ntheEIR/EIS – i.e. the ‘three-legged stool’ of a 6.4 million

gallons per day (mgd) desal plant, a 3,500 acre feet annually water recycling plant, and

expanded Aquifer Storage and Recovery - is barely suffcient to supply the water the

Monterey Peninsula needs. If one ‘leg’ underperforms – that is, if the water recycling

facility fails consistently to produce 3,500 acre feet annually (a distinct possibility) or if

expanded Aquifer Storage and Recovery fails to yield 1,300 acre feet annually (which

recent experience shows is likely) – then the desal plant, originally proposed to be 9.6 mgd,

must be relied on to produce a suffcient and sustainable water supply. The Monterey

County Hospitality Association, a member of the Coalition, has been in the forefront of our

community efforts to conserve on water use; our hospitality facilities have conserved on

water use to the point where it can achieve no more savings on water use. The Public

Utilities Commission should approve a 9.6 mgd desal plant with a 6.4 mgd desal plant to

be constructed immediately and one or two 1.6 mgd modules to be added as needed to

accommodate demand or demand increases should any project in the water supply

portfolio fail to meet water supply production projections. As Administrative Law Judge

Gary Weatherford stated several years ago in this proceeding, the California Public

Utilities Commission is not in the business of approving permanent water rationing or

water shortages.

The EIR/EIS Appendix L - Alternative Demand-Supply Scenarios explained at pp

1 to 6 assume that only half of the water projected to be needed to accommodate

hospitality industry recovery (250 acre feet annually instead of 500 acre feet annually) and

half the water required to serve legal lots (590 acre feet annually instead of 1,180 annually)

need be included in its analysis. The Coalition believes this is a fawed concept because,

among other things, it ignores the concept of “market rate of absorption” (that is, water

supply available today cannot and will not be used immediately and, in the case of

hospitality industry recovery, may not be used for several years or even a decade).

The Coalition approves the conclusion in Appendix L that no change in the size of

the project is warranted even though those crucial supply fgures are cut in half but insists

that the larger 9.6 mgd desal plant is still needed because of the possible failure of the

recycled water plant to produce its expected 3,500 acre feet annually and the likelihood

that expanded aquifer storage and recovery will fail to yield its expected 1,300 acre feet

annually.

As to Water Rights, the Coalition insisted in the beginning of this

proceeding that project water rights must be established to the satisfaction of

Monterey County agricultural interests. [Pr
