(TO THE MOTION TO ADMIT FORMAL OFFER OF EXHIBITS
and FORMAL OFFER OF EXHIBITS)

ACCUSED, through counsel, unto this Honorable Court, by way of

Comment/Objection to the Motion to Admit Formal Offer of Exhibits and Formal
Offer of Exhibits, most respectfully states:

1.)On SEPTEMBER 28, 2005, the prosecution was given 15 days or

until October 13, 2005 to file their Formal Offer of Evidence;

2.)After the Defense rested its case on AUGUST 15, 2006, the

Prosecution still has not yet filed any Formal Offer of

Evidence;

3.)On NOVEMBER 21, 2006, the prosecution filed a Motion to Admit

Formal Offer of Exhibits with the Formal Offer of Exhibits attached;

4.)It is noteworthy to state that the case is already scheduled for

promulgation on November 23,2006

5.)Inasmuch as the Formal Offer of Evidence was filed way out of time

and the case is already scheduled for promulgation , the prosecution

has waived its right to file their Formal Offer of Evidence;

6.)Hence, the Defense objects to the Motion to Admit Formal Offer of

Exhibits and its Formal Offer of Exhibits considering that it was filed
 after the Defense has rested its case, it was filed for more than one

(1) year since October 13, 2005 which is the last day to file their

Formal Offer of Evidence and there is already a setting for the

promulgation of Judgment;

7.)At any rate , Exhibits “A” to “F” and its submarkings are objected

to on the ground that the same is self-serving, irrelevant , immaterial

and was filed beyond the period to file formal offer of exhibits;

WHEREFORE, premises considered, it is respectfully prayed that the

motion to admit formal offer of exhibits be denied and the exhibits objected to

be denied admission.

Chemical Officer who conducted the drug-test examination and prepared the report was not

presented in open court to testify.

WHEREFORE, premises considered, it is respectfully prayed that the exhibits objected

to be denied admission.
