OPPOSITION TO THE PETITION

OPPOSITOR, through undersigned counsel, respectfully OPPOSES

the appointment of Georgia S. Chavez as guardian of Krisna Y. Sanches and
states:
1. That he is 39 years old, Filipino, single and a resident of Rica Village,
Jaro, Iloilo City, Philippines.
2. That he may be served with summons and other court processes in the
office of the undersigned counsel stated hereunder; and
3. That he is a relative of the minor within the 2nd civil degree and
should be appointed as the guardian of said minor.

ARGUMENTS IN SUPPORT OF THE OPPOSITION

OPPOSITOR respectfully submits that the appointment of Guardian Georgia

Y. Chavez is not valid and should not therefore be allowed on the ground
that said guardian is unsuitable and presents the following support of its
opposition:

I. That the person for whom letters are prayed for is unsuitable.

Rule 93, Section 4 of the Rules of Court provides that, “Any

interested person may, by filing a written opposition, contest the
 petition on the ground of majority of the alleged minor,
competency of the alleged incompetent, or the unsuitability of the
person for whom letters are prayed, and may pray that the petition
be dismissed, or that letters of guardianship issue to himself, or to
any suitable person named in the opposition.”

Georgia S. Chavez being known to be a person of ill- repute for being

a drunkard and a drug addict is not suitable to be a guardian of a minor, it
being stated in the Rules of Court as a ground for opposition of appointment
for guardianship.
PRAYER

WHEREFORE, premises considered, OPPOSITOR HENRY S. YU

respectfully prays from this Honorable Court that:

1. the Petition for the guardianship of minor Krisna Y. Sanches be

dismissed;
2. the letters of guardianship issue to himself, or to any suitable person
named in the opposition; and
3. other just and equitable remedies.
