INABILITY TO APPEAR BEFORE PORTFOLIO COMMITTEE OF PUBLIC
ENTERPRISES DUE TO REPORTED ILLNESS AND INCAPACITY
4. In pursuance of correspondence to Hon Acting Chairperson on Monday, 05
March 2018 on my written submission in response to allegations made to the
Committee against me by former Eskom Chairperson, | had hoped to be able to
appear sooner before your Honourable Members of Parliament. | am sadly ill and
not in fully capacity to appear before your Committee.
2, | have noted another call for me to appear before the Committee, despite my
written and verbal report of my ill health. As pointed out in-a telephone conversation on
to yourself as Acting Chairperson of the Portfolio Committee of Public Enterprises, | am
not in fit and full capacity at this stage to appear before your Portfolio Committee to
personally present my Written Statement, due to il-health, | have at al times declared
my commitment to personally clear my name, but at this stage, | have, despite my
health condition submitted a comprehensive statement refuting those allegations made
by Mr Zola Teotsi against me bem3 thas come to my realization thal, In spite of indicating to the Committee that |
am not fit and in full capacity to appear at this stage due to illness, which will be
medically confirmed, that your Portfolio Committee appears to take no regard to my
inability to honour your invitation owing to my illness. It appears that there is lack of
support and it seems as If the Portfolio Commitee Is insensitive to my rights as a
citizen, in terms of being afforded an opportunity to recover |n dignity. When | called the
Acting Chairperson, | did not get that sense, but, seemingly, | am stripped of my rights
‘Than, ifthat is the case, | have serious difficulties and would need protection af the /aw,
| am conscious of the fact that the right to human dignity is also extended to me as a
person who is not well, and therefore, | had expect ed, Parliament and its Portfolio
Committee, as a constitutional centre of observance, protection and upholding the
fundamental rights enshrined in the Constitution, to show me compassion by extending
me the right to human dignity in this difficult lime of being sick. Is this the way in which
all the citizens of South Africa will be treated, or It is only done tome? Am | now @
suspect or a criminal?
4, Notwithstanding my willingness (and not in any way a refusal) to co-operate
with your Committee in your inquiry on Eskom, as demonstrated by submission of my
Written Statement on Monday, | appear to be treated like a criminal, | presume that my
rights as a sick person, who is entitled fo human dignity and equality of all people in my
situation, shall be respected and | would not feel prejudiced and pressurized to appear
before your Committee prematurely.
5, The Committees insistence that | should appear before your Committee, despite
my illness, is insensitive and uncaring and thus amounting, in my view, to a violation of
demmy constitutional rights of human dignity, equality and freedom. | feel | am not treated
with dignity. | feel | am discriminated against for reasons | would not comprehend. | feel
like | am treated like a criminal, which would thus be a violation of my own freedom. |s
this done to all South African citizens that if they are not well, they have no dignity. This
does not shock me, but sounds like de ja vous. | have had no nghts for all my life, and
today, the only thing | have requested is to be given time to recover, and do all
necessary tests | am undergoing.
6 | hereby, nevertheless, make an unequivocal undertaking to inform your
esteemed office as soon as possible about my fitness and readiness to appear before
your Committee, and that is dependent upon my recovery and confirmation by my
doctors on my medical fitness and capacity to perform public appearance
7, Should | be compelled to appear regardless of this letter, | reserve my right at law
to seek an appropriate legal remedy.
May | please, with utmost respect, request acknowledgement and to response to this,
letter with assurance that Parliament shall consider my constitutional rights as a sick
person, and unable to appear before your Portfolio Committee at this stage, until
practitioners confirm my fitness and capacity to do so
