The nature of the constitutional order and system was an effort to perpetuate and

preserve Christian rationalism, and so it was inherently dualistic in nature. This meant that one
component of nature of from a biblical worldview, while another component came from a
rationalist worldview. It was supported by Lockes Natural Rights thesis and by a holy
commonwealth. The founders came from backgrounds with biblical principles, and therefore
understood the depravity and fallen nature of man, which heeds a need for limited government
to hold man accountable. The rationalist side of the American constitutional order and system
came from Lockes natural rights thesis, which determined that man had a right to life, liberty
and property. The objective was limited government so that these rights could best be
preserved.
The mechanics of the constitutional order and system was a diffusion of power which
stemmed from federalism. There are four types of powers within government: enumerated,
implied, concurrent, and residual powers. These divisions of power gave divided
authority(horizontal power) and diffused (vertical) power divided. divided authority is
administered through a tripartite system of checks and balances through the three branches of
government. the legislature creates the laws, the executive branch carries out the laws, and the
judicial branch carries out judicial review with the purpose of limiting government power.
Diffusion of powers is held between the federal and state governments, limiting power from
being too centrally held or being too freely administered by the states. This is defined clearly in
the 9th and 10th amendments.
The purpose of the American constitutional order and system was in fact to limit the
power of government and avoid tyranny. The government was not created nor intended to be
the final authority for the nation, but instead either the biblical God or rationalist natural law.
This tension was to limit any overarching power by the government from gaining hold.
But ever since the civil war, the American constitutional order and system has
unfortunately been turned on its head. Through the passing of the 14th amendment, the federal
government has become a national government. The second revolution is arguably the New
Deal during the Great Depression, which sovereignized the national power of government over
the states. The last vestige of federalism to which we hold is the electoral college. This invites
all of the states, including the smaller ones, to be heard through the election process. This
enables otherwise close elections to become clear. If this were to be abandoned, there would
be a proliferation of parties and the nation would be irrevocably split. Election campaigns
would focus on the money cities, the big cities with largest votes, leaving the lowly populated
areas behind and unheard. This is why the democrats cannot put away with the college.
