Sir/Madam,
Under instruction of my client Mr. Ravi Pratap Singh, R/o L-21, 2nd
Floor, Shriniwaspuri, New Delhi- 110065, (hereinafter referred to as “the
client”) buyer of Unit No. M9-G06, in your project called Amarpali Golf
Homes located at Group Housing Plot No. GH-02, Sector-04, Greater Noida,
Gautam Budh Nagar(U.P.), the undersigned is instructed to hereby serve you
with the notice of following contents:
2. That the total cost of the Unit No. M9-G06 as agreed between you the
addressee and my client was Rs. 34,30,350/-. Consequently, my client
made payment of booking amount of Rs.50,000 through cheque on
3.12.2014. Subsequent, payments were made through cheques i.e. on
20.12.2017 of Rs.2,50,000-/ and on 5.01.2015 a sum of Rs.53,635-/ were
paid towards you the addressee by my client.
3. That my client had got sanctioned loan from Bank of Baroda amounting
to Rs. 27,00,000. Thus in all 90% of the total amount had been furnished
by my client to you, the addressee. Despite this neither possession is
handed over to my client nor is any other obligation being complied by
you, the addressee.
4. That as per the MoU dated 27.04.2015, my client and you, the addressee,
entered into an agreement for the purpose of “No Pre-EMI till 18
months or till date of intimation of possession whichever is earlier”
whereby you, the addressee agreed to pay the EMI to my client in the
event that the possession offer of the booked unit gets delayed, however
even after failing to hand over the possession of the aforementioned
unit, you are in violation of this subvention agreement by non-
disbursement of the Pre EMI Interest amount to the bank.
5. That since my client has already paid 90% of the amount on believing
that you will honour your commitment of disbursal of the Pre EMI
Interest in favour of the bank but due to your lackadaisical attitude and
complete disregard to the rule of law have failed to follow your
commitment leaving my client to appear as a defaulter in front of the
bank.
You are also liable to pay sum of Rs. 11,000/- (Rupees Eleven
Thousand only) towards the cost of this legal notice.
