STATEMENT OF PROBABLE CAUSE 3/12/2018 09:14:54 AM
Blue Earth County, MN

Office Steve Hoppe, a licensed peace officer in the State of Minnesota currently employed by the Mankato
Department of Public Safety, reports that on March 10, 2018, he was on routine patrol for the Mankato
Department of Public Safety. At around 2:25 a.m., he, along with Officer Fischbach, responded to an
address in the Mankato hilltop area on the report of an intruder in the home.

Hoppe reports dispatch stayed online with the female caller, identified as Victim 1, who advised her young
juvenile children were also in the home; and she did not know the male in the home. Dispatch also relayed
that Victim 1 was telling the intruder that she was with the police department and was going to get her gun.
Hoppe notes those statements were later determined to be used in an attempt to protect Victim 1 and her
children from potential physical harm.

Hoppe and Fischbach arrived on scene at the same time and made their way up to the residence. Victim 1
opened the front door to officers; and Hoppe was met by a male, later identified as Dylan Bradley Madden.
Hoppe notes Madden was now attempting to exit the residence. Hoppe immediately turned Madden
around and detained him in handcuffs and handed him off to Officer Fischbach to get him out of the house
and to get him away from visibly distraught Victim 1, who was shaking uncontrollably. Hoppe then asked
Victim 1 if she was okay, and it took her a bit to acknowledge that she was.

Hoppe then spoke to Victim 1 about what had transpired and also spoke to her again after speaking to
Officer Fischbach. During those conversations, Officer Hoppe reports Victim 1 advised what had occurred.

Hoppe notes that he was able to determine that Madden's point of entry was through the garage door and
then through the garage house entry door, which Victim 1 had forgotten to lock. Hoppe was able to
determine this after locating wet footprints in the garage and finding that door to be the only unlocked door
to the residence.

Hoppe further reports Victim 1 advised him that she was awoken by a dream of something being wrong.
Victim 1 advised she came down with 911 entered and ready to dial 911. Victim 1 heard and then saw
Madden, who she initially thought was her son. Victim 1 then confronted Madden, who advised he didn't
know where she was; and she thought he was possibly intoxicated. Madden then began to walk at her, and
Victim 1 thought he may hurt her. Victim 1 asked if he had a gun or a knife. Victim 1 advised that Madden
had cooked himself her children's chicken nuggets and drank something from their kitchen as well. Victim 1
further advised that her husband was out of town at training in Washington, DC, and that her two children
were upstairs sleeping.

Victim 1 reports she heard her horn honking earlier and believed that Madden had also been in her vehicle.

Hoppe then checked her vehicle, and it appeared that Madden had entered the vehicle, checking above
the visors and in the center console. It did not appear that anything had been taken, however. Hoppe then
locked Victim 1's vehicle back up for her.

Officer Fischbach then advised that Madden provided a preliminary breath test of .10, and he did not
appear to be intoxicated to the point of not being able to make conscious decisions.

Hoppe reports Madden was then transported to jail.

Hoppe then went back to speak with Victim 1 further, who indicated she was afraid that Madden may come
back. Hoppe assured her she could call law enforcement for a response any time.
