SUBJECT: GUIDELINES IN THE ISSUANCE OF RELEASE CLEARANCE AND


CERTIFICATE OF EXEMPTION OF VARIOUS RADIO
COMMUNICATIONS EQUIPMENT

Pursuant to Act 3846 as amended and Memorandum CircularNo. 09-08-91 (Guidelines in the
Sale, Purchase and Importation of Various Radio Communications Equipment Intended for
Use in Private and Govemment-owned Radio Communications Networks), the following
guidelines governing the issuance of Release Clearance and Certificate of Exemption for th!
sale, purchase and importation of various telecom and communications equipment are hereby
promulgated:

l. All importations of any radio communications equipment shall be covered by an


appropriate Permit to Import issued by this Commission.

2. An entity or an individual who had imported radio communications equipment, absent of


a Permit to Import issued by the Commission maybe issued a Release Clearance" onlv
under any of the following circumstances :

2.1 Entities /individuals who comply with the requirements conditions/provisions


stipulated in Section 1.2 ofNTC Memorandum circular 9-g-91;

2-2 Impotted radio communications equipment are intended for personal use or for
private use only and not of commercial quantity;

2.3 A permit to purchase shall be required for radio transceivers/transmitters intended


for the use of an entitylindividual who have been duly authorized by this
Commission duly authorized to operate its own radio communications network.

J. Grantees of Release Clearance shall present evidences of tax payments and corresponding
customs duties of all items imported under such Release Clearance issued bv the
Commission;

4. All radio communications equipment covered by a Release clearance shall be subject to


the Inspection of the Commission's authorized representative at the port of entry;

5. Release clearance shall be subject to the following schedule of fees:

i. Release Clearance Fee -php240.00 per invoice


ii. Penalty Fee - php 85.00 per unit

6. The Release Clearance shall be issued with a validity period of ninety (90) days from the
date of the issuance thereof.

7. For non-radio equipmenVitems requiring no Purchase Permit, a Certificate of Exemption


shall be issued for the importation of such equipment/items upon payment of Php240.00
certificate fee per invoice.

This Memorandum Circular takes effect immediately and amends any other rules and
regulations inconsistent hereto.

Any violations of the provisions of this Memorandum Circular and other pertinent radio rules
and regulation shall be dealt with accordingly.
