On 30 May 2017, the Department has received a new FOI request from Paul Farrell of the
Guardian Australia.  The FOI Section is in the process of registering the request, and will provide
the formal alert, to a limited distribution list, shortly.
 
Mr Farrell has sought access to "All disclosures made under s 19 of the Australian Border Force
Act 2015."
 
Section 19 of ABF Act provides that:
The Australian Border Force Commissioner must give written notice to the
Minister of any direct or indirect pecuniary interest that the Commissioner has or
acquires and that conflicts or could conflict with the proper performance of the
Commissioner’s functions.
 
On 23 September 2016, the Department received exactly the same request from Mr Farrell.  On
13 December 2016, in response to that request, the Department issued a decision that it held
no documents relevant to that request.
 
In order to manage this request, I would appreciate it if I could meet with you briefly to discuss. 
If that is ok, could you please advise what day and time might suit you best?  I anticipate no
longer than 15-20 minutes would be required.

5. On 23 September 2016, Mr Farrell submitted the same request.

6. On 13 December 2016, a decision was issued advising the applicant that the
Department did not hold any documents relevant to the scope of that request.

7. The FOI Section is now liaising with the Commissioner’s Office in relation to this
new request.

Exclusion of non-SES staff personal details and SES telephone contact details
The Department’s policy is to exclude the personal details of officers not in the Senior
Executive Service (SES), as well as the mobile and work telephone numbers of SES staff,
contained in documents that fall within scope of an FOI request. If you require names and
contact details of non-SES officers, or direct telephone numbers of SES staff, please inform
us so the decision maker may consider your request. Otherwise we will take it that you agree
to that information being excluded from the scope of your request.

Timeframe for request


The statutory time frame provided under the FOI Act for processing requests is a standard
30 calendar days. Due to the unprecedented number of requests currently being received by
the Department, our processing times have increased.

We appreciate your patience and understanding during this busy time and we will endeavour
to finalise your request as soon as possible. Although we endeavour to have all requests
finalised within the statutory timeframes, this is not practicable at this time. Requests that are
outside the processing timeframes under the FOI Act will still continue to be processed by
the Department.

FOI requests will generally be processed in the order that they are received. As the number
of cases on-hand continues to increase, we are unable to give you an exact date for the
finalisation of your request. In some cases where a request is specific and is seeking to
access a single document the Department may process this type of request within the 30 day
timeframe.

As requested, the timeline in this request is as follows:
1. 30 May 2017 – Paul Farrell of the Guardian Australian requested access to “all disclosures
under section 19 of the ABF Act 2015.”
2. It is noted that section 19 provides that the ABF Commissioner must give written notice
to the Minister for any direct or indirect pecuniary interest that conflicts or could conflict
with the Commissioner’s functions.
3. It is further noted that on 23 September 2016, Mr Farrell submitted exactly the same
request.
4. On 13 December 2016, the Department issued a decision in relation to that request that
it held no documents.
5. On 31 May 2017, an email was sent to the Commissioner’s COS advising that the current
request had been received.
6. On 1 June 2017, I met with COS and we discussed the request.  I asked the COS to
ascertain whether any such documents existed, noting that any notice under section 19
must be provided to the Minister, so we could not make any assumptions that such a
notice would be held by the Integrity branch of the Department.
7. COM COS indicated that the FOI decision maker should probably come from either the
Executive Division or the Integrity Branch of ISA Division.  I agreed with that assessment.
8. On 9 June 2017, I spoke with the COM COS who indicated he needed more time to be
able to provide me with advice as to whether any documents existed.  I confirmed that
the due date for the request was 29 June 2017.  COM COS indicated that this timeframe
may not be met.

9. On 26 June 2017, I sent a further email to the COM COS seeking advice regarding the
existence of any relevant documents.
10. To date, no advice as been received as to whether any documents that would be relevant
to this request exist.

identify whether any documents were held by the Department that would be

8. The FOI Section is still awaiting advice as to whether any documents exist that
would fall within the scope of this request and would have been in the
possession of the Department as at 30 May 2017, being the date this request
was received.
 
9. The FOI Section considers that the Director, Employment Suitability would be an
appropriate decision maker for this request, and seek your agreement to be
nominated as such.
