I, Hanush S/o. Raveendran, aged about 25 years, Hindu, residing at No.279.


Vivekananda Road, V.N.Thottam, Ramnagar, Coimbatore-641 009 , do hereby solemnly
affirm and sincerely state as follows.

1. I am the deponent herein and the petitioner in the accompanying petition and the
2nd Defendant in the main suit. I am swearing this affidavit on behalf of the 1st defendant
and I am fully aware of the facts of the case.

2. I submit that the respondent herein has filed the above suit seeking the relief of
Permanent Injunction.

3. I submit that the above case was posted on 11.09.2017 for Cross Examination of
PW1 by me. I submit that due to viral fever I was taking bed rest as per advice of the
doctor. Hence, I could not contact the counsel on record to give the instruction for Cross
Examination of PW1. Hence I was called absent and set-exparte on 11.09.2017.On accout
of non cross examination of PW 1. Non-cross-examination of the PW1 on 11.09.2017 is
neither wanton nor willful.

4. I further submit that On account of the valid reasons stated above I could not cross
examine PW1. Unless the ex-party order passed against me is set-aside I will be put to
great loss and much hardship. I have valid reason to defend the case.
It is therefore prayed that this Hon’ble court may kindly be pleased to set-aside the
ex-parte order passed against me on 11.09.2017 and pass such other and further orders
and render justice.
