AFFIDAVIT OF WITNESS
I, JEAN KEN P. GONZALES, Filipino, of legal age, and a
resident of Gonzales Subdivision, Barangay Buenaflor,
Tacurong City, Sultan Kudarat, after having been duly sworn
to in accordance with law, hereby depose and say, that:
a. On October 17, 2016 at around Five-Thirty in the
morning (5:30am), I loud banging sound woke me up
which I thought was the door at the next house being
forcefully destroyed, I then immediately stood up to
check if what was going on. When I opened the door of
the house, I was shocked to see 3 (three) policemen
standing at the gate and when I checked to see the
other side of the duplex or the house, I saw several
policemen who were standing at the front door of the
other side of the dublex in which the grandmother of
Nathaniel Alid was residing. A certain policeman,
which I do not know his name since it was still dark,
noticed my presence at the other door, he then
approached me and asked me: “ara si jhajha da?” (is
jhajha there), to which I responded to him by saying:
“wala siya diri” (he is not here). After that, one of the
police officers moved me aside and asked me to sign
the search warrant in which I did not sign
immediately. Hence, because of my refusal to sign, the
police officer then persistently and demandingly asked
me to sign the search warrant to which I eventually
agreed so that they can move out of the house as soon
as possible because I want to go back to sleep to have
more time of rest since I was pregnant. While I was
signing the search warrant, some of the police officers
already entered the house. While the police officers
started searching the house, I was just outside the
door standing when a police officer went out and asked
me: “ano tong naka lock didto? kay sin.o to
kwarto?” (what is that locked door? Who owns that
room?), to which I responded to him by saying: “kay
mama to ni jhajha” (it was jhajhas’ mother room)“hindi
niyo na nah dira pag sudla kay naka lock ina, ako gid
ang malintian” (do not enter that room because that
room is locked otherwise I will be answerable to her).
Despite my plea, they still forcefully opened the said
door. I also noticed that the police officers were coming
in and out of the house as if they did not know what
they were doing;
b. One of the police officers then consficated my
cellphone and told me: “relax ka lang, dira ka lang,
indi ka lang mag cge hibi kay ibalik man namon
ang cellphone mo” (just relax, just stay put, do not
cry because we will return your cellphone);
c. When I entered the house to visit the comfort room,
one of the police officers told me “diin na bala si jhajha,
bal.an man namon gna.panghimo niyo” (where is
jhajha, we know what were doing), I then shouted back
at him “wala gani siya diri, tapos nalibot niyo naman
ang balay” (he is not here and you already searched
the house);
d. After visiting the comfort room, I then went back
outside waiting for them to finish, I informed them if
how long will it take them to check the house and one
of the police officers told me “dali lang kay gna.hulat
pa si kagawad” (just wait because we are still waiting
for the barangay official);
e. After that, the Barangay Kagawad arrived and I heard
that the police officers were arguing if who will
accompany the Barangay Kagawad inside the house;
f. And then I, together with the Barangay Kagawad and 3
(three) other policemen, entered the house;
g. When we reached the living room, they searched the
sofa bed where I used to sleep and, the boxes and
other parts of the living room;
h. They then asked me about a certain room at the back
of the living room area if it was ours, and then the
police entered that room. I was shocked when I
reached that room that the lock of the door was
already destroyed;
i. When I was inside the room, the barangay kagawad
was standing near the door and the police officer
searched the room. He searched the room and then
when he found a black shoulder bag, he then searched
the bag and found nothing. After that he then
proceeded to search the sling bag which was hanging
at the back of the door and thereat he allegedly found
30 packs of white substance and showed it to me, I
then told him “grabe ba, wala man na sulod kagab.e
nagkasulod na subong” (wow, that bag was empty last
night and now it has items). He then called the
Barangay Kagawad to stand beside the police officer
who found the items and then asked me to stand with
them in order to be photographed to which I refused,
but still they took the photos;
j. After, we went out of the room and went to the living
area and they asked me if I have a black cloth and
then I told them “wala” (No);
k. After, they invited me to the police station and while
thereat I heard one of the police officers ask his
colleague if how many items/sachets were they going
to declare;
l. They just asked me to wait at the police station and at
around eleven (11am) in the morning, they then
informed me that I can now go home;
m.I am executing this affidavit to attest the truth of the
foregoing statements.
