AFFIDAVIT

I, Judge Arlene I. Lirag-Palabrica, of legal age, Filipino, with

residence at Lunar St. Dona Vicenta Subd. Davao City and Prk. Suaybaguio
Brgy. North Magugpo, Tagum City, after having been sworn to in accordance
with law hereby depose and say:

1. That I am a regular passenger of Metro Shuttle coaster,

particularly, the 6:30 morning first trip from Abreeza
terminal, Davao City;

2. That last Wednedsay, June 28, 2017 at about 6:40

o’clock in the morning, while our coaster was running in
a normal speed along the vicinity of Ladislawa, Buhangin,
Davao City, our coaster driven by Archieval Umali figured
in a vehicular accident;

3. That there was a silver pick-up vehicle driven by a

woman who suddenly and recklessly turned left, coming
from the opposite lane, appearing in front of the coaster,
which driver Archieval Umali instinctively swerved to the
left to avoid collision;

4. That because of the sudden, abrupt and fast speed of the

pick-up vehicle driven by a woman, driver Umali was
taken aback and could no longer avoid colliding and
hitting the right rear side portion of the pick-up vehicle;

5. That I and the rest of the regular passengers at that time,

most of whom are government employees from GSIS,
Pag-Ibig DPWH and others are one in concluding that the
lady driver of the pick-up vehicle is reckless and arrogant
(insisting that she was not at fault);

6. That I can personally say, and this can be attested by the

regular passengers of the 6:30 a.m. first trip from
 Abreeza that driver Archieval Umali is without fault,
and that he is a cautious and respectful driver;

7. That I am executing this Affidavit to attest to the

foregoing facts;

IN WITNESS WHEREOF, I have hereunto set my hand this 3rd day of
