AFFIDAVIT OF COMPLAINT

I, POLICE SENIOR INSPECTOR ROBERTO M GARCIA, of legal age, married,

Filipino, bonafide member of the Philippine National Police, Eastern Police District,
Pasig City Police Station, located along C. Raymundo Ave. Brgy. Caniogan, Pasig City.
After having duly sworn to in accordance with the laws hereby depose and state;

That on October 2, 2017 a memo from PCI EDILBERTO A SANCHEZ, Acting

Chief, DInvU/D7 was received by this office requesting to conduct pre-charge evaluation
to PO1 James D Aggarao Jr for failure to attend in his scheduled court duty hearing
last May 3, 2017, as witness/arresting officer in RTC Br. 81 at Quezon City with Criminal
Case No. R-QZN-16-12135-CR which caused detrimental to the rendition of police
service.

That being the Chief of the Station Investigation and Detective Management
Branch (C, SIDMB) I am the duly designated nominal complainant against any member
of the PNP personnel in our station in which the defense falls under the Breach of
Internal Discipline within the police organization;

That I executed this affidavit to attest truthfulness of the foregoing facts and for
the purpose of filing complaint against PO1 James D Aggarao Jr for administrative
case of “Grave Neglect of Duty” in violation of NAPOLCOM Memorandum Circular
nos. 2016-002 under Rule 21 Section 2 (C) of paragraph 1 (i) which provides that
“failure to appear and testify, without justifiable excuse, in court, prosecutor’s
office, the PNP disciplinary authorities appellate bodies, the IAS or any other
quasi-judicial body when duly notified or subpoenaed as witness. If his non-
appearance resulted in the dismissal of the case or the acquittal of the accused;
or when he is the principal witness or the arresting officer, the penalty of
dismissal from the service shall be imposed.”

That I hereby declare under oath that this complaint is not a form of harassment
or retaliation and the supporting evidence/documents herein are authentic and from
reliable source and fully aware of the consequence of being held liable for perjury in
case of false misrepresentation of this affidavit;
