Effective October 1, 2017, the Department of Consumer & Regulatory Affairs (DCRA) will
increase certain fines pursuant to the DCRA Infraction Fine Increase Amendment Act of 2017
(as part of the Budget Support Act), which requires DCRA to begin issuing doubled fines for
identified provisions. DC Municipal Regulation (DCMR); 16 DCMR 3201 Subsection 3201.0
specifically addresses the change in fines for impacted Class 1 infractions.
The District of Columbia Property Maintenance Code (2013), referred to as the Property
Maintenance Code, will require double fines for certain Code violations, as shown below.
Beginning October 1, 2017, Notices of Infraction for specified offenses will carry fines that are
200% of their current amount for each applicable violation.
16 DCMR 3305.1(a)
Any flagrant, fraudulent, or willful violation by a housing provider of any of the Housing
Regulations that constitute an imminent danger to health or safety.
Class 1 Infraction - Increase from $2,000 to $4,000 for first offense.
16 DCMR 3305.1(b)
Failure to secure or repair an unsafe structure.
Class 1 Infraction - Increase from $2,000 to $4,000 for first offense.
16 DCMR 3305.1(c)
Attempting to repair after expiration of allowed period, or interfering with authorized agents.
Class 1 Infraction - Increase from $2,000 to $4,000 for first offense.
16 DCMR 3305.1(d)
Allowing a nuisance to exist on any lot or parcel of land in D.C. which affects the public health,
comfort, safety, and welfare of citizens.
Class 1 Infraction - Increase from $2,000 to $4,000 for first offense.
16 DCMR 3306.1.1(a)
Failure to obtain required permit; working without a required permit.
Class 1 Infraction - Increase from $2,000 to $4,000 for first offense.
16 DCMR 3306.1.1(b)
Work or conditions exceeding scope of permit.
Class 1 Infraction - Increase from $2,000 to $4,000 for first offense.
16 DCMR 3306.1.1(g)
Failure to comply with terms of a "Stop Work Order."
Class 1 Infraction - Increase from $2,000 to $4,000 for first offense.
16 DCMR 3306.1.1(h)
Unauthorized removal of a posted "Stop Work Order."
Class 1 Infraction - Increase from $2,000 to $4,000 for first offense.
16 DCMR 3306.1.1(i)
Failure to comply with terms of posted "Unsafe Notice."
Class 1 Infraction - Increase from $2,000 to $4,000 for first offense.
16 DCMR 3306.1.1(p)
Allowing/creating unsafe structures, conditions or equipment.
Class 1 Infraction - Increase from $2,000 to $4,000 for first offense.
16 DCMR 3306.1.1(q)
Failure to comply with notice of unsafe structure or equipment.
Class 1 Infraction - Increase from $2,000 to $4,000 for first offense.

Failure to maintain an office or agent in the District of Columbia.
