MY NAME IS MICHAEL PAUL AND I AM A COMMUNITY EMERGENCY RESPONSE TEAM

ORGANIZER that as created a local nonprofit association to promote emergency preparedness for
others in my area because the only team that was operating was in the municipality of New Braunfels.
I originally began as a CERT member in 2009 after joining the Alamo CERT team which operates
through the Bexar county fire marshals office under the authority of the Bexar county Sheriff. I was a
member until 2013 in good standing and was a recipient awarded for recognition as a participating
partner by the Alamo Area Council of Governments at the annual awards dinner for the year 2010due
to the amount of total volunteer hours I accumulated that year. I was asked to resign after it was
learned that even though I have a San Antonio Address my physical property is located in Comal
County thus I could no longer be a member on the Alamo CERT Team. I was patiently waiting for the
Comal County Fire Marshal to institute the county CERT program which was listed on the county web
site but from 2013 to 2016 it never materialized. In August of 2016 I registered to participate in the
City of New Braunfel's CERT training courses and was accepted because I felt my original certification
expired and I needed to be re-certified to be able to provide support in my local community should it
be required. After successfully graduating the class and receiving my FEMA G-317 certificate I again
patiently awaited a program to be instituted at the County level. After another 6 months I finally
contacted the Chief of the Bracken Volunteer Fire Department about starting a county CERT unit at the
fire station under the county authority. The chief responded to my letter a week later and said my
request was denied by the fire marshal.

Beginning in April we formed an unincorporated nonprofit association creation board and after two
meetings were at the unanimous agreement on the formation and bylaws for a local county CERT
public safety entity. I sent an email to the elected county sheriff Mark Reynolds outlining the
formation of the association, it's operating guidelines and requested to be aligned under his authority
for registering on the national registry. Upon receipt of the sheriffs reply which stated he was
welcoming our association to the community and listing our group with his office and to feel free to
call upon him in the future. I filed the National registry request and applied to the Secretary of State
for the required permit to solicit for donations under occupations code 18003 which was received as
certificate #170002.

Not having the money to pay for the IRS 501(c)3 application I began actively soliciting for the needed
capitol. on my second Day I was given a citation for soliciting without a permit from an officer in the
Schertz, Police Department. I appeared at the hearing with a motion to dismiss along with the proper
documents showing he formation of the CERT team and the SOS certificate to solicit. The judge on the
bench stated He couldn't dismiss the ticket until I had met with the prosecutor and the prosecutor
agreed to dismiss the citation. When I asked where the prosecutor was as I am here and announce
ready the judge sad that he was the prosecutor and was resetting the cause for a future date that would
be mailed to me and then dismissed the court.

Four weeks later the city attorney approached me before entry in the court room and stated his name
was Darryl Dullnig and he was sitting in for the judge at the last hearing due to a medical emergency
that he needed to go to the hospital. Then he asked me if I still planned to move forward on my motion
to dismiss. I said that I did. Mr. Dullnig replied "well good luck with that, but I just don't see the
Judge agreeing to it." Then walked away. Later in the courtroom when I made my motion to dismiss
for lack of jurisdiction, instead of hearing only arguments on the issue of jurisdiction the judge began
questioning the officer on the merits of the the charge and was informed by the officer that while
investigating he had called my brother who is an assistant fire marshal in Bexar County and the area
coordinator of all the CERT teams in 5 counties and was informed I was not affiliated with CERT any
longer after being thrown off the New Braunfels Team, I was told not to solicit for money presenting
CERT, and that I had been arrested for it before. I said the officer was lying and the judge threatened
me with contempt of court for any further or future interruption of the court. The Judge then had the
officer state again for the court what my brother had informed him. after the officer had finished the
judge said he had heard enough and said he was denying the motion to dismiss upon which I said I
objected and plan to appeal his decision. The Judge said I was not on trial so I could not object and as
for the appeal i could not appeal until after the judge had given his final rulling and he didnt think that
was going to happen for quite a while. I then said I was just preserving my right to appeal this issue
which I am required to do or else the appeals court can deny my request. Then I said I move for a jury
trial and do not waive my right to a speedy trial. The judge said to expect the trial date to be sent to me
certified mail to my home address then dismissed the court.

The next day I contacted my brother and stated what the officer said he had reported to them. My
brother said he never said any of those statements and said I should request another hearing and he
would appear and testify to the court that he never made those statements to the officer. I immediately
filed a motion for rehearing and filed a civil suit against the officer for defamation and aggravated
perjury before the court.
That was June 19th I have called numerous times to be given a court date and I am always told the
Judge has not signed it. Two weeks after the hearing I received a certified letter from the City of
Garden Ridge to cease and desist using the cities name and if I had filed a formation with their name it
was not authorized and it was reported that I was soliciting money from the citizens in their city and the
cease collecting anything even information.

I had no contact with the City of Garden Ridge at all including soliciting of anything from their city or
anywhere inside Comal County. I sent an Email to the Sherifff's office informing the sheriff of the
allegations from Garden Ridge. The Sheriff replied he was receiving calls from other sources that were
reporting I was seen collecting money using the Sheriffs office as to who the funds were for and had
used his name specifically.

I met with the sheriff and the county judge after commissioners court in late June and the Sheriff stated
that the email I received from him was not any authority to operate in the county and that only the
county judge had that authority so I was mistaken in his written reply and that I was to immediately
stop representing the Community Emergency Response Team and if he sees me wearing anything
resembling CERT he had a warm place for me to stay down at the new jail. Mr Kelly the emergency
management coordinator for the county was there and he said I had been thrown off the New Braunfel's
CERT team. I stated for him to tell the Sheriff and Judge exactly why I was not on the New Braunfels
team. At first he didn't want to say anything so I said If you are going to stand there and inform
everyone that I was thrown off the team then you can tell them why. Mr Kelley then said I was
thrown off the team because I failed the background check. I said that's funny since I was never even
on the team to begin with and I was informed it was due to a liability risk the city was not willing to
accept because I'm disabled. so a false statement was made by Mr. Kelly making me appear as a
criminal unable to pass the background check required for all participants to ensure public safety trust.
Then they went on to say as they always do the real reason for their corruption. There will be only one
CERT team in Comal county and that's the one in New Braunfels.

Two weeks later I appeared before the commissioners court and presented each commissioner with a
manila envelope containing all the documents of the creation of the CERT association including the
written letter to the sheriff and his response. as I was only allowed 3 minuets to present the issue I
informed the court that I was informed that the counties position officially was that no other CERT
programs were going to operate in Comal County except for the New Braunfels CERT which is
operated under municipal authority. I felt it was improper to deny the residents of the county the ability
to have an auxiliary response capability that has been federally designed and implemented in every
state in the united states. And if I thought for one second that if a major disaster were to occur anyone
from the City of New Braunfels was going to travel outside of town to help me or my neighbors then I
wouldn't be standing before them right then.

I never received anything official in writing from the sheriffs office and after conferring with my
brother who stated they can't stop me from being a CERT organization all it means is I can't be on the
National list which means I'm not eligible for FEMA grants.

July passed with no further contact from anyone. Then as I was soliciting in Selma for the rest of the
$275.00 IRS application fee I was written a citation for soliciting without a permit. I signed a promise
to appear and then showed my authority and legal right to solicit under occupations code 18003 to the
sergeant then because the officer and the Sargent both dint tell me I must leave I returned to collecting
donations at which time the officer walked back up to me and placed me in handcuffs and booked me
into the county jail. The next morning a magistrate released me on a pr bond with my original promise
to appear.

It turns out mr Darryl Dullnig and Judge Takas are the judge and city prosecutor for the all of the
surrounding municipalities and they were the ones responsible for informing the different law
enforcement agencies that I was impersonating a public servant and illegally collecting donations.
They were in the court room in Garden Ridge when I took one of the officers of the association to
traffic court for a ticket from 2009. I had the Garden Ridge Police at my residence twice looking for
our Vice President so I guaranteed them I would personally bring him to the courthouse that afternoon.

I had contacted the Chief of Police in Schertz to initiate an internal affairs investigation and was told
that the original officer had since been let go from the force. I filed a motion to nonsuit the civil
complaint until I reached a resolution on the criminal charges against me.
During this time I had continued operations as CERT Garden Ridge/Natural Bridge, UNA. which
according to the associations bylaws requires me to render assistance where ever I may be and receive
a report of a declared emergency by any legal authority that is in my vicinity. To date that will be 2
major Multiple Motor Vehicle Accidents in the Cities of Live Oak, and San Antonio, with injuries and a
rollover by an intoxicated driver who was not wearing a seat belt requiring stabilization before
paramedics arrived to transport injured party. I provided rehab for San Antonio Fire at a multiple alarm
fire of a daycare facility on Thousand Oaks and another Fire in the City of Cibolo on Wald Rd. after a
broadcast as made for mutual aid.

August 11 I was driving home on loop 410 after visiting a family member that lives near Leon Springs.
I had just passed San Pedro Blvd. When there was a broadcast emergency on the City of San Antonio
active incident website showing an emergency at the international Airport that was of unknown origin
or scope as I was only a mile and a half from the declared emergency I proceeded to the location
provided to offer any assistance. upon arrival I flagged two responders down to see if they required
any assistance. They said no, it was a medical call, some guy had fallen and broke his leg. I said okay
and turned and exited the terminal. After placing my medical bag in the back seat of my car I was
approached by a police officer who demanded my ID and said he didn't think I was allowed emergency
light on my vehicle since it didn't have an exempt license plate. My POV was completely legal as
required by the vehicle code and there was enough markings on it to clearly see It was a vehicle for the
Community Emergency Response Team that displayed the name on both front doors as well as both the
front and rear license plate covers. I was wearing a neon yellow and black safety vest that displayed in
large print on the back Community Emergency Response Team. The officer arrested me for
impersonating a public servant, possession of a altered government document both felonies and a traffic
citation for flashing lights on a personal vehicle which isn't even a traffic code violation.

My POV conforms to the requirement for a personal vehicle belonging to a volunteer fireman, red at
each corner front and rear as high as practicable and a magnetic red light attached to the roof all visible
from 500 ft in daylight.

First the Altered Government document is for a US Army Gate Pass Issued to me to get my elderly
father into and out of the Army Hospital and I had to replace on base after bonding out of jail the chief
of personnel gave me a business card and said to have the DA call him which ADA Simms in Bexar
County has done and verified the ID was and always had been real.

Second In responding to a declared emergency at the Airport which the officer states was made and as I
was clearly marked by the authority I was operating under and had the legal documents in my
possession which said I was a member in good standing with CERT a FEMA entity under the
Department of Home Land Security and credentialed by showing my original certification awarded
after completing the required course signed by the Emergency management coordinator and a senior
instructor. My arrest was unwarranted and the protections put in place to protect volunteers in clearly
inadequate.
When a volunteer responds to a declared emergency and is informed there services are not required and
they leave, that volunteer should have some immunity to protect from false charges or allegations being
placed on them and then arrested and detained and placed into the county jail until hearing which for
me would have been October 4th almost two months of illegal detention before seeing a judge.

I believe the only reason this officer charged me was after searching my vehicle had found the court
documents from Schertz and Selma along with the cease and desist from Garden Ridge. But did not
see the response documents that were filed with the courts in those cities. Also the officer was unaware
of my Complaint to the Judicial Review Commission and the State Bar for the actions of the City
Prosecutor Darryl Dullnig and interim municipal Judge Takas that have been making false statements
in regard to my affiliation, status and standing with each of the different city police departments they
serve in which is Garden Ridge, Selma, Schertz, Cibolo, Universal City, Grey Forest, Hollywood Park,
Kirby, and Shavano Park and also contacting the firemarshals in Comal, Guadalupe, and Bexar
Counties. A complaint has been submitted to the Chief Criminal investigator in the Guadalupe County
District Attorneys office requesting a letter be drawn up and sent to the Texas Rangers to investigate
Mr. Dullnig for impersonating a public servant for sitting on the bench in the City of Schertz municipal
court July 15th 2015 and again during my first court appearance in May 2017 while he was employed
under contract as the city prosecutor

Having Just been appointed by the city Council of Schertz August 9th and taking his oath of office as
the newly elected Municipal judge replacing the prior Judge who had passed away in June. Only the
Texas Rangers can investigate an appointed Judge and they must be requested by letter sent from a
County DA requesting the investigation.
