AFFIDAVIT OF CONSENT OF CHARGOR’S SPOUSE

I, JACINTA GATHONI NJOROGE, for the purposes hereof of Post Office Box Number 111-00232,
Ruiru and of Kenyan National Identity Card Number 5700092 do hereby solemnly and sincerely
declare as follows;
1. THAT I am a female adult of sound mind and hence competent and authorised to swear this
affidavit.
2. THAT I am the sole spouse of NELSON NJOROGE MAKUMI, the Chargor herein.
3. THAT my husband is the registered proprietor of Property Title Number: RUIRU WEST
BLOCK 1/497
4. THAT neither my husband nor the Bank has used any compulsion or threat or exercised undue
influence on me to induce me to execute this consent.
5. THAT I acknowledge that I have been advised to take and have taken independent legal advice
regarding the nature, remedies and effect of the within written Charge.
6. THAT I understand the nature and effect of the within written Charge, the effect of Section 90 of
the Land Act and the Bank’s remedies under the Charge.
7. THAT I hereby agree that the Bank’s rights under Sections 82 and 83 of the Land Act and the
restrictions under Section 87 of the Land Act and Section 59 of the Land Registration Act should
be noted against the title to the Property.
8. THAT I hereby give my full consent to the creation of the within written Charge out of my own
free will and volition.
9. THAT I make this Affidavit pursuant to the provisions of the Land Act and the Land Registration
Act.
10. THAT the facts deponed to herein are all true and in accordance with the Oaths and Statutory
Declaration Act, Cap 15 Laws of Kenya.

3. THAT I confirm that I am married to JACINTA GATHONI NJOROGE of National Card Identity
Number 5700092 (my spouse);
4. THAT I confirm that I only have one spouse and that is JACINTA GATHONI NJOROGE;

spouse, gave a consent to the said Charge;
