AFFIDAVIT COMPLAINT

I, Gerardo D. Abao of Legal Age, Filipino, President of VS Pintados


corporation duly organized under the Philippine law, and engage of the
business transportation and the residence of #96 Mirasol Street corner 28th
,Brgy. San Roque Cubao, Quezon City, after having been sworn in
accordance with law, here by states

1. I am filing a complaint in behalf of the company, of which I am duly


authorized representative, as evidenced by a notarized secretary certificate,
a copy which is to hereto attached as Annex A, against Mr. Jason Villena
Palcibar, hereinafter referred to as respondent for the crime of qualified
theft under article 310 of the Revised Penal Code, the latter of legal age
with the residence of Old Mahayag, Catbalogan City.

2. The respondent was employed of the corporation as its officer in charge


in its booking and ticketing office, located at Catbalogan Samar. As such he
has a job description of being dispatcher at the same time cashier and in
charge of all the sales remitted of the said corporation. The copy of his
contract of employment is hereto attached as an annex B. On the basis of
his job description his primary task among others, is to receive, recount or
audit, record and safe keeping of all the remitted sales of the company.

3. All the said remittances duly kept at the vault are to be deposited by
him to the companys bank account every end of the week.

4. The said daily task of work of the responded , He was employed from
the company to be exact for almost 5 years, without any issue or
controversy affecting said duties for the reason that he was a trusted
person ,where trust and confidence repost onto him by the corporation.
Until information coming from the accounting staff of VS Pintados office in
manila was relayed that respondent was not depositing remitted sales to
the companys bank account for certain days. This information has alarmed
the accounting department to immediately investigate the matter.

5. That on the following day, a surprised audit was conducted by Ms. Elisa
Bonco, An accounting supervisor at Catbalogan City. In order to verify in
order to prove the remittance sales are deposited to the companys bank
account. True to that effect it was found out that there were indeed short
remittances of sales that were not deposited. By the responded amounting
to 369,715,000 the copy of the breakdown of the deposited sales is here to
attach honesty.
6. There after Mrs. Bonco was reported to Mrs. Evangeline Apostil of the
head of operation. She the latter instructed the former to immediately call
the respondent and to verify the issue of the short issue of non remittances
and non deposit.

7. That on the following Day, Mrs. Bonco together with team leader
inspector Aldrine Aban of the Visayan , And Sir. MJ Sosa Companied, Mrs.
Bonco to seek and locate the whereabouts of the respondent.

8. Consequently after few hours of searching they finally come to locate the
respondent at his residence. At there, inquiries are made in way of
clarifying the matters at issue. The responded without any hesitation
voluntarily admitted the commission of the above the in titled crime and
subsequently offer a compromise ,by executing a promissory note in which
the promise to pay the looted amount on or before November 15, 2017,
copy of the promissory note is attach by annex.

9. The incident was infect the reported to PNP operatives and here nearby
reported to the police located at the said city, as evidence of the police
report / blather, the copy of this is here to attach as annex.

10. His acts are clearly of the written of the revise pinnacle code, as he was
taken (sales of the company without the consent and without employing
violence and intimidation, with grave ABUSE OF CONFIDENCE.
