PART- I
CHAPTER- I
PRINCIPLE & PROCEDURE OF INVESTIGATION: AN OVERVIEW
Investigation means and includes collection of evidence by a Police Officer (I.O.) or any other
person (not a Magistrate) to whom Court entrusted to do so. In reality, Investigation usually means
collection of evidence in respect of a cognizable case.
On receiving information of a cognizable offence the Officer-in-charge of a Police Station is bound
by law to start a case by drawing up a FIR and to arrange for its investigation. If the officer-in-
Charge of a Police Station refuses to lodge a FIR on information of a cognizable offence the
aggrieved informant may inform the Superintendent of Police of the district or the Courts of Law.
In such cases, the S.P of the District and the concerned Court may direct the officer-in- Charge of
the Police Station to lodge FIR on that specific incident and to start its regular investigation. Denial
of FIR without any reasonable grounds is always criticized by the Court.
Power to Investigate Cognizable cases by ASI of Police:
Government of West Bengal [vide Home (Police) Dept. Order No 4282-PL, No. 4283-PL & No.
4284-PL Dt- 23.12.2009] has empowered the Assistant Sub-Inspectors of Police to undertake
investigation under sub section (1) of Section 157 CrPC together with powers U/S161 & 174 of
CrPC as such,. The relevant portion of the order is reproduced below.
All the Assistant Sub-Inspectors of Police can legally Investigate Criminal cases under IPC
including S.R. Cases and Cases under heinous section of law. But at present the Investigation of
cases by the ASIs have been restricted to Investigation of petty cognizable cases triable by
Magistrate of 1st Class or any other Magistrate. However the ASIs who have gained considerable
experience in investigating cases they may be allowed to investigate heinous cognizable cases and
cases triable by Court of Sessions.
Investigation of Cognizable Cases & Steps of Investigation
There are mainly two types of cases in Criminal laws, i.e., Cognizable Cases and Non-cognizable
cases. First schedule of CrPC describes cognizable / non-cognizable and bailable / non-bailable
offences. Besides, there are so many special Acts and local Acts where some offences are identified
as cognizable offences. Investigation relating to Cognizable Cases starts from the filling of First
Information Report at Police Station as per 154 CrPC and it ends in submitting report in Final Form
U/S173 CrPC General Steps of Investigation are identified as follows:
1. Registration of FIR (154 CrPC) and noting gist of the information in General Diary.
2. Endorsement of the case by OC of the PS.
3. Starts specific action in respect of Investigation and documentation (CD writing).
4. Consult available PS records about crime and criminals such as i) Crime map ii) VCNB iii)
Active criminal list iv) Criminals photo album etc.
5. Departure for the PO with force and necessary investigation kit.
6. Arrival at the PO and safeguarding PO by guarding it from any other disturbances.
7. Inspection of PO (Scene of Crime management):
a. Close observation of PO:-
i. Entry point & Exit point of the offender.
ii. Traces and clues left at the PO by the offender.
iii. Probable ways, how the crime was committed.

b. Sending injured to the Hospital for treatment along with proper requisition.
c. Photography of the PO showing visible traces and clues, weapon of offence and person
and property attacked.
d. Preparation of rough sketch map along with explanatory index with scale in separate
sheet.
e. Intimation to Finger Print/FSL expert for PO Visit (if necessary).
f. Search, seizure, labeling and packing of ALAMATS (Exhibits).
g. Surathal/ inquest to be done in respect of any dead body found at the PO.
h. Sending exhibits to the forensic expert through Court.
i. Sealing of PO (if necessary).
8. Examination of witnesses / Victims (161 CrPC as amended) Judicial statement of
Witnesses/Victims (164 CrPC) when they are willing to give statement judicially.
9. Engagement of sources.
10. Electronic data analysis (if necessary)
11. Arrest of accused and suspects (Amended 41 CrPC) and next:
a. Arrest memo- cum- inspection -memo to be done of the arrested person.
b. Interrogation and recording their statement (161 CrPC).
c. Medical examination of the arrested accused.
d. Forwarding them to the Ld. Court with prayer for remand (if necessary).
e. Search and seizure leading from the statement of the accused/ suspect.
f. Sending accused/suspect before the Court for recording their Judicial Statement (164
CrPC).
g. Test Identification Parade of the arrested accused and property (if necessary) but
preferably be done before taking arrested accused in Police remand.
12. Analysis of the statements recorded.
13. Obtaining expert opinion.
14. Consult OC of the PS and other superior officers.
15. Submission of report in final form and closing of Investigation as well as CD (Case Diary).
16. Intimation to the informant/complainant in writing about the submission of final form
without delay.
Checklist for Investigation
1. FIR sets the investigation into motion and it should be done in accordance with the
provisions of Section 154 CrPC to 176 CrPC.
2. IO must go through the FIR thoroughly.
3. Informant must be examined once again and his/her statement must be recorded keeping in
mind of the missing link of evidences, which were absent in the FIR.
4. Criminal Photo Album and other relevant records such as Crime Map, V.C.N.B., Active
Criminal List, etc. should be checked properly before departure to PO to trace the suspects.
5. The place of occurrence should be visited as quick as possible and it should be guarded
properly.
6. Proper photograph and observation of the PO are needed for locating the traces and clues
which will help the investigator to link victim with the Scene of Crime and suspects.

7. Rough Sketch Map by using scale is mandatory and it would have to be prepared
maintaining directions and the approximate relative distance and length between the
objects which are found in the PO and the relative distance of the PO should be fixed from
a static point. Index in respect of Rough Sketch Map must be done in separate sheet of
paper.
8. Seizure should be done after marking the articles and packing with proper labeling in
presence of seizure witness in the PO. A copy of the seizure list must be supplied to the
accused person at the time of seizure or owner/ caretaker of the premises. Subsequently,
statement U/S161 CrPC of seizure witness/es should be recorded.
9. Statement of credible witness must also be arranged for judicial recording U/S164 CrPC
10. Collection of physical evidences should be done with utmost care and in proper way.
Packing should be done and sent to Forensic Science Laboratory mentioning specific
questions for examination through the Ld. Court duly forwarded by the superiors.
11. Statement of the witness should be recorded at the place of occurrence(other than
exceptional cases) if available and it should be reproduced in the Case Diary as well.
12. After arrest of the accused, if investigation is not completed within 24 hours, the accused
must be forwarded to Ld. Court with report. During the detention of the arrested accused in
Police custody, if required statement u/s 161 CrPC may be recorded.
13. TI parade of the arrested accused may be done, before taking the arrested accused in Police
remand.
14. Case Diary should be written from time to time and it must be in duplicate. Carbon copy of
the same must be sent to the Circle Inspector or Inspector-in-charge of PS on the next day,
for his/her immediate supervision into the investigation of the case.
15. Expert opinion on examination of Alamats examined by Expert should be collected and
the same to be tagged in the Case Diary.
16. Name of the experts such as Medical officer, Autopsy Surgeon, Hand writing expert etc.
must be in full (Exp- Nimai Ch. Das). With full office address and residential address.
17. During investigation when the primafacie charge is established against the accused persons
and apprehension of his escape or distorting of evidences appears, arrest be made u/s41
CrPC.
18. After completion of the process of investigation, departmental Superiors must be consulted
with such progress of investigation of the case and if approved, the case may be ended in
the final form i.e. Charge-sheet, Final Report as True, Final Report as False, Final Report
as Mistake of Fact, Final Report as Mistake of Law etc., subject to the evidence found
during investigation.
19. Information to the informant in writing is mandatory after submitting report in Final Form.
20. Final Form should be forwarded by the appropriate authority and it should reach the
jurisdictional Court without unnecessary delay.
21. Making Copy of A Form for supplying to the Accused person during trial is mandatory
and it is required for easy copy supply process.
22. Khatian Register should be filled up properly by the IO time to time on his part.
23. Challan of case docket should be kept in the Challan Receipt File.

CHAPTER-II
REGISTRATION OF CASES
Registration of formal FIR u/s154 CrPC sets the investigation into motion. Generally,
formal FIR is filled up by the Officer-in-charge himself or by any other officers acting under his
direction as soon as he receives any oral or written information or otherwise relating to the
commission of a cognizable offence. FIR is also drawn u/s156(3) CrPC when the complaint is
submitted before the Court and when the Court sends the complaint to the O/C of a Police Station
for starting a case.
Checklist for Recording FIR:
a. FIR should be recorded without any delay.
b. FIR can be written or oral. In case of oral statement the same must be reduced to writing by
the Officer-in-Charge himself or by his direction. In that case it should be read over to the
informant and get signed by the informant on the same.
c. FIR should be a truthful account neither minimized nor exaggerated and nothing should be
inserted after FIR is drawn.
d. Once FIR is drawn it cannot be cancelled.
e. FIR can be quashed by the High Court only when the ingredients of the complaint are found
to be Non-Cognizable in nature.
f. FIR should be simple and in plain language, time of occurrence, place of occurrence,
modus-operandi, values of properties stolen or damaged including special identification
marks and mentioning injuries should be depicted properly with name of witnesses.
g. Informant should always write his name and address clearly in the body of FIR and if he is
available in the PS, his signature should be taken in the formal FIR, which will help in
contradiction and corroboration during trial.
h. Copy of FIR should be given to the informant free of cost without delay.
i. Original FIR should be sent to court without delay and preferably within next 24 hrs. Delay
in sending FIR to Court may be considered as a negative point during trial.
j. Copies should be sent to the CI and SDPO immediately.
k. Formal information of the recording of the FIR should be given to the superiors as soon as
possible.
Refusal to register FIR in a cognizable offence/ case is now punishable U/S166A IPC, as per latest
amendment.

CHAPTER-III
CONSULTATION OF CRIME RECORDS
Its the duty of the IO to consult the available records of the PS for getting some idea about the
crime. In this respect he may consult the following Crime Records of PS:
a) Crime map
b) Khatian Register
c) Village crime note book
d) History Sheets
e) Surveillance Register
f) Dagi visit chart
g) List of Active criminals
h) Criminals photo album
i) Crime chart
j) List of Bordering criminals
k) Crime Records of similar crime incidents.
In case of offence against property where complainant/witness got a chance to see the faces of the
offenders he may be shown the photo albums to identify the offenders. Before leaving the place of
occurrence IO should get acquainted himself with the following information from available Crime
Records. This will help the IO to unearth the truth in initial stage of investigation.
a) Similar past crimes in the area or neighborhood.
b) The criminal those who are active in those areas.
c) The number and pattern of similar cases that have occurred in the jurisdiction of the police
station previously from the crime map.
d) Names of bad character reside in and around the area.
e) Known criminals or gangs operate or have operated in the area in the past.
f) Any crime of a similar modus operandi occurred or continues to occur in the locality and if
so at what distance.
g) Whether the crime has occurred in the border region with the neighboring Police Station or
not.
h) Whether the area is vulnerable due to its topography or not.
i) By continuous cell monitoring and tracking of the criminals helps in detecting the crimes.

CHAPTER-IV
INSPECTION OF PLACE OF OCCURANCE
After the registration of the case, the case is endorsed to an IO for investigation. The IO has to
proceed to the PO for investigation. Before proceeding to the PO the IO should carry Investigation
Kit box. IO should mention the same in GD and CD. In case when the PO is extended, a team may
be formed with proper direction for effective visit of PO.
Checklist for Investigation Kit Box:
The following necessary articles/ tools should find place in the Kit box:
a) Stationery items such as papers, carbon sheets, envelops of different size, gum, adhesive
tapes, measuring tape, scale etc.
b) CD book, Seizure list book etc.
c) Photography kit.
d) Match box and candles
e) Torch lights
f) Magnifying glasses and hand gloves.
g) Sealing wax with IOs seal, stamp pad PS seal etc.
h) Ropes for barricading the SOC.
i) Glass containers and glass tubes. Etc.
In addition to these EDTA tubes, finger print detection kit, drug detection kit may be kept.
After reaching at the Place of Occurrence it is the duty of the IO to identify it and thereafter to
guard it. It is desirable that PO should be visited in presence of at least two independent witnesses.
IO must take photograph of the PO from different angles. PO should be visited minutely, as PO
may tell a lot of story related to the offence. All physical traces and clues available in the PO
should be identified and seized, if necessary. The PO may be examined by the Experts if required.
Rough Sketch Maps with scale and index in separate sheets of papers should be prepared after
visiting the PO.
Checklist for Place of Occurrence (PO):
1. Fixing Entry point & Exit point: IO should fix the entry and exit point of the offender
by visiting PO carefully. In theft/dacoity and other offences related to property, entry and
exit point should be identified properly.
2. Discovery of traces and clues: Traces and clues left by the offender at the PO will
connect crime with criminals.IO may collect fingerprints, footprints, hair, blood, other
biological stains and any other materials related with the crime, from PO by observing
crime scene with scientific approach. This may help the IO to identify the criminals.
3. How the crime was committed: IO should ascertain the ways of crime and i.e., how
the crime was committed in order to discover traces and clues and to identify offender as
well by applying his mind with scientific approach.
4.Condition of victims of Crime: IO should recognize the condition of victim, whether
alive or dead, nature of injury and type of weapon used and making arrangement for
sending the injured to hospital at the time of entry into the place of occurrence under proper
requisition, as delay may reduce his/her chance of survival.
5. Photography of Crime Scene: IO should fix the angle and objects of photography,
found at crime scene from different angle, i.e. close range snap and long range snap etc.
after placing scale.
6. Preparing Sketch Map of the P.O with Index: IO should think about the objects of
surroundings of PO which should be included in the Sketch Map in one page and
explanatory index in separate page.

CHAPTER-V
PHOTOGRAPHY AND DRAWING OF SKETCH MAP
Photographs and sketch map with explanatory index of crime scene are recognized as vital
evidences for a case for the following reasons:
1. This evidences help to fix the place of occurrence beyond doubt.
2. These evidences convince the judges about the nature of PO, its surroundings and
truthfulness of the report of IO about the PO and exhibits collected from the scene of crime.
3. These evidences may help the IO as well as experts to discover any important points which
have not been noticed by the IO during crime scene inspection.
Checklist for Photography of PO:
1. Photos should be taken from different angles and from different levels. Both the closer
and the longer views should be taken to prove the approximate and relative distance
between the two objects, available in the Place of Occurrence.
2. It will be better to take photographs not facing the sun or direct source of light.
3. Photograph should be taken by placing the scale and marking direction of the
photographic objects.
4. Statement of photographer u/s161 CrPC should be recorded for keeping it in the Case
Diary.
5. Seizure of Photography with negatives/ chip (One chip for one scene of crime) should
be preserved properly for producing the same in the Court of Law.
Checklist for Rough Sketch Map:
1. To fix the objects, connected with the crime which has utmost importance to show
the same in the sketch map.
2. To fix the periphery of the PO for showing the same in the sketch map by indicating
the scale.
3. To prepare the rough sketch map with index. Index should be made in a separate
sheet of paper showing the objects separately with direction and description.
4. To prepare Rough Sketch Map accurately as possible.
5. To keep the Rough Sketch Map and Index of Sketch Map in the Case Diary
positively.
6. The description of the Rough Sketch Map should be mentioned in the Case Diary.
7. Index of the Sketch Map should be mentioned in the Case Diary in separate sheet of
paper.

CHAPTER-VI
SEARCH, SEIZURE, LABELING AND PACKING OF EXHIBITS
Search can be done in several ways. During search observation of I.O is very much needed.
Observation can also be done through spiral method, stiff method and grid method or zone methods
etc. A team of officers may be formed to search the PO when the same is spread in large area. In
that case zone method of searching is considered the best one. Name of the officers for each
assigned zone must be noted to maintain transparency. At the time of observation the I.O. should
search for evidences at the Place of Occurrence. It is essential for every investigating officer to
know how to search for the clues at the spot, how to seize them, handle, label, pack them, where to
send them and how to preserve their integrity throughout the investigation. Any mistake at any
stage of investigation, may lead to the loss of merit of evidences. The manner in which an article is
seized, packed, labeled, sealed and dispatched should be noted in full in the case Diary. I.O. should
remember that every step of investigation has to be proved before the court, during trial in order to
establish the identification and genuineness of the exhibits.
Observation of the place of occurrence is the main step of investigation. It helps to tag the crime
with the criminals. For the detection of the case IO has to watch the Place of Occurrence minutely
and then to analyze it in the case Diary.
Checklist for Seizure:
1. IO should prepare three copies of seizure list by placing carbons at the Place of Occurrence.
2. Seizure list will reflect the Case References/GDE References.
3. Date, time and place of seizure should be properly mentioned.
4. Seizure from whom is made should be incorporated in the list.
5. Names and address of the witnesses should be written in the seizure list.
6. Articles seized should be properly mentioned, i.e. the position and description of the articles
should be properly reflected in the Seizure List.
7. Signature of the witness should be in the seizure list.
8. Signature of the person from whom the articles is seized will be in the left margin of the
seizure list.
9. Always supply a copy of the seizure list to the person from whom the articles were seized.
Whenever an article is seized, it is the Court`s property and so the original seizure list is
always sent to the Court immediately and the duplicate copy of the same will remain in the
case Diary. Reference of such seizure must be laid down in Police Station General Diary
Book as well as Property Register of the PS.
10. Labeling and sealing of the articles to be done after the seizure list is completed. Label
should contain the signature of the witnesses and also the accused or from whose possession
the article is seized. Labeling must be done at the place of seizure in presence of seizure
witnesses.
11. Signature of the IO mentioning date and time and the place (camp at) should be at the
bottom in the right edge of the Seizure List.
12. Notice should be issued to the informant / witness for producing the document and article as
per the provision of Sec 91 CrPC.
Note on Handling of Exhibits: On arrival at the spot the IO should take steps to preserve all
visible and significant clues. Dead body should be dispatched for post mortem examination

immediately after the inquest. Movable articles should be handled as little as possible so that no
clue is lost or damaged or its relative position disturbed. In certain cases positive clues are finger
prints, blood stains on weapons of offence or hair adhering to blunt instruments etc. Due care also
be taken not to obliterate any clues like finger prints by careless handling of fixed objects like
polished walls, doors, windows , handles and fastenings.
Flat objects like piece of wood or glass sheet only the edge should be hold for lifting the same. A
fired projectile or empty case should be lifted only with rubber tipped forceps. Paper, hair, fiber,
small pieces of glass or any small solid objects should be lifted with forceps. Dust or other
powdered substances should be collected with brush or spoon. The explosive substances should not
be touched; Bomb disposal squad should be called for it. Blood from pool of blood, vomit,
chemicals are collected by a spoon. Control samples should be collected accordingly.
Seizure: After locating any discriminating article, the same should be seized by the IO in presence
of at least two disinterested and respectable local witnesses. Seizure should be done by preparing a
seizure list duly signed by witnesses and a copy of the same should be handed over to the
offender/accused person positively, and also to the person in charge of the place. If anything
collected in a case without proper seizure list, the same will be inadmissible before the Court.
Labeling and packing of exhibits: Collection of exhibits is to be done with utmost care and
protection. Investigation officers should always wear hand gloves and put mask on the mouth while
lifting the exhibits. During lifting of exhibits IO should lift the same in such a way that all the
finger prints and other relevant things remain unchanged. Packing should also be done carefully
and it should be sealed for authentication. Poison, acid, etc. should be packed in glass container and
the blood stains should be taken in plain cotton gauge or filter paper and it should be dried up in
normal room temperature and pack the same in paper envelops. On requisition of IO, Biological
sample are collected by Doctors in EDTA containers for sending it to FSL or CFSL. The signature
of the accused and the witnesses should be in the label. Case Reference/ GD Reference should be
mentioned on the label for authentication of seizure. The label should be done in presence of
witnesses during seizure at the spot and it should be packed properly. Label should be made in
white paper and it should be affixed / kept in the sealed packet. Label is generally made in two
copies and one copy is affixed with the exhibits and another to be kept with case dairies for
corroboration during trial. The exhibits whenever packed should be lac sealed.
Checklist for Packing of Exhibits:
a) Seized article should be labeled and packed properly in the place of occurrence.
b) The front side of the sealed packet should contain the name and address of the institution
where the articles to be sent.
c) The exhibits packet to be lac sealed.
d) The lac seal should be authenticated in the Forwarding Memo (Exhibits Form).
e) The packing should be done carefully so that the label of the exhibits may not be missing or
tear apart when the same will be opened for examination.
f) The packing should be done in such way that the exhibits inside the packet should remain
tight and undisturbed.
g) The packing material will vary depending upon the nature of exhibits.
h) The packing of exhibits should be handled with utmost care and attention.
The exhibits after packing and sealing needs to be sent to the expert for examination and opinion.
In this connection, specific forms should be filled up by the IO.

Checklist for Filling Up of Exhibit Form/ Forwarding Note:

1. The Exhibit Form should be filled up describing the Case reference and the name of the PS.
2. The fact of the case should be narrated clearly on the first page of the Exhibit Form, so that
during examination the Expert gets an idea about the fact and circumstances of the incident.
3. Description of the articles should be crystal clear in the second page of the form mentioning
the chronological numbers of the exhibits.
4. Nature of examination required should be clearly mentioned at the bottom of the second
page of the Exhibit Form.
5. Any other points of interest should be the last point in the forwarding note where the
expert may express any opinion in the interest of the investigation.
6. The names of the criminals and their custody place should be mentioned in the third page.
7. The metal seal used during labeling and packing should be affixed on the 3rd page.
8. Authentication certificate should be given on the 4th page and it should always be given by
the Magistrate/ Superiors.

CHAPTER-VII
EXAMINATION OF WITNESSES AND INTERROGATION OF ACCUSED
Examinations of the witness are done as per 161 CrPC generally; the IO of the case examines the
witness and records the statement in a separate sheet of paper. A replica of the same statement is
also written in the body of the Case Diary. The Prosecution will rely upon the statements recorded
by the I.O. during investigation. During trial Public Prosecutor uses the statement recorded U/S161
CrPC to corroborate the facts. The same statement which was recorded by the I.O will be supplied
to the defense before commencement of trial. On requisition by the I.O magistrate also records the
statement of witness as well as accused according to U/S164 CrPC, provided they are willing to do
so.
(1) Section 164 CrPC relates with the Magistrate. When a confession is given in front of the
Magistrate or the statement which is recorded by the Magistrate U/S164 CrPC any
Metropolitan Magistrate or Judicial Magistrate may, whether or not he has jurisdiction in the
case, record any confession or statement made to him in the course of an investigation under
CrPC or under any other law for the time being in force, or at any time afterwards before the
commencement of the inquiry or trial. Magistrate may record the statement of the accused
under section 164 CrPC audio-visually in presence of advocate of the accused. Police must
not be present at the time of recording of confession of the accused/witnesses before
Magistrate. Before recording of confession, no inducement, threat or promise is made by the
Police Officer to the accused/witness.
(2) The Magistrate shall, before recording any such confession, explain to the person making it
that, he is not bound to make a confession and that, if he does so, it may be used as evidence
against him; and the Magistrate shall not record any such confession unless, upon
questioning the person making it, he has reason to believe that it is being made voluntarily.
(3) If at any time before the confession is recorded, the person appearing before the Magistrate
expresses that he is not willing to make the confession, the Magistrate shall not authorize the
detention of such person in police custody.
Checklist for Recording of Statement U/S161 CrPC:
1. Statements should be recorded in separate sheet of paper & it must be attached with the case
Diary.
2. No threat, inducement, promises can be made by the Police Officer while recording the
Statement.
3. Signature of the witness must not be taken in the Statement.
4. Statement must be recorded in the same language and dialect made by the witness.
5. Statement must be brief, proper and to the point.
6. Statement must be read over to the witness.
7. Statement must be written in the body of the Case Diary in Toto.

8. The date, place and the time of recording must be written at the right bottom end of the
statement as well as in the body of the Case Diary.
9. Regarding sexual offences, the statements of victim must be recorded by the Women Police
Officer at the desired place and time of the victim in presence of her guardian. In case of
mentally or physically challenged victim, the statement must be recorded with the help of
an interpreter or special educator.
10. Statement also is recorded in Audio- Visual method.
11. Much delay of recording statement should be avoided.
12. The witness whose statement was recorded judicially u/s 164 CrPC should be given special
attention.
13. In the event of summoning witness a notice u/s 160 CrPC should be given except female,
child under 15 years of age and senior citizen aged above 65 years of age.

CHAPTER-VIII
ELECTRONIC DATA ANALYSIS AND DETECTION OF CRIME
Presently Cell Phone, as an electronic communication device plays an important role to commit
crime as well as to break through the crime. Call Data Analysis of the cell phone, used by the
criminal, helps IO to gather various information about crimes and criminals. Call Data Report can
provide the following information:
1. Name address and other details of the subscriber.( From Customer Application
Form)
2. Date, time and duration of the call.( From Call Data Report)
3. The financial status of the subscriber. (From Monthly Bill).
4. The location of work place. ( From Tower Location )
5. Location of subscriber during night etc. (From Tower Location).
6. From tower dump analysis we can track the offender also.
7. The direction of coming/fleeing away of offender can be traceable from CDR
8. Association of offenders can be tracked out.
and many other important clues can be traceable by proper analysis.
During investigation of kidnapping / human trafficking cases tracing tower location of the cell
phone of criminals and call data analysis of the same can play an important role to rescue the
victims and to apprehend the criminal as well. So, IO should gather professional skill to analyze the
call data report of Cell Phone of accused / suspects. Considering the importance of Call Data
Analysis of Cell Phone of criminals during crime investigation, a special unit titled as Call
Monitoring Cell is established in every Police District. Call Monitoring Cell can provide the
subscriber details, tower location and call data report of a particular cell phone number to IO.
In Cell Phone Missing cases the IO can get the information about the user of the phone through
Service Providers. Service Provider can supply the required information by matching the IMEI No
of the cell phone. It may be mentioned here that usually the IMEI No of a cell phone has 15 digits.
If first 14 digits matched with the CDR (IMEI No) of the missing cell phones it could be ascertain
that the said missing phone has been used by whom.
In the event of Call Monitoring the strictest privacy is maintained both in district and state level. In
district level Superintendent of Police of the district is the nodal officer and the state level a
competent authority in the state intelligence branch is earmarked. In case of any prayer for tracking
calls are required by the district / unit, the same should be forwarded to the Home Secretary, Govt.
of West Bengal by the unit in-charge / nodal officer through the competent authority of state
intelligence branch for obtaining necessary approval.

CHAPTER- IX
MANAGEMENT OF SOURCE / AGENT / INFORMER
Criminal Intelligence means management of source / agent / informer for prevention and detection
of crime and maintenance of law and order. Police officer especially the investigating officer must
maintain source/agent/ informer for collection of information in respect of criminal liability of
offender, his whereabouts, recovery of stolen property, recovery of other exhibits in connection
with a criminal case. The Investigating Officer is not legally bound to disclose the identity of
sources, neither to the Court nor any other authority.
General Principle of Management of Source/ agent / informer:
1. They should be properly selected.
2. Any individual irrespective of his/her trade, profession may become source for a single
occasion or permanently depending upon the skill of the Police personnel.
3. They should be properly guided by Police and maintained under cover.
4. They should be properly paid through source money as per prescribed procedure.
5. They should be utilized for intelligence network.
6. Their information should be verified/cross- checked before taking any action.
7. They should be dealt with care and caution.
8. They should not be misused for any non-professional purposes.
9. Female sources should be maintained carefully and intelligently as they appear to be vital
source for breakthrough in investigation.
10. They should not be given false assurance.
11. IO should not express his dependence or any type of compulsion on sources.
12. IO should not express his strategy before source.
Criminal Intelligence: Use of Electronic Devices:
Modern era is by and large controlled through electronic devices. Cell Phone Monitoring is
presently done by different Investigating agencies for the detection of the crime. Surveillance upon
a particular person through call monitoring mechanism requires the order of Home Secretary of the
State. Police officers monitor the cell phones or electronic gadgets to track out the movements of
criminals to establish their contact with co-accused / gang members and to discover the stolen
property with its location. Police Officer should be user friendly with electronic devices and
technique with scientific approach and develop skill for collecting criminal intelligence. This call
monitoring mechanism has replaced the role of manual source a greater amount, though a
combined effort is advisable for a total success. Sometimes call monitoring mechanism also proves
effective to keep track on the manual source/agent.

CHAPTER- X
ARREST AND REMAND
Arrest means curtailment of ones fundamental rights. Arrest is an act of depriving a persons
liberty usually in relation to the purported investigation or prevention of crime and presenting the
arrestee before Court as a part of the criminal justice system. The term Arrest is Anglo-Norman in
origin and is related to the French word arrt, meaning "stop".
The arrest can be made by a citizen, a police officer or a Magistrate. The police officer needs to
inform the person being arrested the ground of arrest and that he is entitled to be released on bail if
the offence is bailable. Arrest memo cum inspection memo must be prepared while arrest is being
made. Police can arrest with the help of warrant and without warrant also. A Police Officer can
arrest a person without warrant in the following circumstances:-
1. Police officer must exercise the power of arrest
A. After reasonable care and Justification in case of arrest without warrant under following
manner:-
a) Above seven years of punishment.
b) Below seven years of punishment.
i) In presence of Police officer if offence committed.
ii) In other matters only a) for proper investigation b) tampering evidence c)
witness threat d) Probability of disappearance from jurisdiction e) prevention
from further offence [Ref Sec 41 CrPC]. Arrest u/s41/109/110 CrPC could not
be done.
B. Below seven years of punishment if the above noted circumstances do not exist, Police
officer has to give notice [Ref Sec 41 A- CrPC].
C. Arrest Memo and inspection Memo has to be prepared [41 B CrPC].
D. Police control room has to be established [41 C- CrPC].
E. Arrestee may meet lawyer during interrogation but not throughout interrogation [41 D-
CrPC].
2. When a person commits the offence of house breaking,
3. When a person is proclaimed as an offender by the competent authority,
4. When a person is suspected to be in possession of stolen property and is suspected of having
committed an offence concerning the property in his possession,
5. When one obstructs a police officer while he executes his duty or when one has escaped or
attempts to escape from lawful custody,
6. When there is a reasonable suspicion of being a desert from any armed forces of the Union,
7. When a person has committed any act out of India and it is punishable in India and that he is
liable to be extradited or detained in custody in India,
8. When a released convict commits a breach of any rule that he has to abide under the law.
Checklist for before & after arrest:
1. Before arresting a person, guidelines of the Honble Supreme Court of India regarding arrest
should be kept in mind and followed properly.
2. Special care to be taken while arresting a woman or child.
3. During custody of the arrested accused/remand accused no ill treatment is allowed as per the
guideline of the Honble Supreme Court of India.
4. Section 41 A of CrPC is to be complied with.
5. Handcuffing rules to be kept in mind and obtain permission for the same from the Ld. Court, if
time permits. In the event of scarcity of time, reasons behind hand cuffing must be noted in the

report sent to the Ld. Court the same should also contain in GDE. In case of Remand accused,
permission from the Ld. Court is must for handcuffing.
6. Custodycum-arrest memo and inspection memo should be properly filled up. Previous
injuries of the arrested accused must be mentioned in the arrest-cum-inspection memo.
7. Car Diary should be maintained accordingly with mentioning of places.
8. Personal diary should be maintained accordingly.
9. GDE should be properly written in respect of the arrest.
10. In the event of arrest by officer of the PS, must be informed to the I/C or O/C immediately.
11. Be cautious while taking police remand and the forwarding report of accused person should
carry recommendation of superiors.
12. Medical examination of accused should be conducted as per law.
13. During police remand care should be taken regarding the medical examination of the accused.
14. Proper supply of food and water should be incorporated in GDE as a matter of future
reference.
Remand. Magistrate allows remand of the accused to police custody on the prayer of IO under
section 167 CrPC when investigation is not completed within 24 hrs. The Magistrate allows remand
in such cases where there are really good grounds for it leading to the discovery of facts in the
interest of investigation.
Remand is given on the reasons mentioned below if the Magistrate thinks fit and proper. A remand
to police custody of an accused person should not ordinarily be granted unless there is reason to
believe that material and valuable information would thereby be obtained, which cannot be
otherwise obtained except the remand of the accused to police custody be granted.
Grounds for Police Remand:
1. For the recovery of offensive weapons/tools/stolen articles involved in crime.
2. For recovery of victim and dead bodies involved in the case.
Checklist for Police Remand:
1. The statement of the accused must be written in such a way that without the physical
presence of the accused his/her statement cannot be verified. Mere description of places is
not always sufficient to pursue the information given by the accused and thus role of the
accused for taking in remand is necessary to lead Police to the discovery.
2. The remand prayer must be forwarded and recommended by the superior police officers.
3. Remand is given by the Magistrate only for the interest of investigation leading to the
discovery.
4. Relevant Case Diary and statement of the accused must be sent along with remand prayer to
justify the grounds of remand before the Magistrate.
5. IO of the case should meet with the PP/APP to brief him the matter personally with all
relevant documents so that he/she can take the same with the magistrate properly at the time
of hearing on remand prayer.
6. If the accused needs to be handcuffed while being taken in remand, permission should be
taken from the magistrate beforehand against prayer.
7. In case, any discovery is taken place during remand period, the statement of the remand
accused should once again be recorded containing with recovered portion.

CHAPTER- XI
WRITING OF CASE DIARY
Writing of Case Diary is done under section 172 CrPC. It is written from time to time and step by
step commensuration with the GDE of the PS. It is treated like a mirror which reflects the progress
of investigation. It enables the Ld. Court to decide the merits of the case evidentially and senior
officers to guide and supervise the investigation. A case diary should consist of all relevant
documents viz. rough sketch map with index, seizure list, arrest cum inspection memo, forwarding
notes sent to the Ld. Court, etc. A trial court may use it as an aid to its proceedings during trial.
Case Diary helps the IO to refresh his memory at the time of trial.
Checklist for writing of Case Diary:
1. The case diary should always be written in the supplied prescribed forms.
2. The case diary should be always written in simple language.
3. The case diary should be written at least in two copies. (More copies for SR cases).
4. The case diary should cover all details of the investigation in its body such as rough sketch
map with index, statement of witnesses, description of seizure etc.
5. The synopsis of day to day investigation must be incorporated in the case diary.
6. Chain of custody of seized property must be incorporated in the case diary.
7. The case diary should be kept with utmost care and it should not be kept in an open place.
8. In no circumstances, it should reach to the hand of suspects/accused/defense lawyer.
9. Case diary should be paginated properly, a brief note of the case should be incorporated in
case docket which includes case reference, name of the complainant, date and time of
occurrence, name of the FIR named accused, name of the IO, details of seizure made, name
of the arrested accused with date etc.
10. A Memo of Evidence as per prescribed format should be incorporated with the case diary
to have a clear picture on the progress of investigation.

CHAPTER- XII
SUBMISSION OF REPORT IN FINAL FORM
At the end of the investigation IO should submit a report in final form as per prescribed proforma,
which is known as Police report. Police report is of two types Charge sheet & Final Report. There
is provision u/s 173(8) CrPC for re-opening /further investigation of a case after submitting report
in final form and also supplementary charge sheet can be filled when evidences collected by the IO
subsequently.
Final Report is of various types such as:-
1. Final Report as True: - When the fact is true, but due to lack of evidences the case cannot be
charge-sheeted.
2. Final Report as False: - When the fact is false. Prosecution u/s182 IPC or 211 IPC may be
initiated against the complainant after approval obtained from the Court.
3. Final Report as Mistake of Fact: - When the fact was not judged by the complainant and a
investigation was conducted upon his complaint due to his misconception upon which
investigation was conducted.
4. Final Report as Mistake of Law: - When the complaint has no legal basis.
5. Final Report as Non- Cog: - When the complaint is treated as cognizable information, but
the investigation discloses the fact of non-cognizable in nature.
When a case is ended in charge-sheet and placed before the Ld. Court for its trial, the trial Court
will frame the charge against the accused person from the evidences so far collected by the
Police. Trial is ended in conviction or acquittal of the accused.
Checklist for submission of Final form:
1. The final form must be submitted in triplicate copy in prescribed form.
2. The report in final form should consist the consecutive number with date and section of law.
3. The final form must be filled in simple language.
4. Charge sheet should contain the following information positively in respective columns.
a) Name and address of the complainant and accused.
b) Name and address of the witness including medical officer/ autopsy surgeon/experts/ IO
& RO of the case etc.
c) Description of seized articles.
d) Whether the accused are on bail/ jail custody/ absconding.
e) Synopsis of the investigation and evidences collected.
5. Final form of the case must be sent to the Ld. Court through the superiors without
unnecessary delay.

CHAPTER- I
INVESTIGATION AND PROSECUTION OF NON COGNIZABLE CASES UNDER IPC
OFFENCES
Non-Cognizable offences are such type of offences where police cannot start investigation, and
police cannot arrest without warrant. For investigation of non-cognizable offences police has to
take permission from the court. These offences are less serious. The 1st Schedule of CrPC denotes
the offences as cognizable or non-cognizable and bailable or non-bailable. The Non- Cognizable
cases are dealt with u/s 155 CrPC.
Checklist for Investigation and Prosecution of Non-Cognizable cases:
1. Gist of the complaint must be entered in General Diary.
2. The incident must be endorsed by the officer-in- charge of Police Station with necessary
direction to enquire into that matter.
3. The investigating officer must submit a prayer to the concerned court seeking permission to
cause investigation into a non-cog offence along with the copy of G.D.
4. The Investigating officer must collect the necessary order sheet from the Ld. Court before
commencing investigation of the alleged incident.
5. After receiving the order sheet for investigation from the concerned court, OC will endorse
it to the concerned officer for investigation.
6. During investigation the IO will take the following action :
a) Visit to PO.
b) Preparation of Rough Sketch Map with Index.
c) Recording statement of witnesses u/s 161 CrPC
d) Collection and seizure all available traces and clues from the place of occurrence
through a proper seizure list and will recorded statement u/s 161 CrPC of seizure
witness.
e) Collection of Medical Certificate if required.
7. Writing of the Case Diary may also be done for proving the process of investigation.
8. Every proceeding of investigation must be incorporated in the General Diary and Case
Diary.
9. The IO will submit prosecution report after consulting with O/C of the PS.
10. The prosecution report will duly be forwarded by OC and sent to Court accordingly.
11. The consecutive number of the prosecution report must be noted in the margin of General
Diary and in NCR Register.
12. IO should pursue for issuing summons from the court at the earliest and serve the same
without any delay for effective result.

SUBMISSION OF PROSECUTION REPORT UNDER SPECIAL AND LOCAL LAWS

There are specific provisions in special and local laws to secure arrest of a person without warrant
in non- cognizable offences. After investigating the same, police is empowered to submit NCR /
Prosecution Report against the offender.
Checklist for submission of Prosecution Report under Special and Local laws:
1. The police officer must make an entry in General Diary before leaving Police Station to
hold raids.
2. In course of performing the duty, the police officer will arrest the offender without warrant
where he is empowered to do so.
3. Memo of Arrest should be prepared accordingly and a copy should be supplied to the
arrested person intimating him the ground of arrest.
4. In bailable offence the offender should be released on bail. An intoxicated offender should
not be released on bail without medical examination at the earliest.
5. Details of arrest should be mentioned in General Diary.
6. IO should submit prosecution report after obtaining permission from the court.

CHAPTER- III
ENQUIRY AND PROSECUTION OF SECURITY PROCEEDINGS
Sections 107,109, 110 CrPC are the potential tools in the hands of the police officers. By dint of
these sections police officers submit prosecution to prevent the cog offences and by dint of these
prosecutions Jurisdictional Magistrate also exercises his power in furnishing bonds against a person
or a group of persons for maintaining peace and tranquility in the locality. Executive Magistrates
take cognizance of complaints by police report or on information otherwise as the case may be of
any probable incidence or apprehension of breach of the peace or disturbance of public
tranquility (Under Section 107 CrPC). This is essentially and exclusively a preventive section
which requires and empowers an Executive Magistrate to exercise power requiring a person or
group of persons to execute a bond for keeping peace for a period not exceeding one year or for a
shorter period as the Magistrate thinks fit.
Section 109 empowers an Executive Magistrate to take cognizance when there is reason to belief
that a person who by taking pre-caution to conceal his presence is likely to indulge in a wrongful
act with a view to committing a cognizable offence. The Magistrate in such case may direct such
person to show-cause why he should not be ordered to execute a bond with or without sureties for
his good behaviour for any length of time not exceeding one year.
Section 110 of CrPC empowers an Executive Magistrate to exercise power and to take cognizance
of a complaint when there is sufficient information before him that there is within his local
jurisdiction a person who is a habitual offender i.e. a robber, house breaker, thief or a forger or a
person who habitually protects or harbors thieves or renders help in storage or disposal of stolen
property or so desperate and dangerous as to render his being at large without security hazardous
to the community, commits or attempt to commit or abets the commission of the offence of
kidnapping, abduction, extortion, cheating etc. It is provided under this section that the Executive
Magistrate may proceed to require such a person or group of persons to show-cause why he should
not be ordered to execute a bond with sureties for his/ their good behaviour for a period not
exceeding three years at the maximum.
Checklist for Enquiry and Prosecution of Security Proceedings:
1. The information must be entered in General Diary.
2. The information must be endorsed by the officer-in-charge of Police Station.
3. The information must be properly investigated by the officer performing investigation after
obtaining requisite permission from the Ld. Court.
4. At the time of investigation, the rough sketch map of the PO should be prepared and
statement of the witnesses should be recorded.
5. After completion of investigation the Investigating Officer should diarize the entire pros and
cons of investigation.
6. Progressof the investigation should be intimated to the OC time to time.
7. After seeking permission from the appropriate authority /Court, the I.O. should submit the
Prosecution Report.
8. The prosecution report must reach the Executive Magistrate office after duly forwarded by
OC.
9. The corresponding Prosecution Report Number must be noted in the margin of GD and
GDE No in NCR register.

CHAPTER- IV
INVESTIGATION OF UD CASE
Unnatural Death Cases are also investigated by police officers. In unnatural death cases police
officers have to prepare SURATHAL report before sending the dead body to the earmarked morgue
for holding Post Mortem Examination by Medical Officer / Autopsy Surgeon.
Section 154 to 176 CrPC deal with the investigation of Cases. Amongst those sections, section 174,
175 & 176 CrPC denote Surathal or Inquest in all unnatural deaths. As per Sec 174 CrPC Inquest
can be done by police officers in the event of reporting of an unnatural death case. According to
section 176 CrPC the inquest of the following cases are done by the Magistrate:
i. Inquest for unnatural death of a bride within 07 years of marriage,
ii. Inquest for custodial death,
iii. Disinterring of a dead body from burial place,
iv. Inquest of an unnatural death case which is highly suspicious in nature.
As per section 175 CrPC the police is authorized to summon witness of inquest.
Checklist for investigation of Unnatural Death Cases:
1. The Duty Officer should inform OC of the PS immediately after receiving information of an
unnatural death case.
2. Unnatural Death Register should be properly filled up.
3. The Photograph of the deceased must be taken by the investigating officer from different
angles and range, videography may also be done.
4. The dead bodies have to be identified by the local witnesses preferably by relatives/ friends
/ local persons.
5. While preparing surathal report the investigating officer should maintain proper regard to
the departed soul of the deceased.
6. Surathal Report should be prepared in three copies and duly signed by witnesses.
7. Proper seizure list must be prepared if any seizure is made by the IO.
8. Questionnaires pertaining to post mortem examination should be mentioned in the challan
of the dead body. If necessary, sheet of paper containing the queries may be enclosed.
9. Command Certificate must be issued to the constable escorting the deceased from the place
of occurrence to the nearest police morgue.
10. Proper enquiry /investigation should be done by the Investigating officer, if required the
statement of the witness must be recorded u/s 161 CrPC
11. Post Mortem Report must be collected by the IO.
12. If no anomalies or ground of suspicion found in the Post Mortem Report, Final Report may
be submitted after consultation with OC of PS.
13. If any foul play is detected, separate specific case should be started on the basis of
complaint.
CHARACTERISTICS OF SOME KNOWN TYPE OF UNNATURAL DEATH CASES.
Suicidal Hanging: The victim suspends the whole body weight over a rope and the body weight
causes obstruction in the air pipe/ passage of the throat. Oxygen does not reach the brain and the
death occurs. Most of the victims of suicidal hanging belong to the age group of 11 yrs. to 51 yrs.

Analog period of hanging is from 03 to 05 minutes. In hanging, immense pressure falls on the
Vegus Nurve and for that reason the death occurs.
Signs:
1. Feet towards down, dripping of saliva may be present. It is the surest sign of anti-mortem
hanging. In post mortem hanging it does not occur. The dripping of saliva occurs due to
extreme pressure on the salivary gland.
2. The head will be tilted on the reverse of the knot.
3. Presence of oblique /high up / non-continuous ligature mark.
4. Presence of dotted non-continuous ligature mark and the ligature mark will be at the high
in the neck.
5. Eyes will be half closed.
6. Frothy substances may be out from the nose, mouth, and urine and stool may come out,
sometime semen may come out, and menstruation may occur in case of female.
7. The thumb will be inside bend horizontally and will come in touch of the palm.
8. The throat will be elongated.
Viscera are preserved generally. Viscera consists of parts of stomach, portion of liver,
two halves of both kidneys, intestine.
Drowning: Death occurs due to asphyxia in drowning cases. Water may be found inside the
stomach, heart and lunges in drowning case. Drowning may be suicidal or homicidal in nature.
Signs:
1. Washer man palm and feet will be observed.
2. Water will obviously pass through the thoracic wall and it will be present in the lunges and
in the heart and stomach.
3. Death clutch is often seen, Many particles can be found in the death clutch.
4. Wounds due to the bite of fish or any other animal may be found on the body.
5. Frothy substances will come out from the nostrils or from the mouth.
6. Eyes will be daring.
7. Heart can be stooped if drowning happens in very cold water, which is known as
hypodermis.
There are also other modes of Unnatural Deaths such as Poisoning, Burning, and Lightning
etc.

CHAPTER- V
INVESTIGATION OF MOTOR ACCIDENT CASE
MA (Motor Accident) Case Register is kept in all Police Stations. MA Case is registered on the
basic of such complaint where break down or running down of the motor cars or any other incident
by motor generated vehicle occurred within the PS jurisdiction. If any injury is caused in that
accident then the same is treated as specific case in accordance with the circumstances.
Checklist for Investigation on Motor Accident Case:
1. The information must be diarized and the same should be informed to the OC of the PS.
2. The MA (Motor Accident) Case Register should be filled up in duplicate and the 1st copy
should be sent to CI office immediately.
3. IO should visit the PO and photography should be done. Statements of the witnesses u/s161
CrPC should be recorded and the report of Motor Vehicle Expert should be obtained.
4. Medical test of the driver should be conducted.
5. Seizure of the vehicle along with all its concerned papers should be made.
6. Photocopies of all the seized papers including insurance certificate should be kept in the
file.
7. MVI Report along with all concerned papers to be sent to superior officers for obtaining
necessary orders.
8. Mechanical expert report should accompany with the final report to the office of SP of the
district for final disposal.
9. NCR may be submitted on the point of validity of papers of the vehicle if any; in case driver
of the vehicle is found responsible for damage, NCR u/s 427 IPC may be submitted after
proper order from the court.

u/s379 IPC Hero Honda Motor- Cycle there. He immediately searched for the Motor-
started. Cycle in the nearby areas, but he did not find the same and subsequently came
to PS and submitted a written complaint, which refers to Barasat PS Case No-
401/2014 Dated:- 01/08/2014 U/S379 IPC. The case was endorsed to SI Nikhil
Biswas by the OC of the PS. In this connection, R.T Message is being
transmitted to all concerned regarding the theft of the Motor-Cycle. Noted in

On 03.09.12 received a written complaint from one Himanshu Mallick s/o Bikash Bandhu Mallick
of Purba Ichapur, PO Kadambagachi, PS Barasat, Dist North 24 Parganas to the effect that, on
03.09.12 at about 14.30 hrs his father Bikash Bandhu Mallick heard some noise beside his house.
Accordingly his father came out from his house along with the complainant to know the source of
noise and found that two persons namely 1) Jalal and 2) Sirajul both fromthe same locality were
making noise. Father of the complainant told them to go from that place. Hearing this both attacked
the complainants father with fist and blows and pushed him from the back and as a result Bikash
Bandhu Mondal fell down on the floor of the courtyard and died on the spot. The complainant tried
to save his father but failed. He also sustained injuries out of fist and blows caused by the
miscreants. Both the accused had knowledge about the recent bypass surgery undergone by the
complainant`s father, so intentionally they gave blow on the chest.

I. HISTORY OF THE CASE:
One Giriraj Daman, Chairperson of Camerina (Camera stores) lodged a complaint that theft was
been committed in Camerina Barasat on Jessore road at the night of 30/31.10.13. During
investigation, it clarifies that the front shutter of the said shop is only tilted to 06(six) inches and the
outside annex locks were changed. The inbuilt shutter locks were good and after the arrival of
police the authorities of Camerina broke the lock and submitted the complaint.
Moreover, the shop possessed a CCTV camera which was in the night mode, but astonishingly the
miscreants stole away the DVR (storage unit) of the said CCTV Camera. The CCTV Camera was
nabbed with one internet BSNL broadband connection through fixed I.P. address 117.218.11.41 by
which the owner of the stores can see from anywhere of the world what was actually going on
inside the stores. While I stepped inside the stores after breaking open the annex lock I found the
BSNL broadband Modem in working condition. I straightly unplugged the connection for sending
the same to the CFSL Kolkata for querying that when the jack of CCTV DVR was unplugged from
the said apparatus.

and from the Criminal Photo Album it came to light that his name is Sk Aktar and he is wearing a

(9732529009) of the alleged accused whose name is Sk Aktar. IO ascertained that the subscriber

Tower Location: Tower location comes in a crude form, IO decodes the tower location from
Tower Dumps and it come into the above mentioned table. Tower Dump is usually supplied by
each Service Providers to the District Police Head Qtrs.
IMEI No- It is the unique number of a cell phone. It always remains the same. If a mobile is lost
one can track the mobile through IMEI No or through IMEI search. From the above noted CDR the
IO of the case decoded the Tower Location and it reflects that initially the tower was located in
Barasat Railway Station. Thereafter the tower location changes to Colloney More - Helabottala -
Amdanga and finally at Ashoknagar. In the aforesaid case the accused Aktar was arrested from
Palpara, Ashoknagar and the stolen Hero Honda Motor Cycle was also recovered from a ditch near
Pantapara, Ashoknagar. Seizure list was also prepared by the IO and it was also attached with the
case docket. For more details IO may analyze this CDR through PIVOT Table. Through PIVOT
table IO can easily ascertain the numbers where the accused i.e. Sk Aktar has communicated and
how many times.

aforesaid accused had committed this crime. The stolen Motor Cycle was recovered from a

jungle under jurisdiction of Amdanga Police Station. So, for the recovery of the said
Number Plate and for the sake of investigation at least two days Police Remand is
necessary.
So, I pray that 02 (two) days PC may kindly be granted to the arrested accused for

17. Brief facts of the case: The fact of the case in brief is that on 01.08.2014 at about 08.30 hrs a Hero Honda, Red
Colored Motor Cycle bearing No- WB34H-2459 was stolen by some unknown miscreants from Coloney More
Crossing under PS Barasat, on the basis of written information the owner namely Rama Kanto Mahato the instant
case was started. On endorsement I took up its investigation. During investigation, I visited the PO , examined
witness, recovered motor-cycle, arrested accused Sk Aktar placed him before TI Parade identified by the witness
and taken in Police Remand . During PC leading to his voluntarily confessional statement the number plates of the
Motor Cycle was recovered. The seized Motor Cycle was examined by the MVI & report was obtained. After
completion of investigation and consulting with my superiors, I am submitting Chargesheet vide Barasat PS CS
No-256/14 Dated: - 05/08/2014 U/S379/411 IPC as the primafacie case has been established against the accd. Sk.
Aktar; to stand trial in open Court of Law. The witness as mentioned in Col.14 may kindly be summoned as
prosecution witness during trial.

FORENSIC EXAMINATION AND FORENSIC INSTITUTION
Forensic science is the scientific method of gathering and examining information about the past incident.
The Forensic Science helps a lot to investigating agencies to link crime with criminal adopting various
methods. In Kolkata we have FSL & CFSL. There are four central forensic laboratories in India; these are
situated at Hyderabad, Kolkata, Chandigarh and New Delhi.
Forensic science laboratory is composed of different divisions of physical sciences:-
1. Physics Division: Examines tool marks, restoration of engine no. &chassis no., density gradient test
of different soil samples etc.
2. Chemistry Division: Examination of fire and arson, examination of adulterated fuel samples,
examination of different narcotic samples, Detection of Trap cases etc.
3. Ballistics Division: Examination of fire arms, cartridges, spent cartridges, bullets etc.
4. Biology Division: Examination of biological body fluid samples such as blood, saliva, semen etc.

At the time of conducting investigation it revealed that the said Ramakanto Banerjee is also bad in
nature and he has a probability to assault his elder brother regarding the possession of the common
passage. So the IO revealed from investigation that there is a chance of breach of peace in that area.
So he submitted prosecution U/S107 CrPC in order to maintain peace and tranquility in the area.

that on the morning of today (01/08/2014) at 07.35 hrs. altercation took place in-
between Hemkanti Banerjee and Ramakanto Banerjee regarding the using of a
common passage in between their houses.
I also came to know that the younger brother is aggressive in nature and at any
point of time there is a chance of breach of peace and tranquility by the younger
brother Ramakanto Banerjee. So as to bound him within law I submitted a
prayer before the Ld. Court I am submitting the prosecution after discussing
with OC Barasat PS u/s 107 CrPCvide Prosecution No- 261/2014 against the
accused Ramakanto Banerjee to bound him U/S107/116(3) CrPC.

disclose his identity. This led to suspicion. So
seeing no other alternative I arrested him
u/s42 CrPC. Latter on after being arrested he
disclosed his name and identity as mentioned
in Col. No- (3) of this NCR and he also
disclosed that he came to Pipulpati area last
night with a view to commit theft at any of
the closed shop at that particular area.
Under the above circumstances in
anticipation of the kind order of Ld. Court, I
do hereby submitting prosecution against the
accused person noted in Col. No- (3) of this
NCR u/s109 CrPC and Ld. Court is hereby
prayed to direct the above noted accused to
execute a bond for his good behaviour for the
period as the Ld. Magistrate may thinks fit
and proper under same section of Law.

UNNATURAL DEATH CASE
COMPLAINT (Exp):- Fact is that Mr. Surajit Bose was found hanging in his house at Chinsurah
Gharimore, Hooghly and the said complain is given by his son namely Mr. Asutosh Bose.
Details of the Complaint will be:-

Subj:- Unnatural Death of hanging.
Sir/Madam;
I, Shri Asutosh Bose (H/M32yrs) S/O Lt. Mr. Surajit Bose of Gharimore, Chinsurah,
Hooghly, West Bengal want to state before you that my father Mr. Surajit Bose (H/M 67 yrs retd.
Govt. Employee) S/O Lt. Kalicharan was found hanging in his own room. On today morning
(12/05/2013) at 06/35 hrs while, I along with my brother were going to the tea table then we found
that my father was absent. Out of curiosity, I told my brother to see our fathers room and he saw
that the room was locked from inside. We called many-a-times, our father gave no reply and we
broke open the door and found my father was hanging. My father was a patient of cancer and the
treatment was going on.
If you kindly look into this matter and take legal steps in this regard then it will be helpful.

After that ASI Hemanta Bose of Chinsurah Police Station rushed to the place of occurrence i.e. the
house of the deceased, the house of said Mr. Surajit Bose of Chinsurah, is at Gharimore. And the
dead body was found hanging in the 1st floor extreme eastern side room of the dwelling house of
the deceased. The lock of the said room was broken from outside and the bolt in the inner portion
of door was broken as because the force had been applied from outside. ASI Hemanta Bose then
inspected the room of the deceased very carefully. He searched all the traces and clues which were
availabel in the Place of Occurrence and then he searched for the suicide notes if there is any in the
Place of occurrence. Here in, ASI Hemanta Bose took photographs of the place of occurrence from
different angles both from the closer view and long short was also taken, he then guarded the place
of occurrence and started to perform Surathal report or the inquest report.

5. Details description of the body:- I, ASI Hemanto Bose of Chinsurah Police Station being
accompanied by Const/2014 Sumanto Basak in proper daylight started to perform inquest
over the dead body of Surajit Bose (H/M 67 yrs retd. Govt. Employee) S/O Lt. Kalicharan
of Gharimore, Chinsurah, Hooghly, West Bengal after proper identification of the deceased
and after paying proper homage to the departed soul. The dead body was found hanging in
his own room of his house. The apparent weight of the body is 62 kilos and the dead body
was found hanging in the fan. The height of the room from the ceiling to floor is 14 feet and
the fan in near about one and half inches away from the ceiling and the rope is fastened in
the fan from which the head is two inches below and then the feet is near about four inches
above. An aluminum ladder was just behind the body in the floor lying in the folded
condition. The deceased is near about five and half inches in length. The body is fastened
with a jute rope with the fan and in hanging position. The hair is curling and clean shaved
and forehead is long and the eyes are partial closed. The nose is big and the mouth is open
and the saliva is coming out from it and it is dripping down the floor through the middle of
the belly and the body. The body is tilted towards the left. The knot is on the right side. The
hands are half clutch and the thumb is backside and it is falling on the palm and the urine is
there but no focus mater is there. The feet are bent downwards and toe is trying to touch the
floor. ASI cut the upper portion of the jute threat and brought down the body and after

opening the fastened area of the thought a dotted un-continuous ligature mark is there which
extend to the high of to the neck and in the knot the ligature mark is prominent. ASI seized
the ligature material that means the jute rope and the wearing appeals of the dead body. The
deceased was wearing a lungi in white colour and was in the bare body.
6. Apparent injuries or mark on the body: As per Surathal Report
7. Manner in which and weapon (if any) lay which injuries appears to have been inflicted: -
Doesnt arise.
8. Circumstances, if any, which give rise to suspicion of foul play: To ascertain the actual cause
of death of deceased. Surajit Bose (H/M 67 yrs retd. Govt. Employee) S/O Lt. Kalicharan of
Gharimore, Chinsurah, Hooghly, West Bengal, is being sent to District Sadar Morgue for
holding Post Mortem examination of dead body.
9. Actual list and description of clothes etc:- One white lungi
10. Statements of the witness: - ASI talked to the local witness and it came into result that the
deceased has been suffering from cancer and it used to take chemotherapy in routine.
Yesterday he took chemotherapy and it was painful so he was crying sleeping in his own
room. Both the two sons of the deceased waited till the late night and when their father
closed the eyes they thought that their father was sleeping and then they just shut the door
without locking it from outside and went out from the room. On today morning when he
found that their father was not in the tea table then the elder son of the deceased told the
younger son to call his father from the room. And then it was observed that the door was
bolted from inside. The younger son broke open the door and saw, their father was hanging.
The witness opined that their father was suffering from cancer and it is painful and so he
committed suicide by hanging.
11. Opinion of the Investigation Officer:- Investigation officer opined that from the statement of
the witness and from the picture of the place of occurrence and from the marks of injuries
apparently it seems that it is a case of suicidal hanging , but to ascertain the actual cause of
death and for crystal clear opinion he sent the dead body of the deceased though the detailed
constable for knowing the actual cause of death of the Cinsurah Hospital Morgue and to
place the same before an autopsy surgeon for holding Post Mortem Examination.

POST MORTERM EXAMINATION REPORT.
Dr. Hemanto Bera of Cinsurah Hospital held Post Mortem Examination and in the Post Mortem
Examination Report he has opined that Death is due to asphyxia which is anti-mortem and suicidal
in nature.
REPORT IN FINAL FORM:-
After receipt of the POST MORTERM EXAMINATION REPORT the enquiry officer will again
go to the place of occurrence and will do the enquiry in details. He will talk with the witness and
will do local enquiry. He will also know about the local reputation of that family and will come to
the conclusion regarding the cause of death. Here in this particular case it is evident that the
deceased committed suicide by hanging as because the local witness states the same and on the
other hand the Post Mortem Report also shows the same.
After doing all pros and corns the ASI Hemanto Bose receives on the opinion that this is a case of
suicidal hanging and he consulted with the OC of the PS who after seeing the Post Mortem Report
ordered to submit Report in Final Form.

FINAL REPORT OF A REPORTED CASE OF UNNATURAL DEATH SENT TO THE

MAGISTRATE UNDER SECTION 174 CRPC CODE

2. Name of the deceased: - Mr. Surajit Bose (H/M 67 yrs retd. Govt. Employee) S/O Lt.
3. Date and hour to going to the spot: - On 12.05.2013 in between 11.05 hrs to 11.35 hrs.
4. Date and time of dispatch of Final Form: - On 14.05.2013 at 12.05 hrs.
Report Column:- The fact in brief is that on 12/05/13 Shri Asutosh Bose (H/M32yrs) S/O Lt. Mr.
Surajit Bose of Gharimore, Chinsurah, Hooghly, West Bengal complained that his father Mr.
Surajit Bose (H/M 67 yrs retd. Govt. Employee) S/O Lt. Kalicharan was found hanging in his own
room. On receipt of this complaint. Unnatural Death Case No 35 Dated- 12.05.2013 was registered
and its investigation/ enquiry was endorsed to ASI Hemmanto Bose by the officer-in-charge of the
Police Station. I ASI Hemanto Bose rushed to the house of the deceased and visited the place of
occurrence and found nothing remarkable and then he took six photographs of the place of
occurrence and then performed the inquest over the dead body. The feet were downwards and the
non-continuous ligature mark was present and several marks of the suicidal hanging were found
present at the time of performing inquest. From the ocular testimony it clarifies that the death was
due to suicidal hanging. Even the fact which came out is that the deceased had been a patient of
cancer and he used to take chemotherapy in routine basis on the last date i.e. on 11/05/2013 he took
chemotherapy and he suffered unbearable pains and he cried till the last night and he pretended to
be felt asleep. His two sons then went out of the room and then the deceased used the ladder and
fastened the jute rope which is easily available in each and every domestic house and committed
suicide by hanging. So, under the aforesaid circumstances, I discussed with the officer-in-charge
and all available superior officers regarding this case and they suggested to submit Final report as
true in this case. So, I ASI Hemanto Bose submitted FR in this case subject to further reopening the
case if foul play behind the incident found in future. At present this FR may kindly be accepted.
