TERMS AND CONDITIONS OF SALE

A completed and signed 2017 Home Gardener Order Form can be posted, emailed or faxed to our office accompanied with full payment.
PAYMENT METHODS
Payments must be made by either sending a crossed cheque, money order or direct deposit payable to Sweets Strawberry Runners Pty Ltd, MS 312,
Stanthorpe, Qld, 4380. For direct deposit details, refer to front page of Order Form.
1. Receipt of Order Form by Sweets Strawberry Runners Pty Ltd does not necessarily mean acceptance of the order. Before delivery, Sweets
Strawberry Runners reserves the right to accept the order in whole or in part at any time prior to delivery.
2. All direct deposits made to the Sweets Strawberry Runners Pty Ltd bank account must be accompanied on the day of deposit with an email or
facsimile of the deposit slip stamped by your bank or bank transfer receipt before acknowledgment of your receipt is made.
3. Sweets Strawberry Runners reserve the right to withhold any order or dispatch of runners should the grower fail to have paid any outstanding
balance on their account, or if full payment of order has not yet been received in full.
4. Sweets Strawberry Runners will endeavor to meet its projected times of delivery and quantity but will not accept responsibility for delay or failure
to deliver or for damage or loss in any way from any cause beyond the control of Sweets Strawberry Runners.
5. Sweets Strawberry Runners will replace with other plants (subject to availability) any part of the order unable to be supplied.
6. Sweet’s Strawberry Runners must be notified within 2 working days of delivery if plants are found to be out of grade and in a condition unsuitable
for planting.
1. The purchaser of the strawberry runners agrees and covenants that the runners will be grown only for the production of fruit and WILL NOT under
any circumstance attempt to undertake the propagation in any form of any of the plants supplied by Sweets Strawberry Runners.
2. All planting material supplied by SSR to nurseries/purchaser for re-sale can only be on-sold for the purpose of non-commercial (home garden)
fruit production and not for any other purpose.
3. All plants supplied are subject to protection under the Australian Plant Breeder’s Rights Act 1994 and the regulation therein. A brief summary
of the Plant Breeder’s Rights Act are included in part in this Agreement but in no way constitute a total interpretation of the Act. The purchaser
should seek legal advice from their solicitor or other appropriate legal representative for any variance to growing the plants solely for fruit. Refer
to the IP Australia website www.ipaustralia.gov.au for further information on Plant Breeder’s Rights.
4. Sweets Strawberry Runners, its authorised agents, or the holder of the Plant Breeder’s Rights, shall have the right to enter any land or area used
by the purchaser for the supplied plants between 7 am and 6 pm on any day and from time to time for the purpose of determining whether the
purchaser is breaching the Plant Breeder’s Rights Act. Refusal by the purchaser to allow such entry shall be “prima facie” evidence without further
proof that the purchaser has contravened the Plant Breeder’s Rights Act.
5. INDUSTRY LABELLING GUIDELINES for re-sale of potted plants: Each individual container which contains Strawberry Runners must be clearly
labeled with the correct variety name as listed on this order form, the Plant Breeder’s Rights symbol and state the following: “Unauthorised or
unlicensed commercial propagation or any sale, conditioning, export, import or stocking of propagation material of this Variety is an infringement
under the Plant Breeder’s Rights Act 1994”.
6. The purchaser of these strawberry runners agrees to indemnify, hold harmless and defend Sweets Strawberry Runners against all liabilities, costs,
damages, claims and losses arising out of or from any breach of the purchaser to this Agreement.
