SYNOPSIS:
On August 25, 2016 I received a telephone call from Lakewood Police Department
Crimes Against Children Detective Ray Marion. Detective Marion told me he was at
1639 S. Garland Court executing a search warrant related to the investigation into the
death of Jack Splitt (DOB: 10-05-2000) a fifteen year old male who suffered from
Cerebral Palsy and Dystonia. This search warrant was for evidence related to the crime
of Child Abuse resulting in death, CRS 18-6-40 l(7)(a)(l). Detective Marion advised Jack
was the child "Jack's Law," that had recently gone into effect, referred to. This law
requires schools to allow parents to provide medical marijuana treatment to their children
on school grounds. Detective Marion told me Agents had been out at the residence on
August 24, 2016 when Jack passed away, and had been given consent to search the
residence, but this consent was revoked after Jack's mother Stacey Linn (DOB: 10-19-
1968) consulted with her attorney. Detective Marion told me the scene was then held in
anticipation of the search warrant being signed.
Detective Marion told me the other occupants of the house were Stacey's other son.
Cooper Splitt (DOB: 04-04-2005) and two males who rented the two bedrooms in the
basement, Ronald Niehouse (DOB: 06-27-1975) and Mark Pedersen (DOB: 03-08-1957).
Detective Marion told me the search warrant for the house included "evidence of
cannabis or derivatives." While searching the house, Detective Marion told me
Detectives located a large amount of marijuana and what appeared to be marijuana
concentrate. Detective Marion requested I respond to assist.
Detective Dompier and I responded to 1639 S. Garland Court. While on scene, Detective
Johnson advised the northeast bedroom in the basement belonged to Mark and the
southeast bedroom belonged to Ronald. During a search of the bedrooms, a number of
items related to the distribution of marijuana concentrate were located. It should also be
noted, no medical marijuana caregiver or patient paperwork was located for either Mark
or Ronald.
In Mark's room, items located included two composition notebooks labeled "Mark
Pedersen 2015 - 2016" and "Mark Pedersen Patient Notebook." Both handwritten
notebooks were filled with names of "patients" and lists of symptoms and conditions for
these "patients." Also listed were contact information for them including cities and/or
states where they are located, phone numbers, email addresses, and some pages have the
word "filled" written at the top. Also included on some of the pages were ages with a
number of them being for minors. Some of the pages also included information about
speaking with individual via telephone or being in contact through Facebook.com. Also
listed were treatments recommended and notations. There were also a number of entries
about individuals travelling here to meet. Several pages also listed instructions/dosage
amounts for administering marijuana oil. For example, one page was dated 5/27/16 with
the name Laura Votaw. Below the name it read "stage 4 colon cancer." Below this it
said "wants 60g next week. Fly in on Wednesday 6/2 will meet here 10am at Dennys."
At the top of the page filled "6/2" was written.
While conducting a search of Mark's room. Detectives also located eight 1.75 liter
Everclear grain alcohol bottles containing a brown substance that appeared to be
marijuana oil in the closets in this bedroom. The liquid inside the bottles had an
approximate total weight of 10.045 kilograms. In this closet was another Green Oil
Machine oil extractor. Inside the oil extractor was a dark brown liquid that was
consistent with the liquid found in the Everclear bottles. Also located in the room were a
number of USPS shipping boxes, as well as a FedEx shipping airbill label addressed to
Teresa in Peoria, Illinois. There was also a receipt from FedEx for this package being
sent standard overnight dated August 11, 2015. Also located in this room were the
instructions for the Green Oil machine which described how to use food grade alcohol for
extracting the oil. Detectives also located a blue tub which had among other items,
marijuana that had a gross weight, including packaging, of 2.645 kilograms. In the
smaller closet Detectives also found a locked safe, a white bucket containing four bags of
marijuana with a weight of 0.950 grams (weight in bags). On top of the bucket was a
plastic bowl with a blue lid containing more marijuana with a weight (including bowl) of
0610 kilograms.
Detectives also located an article dated 8/9 by "Randy Robinson" titled "The Shadow
Healer." The article is about Mark, and has what appears to be a hand written correction
on the front page, as well as other corrections throughout the document. The article
describes Mark's process of making cannabis oil by using alcohol to "pull the medicinal
compounds like terpenes and cannabinoids out of the plant matter." It also describes how
Mark doesn't grow cannabis for his patients, but rather makes cannabis oil. The article

describes how the thick syrupy oil can be infused in cooking oils, transferred to gel caps,
or taken in a gel or suppository. Detectives also found a postal shipping box which

contained what appeared to be wax and plastic molds for making suppositories.
A search of Mark's public Facebook.com profile showed what appeared to be mason jars,
just as we located in the freezer, covered in frost. The post associated with the
photograph was dated August 9 at 1:19 p.m. The post read "Well...vacation plans were
cancelled. Pretty depressed about that. You have no idea. But sometimes...1 need to be
reminded my life is not my own. I have a purpose.. .1 can make oil. I can provide
hope.. .Science has proven.. .Cannabis in nontoxic. 25,000 years of history has
overwhelmingly shown that cannabis is food. Countless healings testify to the fact that
cannabis is the single most important medicine of the 21st century."
Another post that was dated August 6 at 2:29 a.m. had a picture of mason jars containing
what appeared to be marijuana oil/concentrate with one of the jars on a digital scale. The
post read "What am I doing at 2:30 am? Why, weighing out cancer regiments. Of
course! What else would I be doing? Cannabis is nontoxic. Cannabis is food. Cannabis
is the single most important medicine of the 21st century."
Another post dated July 12 included " I lost another cancer patient this week. I got him
oil, but I was too late. So many.. .so sick.. .waiting for me to make them oil. Without
plant material, I can't make oil, but lean clean my area...i can wash jars. Then I'll go
beg for trim. Whatever it takes..." This was accompanied by a photo of someone
washing mason jars.
Another post dated June 30th read "My every day lately has been blessed with first, a
dawn walk around a beautiful and serene lake.. .Before the calls come... "Hi, I have a 2
year old daughter with spine and brain cancer. We have no options left. I was told you
could help us. Hi, we spoke last week. Myfiancehas esophageal cancer. Is there any
chance you will have oil for him this week? Hi Mark. I have a good friend that has
prostate cancer that has metastasized to the liver. Please tell me as soon as possible when
oil might be available. Hello Mark. I have triple negative breast cancer that has
metastasized to my lung. I was told that you can help me. And I am only one. There are
others across Colorado doing the very same thing. We do, because we must. When we
don't, people die. It's really that simple. It doesnt have to be that way. If cannabis were
truly legal, healing most - of very horrific and terminal illness - could be as simple as

consuming a supplement...a highly nutritious super food...from the local grocery store.
Until then, we'll struggle to provide for as many as we can. Help us, so we can do
more... much ... much more.
This search warrant was served on September 9, 2016 at 1509 hours. I was assisted by
Detective Roubidoux and Sergeant Maestas. Inside the safe I found numerous personal
papers and items belonging to Mark, an envelope of foreign currency, and an envelope of
US currency. Sergeant Maestas and I later counted the money using the money counter
at the West Metro Drug Task Force and the total was $7,000. These items were booked
into evidence at the Jefferson County Sheriffs Office Evidence vault.

DETAILS:
On December 20, 2016, I received the laboratory results in this case from the Jefferson
County Regional Crime Lab. The laboratory report was completed by Lisa Lehl and was
dated December 6,2016.
The results indicated items #13a - 13k were tested and contained marijuana. Items #20a
- 20h, items 21a - 21 b, items 23, 26, 27, and 28 all contained Tetrahydrocannabinol.
Other items submitted were not tested due to JCRCL Sample Selection Guidelines
(weight threshold).
Total net marijuana plant material: 2,599.1 grams (approximately 5.73 pounds)
Total net marijuana concentrate: 11,737.23 grams (approximately 25.88 pounds)
That the foregoing offense(s) alleged was committed of this affiant's own personal knowledge,
and the facts stated therein are true.
Your affiant. Detective Christopher Loveall, a commissioned police officer, hereby requests an
arrest warrant be issued based on the following related incident alleged to have occurred in the
City of Lakewood, County of Jefferson, State of Colorado. Your affiant. Detective Christopher
Loveall is a commissioned police officer for the Lakewood Police Department, currently assigned
to the West Metro Drug Task Force. Your affiant has been a police officer since 2006.

In the utility room in the basement there was what could best be described as a processing area.
There, on top of a table. Detectives located coffeefilters,a food processor with marijuana
residue, mason jars with marijuana residue, a syringe with what appeared to be marijuana and
concentrate residue. On the floor were several empty 1.75 liter bottles of Everclear, and a case of
six unopened bottles. In a bucket on the floor were a number of lids for mason jars and a blue
plastic five gallon bucket. On top of the bucket was a bag of marijuana. Inside the bucket were
several more bags of marijuana. Also located in this area was a crockpot type slow cooker on the
floor, and another with two pots in the same unit on top of a tarp near the table. Near the table
was an upright freezer. Inside the freezer Detectives located numerous bags of marijuana, as well
as jars of marijuana and what appeared to be alcohol, and nine mason jars of what appeared to be
marijuana oil. The estimated weight of the oil in the jars is 3.465 kilograms.

On September 9, 20161 had a search warrant signed for the safe located in Mark's room. This
search warrant was signed by the Honorable Jefferson County Judge KJ Moore. I previously

On September 13,20161 received a letter addressed to Detective Lowewell regarding the Mark,
Ron, and the search warrant at 1639 S. Garland Court. The letter was from the law office of
Corry & Associates. The letter was a request to return property seized, and that an attorney be
allowed to be present when any unsearched items are opened pursuant to a search warrant.
On September 22, 2016,1 asked West Metro Dmg Task Force Intelligence Analyst Carl Gardella
to request wage histories for Mark and Ronald from the Colorado Department of Labor and
Employment, in order to determine if there was any record of legitimate employment/reported
income for either of them. Records showed no reported earnings for either, and the most recent
quarter for which the Department of Labor and Employment had records was the first quarter of
2016. This information was provided by Donovan Hackler.
A request for weighing and analysis of dmg evidence was submitted to the Jefferson County
Regional Crime Laboratory on November 1, 2016.
On December 7, 2016,1 again asked Analyst Gardella to again request wage histories for Ronald
and Mark, as it seemed odd men of their ages would have no wage histories. The result was the
same as in September when I previously requested this information. There was no record of any
reported earnings for either Ronald or Mark in Colorado or nationwide. Again, this seemed
unusual based on their ages to not have any record of legitimate taxable earnings, so Analyst
Gardella called the Colorado Department of Labor and Employment and the information above
was confirmed. At this time. Analyst Gardella was in contact with Ritchie Sauceda of the
Department's Investigations and Criminal Enforcement Division.
On December 20, 2016,1 received the laboratory results in this case from the Jefferson County

Supplemental Report
On 08/25/16, I (Detective Dompier) was contacted by Lakewood Agent/West Metro Drug Task
Force Detective Loveall reference an ongoing investigation being completed by the Crimes Against
Children Unit at Lakewood Police Department. Detective Loveall informed me he was contacted by
this unit during the execution of a search warrant at the residence of 1639 S. Garland St, Lakewod,
Colorado 80232. Det. Loveall stated that during the execution of the search warrant on an unrelated
matter, Lakewood detectives observed items which was believed to be related to marijuana
concentrate extraction and WMDTF was contacted to assist in this portion of the investigation. Det.
Loveall requested my assistance at the residence to investigate further. I then responded to the
residence noted.
Upon my arrival at 1639 S. Garland St, I observed Det. Loveall and multiple CAC Lakewood
Detectives to currently be on scene. I was advised Lakewood was present at the residence on the
search warrant related to their case. I was advised that the items in question were located within the
basement of the residence and that this area was occupied by two parties identified as Mark Pedersen
and Ronald Niehouse. Det. Loveall then directed me downstairs to observe the items in question.
Upon being taken downstairs, I was advised that the bedroom in the northeast corner of the basement
belonged to Pedersen and the bedroom in the southeast corner belonged to Niehouse. I noted also
observing a bathroom, main living area with workout equipment, small closet, and a utility/storage
area in the basement.
I first started in the southeast bedroom with Det. Loveall. Det. Loveall and I searched the areas of the
basement together as to keep the items located separate from items located in other areas of the
basement. All areas were photographed by CSI investigators with Lakewood Police Department, Det.
Loveall and myself All items of evidence collected were documented by the same personnel when
collected. For more information on these documents, please see the details documented on the
Property and Evidence reports.
Upon entering the SE bedroom, I observed multiple postings on the wall and orange buckets/bags on
the floors. I observed the buckets/bags to contain a green leafy substance consistent with dried

marijuana. There was a large white piece of paper attached to the wall which had the heading of
"MPO." Further writing on the paper included terminology associated with what appeared to be a
business model to include words such as "Profit" and "selling point." At this point in time, it was
unknown what "MPO" stood for but later investigation revealed it stood for "Mark Pedersen Oil."
Upon looking at the packaged green leafy substance packaged in the bags, I noted observing writing
on many of the bags which indicated a weight as well as writing which appeared to name the green
leafy substance inside. Some of these included "Bruce Banner", Green Crack", and "Sativa
Wheaties." I know via my training and experience that these names are known strains of marijuana. I
also noted observing medical marijuana stickers/labels on some of the packages. These labels
indicated batch numbers, MMJ customer numbers and MMJ customer name. They also included a
date and weight. The name on these stickers indicated the customer was a "Beaver Kyle Leaver." I
was not informed of any party living at the residence with this name. It also provided a MMJ
customer number of 10064240. All these items were photographed and collected.
In addition, in the closet of this room, detective Loveall and I located a unit with the name "Green
Oil Machine" on it. It was determined to be a marijuana oil extractor. Due to the condition of the
machine, it had obviously been used. Additional items located in this room were multiple jars of
presumed marijuana concentrate, a scale, a business card for eCS Therapy Center which contained
the name of Mark Pedersen as the president of the company, and multiple empty medical marijuana
marked containers. Detectives also observed a box of parchment paper and a package of coffee filters
which I know via my training and experience, when found with other items in this room, to be
consistent with marijuana concentrate extraction. To note. Detectives did not located any medical
marijuana associated paperwork in this room. However, detectives did located items of identification
for Niehouse in this room to include a passport and mail with his name and the Garland St address on
it.

Detective Loveall and I then proceeded to the northeast bedroom which we were told belonged to

Pedersen. In this room, again, detectives observed large paper hanging on the wall. In this room, I
observed paperwork to have the same "MPO" title with "Mark Pedersen Oil" written next to it. On
these handwritten papers, I observed the following information:

In a further search of the room, detectives located instructions for the "Green Oil Machine" as well as
another unit. In the closet, detectives located an unlocked black trunk which contained multiple
manufactured labeled bottles of "Everclear" however, the contents of these bottles were dark and oily
in nature and obviously not the original "Everclear" contents. Via my training and experience and
with looking at the totality of the items observed during the execution of the search warrant, it
appeared the contents were consistent with a marijuana concentrate oil.
Other items located in this room included additional business cards for Mark Pedersen, mailing boxes
with his name and address listed on them, scales, additional bags of a green leafy substance
consistent with marijuana and labeled similarly as the other bedroom, mailing and packaging
material, a locked safe, receipts indicative of marijuana related purchases, suppository capsules, wax
tablets,financialtransaction receipts, CDs of presumed recorded interviews, and specifically 2 black
and white composition notebooks which were marked "Mark Pedersen." One book had the notation
of "Patient Book" and the other "2015-2016." Upon briefly looking at these books, I observed on the
first couple of pages to be handwritten notes similar to doctor notes reference patients. In addition,
there were notations reference marijuana concentrate products. I advised Det. Loveall of these
fmdings and they were collected. I did not review the specifics of every page of these books but note
that multiple pages had similar notations throughout.
Detectives then went to the southwest portion of the basement which appeared to be a utility
room/storage area. However, I observed a work station set up on the west side of the room. From
looking at the materials in this area, it appeared as though this was a processing/manufacturing area
for marijuana concentrate. I also observed a stand up freezer in this area which contained multiple
glass jars with a green leafy substance which appeared to be consistent with marijuana and jars filled
with a brown oil like substance consistent with a marijuana concentrate/oil. There were multiple
additional bottle of marked "Everclear", coffeefilters,additional empty glass jars, heating elements.

a food processor, bags of what appeared to be wet green leafy substance consistent with marijuana,
large canisters of coconut oil, scents/flavoring jars, and empty labeled bags. From my training and
experience, all the items observed are consistent with varying stages of an alcohol based marijuana
concentrate extraction lab.
Upon the conclusion of the execution of the search warrant, detectives left the residence and all items
collected were taken to the WMDTF for drying and processing.
On 08/30/16,1 assisted Det. Loveall with the packaging and logging of evidence. All items collected
as evidence can be located on the Jefferson County Sheriffs Office Evidence and property report
under Jefferson County CR# 16-22229.
At no time during this investigation did I speak with or meet with either suspect in this investigation.
All items located and collected were turned over to Det. Loveall for the furtherance of his
investigation. I was also not involved in any portion of the Lakewood Police Department CAC
investigation.

DETAILS:
On August 25, 2016 I received a telephone call from Lakewood Police Department
Crimes Against Children Detective Ray Marion. Detective Marion told me he was at
1639 S. Garland Court executing a search warrant related to the investigation into the
death of Jack Splitt (DOB: 10-05-2000) a fifteen year old male who suffered from
Cerebral Palsy and Dystonia. This search warrant was for evidence related to the crime
of Child Abuse resulting in death, CRS 18-6-401(7)(a)(l). Detecfive Marion advised Jack
was the child "Jack's Law," that had recently gone into effect, referred to. This law
requires schools to allow parents to provide medical marijuana treatment to their children
on school grounds. Detecfive Marion told me Agents had been out at the residence on
August 24, 2016 when Jack passed away, and had been given consent to search the
residence, but this consent was revoked after Jack's mother Stacey Linn (DOB: 10-19-
1968) consulted with her attorney. Detecfive Marion told me the scene was then held in
anticipation of the search warrant being signed.
Detective Marion told me the other occupants of the house were Stacey's other son.
Cooper Splitt (DOB: 04-04-2005) and two males who rented the two bedrooms in the
basement, Ronald Niehouse (DOB: 06-27-1975) and Mark Pedersen (DOB: 03-08-1957).
Detective Marion told me the search warrant for the house included "evidence of
cannabis or derivatives." While searching the house, Detective Marion told me
Detectives located a large amount of marijuana and what appeared to be marijuana
concentrate. Detective Marion requested I respond to assist.
Detecfive Dompier and I responded to 1639 S. Garland Court. While on scene. Detective
Johnson advised the northeast bedroom in the basement belonged to Mark and the
southeast bedroom belonged to Ronald. During a search of the bedrooms, a number of
items related to the distribution of marijuana concentrate were located. It should also be
noted, no medical marijuana caregiver or patient paperwork was located for either Mark
or Ronald.
which listed Mark Pedersen as the co-founder and vice-president. In this room
Detectives also located two orange Home Depot five gallon buckets containing
marijuana, which was later weighed and had a net weight of 1.805 kilograms. There
were also a number of other bags of marijuana, these were later weighed and had a
weight of 2.860 kilograms. In the closet of this' bedroom. Detectives located a number of
containers of different types of marijuana concentrate.
In Mark's room, items located included two composidon notebooks labeled "Mark
Pedersen 2015 - 2016" and "Mark Pedersen Patient Notebook." Both handwritten
notebooks were filled with names of "patients" and lists of symptoms and conditions for
these "patients." Also listed were contact information for them including cities and/or
states where they are located, phone numbers, email addresses, and some pages have the
word "filled" written at the top. Also included on some of the pages were ages with a
number of them being for minors. Some of the pages also included information about
speaking with individual via telephone or being in contact through Facebook.com. Also
listed were treatments recon^iended and notations. There were also a number of entries
about individuals travelling here to meet. Several pages also listed instrucfions/dosage
amounts for administering marijuana oil. For example, one page was dated 5/27/16 with
the name Laura Votaw. Below the name it read "stage 4 colon cancer." Below this it
said "wants 60g next week. Fly in on Wednesday 6/2 will meet here 10am at Dennys."
At the top of the page filled "6/2" was written.
While conducting a search of Mark's room. Detectives also located eight 1.75 liter
Everclear grain alcohol bottles containing a brown substance that appeared to be
marijuana oil in the closets in this bedroom. The liquid inside the bottles had an
approximate total weight of 10.045 kilograms. In this closet was another Green Oil
Machine oil extractor. Inside the oil extractor was a dark brown liquid that was
consistent with the liquid found in the Everclear bottles. Also located in the room were a
number of USPS shipping boxes, as well as a FedEx shipping airbill label addressed to
Teresa in Peoria, Illinois. There was also a receipt from FedEx for this package being
sent standard ovemight dated August 11, 2015. Also located in this room were the
instructions for the Green Oil machine which described how to use food grade alcohol for
extracting the oil. Detecfives also located a blue tub which had among other items,
marijuana that had a gross weight, including packaging, of 2.645 kilograms. In the
. smaller closet Detectives also found a locked safe, a white bucket containing four bags of
marijuana with a weight of 0.950 grams (weight in bags). On top of the bucket was a
plastic bowl with a blue lid containing more marijuana with a weight (including bowl) of
0610 kilograms.
Detectives also located an article dated 8/9 by "Randy Robinson" filled "The Shadow
Healer." The article is about Mark, and has what appears to be a hand written correction
on the front page, as well as other correcfions throughout the document. The article
describes Mark's process of making cannabis oil by using alcohol to "pull the medicinal
compounds like terpenes and cannabinoids out of the plant matter." It also describes how
Mark doesn't grow cannabis for his pafients, but rather makes cannabis oil. The arficle
describes how the thick syrupy oil can be infused in cooking oils, transferred to gel caps,
or taken in a gel or suppository. Detectives also found a postal shipping box which
contained what appeared to be wax and plastic molds for making suppositories.
In the utility room in the basement there was what could best be described as a processing
area. There, on top of a table. Detectives located coffee filters, a food processor with
marijuana residue, mason jars with marijuana residue, a syringe with what appeared to be
marijuana and concentrate residue. On the floor were several empty 1.75 liter bottles of
Everclear, and a case of six unopened bottles. In a bucket on the floor were a number of
lids for mason jars and a blue plastic five gallon bucket. On top of the bucket was a bag
of marijuana. Inside the bucket were several more bags of marijuana. Also located in
this area was a crockpot type slow cooker on the floor, and another with two pots in the
same unit on top of a tarp near the table. Near the table was an upright freezer. Inside
the freezer Detectives located numerous bags of marijuana, as well as jars of marijuana
and what appeared to be alcohol, and nine mason jars of what appeared to be marijuana
oil. The estimated weight of the oil in the jars is 3.465 kilograms.
A search of Mark's public Facebook.com profile showed what appeared to be mason jars,
just as we located in the freezer, covered in frost. The post associated with the
photograph was dated August 9 at 1:19 p.m. The post read "Well,.,vacafion plans were
cancelled. Pretty depressed about that. You have no idea. But somefimes...I need to be
reminded my life is not my own. I have a purpose...! can make oil. I can provide
hope...Science has proven...Cannabis in nontoxic. 25,000 years of history has
overwhelmingly shown that cannabis is food. Countless healings testify to the fact that
cannabis is the single most important medicine of the 21st century."
Another post that was dated August 6 at 2:29 a.m. had a picture of mason jars containing
what appeared to be marijuana oil/concentrate with one of the jars on a digital scale. The
post read "What am I doing at 2:30 am? Why, weighing out cancer regiments. Of
(J course! What else would I be doing? Cannabis is nontoxic. Cannabis is food. Cannabis
is the single most important medicine of the 21st century."
Another post dated July 12 included " I lost another cancer pafient this week. I got him
oil, but I was too late. So many...so sick...waiting for me to make them oil. Without
plant material, I can't make oil, but I can clean my area...i can wash jars. Then I'll go
beg for trim. Whatever it takes..." This was accompanied by a photo of someone
washing mason jars.
Another post dated June 30th read "My every day lately has been blessed with first, a
dawn walk around a beautiful and serene lake...Before the calls come... "Hi, I have a 2
year old daughter with spine and brain cancer. We have no options left. I was told you
could help us. Hi, we spoke last week. Myfiancehas esophageal cancer. Is there any
chance you will have oil for him this week? Hi Mark. I have a good friend that has
prostate cancer that has metastasized to the liver. Please tell me as soon as possible when
oil might be available. Hello Mark. I have triple negafive breast cancer that has
metastasized to my lung. I was told that you can help me. And I am only one. There are
others across Colorado doing the very same thing. We do, because we must. When we
don't, people die. It's really that simple. It doesnt have to be that way. If cannabis were
truly legal, healing most - of very horrific and terminal illness - could be as simple as
consuming a supplement...a highly nutritious super food...from the local grocery store.
Unfil then, we'll struggle to provide for as many as we can. Help us, so we can do
more.. .much .. .much more.
On September 9, 2016 I had a search warrant signed for the safe located in Mark's room.
This search warrant was signed by the Honorable Jefferson County Judge KJ Moore. I
previously spoke with Matt Odom who indicated he was the attomey represenfing Mark
and Ronald. At this time, he requested someone from his office be able to be present
during the execution of the search warrant and also said he may be able to get the
combinafion to the safe so we would not have to force the safe open. On September 9,1
again spoke to Matt who indicated he did not have the combination to the safe.
This search warrant was served on September 9, 2016 at 1509 hours. I was assisted by
Detective Roubidoux and Sergeant Maestas. Inside the safe I found numerous personal
papers and items belonging to Mark, an envelope of foreign currency, and an envelope of
US currency. Sergeant Maestas and I later counted the money using the money counter
at the West Metro Drug Task Force and the total was $7,000. These items were booked
into evidence at the Jefferson County Sheriffs Office Evidence vault.
On September 13, 2016 I received a letter addressed to Detective Lowewell regarding the
Mark, Ron, and the search warrant at 1639 S. Garland Court. The letter was from the law
office of Corry & Associates. The letter was a request to retum property seized, and that
an attorney be allowed to be present when any unsearched items are opened pursuant to a
search warrant.
On September 22, 2016,1 asked West Metro Dmg Task Force Intelligence Analyst Carl
Gardella to request wage histories for Mark and Ronald from the Colorado Department of
Labor and Employment, in order to determine if there was any record of legitimate
employment/reported income for either of them. Records showed no reported earnings
for either, and the most recent quarter for which the Department of Labor and
Employment had records was the first quarter of 2016. This information was provided by
Donovan Hackler.
A request for weighing and analysis of drug evidence was submitted to the Jefferson
County Regional Crime Laboratory on November 1, 2016.
On December 7, 2016,1 again asked Analyst Gardella to again request wage histories for
Ronald and Mark, as it seemed odd men of their ages would have no wage histories. The
result was the same as in September when I previously requested this information. There
was no record of any reported earnings for either Ronald or Mark in Colorado or
nationwide. Again, this seemed unusual based on their ages to not have any record of
legitimate taxable earnings, so Analyst Gardella called the Colorado Department of Labor
and Employment and the informafion above was confirmed. At this time. Analyst
Gardella was in contact with Ritchie Sauceda of the Department's Investigations and
Criminal Enforcement Division.
On August 25, 2016, at approximately 1700 hours, I was in contact with Detective
Loveall, and he advised that he was assisting Lakewood Police Department detectives in
serving a search warrant at 1639 South Garland St. This investigation is a L.P.D. Persons
Crime investigafion, and members of the West Metro dmg Task Force were assisfing
with the invesfigation due to large amounts of marijuana/marijuana concentrate being
located at the residence.
Upon arriving on scene, I found that W.M.D.T.F. members were focusing on searching
the basement of the residence, and the search was now taking place in the northeast
basement bedroom. To my knowledge the rest of the basement had been searched,
except for this northeast bedroom. Additionally, I was advised by Detective Loveall that
L.P.D. detectives had located several jars of marijuana/marijuana concentrate in a
basement freezer, and this freezer is located in a basement utility room. The evidence in
this freezer had not yet been collected as evidence.
Upon assisfing with the search of the northeast bedroom, I did not locate anything of
evidentiary value, but other detectives did locate items of evidentiary value in this
bedroom. See the supplemental reports of Detective Loveall and Detective Dompier for
further information.
Following the search of this bedroom, detectives moved into the basement utility room,
and we began clearing out the evidence in the freezer and collecting the evidence. Inside
this freezer detectives located several jars of marijuana concentrate, several jars of
marijuana and bags of marijuana. For more specific information on the items located in
this freezer see the L.P.D. property inventory sheet and the supplemental report of
Detective Loveall.
Lastly, all the evidence collected from this residence was transported to the W.M.D.T.F.
by Sergeant Orndoff, where it was temporarily stored prior to being booked at the
Jefferson County Sheriffs Office Property Evidence Vault.

scale, a business card for the eCS (Endocannabinoid System) Therapy Center which listed Mark Pedersen

kilograms. In the closet of this bedroom, Detectives located a number of containers of different types of
In Mark's room, items located included two composition notebooks labeled "Mark Pedersen 2015 - 2016"
and "Mark Pedersen Patient Notebook." Both handwritten notebooks were filled with names of "patients'*
and lists of symptoms and conditions for these "patients." Also hsted were contact information for them
including cities and/or states where they are located, phone numbers, email addresses, and some pages
have the word "filled" written at the top. Also included on some of the pages were ages with a number of
them being for minors. Some of the pages also included information about speaking with individual via
telephone or being in contact through Facebook.com. Also listed were treatments recommended and
notations. There were also a number of entries about individuals travelling here to meet. Several pages
also listed instructions/dosage amounts for administering marijuana oil. For example, one page was dated
5/27/16 with the name Laura Votaw. Below the name it read "stage 4 colon cancer." Below this it said
"wants 60g next week. Fly in on Wednesday 6/2 will meet here 10am at Dennys." At the top of the page
filled "6/2" was written.
While conducting a search of Mark's room, Detectives also located eight 1.75 liter Everclear grain alcohol
bottles containing a brown substance that appeared to be marijuana oil in the closets in this bedroom. The
liquid inside the bottles had an approximate total weight of 10.045 kilograms. In this closet was another
Green Oil Machine oil extractor. Inside the oil extractor was a dark brown hquid that was consistent with
the liquid found in the Everclear bottles: Also located in the room were a number of USPS shipping
boxes, as well as a FedEx shipping airbill label addressed to Teresa in Peoria, Illinois. There was also a
receipt from FedEx for this package being sent standard overnight dated August 11, 2015. Also located in
this room were the instmctions for the Green Oil machine which described how to use food grade alcohol
for extracting the oil. Detectives also located a blue tub which had among other items, marijuana that had
a gross weight, including packaging, of 2.645 kilograms. In the smaller closet Detectives also found a
locked safe, a white bucket containing four bags of marijuana with a weight of 0.950 grams (weight in
bags). On top of the bucket was a plastic bowl with a blue hd containing more marijuana with a weight
(including bowl) of 0610 kilograms.
Detectives also located an article dated 8/9 by "Randy Robinson" titled "The Shadow Healer." The article
is about Mark, and has what appears to be a hand written correction on the front page, as well as other
corrections throughout the document. The article describes Mark's process of making cannabis oil by
using alcohol to "pull the medicinal compounds like terpenes and cannabinoids out of the plant matter." It
also describes how Mark doesn't grow cannabis for his patients, but rather makes cannabis oil. The article
describes how the thick sympy oil can be infused in cooking oils, transferred to gel caps, or taken in a gel
or suppository. Detectives also found a postal shipping box which contained what appeared to be wax and
plastic molds for making suppositories.
In the utility room in the basement there was what could best be described as a processing area. There, on
top of a table, Detectives located coffeefilters,a food processor with marijuana residue, mason jars with
marijuana residue, a syringe with what appeared to be marijuana and concentrate residue. On the floor
were several empty 1.75 liter bottles of Everclear, and a case of six unopened bottles. In a bucket on the
floor were a number of lids for mason jars and a blue plastic five gallon bucket. On top of the bucket was
a bag of marijuana. Inside the bucket were several more bags of marijuana. Also located in this area was a
crockpot type slow cooker on the floor, and another with two pots in the same unil on top of a tarp near the
table. Near the table was an upright freezer. Inside the freezer Detectives located numerous bags of
marijuana, as well as jars of marijuana and what appeared to be alcohol, and nine mason jars of what
appeared to be marijuana oil. The estimated weight of the oil in the jars is 3.465 kilograms.

be marijuana oil/concentrate with one of the jars on a digital scale. The post read "What am I doing at
2:30 am? Why, weighing out cancer regiments. Of course! What else would I be doing? Cannabis is
nontoxic. Cannabis is food. Cannabis is the single most important medicine of the 21^' century."
Another post dated July 12 included " I lost another cancer patient this week. I got him oil, but I was too
late. So many.. .so sick.. .waiting for me to make them oil. Without plant material, I can't make oil, but I
can clean my area...i can wash jars. Then I'll go beg for trim. Whatever it takes..." This was
accompanied by a photo of someone washing mason jars.
Another post dated June 30**' read "My every day lately has been blessed with first, a dawn walk around a
beautiful and serene lake...Before the calls come... "Hi, I have a 2 year old daughter with spine and brain
cancer. We have no options left. I was told you could help us; Hi; we spoke last week. Myfiancehas
esophageal cancer. Is there any chance you will have oil for him this week? Hi Mark. I have a good
friend that has prostate cancer that has metastasized to the liver. Please tell me as soon as possible when
oil might be available. Hello Mark. I have triple negative breast cancer that has metastasized to my lung.
I was told that you can help me. And I am only one. There are others across Colorado doing the very
same thing. We do, because we musL When we don't, people die. It's really that simple. It doesnt have
to be that way. If cannabis were truly legal, healing most - of very horrific and terminal illness - could be
as simple as consuming a supplement.. .a highly nutritious super food.. .from the local grocery store. Until
then, we'll stmggle to provide for as many as we can. Help us, so we can do more...much ...much more.
Due to the facts set forth in this affidavit, your affiant feels that there is probable cause to believe the
resident(s) of 1639 S. Garland Court, in the City of Lakewood, County of Jefferson are involved in the
continuous possession of marijuana in amounts in excess of that allowed by law, and the sale/possession of
marijuana concentrate, as described in the Colorado Revised Statutes, and the safe seized during the search
warrant conducted on August 25, 2016 is likely to contain evidence related to the distribution of marijuana
concentrate.
Based on my knowledge, training, experience and participation in other dmg investigations, I am aware
that it is common for dmg dealers to maintain books, records, notes, ledgers, money orders and other
papers relating to the transportation, ordering, storage, sale and distribution of controlled substances and
other items relating to dmg dealing, in safes. These records include bank records, other documents of
financial transactions, telephone records, and telephone directories, and proceeds from the illegal sales of
controlled substances.
Based on the aforementioned information, your affiant respectfully requests that the Court issue a search
warrant for the above safe for the purpose of seizing evidence of violations of Colorado Revised Statutes,
specifically section 18-18-406, Possession of Marijuana (weight not otherwise allowed by regulatory
scheme) and Distribution/Possession with Intent to Distribute Marijuana Concentrate, and any controlled
substances which are unlawfully possessed within the premises described below, together with articles of
personal property tending to establish the identity of the person or persons in control of and said property,

1639 S. Garland Ct., which is further described as a single family home. It is a ranch style
home with a basement. The home Is situated on the west side of 8. Garland Ct. and the
front door faces south. The building is comprised primarily of red and brown bricks with
white colored siding. The numbers "1639" are affixed 19 the home facing east and are
located in between a window and the front door.

DETECTIVE Lauren Johnson, being first duly sworn upon her oath, relates the following facts:
Your affiant has. been a police officer for the city of Lakewood for approximately 6 years. Your
affiant has personal knowledge of the facts contained within this affidavit through personal
involvement, interviews with witnesses and other police officers and through reviewing official
police reports.
Agent Schurmann arrived and contacted the reporting party, home care nurse, John
Robertson (021354). John advised he is in charge of taking care of the victim, Jack
Splitt (DOB 100500) between the hours of 0700 and 1900. Jack suffers from Cerebral
Palsy and Dystonia. John said when he arrived this morning at 0700 Jack was
extremely agitated; which is a common occurrence. John did not take Jack to school at
0900 as planned due to his agitated state. Around 0900 hours John gave Jack Tylenol
and ibuprofen because he had a temperature and between 0900 and 1100 John gave
Jack between 6 and 7 milligrams of phenobarbital which is prescribed to Jack. John was
unsure of the time frame and amount of phenobarbital and when Agent Schurmann
asked him if he was required to keep a log/write down the amount of medications and
the times that they are given John said he is supposed to write them down but he hadn't
yet because "things were so hectic". John advised he administered 2 mg at 0900 hours,
1 mg at 0930 hours, 1 mg at 1000 hours and 2 mg at 1100 hours.
Jack fell asleep at 1100 hours and at 1300 hours when John went to check on Jack he
noticed he was pale and "did not look good." John called Jack's mother, Stacey Linn
who told him "not to call the fire department or police because they just bring him to the
ER".
Agent Schurmann also interviewed West Metro Fire Department (WMF) personnel and
learned from Engineer Scott Muller that when they arrived on scene at 1443 hours they
met John the nurse. John was performing CPR and he said "Jack had a pulse just a few
minutes prior". However the fire staff noted that it was apparent from their experience
that Jack had been deceased for at least a couple of hours prior to their arrival. WMF
staff, via phone with Dr. Altman, pronounced Jack dead at 1500 hours.
Detectives Jackson, Collins and your affiant responded to the scene at approximately
1655 hours. Detective Marion arrived shortly after. The residents of the home were
identified to be Jack, Stacey, Stacey's son. Cooper Splitt (040405) and two roommates
Mark Pedersen (030857) and Ronald Niehouse (062775); both of whom reside in the
basement.
Jack was located in his room on the main level of the home. It is the first room on the

left side of the hallway. His bed is up against the west wall and the head of the bed is
along the south wall. Jack was lying on his back on top of a blue blanket and white
sheets and there was a pillow resting on t6p of his forehead. Jack was wearing a blue
shirt and a white diaper. He did not have any other clothing on his person. There were
catheter tubes as well as a trachea tube connected to his person and various medical
equipment located within the room.
I interviewed Mark and Ronald on scene while Detective Jackson spoke with Stacey
and Detective Collins transported John to LPD to be interviewed.
In my interviews with Mark and Ronald I learned Jack receives 24 hour care due to his
condition and they both advised that they had no interaction with Jack today because he
After leaving in the morning to have breakfast, Mark returned at approximately 1130
hours and was seated on the back patio talking to a friend for a couple hours. Mark told
me he saw the lights from the firetruck and when he went inside John told him that Jack
had passed away. Mark had no contact with John that day in reference to Jack's state
prior to learning of his death. Both Mark and Ronald said they only spoke to John in
passing. Mark immediately called Stacey who was not home, however she did not
answer. He called Ronald and informed him over the phone that Jack had died.
Ronald returned home after first responders were already on scene.
The following is Detective Jackson's account of her contact and interview with Stacey
Linn on scene:
John further stated that upon his arrival Jack's face had some blood on it from an
apparent self-inflicted lip and tongue bite. John stated that this type of injury was very
unusual for Jack.
John said that he checked Jack's vital stats upon arrival and found that the child had a
high fever (102.2 degrees Fahrenheit) and also noted that Jack's pulse rate was reading
between 180-190 beats per minute and confirmed that Jack was especially agitated.
John told Detective Marion that between 0700-0730 hours he approached Jack's
mother, Stacey, and told her that Jack was not doing well and believed that the child
should not go to school that day. John said that it was at that time that Stacey told him
to give Jack more Phenobarbital.
John told Detective Marion that he retrieved a bottle of Phenobarbital from one of the
kitchen cabinets. Prior to administering the drug, John stated that he called the
pharmacy phone number listed on the prescriptiori label on the bottle and asked about
appropriate dosage information. He stated that the pharmacist that he spoke with told
him that he could administer up to 25ml in a 24 hour time period however that the
individual doses needed to be spread out and small.
John said that he first gave a 2ml dose of Phenobarbital to Jack at approximately 0900
hours. He said that dose did not appear to calm Jack down and therefore provided
another 2ml dose half an hour later. John further stated that he then gave three more
doses of Phenobarbital, consisting of 1ml eaqh over the course pf the next 90 minutes.
John said that all drugs provided were" administered though one bf Jack's "G-tubes."
John told Detective Marion that at approximately 1200 hours Jack finally calmed down
and fell asleep. At approximately 1300 hours, John said that Jack's "pulse ox" machine
started beeping, indicating that Jack's oxygen levels were low and that his pulse was
abnormal. At that time, John said that he used his cell phone (Black in color LG flip
phone, 303-503-6451) to call Stacey on her cell phone (l-Phone 6S, phone number 303-
520-6429) and told her that he believed he needed to call 911 for help. He explained to
Detective Marion that Stacey told him not to call 911 but that she would be on her way
home shortly. John stated that at approximately 1330 hours Jack's 02 levels were in the
40's and that his pulse rate was very abnormal. He stated that he again called Stacey,
and told her that he needed to call 911 for help. John stated that again Stacey told him
not to call 911.
John stated that at approximateiy 1440 hours he called his boss Steve at Atlas Home
Health Care and asked for advice on what to do. John said that Steve told him to call
911, which John stated that he did at 1442 hours. John said that he did perform CPR
until WMFD arrived, however stated that Jack was deceased at that time. All calls made
by John were made from his cell phone.
John stated that on the day in question he did not administer any of Jacks regular
medication. John stated that he was unable to tell me all of Jack's medications and that
he administered medications based on a schedule that he had in two white notebooks
that were kept in Jack's room. John also stated that the schedule and medication list
was also on a file on his computer that was also located in Jack's room.
John further told Detective Marion that the majority of Jack's medications are stored in
Jack's bedroom. He stated that only the Phenobarbital, which was stored in a kitchen
cabinet, and some of the marijuana medications, which are stored in the refrigerator,
are kept outside df Jack's room.
Detective Marion, while on scene at 1639 S. Garland Ct. also spoke with Major Medical
Supply Company personnel concerning the pulse ox and ventilator machines that were
in Jack's room and connected to Jack at the time of his death. Detective Marion was
Informed that both pieces of equipment had CPUs that would record information
concerning Jack's vital statistics and that such information was downloadable and
recoverable.
This concludes Detective Marion's account and the following is Detective Collins
involvement that she relayed to me:
Joe stated that he worked Monday, August 22, 2016 on the night shift and Tuesday,
August 23. Joe said Monday night, he arrived and relieved day shift nurse John
Robertson. He said John told him it was a day "from hell". Joe said he talks with John at
the beginning of his shift to learn what happened the night before. Joe goes about his
roiJtines for the night.
Joe described his routine in detail. He noticed Jack looked "ashen" Monday night but
attributed that to Jack starting school again recently and having been to school that
morning. Otherwise, Joe described the rest ofthe night as being routine. With Jack, Joe
said it is routine for him to throw-up sometimes and for his dystonia to flare up. He
explained that Jack has regular non-narcotic medications that he takes on a schedule,
the schedule is written down and posted for the nurses along with the medications and
the dosages. The documentation for the medication is located on a clipboard by the
desk in Jack's room. One of the regular medications is the suppository that contains the
doctor prescribed marijuana. This is kept in the refrigerator in the kitchen. Joe said the
prescribed Ativan is in a small liquid jar ih the refrigerator in the kitchen as well.
Joe said he left at 0700 hours Tuesday morning and returned 1900 hours Tuesday
night. Joe arrived and was briefed by John. Jack looked ashen and John said he had a
busy day and that Jack was puking up a storm. Joe shut off the tube feeding at that
point. John said Jack had two small bowel movements, was busy at school and that he
was constantly throwing up. Joe said he went through his routine that night but that
Jack's dystonia was seriously flaring up. He went down his check list that illustrates a
Tuesday night Joe said Jack had dystonia and he went through #1-3 on his check off
list. He decided he had to go to #4, Phenobarbital, because #1-3 was not working and
his heart rate was up to 140. Joe said they got a new package of Phenobarbital 2-3
months ago and have not used any of the new package yet. Jack doesn't get
Phenobarbital often but it is used if necessary.
Joe said that Jack bit his tongue at some point in the night as a result of the dystonia.
He said the dystonia causes Jack to tighten up and sometimes he will bite his tongue.
He did say it was rare but that it does happen that Jack can bite his tongue. Joe said he
cleaned out Jack's mouth.
John arrived for his shift Wednesday morning and Joe explained to him what happened
the night before. Joe specifically told John that he gave Jack two half doses of
Phenobarbital, one at 0100 hours and another at 0300 hours. Joe said John could have
referenced his log entry in the narcotics log if he forgot how much Joe told him he used.
Joe said when he left Wednesday morning, that Jack didn't have a fever or high
temperature.
Det. Collins asked him his thoughts on if John said Jack's temperature went up to 102.2
degrees and Jack said that would be really high. Joe said he had to give him 15ml of
Ibuprophen at 2100-2200 hours Tuesday night for the higher temperature of 98.9
degrees the night before but that he thought if Jack's temperature jumped up to 102,2
that he may have aspirated. Aspiration was described as when the lungs fill up with
liquid from Jack's feedings through is G-tube.
The feedings are timed to give him a specific amount of "food" every hour and if Jack is
throwing up more, then the nurses will generally stop the G-tube feeding to help prevent
aspiration. The aspiration is what has landed him in the hospital in the past because it
can cause complications like pneumonia and requires a more intense suction process to
get the liquid out of Jack's lungs.

Joe reiterated that he did not think Jack felt that warm when he left and that he moved
Joe submitted his documentation to Atlas Home Health Care on the Atlas Home Health
Care computer that is kept in Jack's room. Joe further explained to Det. Collins that the
prescription for Phenobarbital calls for only one dose (which is two pills) once every 4
hours. Joe described the more Phenobarbital given to Jack, the more "out ot it" Jack
wouid be the next day. Joe said 6-7 doses of Phenobarbital would be too much and
unnecessary. Joe thought that Jack would need to go to the hospital if a "couple" doses
of Phenobarbital were not working to get Jack's heart rate down. Joe said in general
they are supposed to ask Stacey, Jack's mom, for what she wants to do with Jack as far
as medications to administer or if she's okay with taking Jack to the hospital. Stacey
normally did not want Jack in the hospital. Joe also said that he and the other nurses
also have a duty to do no harm and if Jack needs to go to the hospital then it is their
duty to call 911.
Detective. Collins asked Joe if he would have called 911 if the few doses of
Phenobarbital were not working. He said he would have called 911 at that point. Joe
said if he was not getting a pulse from the first pulsox (finger cover that reads oxygen
levels and pulse rate) that he would use the second back-up pulsox that Joe provided
on his own to Stacey. He said the second one was reliable and that he had to do that
Tuesday night when the first pulsox wasn't reading correctly. Joe stated that if the
second pulsox was not reading correctly as well, then he would call 911 right away. He
did say he would try to find a pulse manually as well, but that if there was no pulse or
difficulty finding a pulse that he would call 911 immediately. Joe said that calling 911
would likely get him fired because it would be against what Stacey wanted, but that in
the previous hypothetical situations he was asked about, he would have a duty to call
911 to not do harm to Jack.
LPD Crime Lab responded to the scene for photographs and evidence collection based
on Stacey's consent. The scene was secured and will remain secured until the
execution of this warrant.
Based on the aforementioned facts and circumstances, your, affiant has probable cause
to believe that the crime of Child Abuse-Death, 18-6-401 (7)(a)(i), C.R.S., and the fruits
and/or instruments of that crime are located at 1639 S. Garland Ct, in the City of
Lakewood, County of Jefferson, and State of Colorado.
Based on the aforementioned facts and circumstances, application is hereby made for
issuance of a search warrant, directed to any officer authorized by law to execute warrants
in the county wherein said property is located, commanding said officer to search forthwith
the person or place named above for said property, and the said property and every part

Mark Pedersen was bom and raised in the lead belt of Missouri. At 60 years old, he's rather spry. His glowing smiles, his confident gestures, his passionate speech would never
indicate he suffers from what doctors diagnosed as fibromyalgia with severe migraines. Pedersen says he knows the cause of his illness: exposure to heavy metal pollution
while growing up in his hometown of Herculaneum, MO.
Like all fibfo patients, Pedersen experiences intense, chronic pain in his muscles and joints. He suffers from fatigue and insomnia. His digestive system can go haywire at a
i;' J moment's notice, an issue that was worsened by years of pharmaceutical treatments. The dolor in his gut can lead to an extreme loss of appetite, weight loss, and exhaustion,

'' ' "My memories were still there, but the connections were damaged," Pedersen says. Contrary to myths that cannabis consumers have poor cognition and memory recall,
' ^ Pedersen says cannabis not only helped restore his memory, but it continues to help him focus, too. "One of the most amazing things about cannabis is the clarity of thought,
being able to think again. Being able to remember a person's name or situation, or important things, like birthdates."
By acting directly on Pedersen's endocannabinoid system, cannabis alleviates all of these symptoms. This plant helps him, like many others, to live a normal life. msz^.
Pedersen first leamed that cannabis could help him in the late 1990s while browsing an online forum. Although he had experimented with marijuana when he was yo

didn't always think of it as medicine. With time, he leamed about other people around the country who also claimed cannabis restored their quality of life.
Determined to shift the culture, Pedersen set out wilh a video camera. In 2006, he began recording patient testimonials from people who lived with Crohn's, cancer, AIDS,
arthritis, anorexia, multiple sclerosis, PTSD, and a vast array of other crippling diseases. These videos were meant to show that cannabis could heip with more than just nausea
or glaucoma. With the help of activists, patients, and scientists, he eventually cofounded the Cannabis Patients Network Institute with author Regina Nelson. The nonprofit
gathers patient stories to share with others and educates the public on the medical potential of cannabis through public events and benevolent outreach programs.
Today, Pedersen no longer wields a video camera to share paiient testimonials. Vice, CNN, and other mainstream media outlets have picked up where he left off over a year
ago. Now, he's solely focused on getting medicine to others, namely patients dying of Stage IV cancers, children, and the poor.
CANNABIS
WHAT IS A CAREGIVER?
Colorado's Amendment 20 defines a caregiver as anyone (besides a patient's physician) who is an adult responsible for helping that patient manage their debilitating condition.
In the medical cannabis world, caregivers are usually people who grow plants and make infused products for their patients. But not every caregiver grows.
Instead of growing cannabis for his patients, Pedersen makes cannabis oil. To make this oil, he steeps the plant material in ethanol (the kind of alcohol we drink, specifically
Everclear). This process pulls medicinal compounds like terpenes and cannabinoids out of the plant matter. After soaking, the alcohol is removed, and what's lefl is a thick,
syrupy oil that can be infused into cooking oils, transferred to gel caps, or taken by teaspoon.
This oil is the most potent form of cannabis extract. Just one gram of oil, the size of a gum ball, holds around 1,000 mg of THC. Compare that to Colorado's strongest
prepackaged medical edibles, which only contain up to 300 mg THC. Although concentrated oil may not be ideal for most patients, those with terminal illnesses or extremely
debilitating conditions require high amounts of cannabinoids. Unfortunately, most dispensaries can't meet this need, and patients continue to rely on caregivers such as
pedersen to make this life-restoring medicine by hand.
Although Pedersen is registered as a caregiver with the state, he doesn't call himself a caregiver. Rather, he considers himself a cook. That's because he sees cannabis as a super
food. Some patients prefer to avoid cannabis's trademark "high," especially patients who require a constant, round-the-clock intake of cannabinoids. And Pedersen is just the
man for that job; part of his mission is educating others on how to take theii cannabis in a way that mitigates the plant's elevating effects.
"We need to introduce cannabis as part of our diet, not just as a supplement," Pedersen says. "Socrates once said, 'Let your food be your medicine and your medicine be your
food.' Cannabis is a food, and we need to start talking about it as such."

Mark Pedersen was bom and raised in the lead belt of Missouri. At 60 years old,
minister he's rather spry. His glowing smiles, his confident gestures, his passionate speech
would never indicate he suffers from what doctors diagnosed as fibromyalgia with severe
migraines. Pedersen says he knows the cause ofhis illness: exposure to heavy metal pollution
while growing up in his hometown of Herculaneum, Mo.
Like all fibre patients, Pedersen experiences intense, chronic pain in his muscles and joints -
neuropathy. He suffers from fatigue and insomnia. His digestive system can go haywire at a
moment's notice - mostly caused by his past pharmaceutical treatments, leading to an
extreme loss of appetite, weight loss, and exhaustion. Without cannabis, his migraines can
become so intense that he can undergo seizures, - seizures which can effect his short-term
memory.
"My memories were still there, but the connections were damaged," Pedersen says. Contrary to
myths that cannabis consumers have poor cognition and memory recall, Pedersen says cannabis
not only helped restore his memory, but it continues to help him focus, too. "One of the most
amazing things about cannabis is the clarity of thought, being able to think again. Being able to
remember a person's name or situation, or important things, like the births of children."
Pedersen first leamed that cannabis could help him in the late 1990s while browsing an online
forum. Although he experimented with marijuana when he was younger, he didn't always think
of it as medicine. With time, he leamed about other people around the country who also claimed
cannabis restored their quality of life.
Determined to shift the culture, Pedersen set out with a video camera. In 2006, he began
recording patient testimonials from people who lived with Crohn's, cancer, AIDS, arthritis,
anorexia, multiple sclerosis, PTS, and a vast array of other crippling diseases and posting them
on his Youtube channel, "cannabispatientnetwork.org". These videos were meant to show
that cannabis could help with more than just nausea or glaucoma. With the help of activists,
patients, educators, and scientists, he eventually cofounded the non-profit Cannabis Patients
Network Institute with author and academic, Regina Nelson. The non-profit gathers patient
Nelson and Pedersen went on to found the eCS Therapy Center, a national 501 c3 focused
on patient education. Their collaboration is not only effecting state policy throughout the
country, but is also helping to shape the rebirth of medical efficacy across Europe and
other countries.
Today, Pedersen no longer wields a video camera to share patient testimonials. Vice, CNN, and
other mainstream media outlets have picked up where he left off over two years ago. Now, he's
solely primarily focused on getting medicine to others, namely patients dying of Stage IV
cancers, children and the poor.
What is a Caregiver?
Instead of growing cannabis for his patients, Pedersen makes cannabis oil. He provides this oil
for free, a rare service in an age where marijuana has become a billion dollar commodl^
To make this oil, he agitates the plant material in ethanol alcohol (i.e. everclear).-using^t
sfieckl machine. Thisfeotfingprocess pulls the medicinal compounds like terpenes and
cannabinoids out of the plant matter. After soaking for a period of time, the alcohol is removed,
and he's left with a thick, syrupy oil that can be infused in to cooking oils, transferred to gel
caps, or taken orally or in suppository.
This oil is the most potent form of cannabis extract. Just one gram of oil, the size of a gumball,
holds around 1000 mg of THC. Compare that to Colorado's strongest pre-packaged edibles,
which only contain up to 300 mg THC. Although concentrated oil may not be ideal for most
patients, those with terminal illnesses or extremely debilitating conditions require high amounts
of cannabinoids. Most dispensaries cannot meet this need, yet it is essential that patients
have access to efficiently effect disease - like the remarkable healings witnessed by
Pedersen and other caregivers across the state and around the world.
Raw oil also serves as a cost-effective method for patients who want to control how they're
medicated.
Although Pedersen is registered as a caregiver with the state, he doesn't call himself a caregiver.
Rather, he considers himself a cook. That's because he sees cannabis as a "super food", and a
source of great nutrition. Not every patient or consumer wants to get "high," especially patients
who require a constant, round-the-clock intake of cannabinoids. And Pedersen is just the man for
that job; part ofhis mission is educating others on how to take their cannabis while mitigating
much of the "high", without ever getting elevated. By juicing, infusing cooking oils and
natural sweeteners, or using suppositories adding buds to salads, or taldng drops of
tinctures, anyone can benefit from cannabis without catching a buzz.

and metal allergies go hand-in-hand. Exposure to heavy metals may exacerbate inflammation,

1. Place plant material in glass receptacle and add food grade alcohol.
a. For fast wash, agitate material and alcohol for 3 to 5 minutes. Strain to separate plant material
from alcohol. Pour alcohol through coffee filter for final filtration.
b. For long wash, agitate periodically while soaking for desired length of time, 24 hrs or longer.
This process will pull more chlorophyll and plant waxes from green material.
c. To insure maximum reclaim of solvent, try very hard to separate as much from plant material
after soak.
2. Add plant infused alcohol to cylinder of machine. Place top on machine, making sure to plug in fan to
cylinder. Failure to plug in fan do may result in damage to unit or harm to user.
3. Make sure reclaim tube is in place for recapture into container of your choice,
4. Turn temperature dial clockwise until it stops at the distillation reclaim stop screw at 100 Celsius.
5. Turn on power switch. Depending on quantity of alcohol and quality, recapture will begin within 3-10
minutes.
6. Total oil production process time depends on proof of alcohol. It is normal for the machine to cycle on
and off throughout the process.
7. When alcohol reclaim slows you will notice a spike in temp of about 5 degrees, this signals the reclaim
process has completed. Turn off machine, wait a few minutes before opening top of unit, lower proof
alcohol will have water remaining in unit which may mean steam, open top to check oil. If 95% of
alcohol is gone, unplug top/fan, remove, turn machine down to between 60-75 Celsius for final alcohol
purge.
8. Stir remaining oil with a spatula to help release remaining alcohol from oil.
9. Oil is complete when it reaches desired consistency, you can use a syringe to extract from machine
when it is still warm, or wait until it cools and scoop with a spatula.
10. Cleaning: Use food grade alcohol to clean unit. As another option, you can add olive, coconut, or
another carrier oil and it will infuse the remaining "essential" oils into the other oil for easy extraction.

arrest warrant be issued based on the following related incident alleged to have occurred in the
City of Lakewood, County of Jefferson, State of Colorado. Your affiant, Detective Christopher
Loveall is a commissioned police officer for the Lakewood Police Department, currently assigned
to the West Metro Drug Task Force. Your affiant has been a police officer since 2006.
The affiant, Detective Christopher Loveall, being first duly swom upon his oath, relates the
following facts:
Your affiant knows the following information to be tme based upon her personal involvement,
conversations with parlies involved, and research of official police documents.
On August 25, 2016 I received a telephone call from Lakewood Police Department Crimes
Against Children Detective Ray Marion. Detective Marion told me he was at 1639 S. Garland
Court executing a search warrant related to the investigation into the death of Jack Splitt (DOB:
10-05-2000) a fifteen year old male who suffered from Cerebral Palsy and Dystonia. This search
warrant was for evidence related to the crime of Child Abuse resulting in death, CRS 18-6-
401(7)(a)(l). Detective Marion advised Jack was the child "Jack's Law," that had recently gone
into effect, referred to. This law requires schools to allow parents to provide medical marijuana
treatment to their children on school grounds. Detective Marion told me Agents had been out at
the residence on August 24, 2016 when Jack passed away, and had been given consent to search
the residence, but this consent was revoked after Jack's mother Stacey Linn (DOB: 10-19-1968)
consulted with her attorney. Detective Marion told me the scene was then held in anticipation of
the search warrant being signed.
Detective Marion told me the other occupants of the house were Stacey's other son, Cooper Splitt
(DOB: 04-04-2005) and two males who rented the two bedrooms in the basement, Ronald
Niehouse (DOB: 06-27-1975) and Mark Pedersen (DOB: 03-08-1957). Detective Marion told me
the search warrant for the house included "evidence of cannabis or derivatives." While searching
the house. Detective Marion told me Detectives located a large amount of marijuana and what
appeared to be marijuana concentrate. Detective Marion requested I respond to assist.
Detective Dompier and 1 responded to 1639 S. Garland Court. While on scene. Detective
Johnson advised the northeast bedroom in the basement belonged to Mark and the southeast
bedroom belonged to Ronald. During a search of the bedrooms, a number of items related to the
distribution of marijuana concentrate were located. It should also be noted, no medical marijuana
caregiver or patient paperwork was located for either Mark or Ronald.
In Mark's room, items located included two composition notebooks labeled "Mark Pedersen 2015
- 2016" and "Mark Pedersen Patient Notebook." Both handwritten notebooks were filled with
names of "patients" and lists of symptoms and conditions for these "patients." Also listed were
contact information for them including cities and/or states where they are located, phone
numbers, email addresses, and some pages have the word "filled" written at the top. Also
included on some of the pages were ages with a number of them being for minors. Some of the
pages also included information about speaking with individual via telephone or being in contact
through Facebook.com. Also listed were treatments recommended and notations. There were
also a number of entries about individuals travelling here to meet. Several pages also listed
instmctions/dosage amounts for administering marijuana oil. For example, one page was dated
5/27/16 with the name Laura Votaw. Below the name it read "stage 4 colon cancer." Below this
it said "wants 60g next week. Fiy in on Wednesday 6/2 will meet here 10am at Dennys." At the
top of the page filled "6/2" was written.
While conducting a search of Mark's room. Detectives also located eight 1.75 liter Everclear
grain alcohol bottles containing a brown substance that appeared to be marijuana oil in the closets
in this bedroom. The liquid inside the bottles had an approximate total weight of 10.045
kilograms. In this closet was another Green Oil Machine oil extractor. Inside the oil extractor
was a dark brown liquid that was consistent with the liquid found in the Everclear bottles. Also
located in the room were a number of USPS shipping boxes, as well as a FedEx shipping airbill
label addressed to Teresa in Peoria, Illinois. There was also a receipt from FedEx for this package
being sent standard overnight dated August 11, 2015. Also located in this room were the
instmctions for the Green Oil machine which described how to use food grade alcohol for
extracting the oil. Detectives also located a blue tub which had among other items, marijuana that
had a gross weight, including packaging, of 2.645 kilograms. In the smaller closet Detectives
also found a locked safe, a white bucket containing four bags of marijuana with a weight of 0.950
grams (weight in bags). On top of the bucket was a plastic bowl with a blue lid containing more
marijuana with a weight (including bowl) of 0610 kilograms.
Detectives also located an article dated 8/9 by "Randy Robinson" titled 'The Shadow Healer."
The article is about Mark, and has what appears to be a hand written correction on the front page,
as well as other corrections throughout the document. The article describes Mark's process of
making cannabis oil by using alcohol to "pull the medicinal compounds like terpenes and
cannabinoids out of the plant matter." It also describes how Mark doesn't grow cannabis for his
patients, but rather makes cannabis oil. The article describes how the thick sympy oil can be
infused in cooking oils, transferred to gel caps, or taken in a gel or suppository. Detectives also
In the utility room in the basement there was what could best be described as a processing area.
There, on top of a table, Detectives located coffeefilters,a food processor with marijuana
residue, mason jars with marijuana residue, a syringe with what appeared to be marijuana and
concentrate residue. On thefloorwere several empty 1.75 liter boUles of Everclear, and a case of
six unopened bottles. In a bucket on thefloorwere a number of lids for mason jars and a blue
plastic five gallon bucket. On top of the bucket was a bag of marijuana. Inside the bucket were
several more bags of marijuana. Also located in this area was a crockpot type slow cooker on the
floor, and another with two pots in the same unit on lop of a tarp near the table. Near the table
was an upright freezer. Inside the freezer Detectives located numerous bags of marijuana, as well
as jars of marijuana and what appeared to be alcohol, and nine mason jars of what appeared to be
marijuana oil. The estimated weight of the oil in the jars is 3.465 kilograms.
A search of Mark's public Facebook.com profile showed what appeared to be mason jars, just as
we located in the freezer, covered in frost. The post associated with the photograph was dated
August 9 at 1:19 p.m. The post read "Well...vacation plans were cancelled. Pretty depressed
about that. You have no idea. But sometimes...! need to be reminded my life is not my own. I
have a purpose.. .1 can make oil. I can provide hope.. .Science has proven.. .Cannabis in
nontoxic. 25,000 years of history has overwhelmingly shown that cannabis is food. Countless
healings testify to the fact that cannabis is the single most important medicine of the 21st
century."
Another post that was dated August 6 at 2:29 a.m. had a picture of mason jars containing what
appeared to be marijuana oil/concentrate with one of the jars on a digital scale. The post read
"What am I doing at 2:30 am? Why, weighing out cancer regiments. Of course! What else
would I be doing? Cannabis is nontoxic. Cannabis is food. Cannabis is the single most
important medicine of the 21st century."
Another post dated July 12 included " I lost another cancer patient this week. I got him oil, but I
was too late. So many...so sick...waiting for me to make them oil. Without plant material, I
can't make oil, but I can clean my area...i can wash jars. Then I'll go beg for trim. Whatever it
takes..." This was accompanied by a photo of someone washing mason jars.
Another post dated June 30th read "My every day lately has been blessed with first, a dawn walk
around a beautiful and serene lake.. .Before the calls come... "Hi, I have a 2 year old daughter
with spine and brain cancer. We have no options left. I was told you could help us. Hi, we
spoke last week. My fianc^ has esophageal cancer. Is there any chance you will have oil for him
this week? Hi Mark. I have a good friend that has prostate cancer that has metastasized to the
liver. Please tell me as soon as possible when oil might be available. Hello Mark. I have triple
negative breast cancer that has metastasized to my lung. I was told that you can help me. And I
am only one. There are others across Colorado doing the very same thing. We do, because we
must. When we don't, people die. It's really that simple. It doesnt have to be that way. If
cannabis were tmly legal, healing most - of very horrific and terminal illness - could be as simple
as consuming a supplement.. .a highly nutritious super food.. .from the local grocery store. Until
then, we'll stmggle to provide for as many as we can. Help us, so we can do more.. .much
...much more.
On September 9,20161 had a search warrant signed for the safe located in Mark's room. This
search warrant was signed by the Honorable Jefferson County Judge KJ Moore. I previously
This search warrant was served on September 9,2016 at 1509 hours. I was assisted by Detective
Roubidoux and Sergeant Maestas. Inside the safe I found numerous personal papers and items
belonging to Mark, an envelope of foreign currency, and an envelope of US currency. Sergeant
Maestas and I later counted the money using the money counter at the West Metro Dmg Task
Force and the total was $7,000. These items were booked into evidence at the Jefferson County
Sheriffs Office Evidence vault.
On September 13,20161 received a letter addressed to Detective Lowewell regarding the Mark,
Ron, and the search-warrant at 1639 S. Gariand Court. The letter was from the law office of
Corry & Associates. The leUer was a request to retum properly seized, and that an attomey be
allowed to be present when any unsearched items are opened pursuant to a search warrant.
On September 22, 2016,1 asked West Metro Dmg Task Force Intelligence Analyst Cari Gardella
to request wage histories for Mark and Ronald from the Colorado Department of Labor and
Employment, in order to determine if there was any record of legitimate employment/reported
income for either of them. Records showed no reported eamings for either, and the most recent
quarter for which the Department of Labor and Employment had records was the first quarter of
2016. This information was provided by Donovan Hackler.
A request for weighing and analysis of dmg evidence was submitted to the Jefferson County
Regional Crime Laboratory on November 1,2016.
On December 7, 2016,1 again asked Analyst Gardella to again request wage histories for Ronald
and Mark, as it seemed odd men of their ages would have no wage histories. The result was the
same as in September when I previously requested this information. There was no record of any
reported eamings for either Ronald or Mark in Colorado or nationwide. Again, this seemed
unusual based on their ages to not have any record of legitimate taxable eamings, so Analyst
Gardella called the Colorado Department of Labor and Employment and the information above
was confirmed. At this time, Analyst Gardella was in contact with Ritchie Sauceda of the
Department's Investigations and Criminal Enforcement Division.
On December 20, 2016,1 received the laboratory results in this case from the Jefferson County
Regional Crime Lab. The laboratory report was completed by Lisa Lehl and was dated December
6,2016.
The results indicated items #13a - 13k were tested and contained marijuana. Jtems #20a - 20h,
items 21a - 21 b, items 23, 26, 27, and 28 all contained Tetrahydrocannabinol. Other items
submitted were not tested due to JCRCL Sample Selection Guidelines (weight threshold). The
total net weight of marijuana plant material is 2,599.1 grams (approximately 5.73 pounds), and
the total net weight of marijuana concentrate is 11,737.23 grams (approximately 25.88 pounds).
Based on the aforementioned information, your affiant believes there is probable cause to
issue and arrest warrant for Niehouse, Ronald, DOB: 06-27-1975, White male, 5' 10", 180
pounds, brown hair and brown eyes, Driver's license # 16-258-0994, Social Security # 545-61-
