It provides that: “Section 17. Proscription of Terrorist et Organizations, Association or Group of Persons. - Any organization, association or group of persons organized for the purpose of engaging in terrorism, or which, although not organized for that purpose, actually uses the acts to terrorize mentioned in this Act or to sow and create a condition of widespread and extraordinary fear and panic among the Populace in order to coerce the government to give in to an unlawful demand shall, upon application of the Department of Justice before a competent Regional Trial Court, with due notice and Opportunity to be heard given ~ to the organization, association or group of Persons concerned, be declared as a terrorist and outlawed organization, association or group of persons by the said Regional Trial Court’; (44) Section 17 of R.A. No. 9372 provides two (2) grounds for the issuance of an order declaring an organization, association or group of persons as terrorist and outlawed organization, association or group of Persons. Terrorism. - Any person who commits an act punishable under any of the following provisions of the Revised Penal Code: “(a) Article 122 (Piracy in General and Mutiny in the High Seas or in the Philippine Waters); ™~ “(0) Article 134 (Rebellion or Insurrection); “(C) Article 134-a (Coup qd! Etat), including acts committed by private persons; “(@) Article 248 (Murder); “(e) Article 267 (Kidnapping and Serious Illegal Detention); a “() Article 324 (Crimes Involving Destruction), “or under “(1)_ Presidential Decree No. 1613 (The Law on Arson); “(2) Republic Act No. 6969 (Toxic Substances and Hazardous and Nuclear Waste Control Act. of 1990); "(3) Republic Act No. 5207, (Atomic Energy Regulatory and Liability Act of 1968); Page 45 of 55 Petition to Deciare the CPP & NPA as Terrorist Organizations eres(46) From the very purpose for which they were organized, ie., to overthrow the duly constituted authorities and to seize control of the Philippine Government through armed “A “6) ‘© “thereby sowing and creating a condition of widespread and extraordinary fear and panic among the populace, in order to coerce the government to give in to an unlawful demand shall be guilty of the crime of terrorism and shall suffer the penalty of forty (40) years of imprisonment, without the benefit of parole as provided for under Act No. 4108, otherwise known as the Indeterminate Sentence Law, as Republic Act No. 6235 (Anti- Hijacking Law); Presidential Decree No. 532 (Anti- Piracy and Anti-Highway Robbery Law of 1974); and Presidential Decree No. 1866, as amended, (Decree Codifying the Laws on illegal and Unlawful Possession, Manufacture, Dealing in, Acquisition or Disposition, of Firearms, Ammunitions or Explosives), amended”; struggle and, from “N (a) (b) (c) (d) it is clear that respondents CPP and NPA were organized the bombing of Plaza Miranda; their “Anti-Infiltration Campaigns” or purging operations; the killing of Rejectionists Filemon “Popoy” Lagman, Romulo “Rolly” Kintanar, and Arturo “Art’ Tabara; and their extortion activities, for the purpose of engaging in terrorism; (47) The Preamble of the Constitution of the CPP even reads as follows: “x x x In order to defeat the US Imperialists, the comprador, big bourgeoisie and the Page 46 of Petition to Dectare the CPP & NPA as Terrorist Organizationslandlords, the Party uses the weapons of protracted people’s war and national united front. The party upholds the leadership of the working class, builds the basic alliance of the working class and the peasantry, and also attracts the petty urban bourgeoisie and the patriotic national bourgeoisie to the side of the national democratic revolution. “In waging the people's war, the Party relies mainly on the mass support of the peasantry, especially the poor peasants and farm workers. The Party develops the revolutionary forces in the countryside to destroy the pillars of feudalism and the armed counterrevolution there and surround the cities from revolutionary bases until the People’s democratic forces are ready to seize Power in the cities’ (pages 79 and 80, Foundation for Resuming the Philippine Revolution, 2013, by Jose Ma. Sison [Amado Guerrero); (48) Article IX of the Constitution of the CPP also reads that: “Section 3. The New People’s Army shall be the main weapon of the Party in the people's democratic revolution and in the subsequent socialist stage. It fully welds the basic alliance of the working class and the peasantry. Mass movements defending the livelihood and welfare of the people should be strengthened alongside the resistance against the regime's fascist measures and triple wars of suppression. The regime’s. disregard for the People’s welfare while defending the imperialist interests and those of the ruling classes should be thoroughly exposed and opposed. “Duterte’s overthrow is the most important task at present for the Tevolutionary forces.
