AFFIDAVIT
I, URBANO B. MIRANTE, of legal age, single, Filipino, and with residence
and postal address at 125 North Sanitary Camp, Baguio City, after having been
sworn in accordance with law, do hereby depose and state:

1. That pursuant to Memorandum Order OG-PO-17330 (Return to Work

Order) issued by the NCIP-CAR Regional Director, I reported to the NCIP
Apayao Provincial Office at San Isidro, Luna Apayao;

2. That in order to seek further instruction from the NCIP Provincial

Officer as per the order, I proceeded to Luna, Apayao on May 15, 2017 and
arrived at the NCIP Provincial Office the early morning of May 16, 2017;
however at that time the Provincial Officer was not around so I waited at the
office until her arrival late in the afternoon;

3. That later on after her arrival, the provincial officer invited the
Administrative Officer, the Geodetic Engineer near the table where I seated and
brief us with the present activities to be done at the service centers as well as
in the NCIP-Provincial Office which she plans to be done before her voluntary
exit in the office at the end of June 2017;

3. That at around six oclock in the evening, the Administrative Office

(Mr. Roger Piagan) brought out a 4x4 gin and placed it on the table near the
office kitchen and invited me for a drink, being an employee of the same office I
acceded to his invitation, joining us later at the table was the Provincial
Engineer, the Driver and the NCIP Provincial Officer;

4. That while drinking there were stories relative to office activities

involving past and present, when the bottle of gin is almost empty, I bought
another bottle; as we continue drinking the administrative officer started
discussing about re-assignments of employees specifically on the place of my
assignment in Kabugao, Apayao and insisting my reporting thereat. Roger
Piagan suddenly uttered to me that Adun to ti travel mo inya, but I did not
reacted to what he said, instead, I suggested that maybe I can served or lead
the Kabugao Service Center without necessarily staying in that CSC office,
citing the standing petition of concerned officials that has yet to be resolved
and that we instead developed or let the Community Affairs Officer (Ms. Noime
Duran) spearhead the activities in the communities under the jurisdiction of
Kabugao Service Center. I also told him that on the issue of my previous
reassignments they are covered by Memorandum Orders issued by higher
officers. I did not leave my office just for the reassignments without the said
orders. I just complied with the aforementioned orders as part of my job; it was
at this juncture that Roger Piagan got irked and uttered the word okinam
and suddenly pick up the 4x4 bottle of gin aiming of throwing at me, but was
immediately parried by Austin Bisin (the Office Driver), after that he (Roger)
went out for a while but came back immediately uttering vindictive words
and took a shot of gin and attempted again to throw the bottle to me, but was
again pacified by the Driver. For three-times he tried to hit me with the said
bottle of gin. The provincial officer tried to call his attention but nevertheless

continued accusing me and saying that: okinam linoklokum tatao ti
Apayao ( you fooled/cheated the people of Apayao). He also said that agbain
ka kenni boss, swerte ka ta pinorprotektaran naka ni boss (referring to
Dr. Claveria). Being upset and insulted of his actuations and accusations I
reminded him of being the Administrative Officer of the office but again he pick
up the bottle attempting to throw against me but the driver was always there
pacifying him, it was at this moment that he told me okinam wen abogado
ka, uray edarum nak, agdarum ka nu kayat mo then he challenged me to
go outside and uttered words in their vernacular language which I cannot
understand. Later on I noticed that he leave the office accompanied by the
driver;

5. That after that incident, at around 9:30PM, I packed my things and

decided to go back home to Baguio City for fear that Roger Piagan will come
back or will send somebody and to evade any worst scenario that might occur
on that particular night. While I was leaving the office, the Provincial Officer
told me that Umay ka ketdi ditoy uneg ta mapan ka nu bigat ijay
Kabugao, but I did not heed him instead proceeded to Junction, Luna where I
waited for the bus;

6. That I am executing this affidavit to attest to the truth of the foregoing

and for the purpose of possible filing the necessary case against the NCIP
Apayao Administrative Officer and for all legal intents and purposes it may
serve.
