Subject: Delay in implementation of 7th CPC recommendations for CMT organisation


of mechanical department of Indian Railways.

Respected Sir,

With due respect, we would like to put following few lines on above subject matter which
certainly enlighten the issue for your kind consideration please.

Chemical & Metallurgical organisation (Popularly known as Laboratory) in Indian Railways,


is engaged in testing and certifying of raw materials from trade and ensuring vital safety of
items like Wheels, Axles, Springs, Bogie frames and controlling production processes in the
manufacturing of Rolling stocks/ Coaches, thereby ensuring safety of travelling passenger.
‘The Railway Board Management Services in its ‘Approved modules for stage wise
training of CMT organisation’ June 2004, has considered C & M Organization as the
back bone of entire quality control and preventive maintenance exercise of all
engineering departments’.

We would like to attract your kind attention regarding upgradation of pay scale as
recommended by 7Th pay CPC vide reference above to the posts of CMA, CMS & ACMT of
Chemical & Metallurgical Cadre, which comes under safety category in Indian Railways.
Anomalies of CMT cadre came into light after 2006 where a Chemical & Metallurgical
Assistant (CMA) was directly recruited through RRBs with requisite minimum qualification
of B. Tech (Metallurgy/Chemical) or M.Sc (Chemistry) in Pay Band -2 & Gp-4200, the same
grade pay also given to a diploma holder i.e. Junior Engineer(JE). This severe anomaly was
raised before CAT Kolkata bench and also before the PNM, the highest negotiation focus in
Railway board with recognised Railway federations (AIRF & NFIR) in 2011 with PNM Item
no. 2/2011 and 21/2011 of respective federation, where it was unanimously agreed to send
the said anomaly to 7th CPC for final decision. Finally, the 7th CPC too delivered
judgement in favour of the CMT cadre after hearing detailed rationale given by
Railway Board and recommended for upgradation of these posts vide Para No.
11.40.123 and Para 11.40.124 of 7th CPC report.

While accepting the said recommendation of 7th CPC, Govt. of India had asked to refer it to
DOPT under Ministry of Personnel, Public Grievances and Pensions for comprehensive view
in the matter vide Gazette Notification No. 1-2/2016-1C, Resolution notification (Annexure
III) of Ministry of Finance on 25th July 2016(Ref -3). Since then the matter is pending with
Ministry of Railways & DOPT.
Viewing above justifications, maintaining parity vis-à-vis other subordinate engineering
cadres, natural justice and in compliance of Verdict of Honorable CAT Bench of Kolkata, it
is humbly requested that CMA should be granted Level 7 in Pay matrix as recommended
by 6th CPC and re-affirmed by 7th CPC.

We therefore, humbly request you to kindly look into the matter for early action so that the
justice is delivered to this long time deprived energetic, efficient and highly educated cadre
having 100 % directly recruited B. Tech (Metallurgy/Chemical) or M.Sc qualified technocrats in
Indian Railways.
