SUBJECT: BWM Convention Entry Into Force, Implementation Deadline &
Surveys Requirements

BACKGROUND & IMPLEMENTATION DEADLINE

The International Convention for the Control and Management of Ship's Ballast Water and
Sediments, 2004 (Hereinafter referred to "the BWM Convention") was adopted in 2004 in
order to prevent the adverse effects to the maritime environment caused by the transfer of
ballast water. The entry into force for the BWM Convention were met on 8 September 2016
and consequently the Convention will enter into force on 8 September 2017.
From 8 September 2017, ships to which BWM Convention applies are required to carry
onboard an approved ballast water management plan, ballast water record book and
conduct ballast water management in accordance with regulation B-3, as amended.

The implementation deadline for Ballast Water Management Systems (BWMS), according
to IMO Resolution A.1088(28) and MEPC 69, will be as follows:

On or after 8 September 2017 and prior to the implementation deadline for BWMS, ships
engaged on international voyages are required to conduct ballast water exchange offshore.
On or after the implementation deadline for BWMS, the ships are required to conduct
ballast water exchange through BWMS.

(*): Surveys and certifications are required only for vessels of 400GT or more (which BWM

Conducting ballast water management under regulation B-3, as amended

Ships to which the BWM Convention applies shall conduct ballast water management in
any one of the following ways:

1. Carry out ballast water exchange as described in regulation D-1 until the date of the
renewal survey determined by the Committee at MEPC 70 to be held from 24 to 28 October
2016; after which time it shall at least meet the ballast water performance standard
described in regulation D-2;

2. Discharge ballast water to a reception facility;

3. Be exempted by a Party or Parties under regulation A-4 of the BWMC when operating in
a same risk area;

4. Under an exception in regulation B-3.5 of the BWM Convention, discharge ballast water
and sediments at the same location where the whole of that ballast water and those
sediments originated and provided that no mixing with unmanaged ballast water and
sediments from other areas has occurred; or

5. Other methods of ballast water management may also be accepted as alternatives,


provided that such methods ensure at least the same level of protection to the environment,
human health, property or resources, and are approved in principle by the Committee

BWM CONVENTION INITIAL SURVEY REQUIREMENTS:

Although the installation of Ballast Water Management System (BWMS) (Regulation D-2 of
the BWM Convention) which satisfy the relevant Ballast water performance standard will be
required according to the compliance schedule for BWMS after the BWM Convention entry
into force, the use of Ballast water exchange standard (Regulation D-1 of the BWM
Convention) will continue to be accepted up until the compliance date for the installation of
BWMS.
The approval of a Ballast water management plan and proper maintenance of a Ballast
water record book is, however, required regardless of whether Regulation D-1 or
Regulation D-2 is applied.

Once the BWM Convention enters into force, all ships of 400 gross tonnage and above to
which the BWM Convention applies should have an International Ballast Water
Management Certificate (IBWMC) for the BWM Convention on board.

ClassIBS is preparing to start the certification process, leaded to the issuance of the
International Ballast Water Management Certificate (IWBMC), once carried out an Initial
survey, as per BWM Convention requirements, subject to the authorization from Flag
Administration.

Approval Plans, Documents and Initial Survey

The plans and documents required to be submitted to ClassIBS for approval, which need to
be performed prior to that carrying out of initial survey, are as listed below. Plans and
documents required to be submitted for approval which were previously submitted or
approved during the classification approval process do not need to be re-submitted.

Ships applied with Ballast water exchange standard (Ships applied with only Regulation
D-1):

a) Ballast water management plan is to be submitted to ClassIBS Head Office or


Survey Sites Offices (for provisional approval).

2. Initial survey

a) Request for initial survey for the BWM Convention should be submitted to the
ClassIBS

HO or Survey Sites offices responsible for carrying out the survey.


It is to be confirmed an approved BWM plan and a proper maintained Ballast water record
book are kept on board.

Ships applied with Ballast water performance standard (Ships applied with both
Regulation D-1 and Regulation D-2, or only Regulation D-2):

1. Approval plans and documents

Following plans and documents are to be submitted to ClassIBS HO. For existing ships,
in case of modifications for BWMS installation will be conducted, it is necessary to be
submitted revised plans and documents clearly indicated modified parts (This also apply
to existing vessels previously certified by other Class Societies).

a) A copy of the Type Approval Certificate of BWMSissued by Flag Administration


or a Class Society/Recognized Organization duly authorized by relevant Flag
Administration, as applicable, in accordance with IMO Resolution MEPC.174(58):
"Guidelines for Approval of Ballast Water Management Systems (G8)" - Including
future amendment.
b) Drawing of BWMS.
c) BWMS arrangement drawing.
d) Arrangement of ballast water piping.
e) Arrangement of construction of sampling points (Detailed drawing described
position and construction of sampling points).
f) Wiring diagram of Main (power) Circuit / Control and Instrument.
g) Arrangement of Electric Apparatus, Electric Power Table and Short Circuit
Current Analysis.
h) List of explosion-proof type electric equipment and arrangement (If applicable).
i) Ballast water management plan.
j) On board test procedure.
k) Other drawings considered necessary by ClassIBS.

2. Initial survey

Applications for initial survey for the BWM Convention should be submitted to the
ClassIBS HO or Survey Site offices responsible for carrying out the survey.
Following matters are to be confirmed on board. In addition, it is to be confirmed an
approved Ballast water management plan and a proper maintained Ballast water record
book are kept on board.

a) Actual layout of ballast water piping system, including ballast pumps and BWMS
as well as sampling facilities with reference to approved plans and documents.
b) Operation test of BWMSIn general, this test should include both ballast and de-
ballast operation tests under rating capacity).
c) Confirmation of proper storage and maintenance of chemical substances used for
BWMS.
d) Confirmation of onboard BWMS is corresponding to its Type Approval Certificate.
e) For BWMS which use chemical substances for treatment, confirmation of the type
to clarify its compliance to "IMO Resolution MEPC. 169(57): Procedure for
Approval of Ballast Water Management Systems that Make Use of Active
Substances (G9)" (including future amendment).
f) Necessary stocks of consumables for the control and monitoring devices for
operation test and the record of its result, if the ballast water management
recording device is installed.
g) For BWMS that produce residual products such as sediments in its operation,
storage of facilities exclusively used for these substances.
h) Other inspections considered necessary by ClassIBS.

3. Documents to be kept on board

It is to be confirmed that the following documents are to be kept on board.

a) A copy of the Type Approval Certificate of BWMSissued by flag administration


or a Class Society/Recognized Organization duly authorized by relevant Flag
Administration, as applicable, in accordance with IMO Resolution MEPC.174(58):
"Guidelines for Approval of Ballast Water Management Systems (G8)" - Including
future amendment.
b) A Statement to confirm that the electrical and electronic components of the
BWMS have been type-tested in accordance with above mentioned G8 which is
the specified for environmental testing.
c) Equipment manuals for major components of the BWMS.
d) An operations and technical manual for the BWMS specific to the ship.
e) Installation specifications.
f) Installation commissioning procedures.
g) Initial calibration procedures.
h) Other documents considered necessary by ClassIBS

Note: BWM Plan approval can be carried out by ClassIBS against IMO Res. MEPC.127(53)
Guidelines for Ballast Water Management and Development of Ballast Water Management
Plans (G4), but ships Owner/Operator have to bear in mind that some Flag Administrations
will carry out the BWM Plan Approval by themselves according their approval procedures.
Therefore, relevant plan under these Flag Administrations must be available on board duly
approved on behalf of these Flags before ClassIBS surveyor carries out Initial Survey for
the issuance of the International Ballast Water Management Certificate (IBWMC). Same
applies for BWMS Type Approval certificate issued by the Flag Administration, certificate
must be available on board.

BWMConvention,Article3Application
1ExceptasexpresslyprovidedotherwiseinthisConvention,thisConventionshallapplyto:

(a)shipsentitledtoflytheflagofaParty;and

(b)shipsnotentitledtoflytheflagofaPartybutwhichoperateundertheauthorityofaParty.

2ThisConventionshallnotapplyto:

(a)shipsnotdesignedorconstructedtocarryBallastWater;

(b) ships of a Party which only operate in waters under the jurisdiction of that Party, unless the Party
determinesthatthedischargeofBallastWaterfromsuchshipswouldimpairordamagetheirenvironment,
humanhealth,propertyorresources,orthoseofadjacentorotherStates;

(c) ships of a Party which only operate in waters under the jurisdiction of another Party, subject to the
authorizationofthelatterPartyforsuchexclusion.NoPartyshallgrantsuchauthorizationifdoingsowould
impairordamagetheirenvironment,humanhealth,propertyorresources,orthoseofadjacentorother
States.AnyPartynotgrantingsuchauthorizationshallnotifytheAdministrationoftheshipconcernedthat
thisConventionappliestosuchship;

(d)shipswhichonlyoperateinwatersunderthejurisdictionofonePartyandonthehighseas,exceptfor
shipsnotgrantedanauthorizationpursuanttosubparagraph(c),unlesssuchPartydeterminesthatthe
discharge of Ballast Water from such ships would impair or damage their environment, human health,
propertyorresources,orthoseofadjacentofotherStates;

(e)anywarship,navalauxiliaryorothershipownedoroperatedbyaStateandused,forthetimebeing,
only on government noncommercial service. However, each Party shall ensure, by the adoption of
appropriatemeasuresnotimpairingoperationsoroperationalcapabilitiesofsuchshipsownedoroperated
byit,thatsuchshipsactinamannerconsistent,sofarasisreasonableandpracticable,withthisConvention;
and

(f)permanentBallastWaterinsealedtanksonships,thatisnotsubjecttodischarge.

3 With respect to ships of nonParties to this Convention, Parties shall apply the requirements of this
Conventionasmaybenecessarytoensurethatnomorefavourabletreatmentisgiventosuchships.

BWMConvention,Article9InspectionofShips
1AshiptowhichthisConventionappliesmay,inanyportoroffshoreterminalofanotherParty,besubjectto
inspectionbyofficersdulyauthorizedbythatPartyforthepurposeofdeterminingwhethertheshipisin
compliance with this Convention. Except as provided in paragraph 2 of this Article, any such inspection is
limitedto:

(a)verifyingthatthereisonboardavalidCertificate,which,ifvalidshallbeaccepted;and

(b)inspectionoftheBallastWaterrecordbook,and/or

(c)asamplingoftheship'sBallastWater,carriedoutinaccordancewiththeguidelinestobedevelopedby
theOrganization.However,thetimerequiredtoanalysethesamplesshallnotbeusedasabasisforunduly
delayingtheoperation,movementordepartureoftheship.

2WhereashipdoesnotcarryavalidCertificateortherearecleargroundsforbelievingthat:

(a)theconditionoftheshiporitsequipmentdoesnotcorrespondsubstantiallywiththeparticularsofthe
Certificate;or

(b)themasterorthecrewarenotfamiliarwithessentialshipboardproceduresrelatingtoBallastWater
Management,orhavenotimplementedsuchprocedures;

adetailedinspectionmaybecarriedout.

3Inthecircumstancesgiveninparagraph2ofthisArticle,thePartycarryingouttheinspectionshalltakesuch
stepsaswillensurethattheshipshallnotdischargeBallastWateruntilitcandosowithoutpresentinga
threatofharmtotheenvironment,humanhealth,propertyorresources.

STANDARDSFORBALLASTWATERMANAGEMENT

BALLASTWATERPERFORMANCESTANDARD(REGULATIOND2)

A.MethodstocomplywiththeBallastWaterExchangeStandard(D1):
DilutionMethodmeansaprocessbywhichreplacementballastwaterisfilledthroughthetopoftheballast
tankintendedforthecarriageofballastwaterwithsimultaneousdischargefromthebottomatthesameflow
rateandmaintainingaconstantlevelinthetankthroughouttheballastexchangesystem.


"FlowthroughMethodmeansaprocessbywhichthereplacementballastwaterispumpedintoaballast
tankintendedforthecarriageofballastwater,allowingwatertoflowthroughoverfloworother
arrangements.


SequentialMethodmeansaprocessbywhichaballasttankintendedforthecarriageofballastwateris
firstemptiedandthenrefilledwithreplacementballastwatertoachieveatleasta95percentvolumetric
exchange.

B.MethodstocomplywiththeBallastWaterPerformanceStandard(D2):
Physical & Chemical treatment:A typical ballast water treatment system is shown in figure, where ballast
waterispassingthefilterforphysicaltreatment.Duringthisprocess,particlesororganismslargerthan50
arebeingfiltered.Thefilteredballastwateristhensterilizedbychemicaltreatmentbeforesenttotheballast
tank. Those requiring retreatment or neutralization when discharge are designed to deballast after the
treatment.

GasHydroxylIon:Thissystemconsistsofafilter,acavitationunitandanN2generator.Thismethoddoesnot
makeuseofanyactivesubstances.Theballastwaterpassesthroughthefilterwhereaquaticorganismor
sedimentslargerthan50arefiltered.Thefilteredballastwateristhensanitizedbythecavitationunit,and
thentheballastwaterisfurthersanitizedbyaddingelectrolysisproducedhydroxylionandN2gasintothe
ballasttank.

Electrolysis:ThismethodusesanelectrolysisdevicethatdestroyscellnucleuswithHypochloriteandradicals,
and sterilizes by destroying cell membranes through Oxidation Reduction Potential (ORP). Meanwhile, to
preventthereproductionofmicroorganismintheballasttank,thesystemletsHypochloriteremainedinthe
ballast water. For the reason, the ballast water is discharged after adding hyposulfite to neutralize the
Hypochloritesodiumremainingintheballastwater.

InertgasInjectionWaterQualityControl:Thismethodusesinertgaswhichisinjectedintoballastwatervia
aventuripipeduringballastwaterfillinginordertoreducetheoxygencontentintheballastwater.Also,
duringvoyage,thissysteminertsballasttankstopreventtheproliferationofaquaticorganisms.And,because
the oxygen content in the ballast water is so low that no living organisms can reproduce, ballast water
dischargeiscarriedoutwithairblownintotheballastwaterviatheventuripipe.

PhotoCatalysis:Theadvantageofthismethodisthatitdoesnotuseanychemicalsubstances.Thesystem
first eliminates large aquatic organisms by the filter and then, sterilizes the leftout aquatic organisms or
viruseswithradicalsthatareproducedwhentitaniumdioxideisexposedtothelight.Radicalmeansanatom
ormoleculecontainingunpairedelectron.

Stir&MagneticSeparation:Thissystemconsistsofastirringfacility,amagneticseparationdeviceandafilter.
Thismethodtreatsballastwaterbyinsertingmagneticsubstancesintheballastwaterduringballastuptake
toinducestirandmagneticseparation.Thissystemusesnochemicalsnorchangesthepropertyofballast
waterandthereforenoretreatmentorneutralizationisrequired.

UVUnit:ThissystemiscomposedofafilterandaUVunit.Thissystemfirsteliminateslargeaquatic
organismandsedimentsbythefilterwithoutusinganychemicalsubstancesandthensterilizesmicrobes
andvirusesbyUV.Duringdischarge,theballastwaterispassingtheUVunitagaintomakesureallthe
microbesandvirusesthatmighthavebeensurvivedarecompletelysterilized.
