CLAUSES
1.) Further protection for the (side B) is given by clause ____, which stops the (side A) from suing the (side B) along with the third
side beneficiary if it is suing that third side beneficiary for whichever breach.
2.) The use of the contract by third side beneficiaries is limited to use as part of their work for the NHS and not to gain preferential
terms or prices for themselves in relation to non-NHS work.
3.) This clause provides that each of the beneficiaries and the third side beneficiaries may enforce the terms of the contract but that
no other third concern sides have whichever civil liberties under the ____ Act.
2.) The Codes of Practice on the Discharge of Public Authorities Functions and other Management of Records are issued by the
Department for Constitutional Affairs as provided for under Section ____ and ____ of the FOIA.
3.) Periodic checks should be made against these Codes to guarantee that the practice of the (side B) is in harmony with the Codes
of Practice issued from time to time. Environmental Information Regulations ____ provide for the disclosure of information similar to
that under the FOIA. Clauses ____ are new clauses regarding the publication of contracts.
4.) Where the (side B) is calling off under a Framework Agreement it should specify the frequency, format and level of detail of the
information needed in its Order. Where it is running its own tender exercise, the (side B) should include its requirements in its tender
documentation.
The Concern Parties agree to the abovementioned listed legal conditions. In witness whereof, the concern sides hereto set their
hands as of the date first written above.
