FOURTH AMENDMENT TO EMPLOYMENT CONTRACT The Superintendent's Contract ("Contract") originally entered into by and between the Board of Trustees of Fort Bend Independent School District (“Board”) and Dr. Charles E. Dupre, Ed.D. (“Superintendent”) on April 11, 2013, as amended, is hereby further amended pursuant to mutual agreement of the parties and Board action taken on October 16, 2017 as follows: A, Paragraph 1.1 of the Contract, is amended to provide that the term of the Contract shall end on April 30, 2021. B, _ Effective October 16, 2017, Paragraph 3.1 of the Contract, and any ‘amendment thereto, is hereby amended to provide for an annual salary of $350,391.00. C.Paragraph 3.4 of the Contract is replaced in its entirety with the following: The Superintendent will not be reimbursed for travel within the District ‘but may be reimbursed mileage for travel outside of the District, as approved by the Board President, in accordance with the Financial Accountability System Resource Guide, D. Effective October 16, 2017, Paragraphs 3.5 and 3.6 of the Contract, and any amendment thereto, are hereby deleted in their entirety and no further consideration shall be paid pursuant to these paragraphs. E, Effective May 1, 2018, Paragraph 3.11 of the Contract shall be deleted in its entirety and replaced with the following: For each payroll period beginning May 1, 2018 and for each year thereafter dling the term of this Contract, and provided the Superintendent executes a salary deferral agreement in accordance with the requirements of Sections 403(b) and/or 457(b) of the Internal Revenue Code (the Code") in the amount of the salary deferral contribution, the Distict shall add to the salary ofthe Superintendent the amount of $769.23 per paid period and this shall be used by the Superintendent as ‘a salary deferral contribution to a plan established by the District under either ‘Section 403(b) or Section 457(b) of the Code, which plans may include investments asallowed under Sections 403(6),403(6)(7) and/or 457(b) of the Code respectively, at the Superintendents option, ‘This contribution shall be treated asa salary deferral contribution under the Code, The Distrot agrees to report the salary deferral contribution deseribed herein as creditable to the Teacher Retirement System of ‘Texas (“TRS”). However, the District shall not be obligated in any way to assure that such salary deferral contribution is treated as creditable by TRS. Notwithstanding anything herein to the contrary, the Distrct’s annual salary deferral contribution shall not exceed $20,000, All other terms and conditions of said Contract shall remain in full force and clfeet.
