Rights of Membership in Labor Organizations

1.) Right over money matters


2.) Right against unauthorized collection
3.) Right to vote on officers' compensation
4.) Member's right against excessive fes
5.) Right to adequate records of income and expenses
6.) Right to vote on proposed special assessments
7.) Right to be informed about organization's construction and by-laws and collective bargaining
agreements.

Requirement of registering a union


It depends on WHAT KIND of labor organization is to be registered

A.) Federation or National Union


1.) Registration fee
2.) Names of its officers, their addresses, the minutes of organizational meeting and list of
workers who participated
3.) If the applicant union has been in existence for one or more year, copies of its annual
financial reports
4.) FOUR (4) copies of the constitution and by laws of the applicant
5.) The names and addresses of the companies where the local or chapter operates
6.) Lists of all members

B.) Independent Union


1.) Registration fee
2.) Names of its officers, their addresses, the minutes of organizational meeting and list of
workers who participated
3.) The names of all its members comprising at least 20% of all the employees in the bargaining
unit where it seeks to operate
4.) If the applicant union has been in existence for one or more year, copies of its annual
financial reports
5.) FOUR (4) copies of the constitution and by laws of the applicant

C.) Charter Union


1.) Charter certificate indicating the creation of local chapter
2.) Names of its officers, their addresses, and the principal office of the chapter
3.) The chapter's Constitution and by laws

Inter and intra union dispute


Inter-union dispute - all disputes or grievances arising from any violation of
or disagreement over any provision of the constitution and by laws of a
union, including any violation of the rights and conditions of union
membership provided for in this Code.

Intra union dispute - any conflict between and among legitimate labor
union involving representation questions for purposes of collective
bargaining as to any other conflict or dispute between legitimate labor
unions.
It covers
1. Conduct or nullification of election of union and workers’ association officers
2. Audit/accounts examination of union or workers’ association funds
3. Deregistration of collective bargaining agreements (CBAs)
4. Validity/invalidity of union affiliation or disaffiliation
5. Validity/invalidity of acceptance/ non- acceptance for union membership
6. Validity/invalidity of voluntary recognition
7. Opposition to application for union or CBA registration
8. Violations of or disagreements over any provision of the constitution and by-laws of union or
workers’ association
9. Disagreements over chartering or registration of labor organizations or the registration of
CBAs;
10. Violations of the rights and conditions of membership in a union or workers’ association;
11. Violations of the rights of legitimate labor organizations (LLO), except interpretation of CBAs;
12. Validity/invalidity of impeachment/ expulsion/suspension or any disciplinary action meted
against any officer and member, including those arising from

The jurisdiction of the BLR are confined to


1.) Union Matters

The BLR has exclusive jurisdiction over


1.) Inter-union disputes
2.) Intra-union disputes
3.) Other related labor relations disputes

Difference between labor union and workers association


A.) Labor Union -An organization intended to represent the collective
interests of workers in negotiations with employers over wages, hours of
work, benefits and working conditions.
B.) Workers' association - An association of workers organized for mutual
aid and protection of its members or for any legitimate purpose other than
collective bargaining and duly registered with the Department of Labor.

Tripartitism - Is the representation of 3 sectors.


These are:
1. The public or the government
2. The employers
3. The workers
– in policy-making bodies of the gov’t
Example:
Comprehensive income policy agreements - They are policy documents
covering a wide range of economic and political issues, such as salaries,
taxation, pensions, unemployment benefits, and housing costs.

Requirement of affiliation
The report of affiliation of independently registered labor unions with a federation or national
union shall be accompanied by the following documents:
1. Resolution of the labor union's board of directors approving the affiliation;
2. Minutes of the general membership meeting approving the affiliation;
3. The total number of members comprising the labor union and the names of members who
approved the affiliation;
4. The certificate of affiliation issued by the federation in favor of the independently registered
labor union; and
5. Written notice to the employer concerned if the affiliating union is the incumbent bargaining
agent.

Right to disaffiliation
The right of the affiliate union to disaffiliate from its mother federation can be invoked consistent
with the freedom of association guaranteed in the Constitution. Disaffiliation is not an act of
disloyalty. The affiliate union does not owe its existence to the federation with which it is
affiliated. Once a local chapter disaffiliates from the federation, it ceases to be entitled to the
rights and privileges granted to a legitimate labor organization. Hence, it cannot by itself file a
petition for certificate election.
