4."Equipment"meansthemodem,routerand/orotherequipmentprovidedbyVerizonforusewiththeService.
Fortheavoidanceofdoubt,theterm"Equipment"shallincludeanyrouterprovidedtoyoubyVerizonthatis
eitherrentedbyyouorotherwiserequiredtobereturnedtoVerizonuponterminationorcancellationofService,
butshallnotincludeanyrouterthatyoupurchasefromVerizonorathirdparty.
5."Service"meansallVerizon,BroadbandServiceandWiFiwirelessInternetaccessservices(where
applicable),Software,Equipment,Content,AdditionalServicesasdefinedinAttachmentB,technicalsupport,
domainnameserver("DNS")andrelatedservices(includingfunctionalitythatenablesthedeliveryofVerizon
messagestoyourinternetbrowser),VerizonToolbar,VerizonWebSitesandotherproductsandservices
providedbyVerizonunderthepricingplanapplicabletoyourService.TheServicedoesnotincludevoice
telephonyservices,butmayincludeemailservices,assetforthinAttachmentB.

3.REVISIONSTOTHISAGREEMENT.

ThecurrentversionofthetermsofthisAgreementshallbeavailableonhttps://www.verizon.com/terms.

FromtimetotimewewillmakerevisionstothisAgreementandthepoliciesrelatingtotheServiceincludingto
theprovisionsthatgovernthewaythatyouandVerizonresolvedisputes.Wewillprovidenoticeofsuch
revisionsbypostingrevisionstotheWebsiteAnnouncementspage,sendinganemailtotheemailaddressthat
youprovidetoreceivecommunicationsfromus(your"PrimaryEmailAddress"),orsuchothermethodprovided
forinSection15ofthisAgreement.YouagreetovisittheAnnouncementspageperiodicallyandtocheckyour
emailboxtoreviewanysuchrevisions.YoualsoagreetonotifyVerizonimmediatelyofanychangesinyour
PrimaryEmailAddress.Wewillprovideyouwithatleastthirty(30)days'noticepriortotheeffectivedateof
anyincreasestothemonthlypriceofyourServiceorBundledServiceplan(excludingotherchargesasdetailed
inSections9.1(a)(d))revisionstoanyothertermsandconditionsshallbeeffectiveonthedatenotedinthe
postingand/oremailwesendyou.Unlessweprovideotherwise,youaccepttherevisionsandagreetoabideby
thembycontinuingtousetheServiceaftertherevisionsareeffective.

4.AUTHORIZEDUSER,ACCOUNTUSE,ANDRESPONSIBILITIES.

1.LegalAuthority.Youacknowledgethatyouareeighteen(18)yearsofageorolderandthatyouhavethe
legalauthoritytoenterintothisAgreement.YouagreepromptlytonotifyVerizonwheneveryourpersonalor
billinginformationchanges.

2.UseofyourServiceandAccountandCompliancewithApplicableAuthority.Youareresponsibleforall
useofyourServiceandaccount,whetherbyyouorsomeoneusingyouraccountwithorwithoutyour
permission,includingallsecondaryorsubaccountsassociatedwithyourprimaryaccount,andtopayforall
activityassociatedwithyouraccount.Youagreetocomplywithallapplicablelaws,regulationsandrules
regardingyouruseoftheServiceandtoonlyusetheServicewithintheUnitedStates(unlessotherwise
permittedbythisAgreement).

3.RestrictionsonUse.TheServiceisaconsumergradeserviceandisnotdesignedfororintendedtobeused
foranycommercialpurpose.Youmaynotresell,reprovisionorrenttheService,(eitherforafeeorwithout
charge)orallowthirdpartiestousetheServiceviawired,wirelessorothermeans.Forexample,youmaynot
provideInternetaccesstothirdpartiesthroughawiredorwirelessconnectionorusetheServicetofacilitate
publicInternetaccess(suchasthroughaWiFihotspot),useitforhighvolumepurposes,orengageinsimilar
activitiesthatconstitutesuchuse(commercialornoncommercial).IfyousubscribetoaBroadbandService,
youmayconnectmultiplecomputers/deviceswithinasinglehometoyourmodemand/orroutertoaccessthe
Service,butonlythroughasingleVerizonissuedIPaddress.Youalsomaynotexceedthebandwidthusage
limitationsthatVerizonmayestablishfromtimetotimefortheService,orusetheServicetohostanytypeof
server.ViolationofthisSectionmayresultinbandwidthrestrictionsonyourServiceorsuspensionor
terminationofyourService.

5.PRIVACYPOLICYLEGALCOMPLIANCE.

PersonalinformationyouprovidetoVerizonisgovernedbyourPrivacyPolicy,whichispostedontheWebsite
andissubjecttochangefromtimetotime.Verizonreservestherighttoprovideaccountanduserinformation,
includingemail,tothirdpartiesasrequiredorpermittedbylaw(suchasinresponsetoasubpoenaorcourt
order),andtocooperatewithlawenforcementauthoritiesintheinvestigationofanycriminalorcivilmatter.
Suchcooperationmayinclude,butisnotlimitedto,monitoringoftheVerizonnetworkconsistentwith
applicablelaw.Inaddition,Verizonisrequiredbylawtoreportanyfactsorcircumstancesreportedtous,orthat
wediscover,fromwhichitappearstheremaybeaviolationofthechildpornographylaws.Wereservetheright
toreportanysuchinformation,includingtheidentityofusers,accountinformation,imagesandotherfactsto
lawenforcementpersonnel.

6.AVAILABILITYOFANDCHANGESTOSERVICE.

1.ServiceandBandwidthAvailabilityandSpeed.TheServiceyouselectmaynotbeavailableinallareas
orattherates,speeds,orbandwidthgenerallymarketed,andsomelocationsmaynotqualifyforthe
Serviceevenifinitialtestingshowedthatyourlinewasqualified.WewillprovisionqualifiedHSIlinesat
themaximumlinerateavailabletoyourlocationbasedonourstandardlinequalificationprocedures,
unlessyouhaveselectedalevelofservicewithalowermaximumlinerate.Bandwidthisprovidedona
perline(notaperdevice)basis.Thebandwidthavailabletoeachdeviceconnectedtothenetworkwill
varydependinguponthenumber,typeandconfigurationofdevicesusingtheServiceandthetypeofuse
(e.g.,streamingmedia),amongotherfactors.ThespeedoftheServicewillvarybasedonnetworkor
Internetcongestion,yourcomputerconfiguration,youruseofFiosTVvideoondemandservice,the
conditionofyourtelephonelineandthewiringinsideyourlocation,amongotherfactors.Weandour
suppliersreservetheright,atanytime,withorwithoutpriornoticetoyou,torestrictorsuspendthe
Servicetoperformmaintenanceactivitiesandtomaintainsessioncontrol.

2.Changestoyourlocalvoicetelephonyservice.Ifyouchangeyourlocaltelephonecompanyordiscontinue
yourlocaltelephoneservice,wemayinourdiscretioneitherterminateyourServiceorcontinuetoprovide
BroadbandServicewithoutlocalVerizonvoiceserviceatthethencurrentrates,termsandconditionsapplicable
toyournewServiceplanandyouagreetopayanyneworhighermonthlyfeethatmayapplytoyournew
Serviceplan.IfweelecttoterminateyourServiceunderthisSection6.2,thenwereservetherighttochargeany
ETFandtoapplytheEquipmentreturntermsunderSection10.5.

3.ConversionfromDSLServicetoVerizonFiosInternetService.WhenVerizonisabletoprovisionService
utilizingfiberoptictechnologies,wemayinourdiscretionterminateyourDSLServiceandceaseofferingDSL
Servicetoyourlocation.Insuchcase,wewillofferyouVerizonFiosInternetServiceatthethenapplicable
ratesandterms,whichmaydifferfromyourpreviousDSLServiceratesandterms.IfyouareonaTermPlan
andVerizonterminatesorceasestoofferservicetoyourlocationunderthisSection6.3,youshallnotbeliable
topaytheETF.

4.ChangestoServiceorFeatures.Verizonreservestherighttochangeanyofthefeatures,Content,equipment
authorizedbyVerizonforuseinconnectionwiththeService,orapplicationsoftheServiceatanytimewithor
withoutnoticetoyou.ThisincludestheportalserviceswemaymakeavailableaspartoftheServiceorforan
additionalcharge.

7.SOFTWARELICENSESANDTHIRDPARTYSERVICES.

1.SoftwareforusewithService.Wemayprovideyou,forafeeoratnocharge,softwareforuseinconnection
withtheServicewhichisownedbyVerizonoritsthirdpartylicensors,providersandsuppliers("Software").In
somecases,theSoftwaremayenableVerizontodelivermessagestoyou.Wereservetherightperiodicallyto
update,upgrade,change,oraddnewSoftwareremotelyorotherwiseandtomakerelatedchangestothesettings
andsoftwareonyourcomputerorEquipment,oranyequipmentauthorizedbyVerizonforuseinconnection
withtheService,andyouagreetopermitsuchchangesandaccesstoyourcomputer,Equipment,andanysuch
equipmentauthorizedbyVerizonforuseinconnectionwiththeService.YoumayusetheSoftwareonlyin
connectionwiththeServiceandfornootherpurpose.

2.EndUserLicenseAgreement.CertainSoftwaremaybeaccompaniedbyanenduserlicenseagreement
("EULA")fromVerizonorathirdparty.YouruseoftheSoftwareisgovernedbythetermsofthatEULAandby

otherwisetransfertheSoftwaretoanythirdparty.Youmaynotremoveoralteranytrademark,tradename,
copyrightorotherproprietarynotices,legends,symbols,orlabelsappearingonorincopiesoftheSoftware.
YouarenotgrantedanytitleorrightsofownershipintheSoftware.Youacknowledgethatthislicenseisnota
saleofintellectualpropertyandthatVerizonoritsthirdpartylicensorscontinuetoownallright,titleand
interest,includingbutnotlimitedtoallcopyright,patent,trademark,tradesecret,andmoralrights,tothe
Softwareandrelateddocumentation,aswellasanycorrections,updatesandupgradestoit.TheSoftwaremay
beusedintheUnitedStatesonly,andanyexportoftheSoftwareisstrictlyprohibited.

4.TimePeriodforUseofSoftwareorAdditionalServices.YourlicensetousetheSoftwareorany
AdditionalServiceswillremainineffectuntilterminatedbyVerizonoritsthirdpartylicensors,oruntilyour
Serviceisterminated.UponterminationofyourService,youmustceasealluseofandimmediatelydeletethe
Softwarefromyourcomputerorotherdevice.

5.EULAofThirdPartyProvider.Ifyousubscribetoorotherwiseuseanythirdpartyservicesofferedby
Verizon,youruseofsuchservicesissubjecttotheEULAofthatthirdpartyprovider.Violationofthoseterms
may,inoursolediscretion,resultintheterminationofyourService.

6.OwnershipofIntellectualPropertyRights.Alltitleandintellectualpropertyrights(includingwithout
limitation,copyrights,patents,trademarksandtradesecrets)inandtotheVerizonWebSites(includingbutnot
limitedto,relatedsoftware,images,photographs,animations,video,audio,music,text,andcontent),areowned
byVerizon,itsaffiliatesorlicensors.Alltitleandintellectualpropertyrightsinandtotheinformationand
contentwhichmaybeaccessedthroughuseoftheVerizonWebSitesarethepropertyoftherespectivecontent
ownerandmaybeprotectedbyapplicablecopyrightorotherintellectualpropertylawsandtreaties.This
Agreementdoesnotgrantyouanyrightstousesuchcontent,nordoesitgrantanyrightstotheVerizonWeb
Sites,otherthantherighttousetheVerizonWebSitesaccordingtothetermsoftheAgreement.

7.VerizonWiFi.VerizonWiFiSoftwareandServicesareprovidedbyathirdpartyprovider.

8.VERIZONTOOLBAR.

1.VerizonErrorAssist.Aspartoftheinstallationprocess,theVerizonToolbarwillrequestyourconsentto
receiveVerizonErrorAssistpagesandtochangeyourdefaultwebsearchprovidersettings.

2.UsageData.TheVerizonToolbarmaycommunicatecertainnonpersonallyidentifiableusageinformationto
Verizonand/orthirdpartylicensorstohelpVerizonanditslicensorscompileaggregatestatisticalusagedatafor
theVerizonToolbarincludingbutnotlimitedtodataregardingthenumberofVerizonToolbarinstallations,
uniqueusersandsearchesperformed.Suchaggregatedstatisticalinformationwillnotincludeanyinformation
thatindividuallyidentifiesVerizonToolbarusers.TheVerizonToolbarcollectsuser'sIPaddressesforthesole
purposeofenablingpropergeographiclocalization,suchaspresentingweatherinformationbasedonauser's
currentlocation.WhiletheIPaddressisstoredforbackuppurposes,neitherVerizonnoritslicensorsusethis
informationforanypurposeotherthangeographiclocalization.TheVerizonToolbardoesnotcollectany
informationthatindividuallyidentifiesusers.
3.UninstallingtheVerizonToolbar.Onceinstalled,theVerizonToolbarSoftwarewillautomaticallylaunch
everytimeyouexecutetheMicrosoftInternetExplorerand/orMozillaFirefoxbrowserprograms.Youmay
uninstalltheVerizonToolbarSoftwareatanytimebyclickingon"Settings"toolonthefarrightsideofthe
VerizonToolbar,andselecting"Uninstall"orbyusingthestandarduninstallproceduresincludedaspartofyour
computer'soperatingsystem.

4.VerizonToolbarSoftware.VerizonToolbarSoftwareisprovidedbyVisicomMedia,Inc.,whichisathird
partybeneficiaryofthisAgreementcapableofenforcingitstermsindependentlyfromVerizon.

9.PRICINGBILLINGCHANGESTOSERVICEPLANSANDPAYMENT.

1.PricesandFees.YouagreetopaythefeesapplicabletoyourServiceorBundledService,eitherona
monthlyorprepaidbasis,asapplicable,andtopay:a)applicabletaxes,b)surcharges,c)recoveryfees,d)
telephonecharges,e)activationfees,f)installationfees,g)setupfees,h)equipmentcharges,i)ETFs,andj)
otherrecurringandnonrecurringchargesassociatedwiththeServiceplanyouhaveselected.Thetaxes,feesand
otherchargesdetailedin(a)(d)abovemayvaryonamonthlybasis.Surchargesandrecoveryfeesarenottaxes
andarenotrequiredbylaw,butaresetbyVerizonandmaychange.Youalsoagreetopayanyadditional
chargesorfeesappliedtoyouraccount,includinginterestandchargesduetoinsufficientcreditorinsufficient
funds.

2.Billing.Nonrecurringchargessuchassetup,activationandinstallationfees,andcertainequipmentcharges,
willbeincludedinyourfirstbill.MonthlyServiceandBundledServicerecurringchargeswillbebilledone
monthinadvanceanyusagechargeswillbebilledinarrears.PrepaidpricingplansforAdditionalServiceswill
bebilledinadvance.Basedonyourelectionandsubjecttoourapproval,Verizonoritsagentwillbillyou
directly,orbillyourchargecardorlocalVerizonbill(whereavailable).IFYOUELECTTOBEBILLEDON
YOURVERIZONBILL,BYUSINGTHESERVICESYOUAGREETOHAVEALLSERVICECHARGES
INCLUDEDONYOURBILL.IFYOUSUBSCRIBETOABUNDLEDSERVICEPLAN,THENALLOF
THESERVICESINCLUDEDINTHEBUNDLEDSERVICEPLANMUSTBEBILLEDONYOUR
VERIZONBILL.IfyouenrollinVerizon'sPaperlessBillingprogram,youagreetoviewandpayyourbill
electronicallyeachmonthandtoprovideVerizonwithcurrent,accurate,complete,andupdatedinformation
includingyourlegalname,address,telephonenumber(s),emailaddressandapplicablepaymentdatasuchas
yourbankaccountnumber.YouagreetonotifyVerizonimmediatelyofanychangesinyouremailaddressor
otherregistrationorpaymentdata.Youwillnolongerreceiveapaperbill.Instead,eachmonthyouwillreceive
anemailnotifyingyouthatyourbillisavailableonlineforviewingandpaymentatverizon.com.Youmust
continuetopayyourpaperbilluntilyoureceiveyourfirstemailnotificationthatyourbillisavailableonline.If
yourelectronicpaymentisrejectedforanyreason,Verizonmaychargeareturnitemfee(wherepermissible),
cancelyourenrollmentinthePaperlessBillingprogramandresumesendingyoupaperbills.Ifyouwishto
revokeconsenttopaperlessbillingandreceiveapaperbill,selectthe"Account"tabonMyVerizon,thenselect
AccountOverview,thenselect"PaperlessBilling"andfollowthepostedinstructions.Ifyouuseathirdpartybill
paymentvendorordistributortoreceiveandpayyourVerizonbill,Verizonisnotresponsiblefortheaccuracy
andtimelinessofyourbillpayments.IfyoudeenrollfromreceivingyourVerizonbillatyourhomebanking
serviceprovider'swebsite,wewillresumesendingyouapaperbill.BillingforBroadbandServiceswill
automaticallybeginonthedateprovisioningofyourBroadbandServiceiscomplete("ServiceReadyDate")
whichwillbetheDueDateestablishedbyVerizon(aftertheEquipmenthasbeendelivered)ifyouareself
installingtheService.BillingforAdditionalServiceswillbeginonyourServiceReadyDateifyouarealso
orderinganewBroadbandService.Otherwise,billingforAdditionalServiceswillbeginuponsubmissionof
yourorder,unlessotherwisenoted.Wemay,atourelection,waiveanyfeesorcharges.Ifyoucancelany
componentofaBundledServicesplan,themonthlychargesfortheremainingservicesonyouraccountwill
automaticallyconverttotheapplicableexisting,nondiscountedmonthtomonthservicerate.

3.PlanswithMinimumTerms.IfyouchooseaServiceorBundledServicesplanwithaminimumterm
commitment,youagreetomaintainyourServiceforthetermofthatplan(a"TermPlan").ForBroadband
Services,yourTermPlanbeginsonthelaterof:(a)thedateyouchangeyourexistingBroadbandServiceplanto
aTermPlanor(b)yourServiceReadyDateforBundledServices,yourTermPlanbeginsonceallBundled
Serviceshavebeenprovisioned.YouwillbeginreceivinganydiscountassociatedwithaBundledServicesplan
onceallBundledServiceshavebeenprovisioned.AttheendofanyTermPlanyoumaybegiventheoptionto
selectanewTermPlan.IfyoudonotselectanewTermPlan,yourServicewillautomaticallyconverttoa
monthtomonthServiceplanatamonthlyfeethatmaybehigherthanyourcurrentrate.Ifyouselectanew
TermPlan,thetermsofthatplanwillapply.

4.PrepaidServicePlansforAdditionalServices.Youmaybegiventheoptiontoselectaprepaidservice
planforAdditionalServices("PrepaidServicePlan")whichwillbeginonthelaterof:(a)thedateofyourorder,
or(b)thedateyouchangetothePrepaidServicePlan.TherewillbenorefundsforPrepaidServicePlans.At
theendofanyPrepaidServicePlan,youmaybegiventheoptiontoselectanewPrepaidServicePlan.Ifyoudo
notselectanewPrepaidServicePlan,yourServicewillautomaticallyconverttothethencurrentmonthto
monthratefortheAdditionalService.

5.DataCharges.Youacknowledgeandagreethatyoumayalsoincurdatachargesorfeesfromawirelessor
internetserviceprovider(whichmaybeVerizonorathirdparty)foraccessingonlineservicesorpurchasing
productsandservicesthroughinteractiveoptionsavailablethroughtheService.Youaresolelyresponsiblefor
allchargesorfeespayabletoVerizonorthirdparties,includingallapplicabletaxes,andyouaresolely
responsibleforprotectingthesecurityofcreditcardandotherpersonalinformationprovidedtothirdpartiesin
connectionwithsuchtransactions.

6.MoneyBackGuarantee.Ifweprovideamoneybackguarantee("MBG")foryourService,itwillbeginon
yourServiceReadyDate.DuringthisMBGperiodyoumaycancelyourServiceandreceiveafullrefundofall
monthly,onetimeandequipmentchargespaidtoVerizon(providedyoureturnallEquipmentingoodworking
condition).IfyoufailtoreturntheEquipment,anunreturnedEquipmentfeewillapply.ETFswillnotapplyto
ServiceterminatedwithintheMBGperiod.TheMBGdoesnotapplytocustomerswhochangebetweenor
renewbundle,monthly,termorotherpricingplans.TheMBGislimitedtooneperSubscriberperServicetype
perServiceaddress.

7.DiscontinuationofServiceforNonpayment.WemaydiscontinueyourServicewithoutnoticeifService
chargesonyourtelephonebillorchargecardarerefusedforanyreason,orifyoufailtomakepaymentwhen
dueortoprovideuswithanewchargecardexpirationdatebeforetheexistingdateexpires.

8.LateFees.Ifanyportionofyourbillisnotpaidbytheduedate,Verizonmaychargeyoualatefeeonunpaid
balancesandmayalsoterminateorsuspendyourServicewithoutnotice.Ifyourchargesarebilledbyyour
Verizonlocalcarrier,thelatefeewillbeequaltothelatepaymentchargethatthelocalexchangecarrierapplies.
Otherwise,thelatefeewillbethelesserof1.5%permonth,orthehighestratepermittedbylaw.IfVerizonuses
acollectionagencyorlegalactiontorecovermoniesdue,youagreetoreimburseusforallexpensesweincurto
recoversuchmonies,includingattorneysfees.

9.LimitationonSpecialPricingPromotions.Youmayonlytakeadvantageofonespecialpricingpromotion
duringanyconsecutivetwelve(12)monthperiod.Eligibilityforpromotionaloffersmaybecontingentupon
paymentofalloutstandingVerizoncharges.

10.RefundableDeposit.Wemayrequirethatyouprovideuswitharefundabledeposit,whichwillbespecified
atthetimeofyourorderWemayalsorequireanadditionaldepositafteractivationoftheServiceifyoufailto
payanyamountswhendue.Withinninety(90)daysafterterminationofyourService,wewillreturnyour
SubscriberDeposit,lessanyunpaidamountsdueonyouraccount,includinganyamountsowedforunreturned
ordamagedEquipment.Amountsheldondepositwillnotaccrueinterestexceptasrequiredbylaw.

11.CreditRelatedMatters.WemayevaluateyourcredithistorybeforemodifyingorprovidingyouService.In
ordertoestablishanaccountwithusand/orobtainormodifyService,wemayobtainareportfromaconsumer
creditagencyorexchangeinformationwithouraffiliatesinconnectionwithdeterminingyourcreditworthiness.
Ifyoufailtopayyourbill,wemaysubmitanegativecreditreporttoacreditreportingagency,whichwill
negativelyaffectyourcreditreport.
10.TERMINATIONORSUSPENSIONOFSERVICE.

1.SubscriberswithMonthtoMonthAccounts.IfyouareamonthtomonthServicecustomer,eitheryouor
VerizonmayterminatethisAgreementanytimeandforanyreasonbygivingnoticetotheotherassetforthin
thisAgreement.Unlessotherwiserequiredbyapplicablelaw,terminationwillbeeffectiveonthelastdayofthat
month'sbillingcycle,andyouareresponsibleforallchargesincurredthroughthatdate.Activationorsetup
feespaidattheinitiationofyourService,ifany,arenotrefundable,exceptduringanyapplicableMBGperiod.

2.SubscriberswithTermPlansEarlyTerminationFee.EXCEPTASOTHERWISESETFORTHINTHIS
AGREEMENT,IFYOURBROADBANDSERVICEORANYCOMPONENTOFABUNDLEDSERVICE
PLANISTERMINATEDBYYOUORBYUSASARESULTOFVIOLATIONBYYOUOFTHIS
AGREEMENTBEFORECOMPLETINGYOURTERMPLAN,THENYOUAGREETOPAYVERIZON
THEETFSETFORTHINTHEPRICINGPLANYOUHAVECHOSEN.IfyouterminateServiceatyour
location,yourexistingTermPlancannotbecarriedovertoanewServicelocation.Unlessotherwiserequiredby
applicablelaw,terminationwillbeeffectiveonthelastdayofthatmonth'sbillingcycle,andyouareresponsible
forallchargesincurredthroughthatdate.

3.Terminationand/orSuspensionbyVerizon.Verizonreservestherighttochange,limit,terminate,modify
ortemporarilyorpermanentlyceaseprovidingtheServiceoranypartofitwithorwithoutpriornoticeifwe
electtochangetheServiceorapartthereoforifyouviolatethetermsofthisAgreement.IfVerizonterminates
yourServiceunderthisSection10.3,youmustimmediatelystopusingtheServiceandyouwillberesponsible
foranyapplicablefeesand/orEquipment(orequipment)chargessetforthinSections9and10.Ifthe
terminationisaresultofviolationbyyouofthetermsofthisAgreement,youalsoshallbeliabletopaytheETF.
IfVerizonterminatesorceasestoofferservicetoyourlocation,youshallnotbeliabletopaytheETF.Ifyour
Serviceisreconnected,areconnectionfeemayapply.

4.DeletionofDatauponTermination.YOUAGREETHATIFYOURSERVICEISTERMINATEDFOR
ANYREASON,VERIZONHASTHERIGHTTOIMMEDIATELYDELETEALLDATA,FILESAND
OTHERINFORMATION(INCLUDINGANYEMAILS,ADDRESSBOOKAND/ORWEBSTORAGE
CONTENT)STOREDINORFORYOURACCOUNTWITHOUTFURTHERNOTICETOYOU.

5.ReturnofEquipmentuponTermination.IfyourHSIServiceisterminatedforanyreasonpriortotheend
ofthefirstyearofserviceandyoureceivedEquipmentfromVerizon,youmustreturntheEquipmenttoVerizon
oryouwillbechargedfortheEquipment.Exceptassetforthbelow,ifyourFiosInternetserviceisterminated
foranyreasonandyoureceivedEquipment,youmustreturntheEquipmenttoVerizonwithin30days,as
instructedbyVerizon,oryouwillbechargedfortheEquipment.FailuretoreturnanyEquipmentyoureceived
fromVerizon,orreturningEquipmentinadamagedcondition(subjectonlytoreasonablewearandtear),will
resultintheimpositionofanEquipmentfeethatmaybesubstantial.IftheEquipmentisaffixedwithalabel
whichincludesthefollowing(orsimilar)message,"PROPERTYOFVERIZON.DONOTREMOVEFROM
PREMISES,"thenyoumustnotreturntheEquipmentandyouwillnotbechargedanEquipmentfeeaslongas
theEquipmentisleftinplaceinreasonablecondition(subjectonlytoreasonablewearandtear).

11.MANAGEMENTOFYOURDATA,COMPUTERANDOTHERDEVICES.

1.YourResponsibilitiesRegardingManagementofYourComputer,OtherDevicesandData.Exceptasset
forthinthetermsandconditionsofanyapplicablewarrantyprovidedwiththesaleofequipmentbyVerizonand
purchasedbyyoufromVerizon,youaresolelyresponsibleforobtaining,maintainingandupdatingall
equipmentandsoftwarenecessarytousetheService,andformanagementofyourinformation,includingbut
notlimitedtobackupandrestorationofyourdata.YOUAGREETHATVERIZONISNOTRESPONSIBLE
FORTHELOSSOFYOURDATAORFORTHEBACKUPORRESTORATIONOFYOURDATA
REGARDLESSOFWHETHERTHISDATAISMAINTAINEDONOURSERVERSORYOURDEVICE(S).
YOUSHOULDALWAYSBACKUPANYIMPORTANTINFORMATIONSEPARATELYFROMDATA
STOREDONVERIZON'SORANYTHIRDPARTY'SSERVERS.
2.ContentandDataManagementbyVerizon.Wereservetherightto:(a)use,copy,display,store,transmit
andreformatdatatransmittedoverournetworkandtodistributesuchcontenttomultipleVerizonserversfor
backupandmaintenancepurposesand(b)blockorremoveanyunlawfulcontentyoustoreonortransmittoor
fromanyVerizonserver.Wedonotguaranteetheprotectionofyourcontentordatalocatedonourserversor
transmittedacrossournetwork(orothernetworks)againstloss,alterationorimproperaccess.

3.YourResponsibilitiesRegardingSecurity.Youagreethatyouaresolelyresponsibleformaintainingthe
securityofyourcomputer(s),device(s)anddata,includingwithoutlimitation,encryptionofdataandprotection
ofyourUserID,passwordandpersonalandotherdata.Ifyoubelieveyourlogincredentialshavebeenlostor
stolen,orthatsomeonehasgainedaccesstoyouraccountorlogincredentialswithoutyourpermission,callus
immediatelyat18008374966.WESTRONGLYRECOMMENDTHEUSE(ANDAPPROPRIATE
UPDATING)OFCOMMERCIALANTIVIRUS,ANTISPYWAREANDFIREWALLSOFTWARE.Useof
theVerizonnetworkforthedistribution,operation,andmaintenanceofmalicioussoftware(viruses,bots,
worms,Trojanhorses,etc.)isprohibited.Communicationstomaliciousdomainnames(e.g.,domainnamesused
bynetworksofmachinesrunningmalicioussoftware)andtomaliciousInternetprotocoladdresses(e.g.,IP
addressesusedbynetworksofmachinesrunningmalicioussoftware)mayberedirectedbyVerizontoour
networksecuritysystemsatanytimewithoutnoticeasacountermeasureagainsttheoperationofmalicious
softwaresuchas"botnets"intheVerizonnetwork.Verizon'ssecuritysystemsmayretaincertaininformation
suchasthedateandtimeofthemaliciouscommunication,theIPaddressitoriginatedfrom,thedomainname
involved,andothertechnicalinformationforcybersecuritypurposes.Oursecuritysystemsareconfiguredtonot
retainenduserinformationcontainedinthepayloadoftheapplicationlayer,ifany,thatisdeliveredoruploaded
bythecompromisedmachines.WESTRONGLYRECOMMENDTHEUSE(ANDAPPROPRIATE
UPDATING)OFCOMMERCIALANTIVIRUS,ANTISPYWAREANDFIREWALLSOFTWARE.

4.MonitoringofNetworkPerformancebyVerizon.Verizonautomaticallymeasuresandmonitorsnetwork
performanceandtheperformanceofyourInternetconnectionandournetwork.Wealsowillaccessandrecord
informationaboutyourcomputerandEquipment'sprofileandsettingsandtheinstallationofsoftwarewe
provide.YouagreetopermitustoaccessyourcomputerandEquipmentandtomonitor,adjustandrecordsuch
data,profilesandsettingsforthepurposeofprovidingtheService.YoualsoconsenttoVerizon'smonitoringof
yourInternetconnectionandnetworkperformance,andtoouraccessingandadjustingyourcomputerand
Equipmentsettings,astheyrelatetotheService,Software,orotherservices,whichwemayofferfromtimeto
time.Wedonotshareinformationcollectedforthepurposeofnetworkorcomputerperformancemonitoringor
forprovidingcustomizedtechnicalsupportoutsideofVerizonoritsauthorizedvendors,contractorsandagents.
Verizonreservestherighttomodifythepassword(s)fortherouter(s)usedwiththeServiceinordertosafeguard
Internetsecurity,thesecurityandprivacyofSubscriberinformation,whererequiredbylaw,and/orforother
goodcausetoprovide,upgradeandmaintaintheService,protectthenetwork,otherusersoftheInternet,orour
Subscribers.ShouldVerizonchangesuchpassword(s),wewillusereasonablemeanstonotifytheSubscribers
affected,whichmayincludeemailtoaPrimaryEmailAddressonfileand/orthroughnoticeontheWebsite.

12.LIMITATIONSONUSEOFTHESERVICE.

1.YouacknowledgeandagreethatVerizon(a)isnotresponsibleforinvaliddestinations,transmissionerrors,or
thecorruptionofyourdataand(b)doesnotguaranteeyourabilitytoaccessallwebsites,serversorother
facilitiesorthattheServiceissecureorwillmeetyourneeds.

2.YouacknowledgethattheServicewillallowaccesstoinformationwhichmaybesexuallyexplicit,obscene
oroffensive,orotherwiseunsuitableforchildren.YouagreethatthesupervisionofuseoftheServiceby
childrenisyourresponsibilityandthatVerizonisnotresponsibleforaccessbyyouoranyotherusersto
objectionableoroffensivecontent.VERIZONSTRONGLYRECOMMENDSTHEUSEOF
COMMERCIALLYAVAILABLECONTENTFILTERINGSOFTWARE.

3.YouunderstandandagreethatifyoutypeanonexistentorunavailableUniformResourceLocator("URL"),
orenterasearchtermintoyourbrowseraddressbar,VerizonmaypresentyouwithaVerizonErrorAssistweb
searchpagecontainingsuggestedlinksbaseduponthequeryyouenteredinlieuofyourreceivingan
NXDOMAINorsimilarerrormessage.Verizon'sprovisionoftheErrorAssistpagemayimpactapplications
thatrelyonanNXDOMAINorsimilarerrormessageandmayoverridesimilarbrowserbasedsearchresults
pages.IfyouwouldprefernottoreceiveErrorAssistpagesfromVerizon,youshouldfollowtheoptout
instructionsthatareavailable(a)byclickingonthe"About"linkonanyErrorAssistpageand(b)iftheVerizon
Toolbarisinstalledonyourcomputer,byselectingToolbarSettings(thewrenchiconontherightsideofthe
VerizonToolbar)andselectingthe"DisableErrorAssist"option.

4.YouarenotauthorizedtouseanyVerizonnameormarkasahypertextlinktoanyVerizonWebsiteorinany

16.GENERALPROVISIONS.

1.AllobligationsofthepartiesunderthisAgreement,which,bytheirnature,wouldcontinuebeyondthe
terminationofthisAgreement,includingwithoutlimitation,thoserelatingtoLimitationofLiability(Section13)
andIndemnification(Section14),shallsurvivesuchtermination.

2.Verizonwillnotbeliablefordelays,damagesorfailuresinperformanceduetocausesbeyonditsreasonable
control,including,butnotlimitedto,actsofagovernmentalbody,actsofGod,actsofthirdparties,fires,floods,
strikes,workslowdownsorotherlaborrelatedactivity,oraninabilitytoobtainnecessaryequipmentor
services.
3.YoumaynotassignorotherwisetransferthisAgreement,oryourrightsorobligationsunderit,inwholeorin
part,toanyotherperson.Anyattempttodososhallbevoid.Wemayfreelyassignalloranypartofthis
Agreementwithorwithoutnoticeandyouagreetomakeallsubsequentpaymentsasdirected.

4.Exceptasotherwiserequiredbylaw,youandVerizonagreethattheFederalArbitrationActandthe
substantivelawsofthestateofthecustomer'sbillingaddress,withoutreferencetoitsprinciplesof
conflictsoflaws,willbeappliedtogovern,construeandenforcealloftherightsanddutiesoftheparties
arisingfromorrelatinginanywaytothesubjectmatterofthisAgreement.UNLESSYOUAND

isVerizonoritslicensorsandsuppliers.TheuseofSoftwareanddocumentationisfurtherrestrictedin
accordancewiththetermsofthisAgreement.AnyexportoftheSoftwareisstrictlyprohibited.

6.Verizon'sfailureatanytimetoinsistuponstrictcompliancewithanyoftheprovisionsofthisAgreement
shallnotbeconstruedtobeawaiverofsuchtermsinthefuture.IfanyprovisionofthisAgreementis
determinedtobeinvalid,illegalorunenforceable,theremainingprovisionsofthisAgreementshallremainin
fullforceandeffectandtheunenforceableportionshallbeconstruedasnearlyaspossibletoreflecttheoriginal
intentionsoftheparties.

7.ThisAgreement,includingallPoliciesreferredtohereinandpostedontheWebsite,constitutestheentire
agreementbetweenyouandVerizonwithrespecttothesubjectmatterheretoandsupersedesanyandallprioror
contemporaneousagreementswhetherwrittenororal.NochangesbyyoutothisAgreementshallbeeffective
unlessagreedtoinawritingsignedbyanauthorizedpersonatVerizon.

17.VOLUNTARYMEDIATION.

Verizonofferscustomerstheoptionofparticipatinginafreeinternalmediationprogram.Thisprogramis
entirelyvoluntaryanddoesnotaffecteitherparty'srightsinanyotheraspectofthedisputeresolution
proceduresoutlinedinSection18.Inourvoluntarymediationprogram,wewillassignanemployeewhoisnot
directlyinvolvedinthedisputetohelpbothsidesreachanagreement.Thatpersonhasalltherightsand
protectionsofamediatorandtheprocesshasalloftheprotectionsassociatedwithmediation.Forexample,

1.GeneralPolicy:VerizonreservesthesolediscretiontodenyorrestrictyourService,orimmediatelyto
suspendorterminateyourService,iftheuseofyourServicebyyouoranyoneusingit,inoursolediscretion,
violatestheAgreementorotherVerizonpolicies,isobjectionableorunlawful,interfereswiththefunctioningor
useoftheInternetortheVerizonnetworkbyVerizonorotherusers,orviolatesthetermsofthisAcceptableUse
Policy("AUP").

2.SpecificExamplesofAUPViolations.Thefollowingareexamplesofconductwhichmayleadto
terminationofyourService.WithoutlimitingthegeneralpolicyinSection1,itisaviolationoftheAgreement
andthisAUPto:(a)accesswithoutpermissionorrighttheaccountsorcomputersystemsofothers,tospoofthe
URL,DNSorIPaddressesofVerizonoranyotherentity,ortopenetratethesecuritymeasuresofVerizonorany
otherperson'scomputersystem,ortoattemptanyoftheforegoing(b)transmituninvitedcommunications,data
orinformation,orengageinothersimilaractivities,includingwithoutlimitation,"spamming","flaming"or
denialofserviceattacks(c)intercept,interferewithorredirectemailorothertransmissionssentbyortoothers
(d)introduceviruses,worms,harmfulcodeorTrojanhorsesontheInternet(e)postofftopicinformationon
messageboards,chatroomsorsocialnetworkingsites(f)engageinconductthatisdefamatory,fraudulent,
obsceneordeceptive(g)violateVerizon'soranythirdparty'scopyright,trademark,proprietaryorother
intellectualpropertyrights(h)engageinanyconductharmfultotheVerizonnetwork,theInternetgenerallyor
otherInternetusers(i)generateexcessiveamountsofemailorotherInternettraffic(j)usetheServiceto
violateanyrule,policyorguidelineofVerizon(k)usetheserviceinanyfashionforthetransmissionor
disseminationofimagescontainingchildpornographyorinamannerthatisobscene,sexuallyexplicit,cruelor
racistinnatureorwhichespouses,promotesorincitesbigotry,hatredorracismor(l)downloadorusethe
ServiceinCuba,Iran,NorthKorea,SudanandSyriaortodestinationsthatareotherwisecontrolledor
embargoedunderU.S.law,asmodifiedfromtimetotimebytheDepartmentsofTreasuryandCommerce.

3.CopyrightInfringement/RepeatInfringerPolicy.Verizonrespectstheintellectualpropertyrightsofthird
parties.Accordingly,youmaynotstoreanymaterialoruseVerizon'ssystemsorserversinanymannerthat
constitutesaninfringementofthirdpartyintellectualpropertyrights,includingunderUScopyrightlaw.You
understandandagreethatanyandalluseoftheServiceissubjecttothetermsofVerizon'sCopyrightAlert
Program,whichareincorporatedbyreferenceherein.AdescriptionoftheCopyrightAlertProgramcanbe
foundathttp://myverizon.com/verizononlinetermsorhttp://verizon.com/terms.UndertheCopyrightAlert
Program,Verizonwillsendyouanalertifpossiblecopyrightinfringement,suchaspeertopeervideooraudio
filesharingisdetectedonyourInternetconnectionsothatyou,astheaccountowner,cantakestepstoprevent
anyfuturepossibleinfringement.InaccordancewiththeDigitalMillenniumCopyrightAct(DMCA)andother
applicablelaws,itisthepolicyofVerizontosuspendorterminate,inappropriatecircumstances,theService
providedtoanysubscriberoraccountholderwhoisdeemedtoinfringethirdpartyintellectualpropertyrights,
includingrepeatinfringersofcopyrights.Inaddition,Verizonexpresslyreservestherighttosuspend,terminate
ortakeotherinterimactionregardingtheServiceofanySubscriberoraccountholderifVerizon,initssole
judgment,believesthatcircumstancesrelatingtoaninfringementofthirdpartyintellectualpropertyrights
warrantsuchaction.ThesepoliciesareinadditiontoanddonotaffectormodifyanyotherrightsVerizonmay
haveunderlaworcontract.Ifyoubelievethatcopyrightedmaterialhasbeenusedinviolationofthispolicyor
otherwisebeenmadeavailableontheServiceinamannerthatisnotauthorizedbythecopyrightowner,its
agentorthelaw,pleasefollowtheinstructionsforcontactingVerizon'sdesignatedCopyrightAgentassetforth
inVerizon'sCopyrightPolicylocatedathttp://www.verizon.com/copy.html.

4.Verizonmay,butisnotrequiredto,monitoryourcompliance,orthecomplianceofothersubscribers,withthe
terms,conditionsorpoliciesofthisAgreementandAUP.YouacknowledgethatVerizonshallhavetheright,but
nottheobligation,toprescreen,refuse,moveorremoveanycontentavailableontheService,includingbutnot
limitedtocontentthatviolatesthelaworthisAgreement.

1.VERIZONONLINEBACKUP&STORAGE("STORAGESERVICES").

1.IfStorageServicesaremadeavailableasafeatureoftheService,youagreethatyouaresolelyresponsible
forallcontentyoustoreonorretrievefromsuchservices.AdditionaltermsandconditionsapplicabletoStorage
ServicesarepostedontheWebsiteandareincorporatedhereinbyreference.Youunderstandthatwedonot
providetelephonetechnicalsupportforStorageServices.StorageServicesmaybeaccessedfromanysuitable
Internetconnection.YouacknowledgeandagreethattheServiceisimplementedwithoutspecificcontrolsthat
maygenerallyberequiredorcustomaryforcustomersinanyparticularindustryandarenotdesignedtosatisfy
anyspecificlegalobligations.YouaresolelyresponsiblefordeterminingthattheServicesatisfiesanylegal,
regulatoryorcontractualobligationsYoumayhave.YouagreetousetheServicesinaccordancewithall
applicablelawsandnottousetheServicesinanymannerthatmayimposelegal,regulatoryorcontractual
obligationsonVerizonotherthanthosewithwhichWehaveexpresslyagreedtocomplyinthisAgreement.
Withoutlimitingthegeneralityoftheforegoing,Youagreenottocause,orotherwiserequestthatVerizon
create,receive,maintainortransmitprotectedhealthinformation(asdefinedat45C.F.R.160.103)forYouor
onYourbehalfinconnectionwiththeServicesorinanymannerthatwouldmakeVerizonabusinessassociate
(asdefinedat45C.F.R.160.103)toYou.

2.IfyoubreachthisAgreement,wereservetherightimmediatelytosuspendorterminateyourServiceand/or
anAdditionalService(s)withorwithoutnotice.Insuchcase,youagreethatwemayimmediatelydeletealldata,
files,andothercontentstoredonyourStorageServices,includingarchiveddata,withoutfurthernoticetoyou.It
isyourresponsibilitytoremoveorcopyanycontentstoredontheStorageServicespriortoclosureofyour
accountotherwise,itmaybelost.

3.VerizonreservestherighttoaccessyourStorageServiceaccountatanytimewithorwithoutpriornoticeto
youandtodisableaccesstoorremovecontentwhichinoursolediscretionisorreasonablycouldbedeemed
unlawful.

4.UseRequirementsforFreeStorageServicesAccounts("FreeAccount").IfyousignupforaFreeAccount,
youmustactivelyuseit.To"activelyuse"youraccountmeanstoupload,download,backuporrestorecontent
toit.IntheeventyoudonotuseyourFreeAccountforaperiodofsixty(60)calendardaysormore,then
VerizonreservestherighttocancelyourFreeAccount.Wewillprovidenoticeofcancellationbyemailtoyour
PrimaryEmailAddress.UseofyourFreeAccountwithinfourteen(14)calendardaysofthedateofyour
cancellationnoticewillpreventcancellationofyourFreeAccount.Itisyourresponsibilitytoremoveorcopy
anycontentinyourFreeAccountpriortocancellationorterminationotherwise,itwillbelost.Verizon
may,atitselection,alsodeletearchiveddata.

5.InactivityDisconnectPolicy.IfyourStorageServiceisidleforfifteen(15)minutes,itwillbesubjectto
automaticlogoff.YourStorageServicewillbedeemedtobeidleifthereappearstobenointeractive,
humangenerateddatareceivedfromtheremoteuser'scomputerwithinafifteen(15)minuteperiod.
YourStorageServicewillnotbesubjecttoautomaticlogoffifyouareaccessingyouraccountfroma
wirelessdevice.

6.VerizonOnlineBackup&SharingisprovidedbyDigiDataCorporation,whichisathirdpartybeneficiaryof
thisAgreementcapableofenforcingitstermsindependentlyfromVerizon.

2.EMAILANDEMAILMESSAGINGSERVICE.

1.EmailService.AccesstoemailservicesmaybeprovidedtocustomersbyVerizon,aVerizonaffiliate,ora
thirdparty.YouruseofanyVerizonemailservicewillbegovernedbytheseTermsofService,aswellas
Verizon'sprivacy,email,securityandantispampolicies,whichmayincludeimportantlimitationsonuseofthe
emailservicesuchasthestoragecapacityanddeletionofstoredmessages.YouruseofanyVerizonaffiliate'sor
thirdparty'semailservicewillbegovernedbytheemailprovider'stermsofservice,aswellastheemail
provider'sapplicableprivacy,email,securityandantispampolicies.

2.EmailSecurity.Verizonreservestherightinoursolediscretiontoprovidethelevelofsecuritywedeem
appropriatetosafeguardournetworkandcustomers,andotherInternetusers,againstInternetthreatsorabuses,
includingviruses,spamandphishingthreats.Thesesecuritymeasuresmayinclude,butarenotlimitedto,the
useoffirewallsandblockliststoblockpotentiallyharmfulorabusiveemailsorattachments,antispamfilters,
antivirusandantispywaresoftware,andblockingselectedports.Suchactivitiesmayresultintheblocking,
filteringornondeliveryoflegitimateandnonlegitimateemailsenttoorfromyouremailaccount.By
usinganyVerizon,VerizonAffiliateorthirdpartyemailservice,youagreethatdeliveryandreceiptof
emailisnotguaranteedandtoVerizon'suseofsuchInternetandemailsecuritymeasuresweinoursole
discretiondeemappropriate.

3.EmailAliases.ForVerizonprovidedemailservice,Verizonwillissueemailaliases(alternateemail
addresses)baseduponavailability.Youwillsurrenderyouraliasbychangingitorifyouraccountisterminated
foranyreasonandwewillnotforwardemailsaddressedtothatalias.IfyourServiceisreinstatedwecannot
guaranteeyouraliaswillstillbeavailabletoyou.Verizonaffiliateandthirdpartyemailservicewillbegoverned
bythetermsofserviceandpoliciesapplicabletothatservice.
3.VERIZONINTERNETSECURITYSUITE("VISS").

1.VISSbyRadialpoint.

1.VISSbyRadialpointismanufacturedbyRadialpointSafeCareGeneralPartnershiplocatedat2050Ruede
Bleury,Suite300,Montreal,Quebec,H3A2J5.RadialpointTMisatrademarkofRadialpointSafeCareInc.
(hereunder,alongwithRadialpointSafeCareGeneralPartnership,referredtoasRadialpoint).Thepersonal
jurisdictionandvenueprovisionsinSection16.4shallnotapplytoanycausesofactionbyoragainst
RadialpointInc.underorinrelationtothisAgreement.RadialpointInc.isathirdpartybeneficiaryofthis
AgreementcapableofenforcingitstermsindependentlyfromVerizon.

2.YouacknowledgeandconsentthatRadialpointInc.:(a)mayprovidenonpersonallyidentifiableusagedata
collectedinanonymousandaggregateform("VISSData")toitssubcontractorsinNorthAmerica,foranalysis
oftheperformanceofVISS,includingtheredundancy,reliability,anddisasterrecoverycomponentsofthe
servicesand(b)mayusesuchVISSData(i)toimproveactivationflowand/or(ii)aspartoftrendsorreports
publishedbyRadialpointInc.

2.VISSPoweredbyMcAfee.

1.VISSPoweredbyMcAfeeandVISSMultiDevicePoweredbyMcAfeearemanufacturedbyMcAfee,Inc.
locatedat2821MissionCollegeBoulevard,SantaClara,CA95054,whichisathirdpartybeneficiaryofthis
AgreementcapableofenforcingitstermsindependentlyfromVerizon.Byaccepting,accessingorusingeither
oftheseAdditionalServices,inadditiontothetermssetforthinthisAgreement,Youagreetobeboundbythe
applicabletermsoftheMcAfeeConsumerProductsEndUserLicenseAgreement,locatedat
http://home.mcafee.com/Root/AboutUs.aspx?id=eulaforthisAdditionalService,whichareincorporatedby
referenceasifsetforthinitsentiretyherein.Pleasereviewthesetermscarefullyastheycontainimportant
limitationsandconditionswithrespecttothisAdditionalService.Thepersonaljurisdictionandvenue
provisionsinSection16.4shallnotapplytoanycausesofactionbyoragainstMcAfeeInc.underorinrelation
tothisAgreement.YouacknowledgeandagreethatclaimsagainstMcAfeeregardingtheVISSPoweredby
McAfeeandVISSMultiDevicePoweredbyMcAfeeshallbegovernedbyandconstruedinaccordancewith
thesubstantivelawsoftheStateofNewYork.

2.UseofeachlicenseforVISSPoweredbyMcAfeeislimitedtoonecomputer.Updatestopreviousversionsof
VISSPoweredbyMcAfeerequireavalidlicensetothepreviousversion.Afterreceivinganupdate,youmay
continuetousethepreviousversionofVISSPoweredbyMcAfeeonthesamecomputertoassistin
transitioningtotheupdate.Previousversionsorcopiesthereofmaynotbetransferredtoanothercomputer
unlessallcopiesofupdatesarealsotransferred.PriorversionsofVISSPoweredbyMcAfeewillnotbe
supportedafteranupdatedversionhasbeeninstalled.IfyouupgradetoVISSMultiDevicePoweredby
McAfee,youwillnolongerbeabletouseVISSPoweredbyMcAfee.

3.VISSPoweredbyMcAfeeandVISSMultiDevicePoweredbyMcAfeemayincludesoftwareprograms
licensed(orsublicensed)totheuserundertheGNUGeneralPublicLicense("GPL")orothersimilarfree
softwarelicenseswhich,amongotherrights,permittheusertocopy,modifyandredistributecertainprograms,
orportionsthereof,andhaveaccesstothesourcecode("OpenSourceSoftware").TheGPLrequiresthatforany
OpenSourceSoftwarecoveredundertheGPL,whichisdistributedinanexecutablebinaryformat,thatthe
sourcecodealsobemadeavailable.WithVISSPoweredbyMcAfeeandVISSMultiDevicePoweredby
McAfee,thesourcecodeismadeavailableaspartofthedownloadpackage.IfanyOpenSourceSoftware
licensesrequirethatMcAfeeproviderightstouse,copyormodifyaprogramthatarebroaderthantherights
grantedherein,suchrightsshalltakeprecedence.

4.YouacknowledgethatVISSPoweredbyMcAfeeandVISSMultiDevicePoweredbyMcAfeeemploys
certainapplicationsandtoolstoretrievenonpersonallyidentifiableinformationaboutyourcomputersystemto
provideandsupportVISSPoweredbyMcAfeeandVISSMultiDevicePoweredbyMcAfee.Becausethis
informationisessentialtoprovidingqualityserviceanduptotheminutethreatprotection,thereisnooptout
availableforthisinformationcollection.
4.VERIZONGAMESONDEMAND.VerizonGamesonDemandaremanufacturedbyExentTechnologies,
Inc.,whichisathirdpartybeneficiaryofthisAgreementcapableofenforcingitstermsindependentlyfrom
Verizon.VerizonGamesonDemandarenotavailableforpurchaseatthistime.

5.VERIZONPREMIUMTECHNICALSUPPORTSERVICE("PTS")ANDTECHSUPPORTPRO.

1.PTSandTechSupportProServiceDescriptionandScopeofSupport.Forthepurposesofthissectionoftheis
AgreementpertainingtoPTSandtoTechSupportPro,Verizon,we,andourincludesVerizonand
Verizonsvendor(s)whomayprovideorassistinprovidingPTSand/orTechSupportPro.PTSandTech
SupportProareservicesintendedtoaddressissuesoutsidethescopeofVerizon'sstandardtechnicalsupport,,
andwhichmaybeprovidedbyathirdpartyvendor,includingwithoutlimitationPlumChoice,Inc.Forthe
purposesofthissectionofthisAgreementpertainingtoPTSandtoTechSupportPro,Verizon,weand
ourincludesVerizonandVerizonsvendor(s)whomayprovideormayassistinprovidingPTSand/orTech
SupportPro.

i.PTSincludes:(a)configurationtroubleshooting(b)evaluationofandattemptstocorrectsoftware,
operatingsystemsandnetworkingissues(c)virus/spywaresupportand(d)softwareandperipherals
supportfornetwork,videoandsoundcards,memory,harddrives,CD/DVDreader/writers,printers,
scannersandnetworkingequipmentandcertainInternetofThingsdevicesandobjectsatyourpremises
thatutilizenetworkconnectivitytosendandreceivedataand(e)supportnetworkingnonVerizondevices
toaVerizonnetwork.AllPTSandTechSupportProservicesareofferedinEnglishonly.

ii.TechSupportProincludes:(a)PTS(b)uptofivetotaltuneupsannuallyofaMACorWindowsPC
laptopordesktopcomputer(c)prioritycallhandlingbyPlumChoice(d)additionaltoolstoobtain
technicalsupportwithinthescopeofTechSupportProintheMyFiosApp,whichisavailablefor
downloadbyVerizonInternetsubscribers(e)supportwiththemigrationofdata(excludingsoftware
applications)of50GBorlesstoasupportedstoragedevice(whichdoesnotincludeserversorLinux
devices),excludingtheactivationoffilessubjecttoDigitalRightsManagement(f)advanceddata
migrationsupportforanadditionalpriceandsubjecttoadditionaltermstobeprovidedbyPlumChoice
and(g)accesstothirdpartytechnicianswhocanprovideapricequoteandseparatelycontractwithyou
foronpremisesservices(TechOnDemand).

2.LimitationsofPTSandTechSupportPro.

1.PTSandTechSupportProdonotsupportallsoftware,hardwareorInternetrelatedproducts,applicationsor
featuresandwereservetherighttodefersupportissuestoyourequipmentorsoftwarevendor.PTSandTech
SupportProdonotincludetrainingonhardwareorsoftwareuse.

2.PTSandTechSupportProarenotintendedtoreplacethemoreadvancedtechnicalsupportthatmaybe
availablefromhardwareorsoftwaremanufacturers.

3.PTSandTechSupportProareforincidentspecifictroubleshootingandproblemresolution,andexcludes:(a)
computerprogramming(b)softwaredevelopment(c)warrantyrepairsorproductreplacement(d)supportfor
Windows95andearlierversionsofWindows(e)supportforMacoperatingsystemsearlierthanOSX(f)
problemsorissuesarisingoutofanyimpermissibleorunauthorizeduseormodificationofaproductor(g)
upgradesoffirmware,software,operatingsystems,orapplications.UseofPTSorTechSupportProdoesnot
constitutealicensetousethesoftware,applicationsorequipmentbeingsupported,oranupgradethereto.You
areresponsibleforobtaininganynecessarylicensestouseyoursoftwareandapplications.

4.Insomecases,wemaynotbeabletodiagnoseorresolveaproblembecauseofcomplicationswithyour
computeroritsconfiguration.PTSandTechSupportProareofferedasa"bestefforts"serviceandwithout
warrantyexceptasspecificallysetforthinthisAgreement.Wereservetherighttorefusetotroubleshoot
softwarenotonourlistofsupportedproducts.
5.Youunderstandandagreethattechnicalproblemsmaybetheresultofsoftwareorhardwareerrorsnotyet
resolvedbytheproductmanufacturer,andthatwemaynothavetheabilitytoobtaintheinformationnecessary
toresolveaspecifictechnicalproblem.

6.IfyoupurchasetheThirty(30)MinutePremiumTechnicalSupportService("30MinutePTS"),theServiceis
nonrefundable.30MinutePTShasamaximumdurationofthirty(30)minutesandmustbeusedwithintwenty
four(24)hoursfromthetimeofpurchaseandyoumustbeasubscribertoVerizonHighSpeedInternetor
VerizonFiosInternetservice.

3.YourResponsibilities.

1.InorderforustoprovidePTSorTechSupportPro,youmustfirstconfirmthatyouhave:(a)fullaccess
(includinganyrequiredlicenses)tothehardwareand/orsoftwarethatisthebasisoftheproblemand(b)
completedabackupofanydata,software,informationorotherfilesstoredonyourcomputerdisksand/or
drivesthatmaybeimpacted.Verizonisnotresponsiblefortheloss,corruptionoralterationofdata,softwareor
filesthatmayresultfromperformanceofPTSorTechSupportProbyourtechnicians.Youalsoacknowledge
andagreethatyouaretheownerorauthorizeduserofanyhardwareorsoftwareaboutwhichyouarecontacting
us.PTSandTechSupportProareonlyavailabletoyouandthoseresidingatyourlocation.NeitherPTSnor
TechSupportPromaybetransferredtoanythirdparty.

2.YouagreetocooperatewithandfollowinstructionsprovidedbyVerizonandacknowledgethatsuch

3.YouherebygrantVerizonpermissiontoview,accessandmodifyyourcomputer,computer(including
registry)settingsandanyrelatedsoftwareorperipheralequipment,includingalldata,hardwareandsoftware
components,inordertoperformPTSorTechSupportPro.

4.Youareresponsibleforanyandallrestorationandreconstructionoflostoralteredfiles,data,orprograms,
andforensuringthatanyinformationordatadisclosedtoVerizonisnotconfidentialorproprietarytoyouorany
thirdparty.

4.SupportProcedures.

1.PurchaseTerms.PTScanbepurchasedeither:(a)foranunlimitednumberofIncidentsforatermbeginning
onthedateyouorderPTSandcontinuingforthedurationoftheplanyouselected("TermPlan")or(b)ona
perIncidentbasis(the"PerIncidentServicePlan").ForthePerIncidentServicePlan,Verizonwilladdressa
singleIncident(asdefinedinSection4.4.3below)whichshallincludefollowupcalls,asreasonableand
necessary,regardingtheIncident.OnceanIncidentisresolved(assetforthinSection4.4.4,below),youmay
callbackandobtainassistanceonthesameIncidentforuptoseventytwo(72)hoursatnoadditionalcharge,
afterwhichtheIncidentwillbeconsideredclosed.OnceanIncidenthasbeenclosedbyVerizon,anyfurther
callsorrequestsforassistancewillbeconsideredanewIncidentandadditionalfeeswillapplyifyousubscribe
toourPerIncidentServicePlan.IFYOUPURCHASEPTSUNDERATERMPLANANDYOURSERVICE
ISTERMINATEDBYYOU(ORBYUSIFYOUBREACHTHISAGREEMENT)BEFORECOMPLETING
YOURTERM,THEN,UPONTERMINATIONOFYOURSERVICE,YOUAGREETOPAYVERIZONAN
EARLYTERMINATIONFEEINTHEAMOUNTSETFORTHINTHEPLANYOUHAVECHOSEN.

2.TechSupportProcanbepurchasedonamonthtomonthbasis.

3."Incident"meansaspecific,discreteproblemforwhichVerizonwillattempttoisolateitsorigintoasingle
cause.Verizon,initssolediscretion,willdeterminewhatconstitutesanIncident.

4.AnIncidentwillbeconsideredresolvedwhenyoureceiveoneofthefollowing:(a)informationoradvicethat
resolvestheIncident(b)informationonhowtoobtainasoftwaresolutionthatwillresolvetheIncident(c)
noticethattheIncidentiscausedbyaknown,unresolvedissueoranincompatibilityissue(d)informationthat
theIncidentcanberesolvedbyupgradingtoanewerreleaseofaproduct(e)noticethattheIncidenthasbeen
identifiedasahardwareequipmentissueorif(f)youcannot,orelectnotto,pursuethecourseofactionwe
recommend.

5.OuradvicetoyoumayincludestepsthatyouwillneedtotakebeforetheIncidentcanberesolved,suchas
buyingcablesorcords,acquiringsoftware,etc.andwewillkeepyourservicerequestopenforfuturereference
whenyouarereadytoresumetheprocess.

5.ThirdPartyWarranties.Thirdpartyequipment,softwareandperipheralproductsarecoveredbythe
warrantiesprovidedbytheoriginalmanufacturerortheselleroftheproduct.Thirdpartywarrantiesmayvary
fromproducttoproduct.Itisyourresponsibilitytoconsulttheapplicableproductdocumentationforspecific
warrantyinformation.Inaddition,youacknowledgethatcertainthirdpartyequipmentorsoftwarewarranties
maylimitorvoidtheremediesthattheyofferifunauthorizedpersonsperformsupportserviceontheequipment
orsoftware.ItisyourresponsibilitytoensurethatanyimpactthatVerizon'sdeliveryofPTSorTechSupport
Promighthaveonthirdpartywarrantiesisacceptabletoyou.

6.CustomerSpecificService.PTSandTechSupportProservicesareonlyavailabletoyouandtopersonsyou
authorize.Ineithercase,thetermsofthisAgreementwillapplytothePTSorTechSupportProserviceswe
perform.

7.LIMITATIONOFLIABILITY.VERIZON'STOTALLIABILITYARISINGOUTOFTHEPTSORTECH
SUPPORTPROSERVICE,ORFROMVERIZON'SNEGLIGENCEOROTHERACTSOROMISSIONS,IF
ANY,SHALLBELIMITED,ATVERIZON'SSOLEDISCRETIONANDOPTION,(A)TO
REPERFORMINGTHEPTSSERVICE,OR(B)ASSETFORTHINSECTION13OFTHEAGREEMENT
EXCEPTTHAT,INTHECASEOFPERINCIDENTSERVICEPLANS,YOURREMEDIESWILLBE
LIMITEDTOAREFUNDOFTHECHARGESANDFEESPAIDFORTHEPTSORTECHSUPPORTPRO
SERVICEGIVINGRISETOTHECLAIM,IFANY.THEREMEDIESFORAFAILUREORBREACHOF
SUCHLIMITEDWARRANTYAREEXCLUSIVE.

8.YOUACKNOWLEDGETHATTHEADVANCEDATAMIGRATIONSERVICEANDTECHON
DEMANDSERVICEMADEAVAILABLETOTECHSUPPORTPROCUSTOMERSARENOTPROVIDED
BYVERIZON,THATVERIZONMAKESNOREPRESENTATIONSORWARRANTIESWITHRESPECT
TOTHETECHONDEMANDSERVICE,ANDAGREETHATVERIZONSHALLNOTHAVEANY
LIABILITYFORTHEPROVISIONOFSUCHSERVICES,WHETHERINTORT,CONTRACTOR
OTHERWISE.
