JUDICIAL AFFIDAVIT of WITNESS

Manny X. Duterte
I, Manny X. Duterte, of 25 years of age, Filipino, single, and a resident of Barangay Bagong
Bayan, Dipolog City, after having been duly sworn to in accordance with law, hereby states that:

PRELIMINARY STATEMENT

The person examining me is Atty. Jennel Jiezde T. Capotulan with office address Zamboanga
City Hall of Justice , Sta. Barbara, Zamboanga City, Philippines. The examination is being held at
the same address. I am answering his questions fully aware that I do so under oath and may
face criminal liability for false testimony and perjury.This Judicial Affidavit is written in English, a
language known and understood by me.

PURPOSE: This affidavit/testimony of Witness Manny X. Duterte who will be testifying to prove
that the his cousin RODRIGA DUTERTE y BATO was scheduled to arrive at the Zamboanga City
port on March 1, 2018 in the afternoon, and that she suffered mental and psychological stress
due to the intimidation employed by the accused.

Q1: Please state your name and other personal circumstances.

A 1: I am Manny X. Duterte, 25 years of age, Filipino, single, and a resident of Barangay Bagong
Bayan, Dipolog City;

Q2: Please raise your right hand and answer. Do you swear to tell the truth and nothing but the
truth?
A2: (raising his right hand) I do, sir.

Q3: What is your purpose in executing this judicial affidavit?

A3: My purpose is to prove that the complainant did in fact arrive in dipolog, and that she was
mentally affected by the incident that occurred in Zamboanga.

Q4: Do you know the complainant, RODRIGA DUTERTE y BATO ?

A4: Yes, Ma’am.

Q5: How are you related to the complainant?

A5: She is my cousin

Q6: What do you know of your cousins’ employment?

A6: She works in Sabah Malaysia

Q6: How long has she been working in Malaysia

A6: I’m not really sure but she has been going back and forth from Malaysia and Philippines for
a long time.

Q7: On March 1, 2018 was your cousin scheduled to arrive from Malaysia?
A7: Yes, she contacted us a week that she will be arriving at Zamboanga City port on March 1,
2018 in the afternoon.
Q8: What was the purpose of your cousin coming home to the Philippines?
A8: She came home to visit one of our cousins in dipolog who was very ill.

Q10: was she able to arrive in dipolog?

A10: Yes, sir.

Q9: How was the demeanor of your cousin when she arrived in dipolog?
A9: She was restless; she kept talking about an incident over and over and that she was fearful
for her safety.

Q10: Did you notice anything else?

A10: Well her eye bags were very visible, and she look physically drain.

Q11: Did she mention the incident that causes her restlessness?
A11: Well she said that she was intimated to pay a very high fare by the tricycle driver, and was
threatened by the drivers’ companion, with holdup.

Q12: Why did she immediately leave a day after she arrived?
A12: She told us she would be filing a complaint against the driver, and his companions, as she
was able to take template number

Q13: Did she mention anything else in regards the incident?

A13: No, she did not say anything other than that.

Q14: Do you affirm and confirm the truthfulness and veracity of all the statements you stated in
this judicial affidavit?
A14: Yes, Sir.

Q15: Is there anything you want to add to your statement Mr. Witness?
A15: I have nothing more to add.
