For the construction of residential building at plot #58 D block, AnadaNagar which belongs to
the owner.
The terms of this contract include all the documents listed below and constitute the entire terms
of the agreement between the owner and the contractor. The terms of this contract shall prevail
over any conflicting provision in the documents incorporated as reference.

1. The contractor will construct the building as per architects drawings and specification.
2. The contractor will use materials and workmanship of good quality and good standards
as directed by the architect and the owner. The materials used shall satisfy Indian
Standard Specifications ISI. The contractor should provide in writing a breakup of
materials purchased and workmanship cost after completion of each stage. The
contractor should take written approval from the owner or GPA holder if the purchase of
material / workmanship cost is exceeding the estimated budget allotted for the particular
stage of construction.
3. Safety gears required for labourers will be provided by contractor. Security and safety of
the workers at the construction site will be sole responsibility of the contractor. In case of
any accidents/death at the construction site the owner will not be held responsible for it.
The owner will not be responsible for paying any compensation to the injured/deceased.
Security of materials at construction site will be provided by the contractor, any loss
incurred due to theft will be borne by the contractor.
4. Contractor's responsibility to make sure no damage is done to neighbouring buildings
during construction. The repair works of any such damage to be borne by the contractor.
5. The owner shall not be charged any additional fees for usage of cement mixer,
scaffolding, pipes, floor polisher, welding equipment, transportation of materials from
vendor to construction site, safety gears, labor cost, labor housing cost etc.
6. An amount of 2% of the total construction cost will be paid after 6 months from the date
of completion of the entire project to ensure the quality of work to be satisfactory.
7. Adequate water proofing should be provided for water tank(sump), roof and wall. The
curing for the RCC structures will be done by the contractor taking into consideration the
appropriate number of days for curing period. Cracks in walls, honeycomb formations
due to improper concrete mixture should not occur for a duration of 3 years from the
construction of the house.
8. Rates shall remain fixed during the entire construction of the house. This includes all
duties, taxes, levies etc. If the cost of material or labor increases during the construction
of the house, the contractor will notify the owner in writing and take approval from the
owner in writing prior to proceeding further on construction. The owner will have 15 day
notice period to verify the price increase and agree upon new price. The owner in
consultation with the architect will give in writing his consent to the contractor for the new
price. A deviation caused due to any increase in prices upto 3% will be absorbed by the
contractor.
9. In case any faults like cracks in walls, RCC columns, RCC roof, honeycomb formation in
pillars, dampness in walls, water seepage in walls or water tank occur within a 3 year
period then the rectification of such faults will be done by the contractor free of cost. The
architect will be the arbiter in deciding if the fault is severe enough to be rectified. In case
of any non-compliance to the architect’s plans that is not approved by the owner, the
contractor shall be liable to demolish and reconstruct and re-do the work as per the
architect’s plan free of cost.
10. The contractor will notify the owner in writing mentioning the reason if there is any delay
progress of construction work.
11. The contractor should get written consent from the owner or GPA holder prior to
assigning or sub-letting any portion of construction work.
12. The owner will transfer the payment amount towards construction to the account
provided by the contractor.
13. If at any stage of work the owner desires to make any changes in terms of material
selection or construction, the owner or GPA holder shall provide it in writing to the
contractor and the contractor shall execute the same keeping in view the safety of the
structure. The cost difference associated with such a change will be borne by the owner.
14. Any additional costs incurred or savings made as a result of change specified by the
owner in writing will be adjusted in the stage wise payouts.
15. The contract shall be terminated if any one of the following occur:
a. Construction is stopped beyond 30 days without any prior notice provided by the
contractor to the owner.
b. If contractor persistently neglects to comply with written notice from the architect
or owner requiring him to remove defective work or improper material or goods
and by such refusal or neglect that can materially affect the work.
The contractor shall be entitled for payment as per the schedule of work mentioned below. The
payment shall be made based on the actual measurements of work executed and completed.
This will be determined and certified by the architect and the owner.
