulamaa in comparison to them are few. He did not
intend to limit them to ten or twenty, and this is known from the ways of the Arab in their language. He, as
we hear and have heard constantly praises the „Ulamaa of Najd, the Haramain and Al-Hijaaz and he says
that it (i.e. Saudi) contains the most scholars that are sincere from the lands of Allah, from them being the
body of the major scholars and highly respected permanent committee and other than them and they are
well known, we seek refuge in Allah from debasing the rank of the „Ulamaa, and you (i.e. ash-Shaykh
Yahya) have indicated, may Allah grant you success, that the speech of a person - before and after what has
been quoted from him has an influencing effect regarding the judgement made upon him.

The ninth issue: their statement that he said: “Concerning the opinion of shortening (the prayers)
without any time restriction, that it is a satanic opinion, and that the moving of the finger in the
Tashahhud is like dancing”.

We say: Yes he said this after researching the two particular issues, and one that knows the reason for his
statement concerning the shortening of prayers without any time restriction may excuse him for that, it is
because some of the students of knowledge remain for many years not praying the superiority prayers and
would shorten their prayers and would remain absent from the lessons and despite this they would be
married and would own houses. Likewise this was something that ash-Shaykh, al-„Allaamah, al-Muhaddith
Muqbl Bin Haadee al-Waadi‟ee, may Allah the most high have mercy upon him, would rebuke. Thereafter
al-„Allaamah, the honourable Shaykh Rabee‟ Bin Haadee al-Madkhalee, may Allah preserve him, had
phoned ash-Shayh Yahya and said to him: “Indeed you have people that are jealous of you, and the
enemies become overjoyed by the likes of these statements, and we know that you do not slander the
people of knowledge”. End of his speech.

And that was approximately two months ago, so he (i.e. ash-Shaykh Yahya) had retracted from this
statement when teaching and he said: “I have returned back from these words” and this is well-known from
him that which every just person knows, however those that spread lies conceal it and lie,

…their evidence will be recorded, and they will be questioned! (Az-Zukhruf 43:19)

The tenth issue: their statement: “That he speaks ill of the Fataawa of the Lajnah ad-Daaimah (the
permanent committee of Fataawa for Saudi-Arabia) and he says: „Indeed reading Fath al-Baaree
(the explanation of Saheeh al-Bukhaaree) is more beneficial‟”.

We say: It is a statement that they have torn out from its context, and have tampered with what was before
and after it, we ask Allah for protection and safety. The origin of his speech was that he said, may Allah
grant him success, whilst advising some of the students of knowledge, “Reading Fath al-Baaree is more
beneficial for the student of knowledge then the Fataawa of the Lajnah Ad-Daaimah, because Al-Haafidh
(Ibn Hajar) mentions the particular issue with its evidence, and would elaborate with evidences within it
and (would mention) criticism (upon what he saw to be incorrect), as opposed to the Fataawa of the Lajnah
for it is summarised, with all its due magnificence and benefit for the people”, this is what we know and
have heard when we were present.

So his speech, may Allah grant him success, was to the student of knowledge that is a researcher, one that
looks into issues and is dedicated to them, along with this he warns away from the Aqeedah mistakes
within Fath al-Baaree. Plus, nobody differs concerning the earlier scholars books - in general – being more
beneficial then the latter scholar‟s books, and this is a comparative benefit, however this does not mean at
all that there is no benefit in the books of the latter scholars, rather there is great benefit in them – such as
the Fataawa of the permanent committee, may Allah protect them and benefit others by way of them, that
which he (i.e. ash-Shaykh Yahya) does not seize to mentioned from (i.e. the Fataawa), whilst benefiting
from it, as is evident in the chapter of transactions in his explanation of Munataqaa of Ibn Jaarood and
other than it. Their statement: “He slanders them” is an outright lie! Rather they (i.e. the scholars) as he
(i.e. ash-Shaykh Yahya) has previously taught us are our scholars and ones that direct us, we ask Allah to
preserve the scholars of this Ummah, for indeed their remaining, is a remaining for Khair (goodness) as
comes in the Hadeeth, Wallahul Musta‟aan.

The eleventh issue: they say: “He says that the thief, fornicator and the homosexual are not from
Ahlus-Sunnah”

This statement is something that our Shaykh al-„Allaamah, al-Muhaddith, al-Mujaddid; Abu Abdirrahman
Muqbil Bin Haadee al-Waadi‟ee, may Allah have mercy upon him used to say, his intent behind this was:
that his (i.e. one of the three previously mentioned) claim of being a „Sunni‟ is a mere claim, as he openly
professed this himself, and that his claim of being a Salafi is likewise a mere claim, and that he (one the the
three people) is not upon the Manhaj of the Salaf as-Saalih in the very deed that he does from sinning.

And from this angle is the statement of his student; ash-Shaykh Yahya Bin Alee al-Hajooree, may Allah
grant him success, and this is its exact wording: “The thief, fornicator and the homosexual are not upright
Sunnis”, and this is his exact wording, one may return for more clarification to the two tapes: Tabyeen al-
kadhib wal meen fee qawl dhaalik al-haaqid al-muheen sahib ar-rislaah tanbeeh alghaafileen” dated
11/9/1422. Similarly in these tapes is some speech concerning teachers at mixed-sex institutes, and his
Fataawa concerning that followed which his Shaykh used to say, may Allah the most high have mercy
upon him.

And from that which is well-known is that every statement of a person is dependant upon what the intent
was (of him saying it), then after that it is to be judged upon him with what he is deserving of (from ruling),
as the Imaam and Rabbaani Ibn al-Qayyim, may Allah have mercy upon him, has clarified in his book:
I‟laam al-Muwaqqi‟een.

In conclusion: this is a number of issues and statements; we wanted to write this as a witness concerning
what we have seen and heard, thereafter we read them upon our Shaykh; Yahya Bin Alee al-Hajooree, may
Allah grant him success, and he affirmed and agreed with what was written (i.e. in defence of him), and he
said of which its summary is:

‫يب‬ِ ِ ِ ‫وما اختَ لَ ْفتُم فِ ِيو ِمن َشي ٍء فَحكْمو إِ ََل اللَّ ِو َذلِ ُكم اللَّو رِّّْب علَي ِو تَوَّك ْل‬
.
ُ ‫ت َوإلَْيو أُن‬
ُ َ َْ َُ ُ ُُ ُ ْ ْ ْ ََ
And in whatsoever you differ, the decision thereof is with Allâh (He is the ruling Judge). (And say O
Muhammad to these polytheists:) Such is Allâh, my Lord in Whom I put my trust, and to Him I turn in
all of my affairs and in repentance. (Ash-Shura 42:10)

And he the most high said:

ِ ‫الرس‬ ِ ِ ٍ ِ
… ‫ول‬ ُ َّ ‫…فَإن تَنَ َاز ْعتُ ْم ِِف َش ْيء فَ ُرُّدوهُ إ ََل اللّو َو‬
…(and) if you differ in anything amongst yourselves, refer it to Allâh and His Messenger ( ) (An-Nisa
4:59)

And he the most high said:

ِ ِ
ُ ‫…قُ ْل َى ْل عن َد ُكم ّْم ْن ع ْل ٍم فَتُ ْخ ِر ُجوهُ لَنَا إِن تَتَّبِعُو َن إِالَّ الظَّ َّن َوإِ ْن أَنتُ ْم إَالَّ ََتُْر‬..
‫صو َن‬
…Say: "Have you any knowledge (proof) that you can produce before us? Verily, you follow nothing but
guess and you do nothing but lie." (Al-An'am 6:148)

And likewise (he said) he is ready to return back from any mistake or false statement, because from the
affair of a man is that he makes mistakes, however the virtuous one is one that returns back from them, and
the one that remains upon his mistake and is persistent then he is blameworthy – and this is not something
that we know from him, may Allah grant him success and guide him.

Likewise we would like to draw your (the readers) attention, may Allah preserve you, that our Shaykh;
Yahya, may Allah grant him success, is responsible for Daar al-Hadeeth in Dammaj; that which our
Shaykh, our father, al-„Allaamah, al-Mujaddid; Abu Abdirrahman Muqbil Bin Haadee al-Waadi‟ee, may
Allah the most high have mercy upon him, built, maintained and then advised that the virtuous Shaykh
Yahya Bin Alee al-Hajooree, may Allah the most high preserve him, be responsible of it (i.e. Daar al-
Hadeeth), and in these days around two-three thousand people are led in prayer in this centre and they
increase in the holidays!!4 They come from many countries studying the Manhaj of the Salaf pertaining to
Aqeedah, in how to conduct oneself and in traversing upon it, may Allah make them firm upon the Sunnah
and write for them a good end.

Imaam Abu Shaamah, may Allah the most high have mercy upon him said: “I saw a group from his
companions – i.e. al-Fakhr ar-Raazee- had come to us from Damascus, and all of them used to respect him
with great respect, and it is not befitting to listen to speech which is repugnant concerning one who‟s virtue
is affirmed, perhaps it (i.e. the repugnant speech) maybe from a person with bad motives due to jealousy, or
due to a particular Madhab or Aqeedah being opposed”. End of his speech [Taareekh ul-Islaam wafyaat
year 606H page 216].

Ash-Shaykh Yahya Bin Alee al-Hajooree said: “In the name of Allah; The most gracious, the bestower of
mercy, Na‟am I have read what a number of virtuous students of Daar al-Hadeeth in Dammaj had written,
may Allah have mercy upon the one that built it (i.e. Daar al-Hadeeth), these are my statements and if
anyone sees within them anything that opposes the Kitaab, the Sunnah and the Aqeedah of the Salaf as-
Saalih, may Allah be pleased with them, then let him benefit us with advice that is aided with evidence,
may Allah reward you with good”.
