AFFIDAVIT NO LANDHOLDING

I, EDMUNDO DELA PENA MAGALLON, married, Filipino, of legal

age, and a resident of Davao City, after being duly sworn to in accordance
with law do hereby depose and say that:

1. On April 19, 2017, 8:00 PM, YAKUB CAMILE BALLERDA, my

neighbor informed me that we will examine and inspect a Suzuki
multicab pickup type with canopy as his elder brother OWEN
CAMILE BALLERDA plans to purchase it considering that I have
experience in the overhaul of motor vehicles.

2. On April 20, 2017, at 9:00 AM, we three above as well as the

father of GEOPPEL D. EVANGELISTA, the owner of the said
multicab, went to GEM Village, Ma-a, Davao City as the multicab
was there.

3. Upon inspecting the multicab, we asked for a road test, but the
father of GEOPPEL D. EVANGELISTA refused because they
want us to endorse the full payment to them before allowing the
road test. Only the father of GEOPPEL D. EVANGELISTA was
the one who drove on a road test.

4. On that road test, I found out, based on my experience and

expertise, that there were apparent defects in the motor vehicle,
such as, but not limited to: busted shock absorbers, defective ball
joint and tie rod in, engine oil leaks, and the rusted flooring of the
cargo area, which had holes in it.

5. Thus, upon reaching SIR, our neighborhood, I advised OWEN to

either cancel the sale or negotiate a lower amount. However,
OWEN said that, as the motor vehicle was not in good condition,
he has decided to cancel the sale.

6. I am executing this affidavit without any fraud or intent to deceive

on my part and I forever free any person from any liability that
may arise from this circumstance, and/or any entity, be it
governmental or private.

7. I am therefore executing this affidavit to attest to the truth of all

the foregoing and to apprise any person, natural and juridical,
governmental or private of such fact and for all other legal
purposes that this affidavit may serve.
